Clifford Van Wagner gave this opportunity to allow citizens to address planning issues not on
the scheduled agenda.
JAMES DOYLE, Jefferson Street, Saratoga Springs, stated he would like to take this time to
speak about the activity in the Horse Related Properties and the industry which is flourishing
and starting to see a rebirth over on Gridley Street and Jefferson. One of the reasons this city is
so noted and great is the horse applications. I think this is a great thing and I think it is a great
thing for our city as well.
APPLICATIONS:
1. 10.008 WJ GRANDE INDUSTRIAL PARK SUBDIVISION, Duplainville Road,
continuation of public hearing on a four lot subdivision in the General Industrial District.
Applicant: John Munter, Munter Land Holdings, LLC (Tom Nace agent)
No disclosures.
This is a four lot subdivision request in a general industrial district out at WJ GRANDE Industrial
Park on Duplainville Road.(IND-G). At the last planning board meeting we spoke about
this application. We were made aware that there are some butterfly habitat issues on a couple
of these parcels. We must be mindful is that what is before us right now is a 4 lot subdivision,
and an extension of Duplainville Road which is a county owned road, and is to be extended
by a little less than 800 feet. At the last meeting we did vote on the SEQRA, for the four lot
subdivision. Initially we are voting on drawing lines on a map to subdivide a large parcel of land
into four smaller parcels and to extend the road. When the applicant returns to us with a
building proposal on any one of the lots then the scrutiny will be deeper on those items.
We also left this hearing open because the Saratoga County Planning board met last week and
they were asked to comment. Duplainville Road is a county road. Any application which has a
county road in them needs the County Planning Board review. Their decision for this four lot
industrial subdivision 142 acres was to approve it. The extension of the county road was their
prinicipal area of concern and the work to be conducted in the right of way. Further review by
the Saratoga County Planning Board and the Department of Public Works will take place upon
submission of individual site plans. The letter does not specifically address the ownership of
Duplainville Road. Brad spoke to the County Planner, and he indicated that the County would
indeed plan on taking ownership of the extension of Duplainville Road, some 796 ft.
John Munter, Munter Land Holdings, LLC, Middlegrove stated nothing has really changed since
their last appearance before thre board. What they are requesting is an approval for a four lot
subdivision and the road extension.

Clifford Van Wagner questioned if anyone in the audience wished to make a comment on this
application tonight?
None heard.
POTENTIAL ACTION
Future development on these lots shall require site plan review. It shall be the responsibility
of future applicants for any future development on these lots to install all necessary
improvements for utilities, including but not limited to, improvements to the existing
sanitary pump station. As we indicated two weeks ago, any of the lots that have the Blue
Lupine that they would need to contact Kathy O’Brien from the DEC an expert on this subject.
Questions or comments from the Board.
Amy Durland questioned Mr. Munter regarding the setbacks from the wetlands on the 4th lot.
Also, just to have on the record when this does come back for subdivision approval, there are a
number of issues regarding the hydrology of the area, the wetlands and flood plain and the
issue of the bank and the stability of the banks that go to the stream. Consider possibly
increasing the buffer depending on the circumstances. Assuming that you receive approval for
your subdivision is your intention to simply extend the road and then it will allow the marketing of
the property?
Mr. Munter answered lot #1, 2, and 3 will be marketed and lot 4 will not be aggressively
marketed at the present time.
Amy Durland questioned Mr. Munter as to whether Lot #2 also had hydrology issues?
Mr. Munter answered that the map they are looking at is a very conservative approach at
trying to depict what is there. When lot #2 comes in for approval the wetlands would be
delineated and accurately shown at that time.
Amy Durland states she would like several issues identified for the record. One would be the
hydrology of these lots. Especially Lots 2 and 4. Soil disturbance permit, again this relates to
the hydrology of the area. The Karner Blue habitat as we have mentioned. Kathy O’Brien at
the DEC has spoken about preserving the habitat as well as possible restoration areas.
The Adams Road, rural scenic road designation and the open space plan. One of the
immediate issues, Duplainsville extension, and how that might impact residential areas on the
west end of Adams Road.
Mr. Munter explained that the road extension, is approximately 2,000 feet from Adams Road.
Amy Durland explained when Lot #3 comes in for site plan there probably would be an interest
in the traffic and the access points, the traffic and how that would relate to Adams Road and the
neighborhood. General issues of the single access point to Grande Industrial Park only one
way in and out and generally how much traffic can be handled.
Amy Durland stated there may be a need to reopen SEQRA during the review of any of the lot
site plans. Also if there is an approval tonight, we might want to include as a condition that the
status of the Rowland Hollow Creek as within the “Watercourse Protection Overlay District”

