CITY OF SARATOGA SPRINGS MUNICIPAL CIViL SERVICE COMMISSION SARATOGA SPRINGS, NEW YORK 12866 REGULAR MEETING City council chambers Wednesday, September 27, 2017 MINUTES PRESENT: elio delsette, chairperson robert mains, commissioner mark cacozza, COMMISSIONER Chief of police Gregory veitch CHAIRPERSON DELSETTE CALLED THE MEETING TO ORDER AT 9:30am. Commissioner Cacozza made a motion to adopt the July 26, 2017 meeting minutes as revised. Seconded by Commissioner Mains. Ayes all. Chairperson DelSette opened the public speaking session at 9:30am There being no one wishing to speak, Chairperson DelSette closed the public speaking session at 9:31am. EXECUTIVE SESSION: Chairperson DelSette made a motion to adjourn for executive session to discuss pending disqualifications. Seconded by Commissioner Cacozza. Ayes all. Chairperson DelSette made a motion to close the Executive Session at 9:55am. Seconded by Commissioner Mains. Ayes all. This position would be a 10 month position; working only when school is in session. There is a mandatory eligible list for this Competitive Class title. The secretary informed the Commission that the School District is claiming that the School Bus Dispatcher position is managerial/confidential, has been removed from the Union and that the position has been filled for a few years without an examination. The secretary has requested that the School District provide the Commission with verification of an approved salary for the 10 month dispatcher position; verification of removal from the Union; and supporting documentation as to why the position was classified as managerial/confidential. As of this meeting the School District has not provided the requested information. The salary provided by the School District for the 12 month positions ( 2 positions) is $50,000.00 (2016 – per school district). As of this meeting the salaries being paid are: $53,500.00 and $54,900.00. The proposed salary for the 10 month position would be $38,848.00. There are no board minutes to verify these salaries. The secretary has informed the School District that the continual “employment” of the incumbent in the position of School Bus Dispatcher is not in accordance with Civil Service Law and that payroll could not be certified for any payment for duties other than those as outlined in the job specification for School Bus Driver; the position that he was nominated for and approved by the Civil Service Commission. SCHOOL DISTRICT: It is the secretary’s understanding that the School District continues to assign this employee School Bus Dispatcher duties. The secretary has been informed by the Business Superintendant and the Personnel Director that they would be taking this “issue” under advisement and she would be hearing from their Labor Attorney. Chairperson DelSette reminded his fellow Commissioners that no one is to be appointed to a Competitive Class position who is not in the top three on the Commission designated appropriate eligible list. Also, Section 100 of Civil Service Law, no fiscal officer should issue compensation to an “employee” without approval from the Commission. Also Civil Service Law Section 61 states that no one shall be employed in a position without the approval of the Civil Service Commission. After a brief discussion, the Commission decided to table the request for an additional position; instructed the secretary to contact the School District and request the necessary documentation. Also to send another Request for Additional Classified position form to the School District to be completed accurately. Commissioner Cazozza made a motion to table this agenda item until the October meeting. Seconded by Commissioner Mains. Ayes all. The State had indicated that the resolution will be on the State’s October meeting agenda. To date, there has been no indication that there is any problem with the changes requested to the rules or the appendices. The secretary informed the Commission that they are in the process of records retention. The City has been using Confidata Records Retention Company out of Utica, New York. This company delivers and picks up a large bin; certified the confidentiality of the material submitted for shredding at a cost of $50.00 per bin. These bins are approximately the size of the garbage receptacles used by the area residential waste companies. The secretary informed the Commission that she had transferred $100.00 from office supplies into professional services to pay for the professional shredding of the civil service records. CIVIL SERVICE: The secretary presented a revised Alternate Test Date Policy to the Commission for review. The secretary stated that the policy had not been reviewed in at least 10 years. Commissioner Cacozza made a motion to adopt the Alternate Test Date Policy as revised. Seconded by Commissioner Mains. Ayes all. The secretary presented the Commission a letter from Hank Kuczynski seeking the Commission’s opinion regarding the proposed charter change. After a brief discussion, the Commission decided that Commissioner Cacozza would respond to Mr. Kuczynski. The secretary informed the Commission that the determination has been received from the New York State Division of Human Rights regarding Mr. Daniel Gray’s claim of discrimination. The Division has determined that there is no probable cause to believe that we engaged in or are engaging in the unlawful discriminatory practice complained of. The complaint has been ordered dismissed and the file is closed.
