PUBLIC HEARING Enhancing Union Avenue Mayor Kim opened the public comment period at 6:48 p.m. Rose Tate of Saratoga Springs stated there are issues created by the Union Avenue project that she cannot express within the two minutes allotted. She is requesting a meeting with the Commissioner of Public Safety and any other commissioner that is available. Enhancements to Union Avenue should not be done without including Lincoln Avenue and doing an air quality study. Mayor Kim stated his office has not received a call from Ms. Tate but would be happy to talk with her. There will be a presentation on this at the January 17, 2023 meeting. The state proposed, and will be constructing the portion of Union from exit 14 to East Avenue. Ms. Tate asked where the enhancement is being proposed – East Avenue to Congress Park? Mayor Kim stated that is correct. The enhancement will include multi-use sidewalk and bike lanes. Page 3 of 9 City Council Meeting 1/3/2023 Ms. Tate stated she has noticed a tremendous increase in traffic in front of her house and she has to drive further to get to her house. Mayor Kim encouraged Ms. Tate to attend the City Council meeting on January 17, 2023 to see the presentation on the enhancements to Union Avenue. Ms. Tate asked if there is a target completion date. Mayor Kim stated there is no target completion date at this time. He encouraged Ms. Tate to come to his office to have a conversation. Mayor Kim concluded the public hearing at 7:00 p.m. and left it open. Amend Chapter 225 to Add ‘No Parking’ Signs on Ashley Place Tony Izzo advised the public hearing was duly noticed in the newspaper but was omitted from the agenda. Mayor Kim opened the public comment period at 7:01 p.m. No one spoke. Mayor Kim concluded the public hearing at 7:02 p.m. and left it open. Amend Chapter 225 – 2 Hour Parking Limitations Mayor Kim opened the public comment period at 7:05 p.m. No one spoke. Mayor Kim concluded the public hearing at 7:05 p.m. and left it open. CALL TO ORDER Mayor Kim called the meeting to order at 7:05 p.m. PUBLIC COMMENT Mayor Kim advised there are new rules to public comment. People have 2 minutes to use or lose it. He asked all to be kind; we are a community. He also asked the speakers to be factual. The Council members may respond if they choose. He will also be starting a question period at the end of the City Council meeting. The public must register to present their questions. Mayor Kim opened the public comment period at 7:06 p.m. Ken Gray of Saratoga Springs and member of Complete Streets stated they encourage people to come out to hear the presentation on the enhancement of Union Avenue. The focus is safety so people can get around. Rose Tate of Saratoga Springs stated Lincoln Avenue has become the forgotten street. When talking about the beautification of Union Avenue, Lincoln Avenue should be included. Picnic tables have been lined up by NYRA on her side of the street. Page 4 of 9 City Council Meeting 1/3/2023 Suzanne Jagoda of 16 Empire Avenue and a member of Complete Streets stated there are two proposals they are working on and looking for feedback from the community. They would like to see the enhancements on Union Avenue that would eventually make its way to Lincoln Avenue. Complete Streets is looking for the community to get behind this and the track. The Complete Streets Committee can’t complete everyone’s everything but should be able to make good compromises. Mayor Kim closed the public comment period at 7:11 p.m. SUPERVISORS Matt Veitch Saratoga County Organizational Meeting January 4, 2023 at 4 p.m. Supervisor Veitch reported the annual organizational meeting is scheduled for tomorrow, January 4, 2023 at 4 p.m. at the Board of Supervisors. This meeting is used to choose and vote for a chair and committee assignments will occur. Supervisor Veitch will report which committees he has been assigned to at the next meeting. Tara Gaston Supervisor Gaston thanked the Saratoga County Chamber of Commerce, Saratoga Eagle, Todd Shimkus, Tom Roohan, and DeCresente for assistance with delivery of water due to the water main break. Rich