may require additional protection provisions which would become elements of the site plan.
If that is agreeable to the Board.
Philip Klein stated for the record that there are additional entrances to the Grande Industrial
Park, the main entrance that the trucks and busses take, and then there is another entrance
that goes out from Quad’s headquarters to Adams Road, and is only used by visitors and
Quad employees. All the large traffic comes in on at one single intersection.
Clifford Van Wagner states that when the application of Eagle Beverage Distributing Company,
came before the Board they did a traffic study and showed that at least their impact was minute.
Jamin Totino stated there is a project called Meadow Vista. This project when it comes to
fruition, involves a public trail access throughout these woods and try to develop a connection
a walking connection. This is managed by Saratoga Plan, it was part of the subdivision
process is that they agreed to take the maintenance of those trails over. It really would be in
partnership with them. Interesting potential to try to connect that trail to Adams Rd, and
possibly Beaver Pond.

2. 10.007 SUBDIVISION OF LANDS OF MOUNT OLIVET BAPTIST CHURCH,
Southwest corner of Crescent Street & Jeffersaon Street, public hearing on a two
lot subdivision in the Urban Residential-2 and Urban Residential-4 Districts.
Applicant: James Doyle, Agent

Applicant went to the ZBA for an area variance for mean lot width several months ago and
basically we asked Mr. Doyle to come back tonight because we are concerned about the safety
of the corner lot being Jefferson Street and Crescent St. The two lot subdivision residential
district shows the sidewalk in front of the proposed house but the parking lot of the church is
undefined, there is no sidewalk, there are no curb cuts, and we had a concern for safety as well
as the corner which is rounded out and we need to slow traffic down a little bit. Paul Male, City
Engineer met with Bradley Birge, Administrator of Planning and Economic Development and
Clifford Van Wagner, Chairman of the Planning Board at a meeting last week to take a look at
this. The City Engineer was in favor of widening out that intersection, putting a curb around it
to slow traffic down and also to define the pedestrian traffic.
We asked Mr. Doyle to come back with a proposal, for parking and egress and ingress.

Mr. Doyle stated that there is uncertainty with regard to the Church, and whether it will continue
to go on. What we have discussed and come to some decisions with regard to improving the
curb and sidewalk on Jefferson Street, at least. We did address the safety issue. I have
exteneded the sidewalk from the existing houses to the south. We have extended the curb all
the way around. The City Engineer approved of the widening of the curb. This is a positive
start to the proposed site plan.
Extend the sidewalk from the residential properties to the south, all the way up to the corner of
Crescent Street. We are going to take the curb and run it along the same line and run it around
the corner so that it comes onto Crescent and finds the intersection. At the workshop there was
some concern regarding the stone dust on Jefferson, but Mr. Doyle agreed to take the blacktop
in 8 or 10 feet just so there would not be that problem of the stonedust on the interior of the
sidewalk. We also spoke regarding the potential to possibly get some greenspace in the
area of the intersection.
Philip Klein stated that all the Board was looking for was approximately a 12 foot diameter
small little garden, with flowers and low plantings.
Mr. Doyle agreed to the above recommendation.
Bradley Birge interjected that the department of public works information regarding egress and
ingress in the engineer’s office and they thought that with a 14 foot width in the Crescent Street
area it was most appropriate for an entrance only, along that area. The 24 width on Jefferson
Street could accommodate and would accommodate both egress and ingress at that area.
They did recommend curbing as was recommended to contain stonedust when plowing, etc.,
The only other item they did suggest that the sidewalk at the corner of Crescent and Jefferson
be accessible.
Sidewalk along Jefferson will handicapped accessible at the northern end by Crescent.
The curb that goes all along Jefferson and curbs around onto Crescent to define the
intersection. Concrete apron on the inside of the Jefferson Street driveway access to contain
stonedust and then the Crescent Street access for parking will be a direction in only and on
Jefferson Street, since it got an increase width that it would be ingress and egress and in the
bullnose area at Crescent and Jefferson there will be an effort to plant some greenspace
somewhere in the vicinity of a 12 foot diameter area to lessen the impact of all the blacktop.
Amy Durland stated that she wanted to mention the letter the Board received from Jeff Novo
earlier this month. He had two concerns. Whether the parking lot was actually going to be built.
The other he mentioned grading and water table problems. Has Paul Male signed off on this, in
terms of drainage?
Cliff Van Wagner, Chair informed the Board that at the meeting he attended with Bradley Birge
and Paul Male, the City Engineer was not aware of any issues with drainage.
Mr. Doyle stated that Jeffrey Novo is the neighbor to the immediate south. The two houses that
were built on Jefferson Street they were built with a higher sub basement floor. He is concerned
about the water table there but the City put in a whole new storm system in all the way to
Vanderbuilt, not only for that house but the new house just completed on Crescent Street.
The water table has subsided or has been lessened. There really is not an issue there.
Bradley Birge interjected since he was present at this meeting. Paul Male, City Engineer

did review concerns regarding water table problems, or drainage issues and did not see any
issues there.
Mr. Doyle stated that he will be taking up a lot of blacktop as it appears now. When you
put that curb in we are going to be clawing up a lot and dirt will be on the inside of that curb.
Also. you have a storm system between his property and this church property as well.
I don’t see ground water or surface water traveling down to him or near his property.
Anyone in the audience wish to be heard regarding this 2 lot subdivision? None heard.
Clifford Van Wagner, Chair questioned trees and streetlights? One street tree on Jefferson.
Discussion of placement of street light and trees in this area. Street tree on lot one.
SEQRA short form was reviewed no large or important impacts were identified.
Jamin Totino made a motion based upon the information provided by the applicant in Part I of
SEQRA shortened EAF and the analysis of the information provided and presented in Part II
of the SEQRA shortened EAF I find the project will not result in any large or important impact
and is therefore one that will not have a significant adverse impact on the environment, I move
to issue a SEQRA negative declaration for this action. Seconded by Philip Klein.

Clifford Van Wagner, Chairman states the board needs to vote on the subdivision, conditions as
agreed includes, includes sidewalks, curbs, and an entrance on Crescent Street, exit and
entrance on Jefferson Street, and a green space at the bulb out of Crescent and Jefferson, a
street tree on lot 1, the curb cut at the north end of Jefferson Street will be handicap accessible,
with a wheelchair accessible ramp and the apron of the driveway will be either concrete or
blacktop on either side of the sidewalk on Jefferson Street, and the entrance on Crescent is one
way.
Departmental comments, identify size and type of water line. Drawings show a ¾” line, which is
acceptable. Department of Public works states install catchbasin(s) and drywells and tie into
existing drainage system to the south.
Motion by Philip Klein for the subdivision, seconded by Suzanne Bernardi-Cleary.
Another other discussion on this subdivision.