Ferguson, who acted as the chair for many years has resigned. Announcement: Appointments to Open Space Advisory Committee Page 5 of 9 City Council Meeting 1/3/2023 Mayor Kim announced the appointment of Tom Denny, Anita Morzillo, and Jeff Cheek to the Open Space Advisory Committee. Their terms are for five years. Discussion and Vote: Authorization for Mayor to Sign Saratoga County Arts Council Lease Agreement (23- 001) Mayor Kim moved and Commissioner Montagnino seconded to authorize the mayor to sign the Saratoga County Arts Council lease agreement addendum #6. Mayor Kim advised this is a 30-year lease for $1 per year. Maintenance of the property still needs to be addressed. Tony Izzo, city attorney, advised the corrected lease term is 33 years and that the Arts Council provides a public value. The name has been changed from Saratoga County Arts Council to Saratoga Arts, Inc. Mayor Kim confirmed for the record the name of the agreement he is signing is with Saratoga Arts, Inc. Commissioner Golub stated he has met with the Arts Council in attempt to narrow the scope of the day-to- day responsibility. Commissioner Moran asked the reason for a 33-year lease. Mayor Kim stated for fund raising purposes they needed to make the lease 33 years. Tony Izzo stated he did research and found there is nothing inappropriate with a lease of this term. Ayes – All (Commissioner Moran, Commissioner Golub, Commissioner Montagnino, Mayor Kim) Nays – 0 Announcement: Bills for Counsel Fees Received to Date for Prior Elected Officials Mayor Kim announced the City received subpoenas from the Office of the Attorney General for the former Mayor Meg Kelly and the former Commissioner Robin Dalton. The subpoena was for events that occurred during the summer of 2021. In an effort to be transparent, the current billing is at $20,528 for Mayor Meg Kelly and $15,755 for Commissioner Robin Dalton. Mayor Kim stated he will continue to report on these bills and will bring forward another resolution and they are over the limit in the original approved resolution. Commissioner Montagnino asked if the Council will be voting on the fees at the next Council meeting. Tony Izzo stated the attorneys for both parties should submit the proposed expenses going forward. Mayor Kim stated the bills have gone beyond the ceiling of the resolution. He would like to get an accurate number before bringing back a new resolution. Commissioner Golub stated these bills are not unreasonable. It takes a lot of time to investigate. Set Public Hearing: Restore NY Grant Application Mayor Kim set a public hearing for Tuesday, January 17, 2023. The City is assisting a third party to redevelop a parcel at 53 Putnam Street. To be able to apply for a grant, a public hearing needs to be held. Set Public Hearing: Proposed Amendment 1 to UDO – Remove Uses from Greenbelt Mayor Kim set a public hearing for Tuesday, January 17, 2023. Mayor Kim advised this agreement is to pay $7,000 for the next five years. Issued in 2023 (23-003) Commissioner Moran stated due to staff availability, the requisition was unable to be uploaded to 2022 file. Contract was approved by City Council at the December 20, 2022 meeting. Commissioner Moran moved and Commissioner Montagnino seconded to have the 2022 funded purchase order be issued in 2023 for GAR Associates addendum #8 in the amount of $5,000. Commissioner Golub moved and Commissioner Montagnino seconded to authorize the mayor to sign a contract with Ryan Biggs Clark Davis for professional services for Walton and Woodlawn parking deck condition assessment, valid until 2/28/23 in the amount of $44,000. Ayes – All (Commissioner Moran, Commissioner Golub, Commissioner Montagnino, Mayor Kim) Nays – 0 Discussion and Vote: Approval to Pay Invoice #017563 to SRI Fire Sprinkler, LLC in the Amount of $5,093.12 (23-009) Commissioner Golub advised the purchasing policy was not followed for all City sites, therefore, causing them to bring the invoice to Council. Commissioner Golub moved and Commissioner Moran seconded to approve payment of invoice #017563 to SRI Fire Sprinkler, LLC in the amount of $5,093.12.