3. 10.010 CONGRESS PLAZA REDEVELOPMENT, 46 Congress Street, sketch plan
discussion of redevelopment of site for mixed retail and residential use in the
Traansect-6 and Urban Residential-5 Districts.
Applicant: Donald MacElroy (Matt Hurff, Frost Architure, Agent)
Disclosures; None
Presentation of proposed “District Intent” the urban core is the densest business, cultural and
entertainment concentration of the City of Saratoga Springs and the surrounding region. The
purpose of this district is to appropriately regulate design and creation of a consistently high
quality pedestrian oriented public realm in character with the historic forms, materials, and
colors of Downtown Saratoga Springs without unduly restricting re-use of historic structures
of architectural diversity. Two to seven story buildings as appropriate. Retail, restaurant, office
residential, light industrial and civic uses integrated at building lot and block level. Streetscape
includes pedestrian amenities such as benches, trash cans and information kiosks.
Access by vehicles with egress and ingress along souther portion of parcel where it does not
currently exist. Break up of a large block area in a T-6 district. Safety improvements for internal
circulation patterns. Traffic patterns to be studied along with multiple curb cuts.
Clifford Van Wagner stated that at the workshop if somehow we could take each one of these
buildings with the bridge over and create a cardboard model if you will, so as we go through
these various stages of this we can move them and get a better idea of how this will fit on the
lot. The Board has some concerns regarding how this will effect adjacent and contiguous
properties i.e, CVS, Wendy’s and the existing apartment complex to the south and the parcels
of the land which are on the backside of the alley to the west, this was asked of the architect
Mr. Frost.
Mr. Frost replied that this is so diagramatic at this point that it is not really helpful. We need to
do a three dimensional model of the entire site. This is critical because one of the main features
is site, and the change in grade. There are significant things going on in terms of grade
changes and it was my sense that to do a site model that is fairly accurate in terms of grade
changes and everything else and then put these in a box form that we can move around and
look at different levels, and would be a good tool.
Clifford Van Wagner stated that what you are proposing is great idea, whereby the Board can
look at what is there now and then what is proposed, as well as what is contiguous to it on all
four sides.
Michael Perkins stated that we do need to understand the heights relative to the surrounding
properties. At some point shadow studies, this is early on but also the street connections.
Depending on the height of these properties and the fairly narrow road, what type of potential
tunnel situation is created.
Mr. Frost replied that this type of model is useful for them as well. That is how preliminary this
is. In terms of the design and three dimensionality of the site, scale of it as a model is almost
essential.
Clifford Van Wagner stated that his concern is the street that will be created off the south end

of South Federal and going through and exiting onto Congress Street, the worry is safety.
What you have is a parking lot on either side of that. When you get on the side of CVS and as
that road comes out and goes perpendicular to Congress there could easily be
pedestrians as well as cars coming out of the parking areas with a through street going through
the center of it. Parking is going to have to be clearly articulated.
Jamin Totino states that this is exciting. This area is ripe for redevelopment and there is a lot of
potential here. There is really a change to introduce some historical elements into the site, such
as the railroad bridge we discussed earlier. I do have concern regarding traffic flow. It is a
great concern now in this area and with the increase in traffic it becomes even more of a
concern.
Discussion ensued regarding the placement of the exit road from the plaza. Mr. Frost relates
how when CVS was first in the Plaza there was talk about extending Federal Street right
through. This is a private street, it will be open to the public 24 hours a day as the plaza is now.
It is essentially circulation for this plaza. One of the ideas of this is to bring the people into the
plaza so they can see all the stores visually read the signs and be in there. Quite frankly, we
are not trying to create a shortcut from one point to another and create a public road. There will
be as you are aware stop signs all over the place in here. There will some type of traffic study
done. This is very problematic, it looks simple on a two dimensional drawing. We have to
remember that this is an anchor tenant and he exists. He is very jealous about his parking.
Amy Durland agrees with Jamin Totino regarding the area being ripe for redevelopment.
In general it is a very positive thing although, are any of the retail establishments there
are the entrances both on Congress Street as well as in the plaza?
Mr. Frost answered yes. This is one of the challenges. The entrances to the stores will be on
both sides, so they are at different levels.
Amy Durland states that she is extremely glad that they are coming before the Board for a
sketch plan. This is to everyone’s benefit. The layout of this project does make me feel
uncomfortable as a T-6 project. In reviewing the ordinance, section called streets and street
scapes development standards applicable to the Transect zones and look at the information
regarding the urban center T-6 areas. The fact that they talk about the interior block, shared
public and private parking access by alleys as a defining feature on smaller blocks, I am quite
concerned about the effect of a large parking area inside if people access those retail
establishments from the inside. From my perspective it looks like a sea of parking. That is
contrary to T-6. Whereas there is a big effort to hide the parking, or to have parking accessible
but not dominant. My reaction would be that the access road which you characterized as
private be more of a more public way that may also have storefronts and that their be some
accomodation for parking behind them. This is an opportunity to redefine this type of retail
plaza, really rethinking the configuration of it. This is something that could not be approved right
now according to the Ordinance. There are constraints but my initial reaction at this point
is one of concern. I do not feel this is what was anticipated by the T-6 district.
Mr. Frost stated that this is the challenge here, no question about it. The road is defined by
buildings on both sides. There are ways of defining this better. Is the issue the appearance of
parking or the actual parking?
Amy Durland states the appearance of parking. It looks like a big parking lot as the central
feature of the project. The Ordinance does not state that you cannot have parking lots and

certainly parking is an issue that we are sensitive to. Also, the ordinance does endorse parking
garages which I know is part of this plan. Maybe there are pieces here that perhaps are not
arranged correctly in the broadest sense.
One of the things we are dealing with here is the long term lease with CVS, and they have a
significant amount of site control. They are very jealously guarding their parking. So we have to
work with the City for a plan that works in this particular location, yet at the sametime our tenant
and perhaps other tenants basically have veto power over what we do there. So it is a
balancing act for us.
Clifford Van Wagner states that is why you are in a sketch plan phase of this. Any Board
members comments are fair game and I think your ability to put a 3-D model will open up all
sorts of doors for this. We are not going to come to any finality tonight. I did check with Brad
and the code states that you do get 2 sketch plans but we can waive that certainly that would be
my inclination to bring you back for many sketch plans. This is exciting for us we can actually
do some planning here. This is not knee jerk, this is proactive planning. This gives us
a great opportunity, and the more comments that you hear from us the more we are going to be
able to say pick that up and move it, or turn this in a different direction. Jamin just made a
comment to me regarding parking.
Jamin Totino states that he was listening to Amy Durland’s concern and I wonder if there is an
opportunity for some type of boulevard type of feel down here like in Commonwealth Avenue in
Boston, that mitigates some of the impact of the visual piece of parking and that is a big
question that I will have to wrestle with too, is it parking or is it the visibility of the parking.
How this can be layed out and viewed and the aesthetic value of it is an interesting question.
The other thing is the cemetary up there and as a SEQRA issue and certainly as a sensitivity
issue to the neighborhood, there has been a lot of restoration as you know especially on that
front end up on the street level which has been done. I am concerned regarding parking right
up against that cemetary now after all the concern and care that the neighborhood has put into
it.
Mr. Frost states that they have given thought about the cementary not with anything specifically
to accomodate that concern. It is urban cemetary basically, it was a lot more urban before than
it is now. Assuming that this configuration stays and that this remains a parking garage backed
up to the property line it is an issue how do we treat that wall or what does it look like from the
cemetary, it is a sensitive issue, no question about it.
Suzanne Bernardi-Cleary questioned CVS and their entitlement to so many spaces? Also,
the is the number of parking spaces more than what is there now or less?
There will be less parking spaces available than there is now. If you check the zoning
ordinance regarding what is allowed for parking, they project is actually coming up light where
the parking is concerned.
Suzanne Bernardi-Cleary states that she can envision shopping, sitting down, perhaps on
benches, perhaps eating looking out at trees and have something more than the starkness of
parking. It would be very attractive.
A Lifestyle Center, this will be the first one in the Capital Region, that is really truly a lifestyle
center. live, work and play. The intimacy of a lifestyle center if you have seen them is wonderful
and that is what we are really trying to pattern this in that direction. The intimacy of Saratoga

it is a perfect match.
Philip Klein stated that when he first looked at the drawings, I see that there is another drive thru
bank and I think you touched on it a little regarding the number of tenants that you hoped to
retain and move into that new angular building so in the spirit of retaining tenants, and moving
them is there a possibility of retaining CVS being able to move somewhere else on the lot
thereby opening up the whole lot so that the configuration might have a better flow.
I concur with Jamin the private street needs to be a wide boulevard type with wider sidewalks
with trees with fewer curb cuts and lanes circle around.
Mr,. Frost stated that CVS has a 30 – 40 year lease. Enhancing or strongly defining this
will include a widening of the street and thereby a loss of parking spaces. That is a given with
anything that we do beyond adding trees. We have a lot to deal with.
Discussion ensued regarding number of residential units, parking garage spaces, open parking
spaces and square footage of proposed apartment/condo.
Michael Perkins questioned if the residential area proposed was over 20,000 square feet,
because if it is the T-6 ordinance requires civic space in a project of this size, and this is not
indicated in the sketch plans. Concerns were also expressed regarding traffic in this area as
well.
Matt Hurff commented that the civic space is not indicated in the current sketch plan.
Clifford Van Wagner noted that CVS pharmacy will add a drive thru as well as one of the banks.
How firm are those plans?
Mr. Frost indicated that these were just preliminary thoughts/plans.
Amy Durland stated that if the entire plaza was demolished except for the CVS, it seems you
could start from scratch. I would prefer that you go back to the Ordinance and really reconceive
this project. It is not appropriate the way it is. Tweaking it or trying to disguise things in
a mild way doesn’t seem to work. You are missing an opportunity. The ordinance is really clear
in terms of design guidelines for T-6. This parking in the middle of the project is what again
looks like the central feature. This is not consistent with what was anticipated for this zone.
A different concept would be my preference. Regarding the Lifestyle Center, I am not familiar
with what a lifestyle center is apart from any of the other Transect-6 projects that have
happened in other areas.
Mr. Frost questioned the T-6 zone. His understanding of such a zone is a downtown urban
fabric. Streets that intersect with each other and one of the things is to try and promote
pedestrian activity. We almost go back to some of the comments that came up when CVS
was proposed. We can do some additional drawings and try to present something of what a T-6
zone should be.
Jamin Totino stated that topographical maps would help as well as an aerial site map not just of
the site but of the area around it. It will be important not just for this site but how it will interact
with the areas around it.
Mr. Frost stated the model will help. The addition of some surrounding buildings can also be
added.

Clifford Van Wagner would also like to see the impact of adding on a drive thru to CVS, without
impacting or interferring with thru traffic considering they have parking spaces adjacent to that
corner.
Clifford Van Wagner asked if anyone in the audience would like to speak regarding this
application?
None heard.
Amy Durland apologizes for the late disclosure my son who is a minor has worked for about a
year and half at the CVS. I don’t believe this requires recussal. Just a note for the record.
Dan Gaba questioned again the CVS and it’s lease in the plaza.
Mr, MacElroy states that CVS is about 8 years into what is probably with options a 30 or 40
year lease. For better or worse this is what we have to live with.
Clifford Van Wagner states again this is exciting for the Board. Allow more than two sketch
plans and gives the applicants as well as the Board a much better idea on where this project is.
This is a work in progress and once you have more information Mr. Frost knows the plan and
talk to Bradley Birge and get back on the agenda and we will be able to finesse this and if
it takes more than two weeks to prepare the cardboard model simulated building to scale.
We look forward to working with you.
Philip Klein appreciates the thought that went into the parallel buildings and the wider street.
Wondering why was there a reason you did not carry it through and allow for store fronts on
both sides.
Mr. Frost states they would again have to take a look at the impact on CVS, parking, and
visibility.
Amy Durland comments on items to take back and review and consider I would like to throw out
the whole complete streets emphasis we have been trying to remember especially urban
projects. Congress Street was anticipated as a bike boulevard, and we just want to make sure
that whatever you end up doing that you consider all citizens needs, pedestrians, as well as
cyclists, people with strollers and wheelchairs and all people who might be using that plaza.
Clifford Van Wagner states that just for the record he is disclosing that he also a Phamacist and
his practice does not have any bearing on CVS.
Any concerns, questions, or directions from the Board?
Bradley Birge stated that he believes that the Board has provided very good input to the
applicants. It sounds as if they have been very open to your comments and suggestions and
discussions. Whenever they are ready to be placed back on the agenda, please let me know
and we look forward to that.
