APPLICATIONS UNDER CONSIDERATION: 1. 14.035.1 TRIPLE CROWN SUBDIVISION EXTENSION, RICHARD AVENUE, Subdivision extension Review of a 3 lot residential subdivision in the Urban Residential-2 (UR-2) District. BACKGROUND: Planning Board approval September 11, 2014. Approval will expire March 11, 2015. Applicant is requesting one month extension – April 11, 2015. Approval could be extended (only 1 – 90 day extension allowed. Applicant: Andrew Kazanjian Applicant stated extension is requested due to the construction of the water main which is still under the NYS-DOH review. The NYS-DOH has since signed off on the application and we are looking to proceed forward, following the City’s review. Clifford Van Wagner made a motion for to approve a 90 day extension for the Triple Crown Subdivision Extension, on Richard Avenue. Dan Gaba seconded the motion. CORRESPONDENCE RECEIVED BY THE BOARD: Correspondence received from Richard Culmer, dated February 10, 2015 and March 23, 2015. Correspondence received from adjacent neighbors Linda Pace and Michael Inferna. Applicant: Mark and Patricia Harrison Agent: Dan Wheeler, Survey Associates, LLC City of Saratoga Springs – Planning Board Meeting – March 25, 2015 - Page 3 of 12 BACKGROUND: Property is within the Rural Residential District, conservation subdivision is required. The property was part of a four- lot subdivision approved in May of 1981. Adjacent property owned by Michael Infurna and Linda Pace contains a conservation easement maintained by Saratoga PLAN. The Planning Board previously required a stake out at the site of the proposed property boundaries, wetlands and driveway access. The Board has expressed the need for further information related to potential overall issues of wetlands impact, driveway access, practicality of developing homes on low lying, wet site. Mr. Wheeler stated the applicants are looking for a waiver. This project had to be considered for a conservation subdivision. We did perform a conservation analysis plan. The most important resource was the DEC wetlands. It is contiguous to the old railroad bed and the existing easement on the Pace property. Saratoga County DPW did comment regarding using a common driveway avoiding a second curb cut. We don’t have any issues with that. We did take a look at the conservation subdivision and it does require setting aside another 2.2 acres and I feel this is unique since it is already developed. There is one spot for a house and one spot is not going to change the look of the subdivision. It will create more work on the applicant’s end and there will be a rambling easement struggling to attain the 2.2 acres. We would like the Board to consider leaving this as a conventional subdivision and we would like to create an easement over the DEC wetlands and use a shared driveway. We did receive comments from the City Engineer, and his comments and suggestions will be incorporated. Mark Torpey, Chairman provided some background information. A conservation easement is required as part of a Rural Residential District. The Board does have the ability to issue a waiver. The first part of the process is to figure out the base density and the allowable lots on the property. You have completed that and it shows a base density of 2 units is allowed. Mark Torpey, Chairman continued with a review of what is required in the conservation analysis. The onus or responsibility rests with the applicant in this regard. The Board shall make the final determination as to which land has the most conservation value and should be protected by a conservation easement. The applicant provides the information and the Board makes the determination. If based on the conservation analysis the Board makes a determination that there is no reasonable basis for the conservation easement, and then the Board may approve a conventional subdivision. We don’t have a conservation analysis that articulates what was just stated for us to make this determination in the first place. Even if we did, there are four specific issues that we need to address in order to issue the waiver. First, the land contains no substantial resources with conservation value. In my opinion, you have wetlands on the property, tree buffer and steep slopes, which by definition have conservation value. Also, one of these four needs to be answered, not all four in order to issue the waiver. Secondly, the acreage is too small to preserve a substantial amount of land with conservation value. The answer to this is no also. 7 ½ acres is the total property length, and the property abuts and is contiguous with other conserved lands in Saratoga PLAN eaement and in addition 12 acres with the neighbor. It seems to be a critical mass of land that we are talking about so it would not satisfy that requirement. Thirdly, the configuration is unique and precludes preservation of a substantial amount of land with conservation value. I cannot see anything particularly unique about the property. The property is of sufficient size and wouldn’t satisfy that objective. The last question is there are extraordinary circumstances that are unique to the parcel, which demonstrates that a conventional subdivision is in the best interest of adjacent neighborhoods. We have received feedback from neighbors. I do not see any of the four conditions being appropriate for us to waive. Peter Koscio, representing the applicant. Mr. Koscio spoke regarding the amount of usable land. Mr. Koscio spoke regarding all four issues Mr. Torpey cited and why the applicant should receive the waiver. Mr. Torpey stated the density calculation is based upon constrained lands of 2.7 acres of DEC wetlands and 0.33 acres of ACOE wetlands, resulting in unconstrained lands of 4.39 acres or 2.2 units available under the district’s 2 acre minimum lot zoning. 50% unconstrained land required to be permanently protected open space is 2.195 acres. Mark Torpey, Chairman asked if anyone in the audience wished to comment on this application. Jim Mahuga, I live next door to this property and have lived there for 39 years. This is beautiful piece of property. It is an unusual lot. Meadowbrook Road is a beautiful road. This is a shoehorn fit and this home will look like an afterthought. Mark Torpey, Chairman asked if there was any further discussion from the Board. Howard Pinsley questioned the 2.2 acre requirement. Kate Maynard, Principal Planner reviewed the requirements of the Rural Residential District. Discussion ensued among the Board regarding the requirements of the conservation subdivision. SEQRA: Action appears to be Unlisted, with involved agencies of ZBA, DRC and the Planning Board. The ZBA initiated Coordinated Review on September 22, 2014. The Planning Board issued a Negative SEQRA Declaration on October 8, 2014. BACKGROUND: The following area variances were granted January 26, 2015. Applicant: National Retail Properties, Inc. Agent: Matthew J. Jones, Alex Besso, Attorneys’ Jones Firm; Jaclyn Hakes, MJ Engineering Mr. Jones reviewed the project for the Board provided a visual presentation for the Board reviewing the site and the surrounding neighborhood as well as a history of the project. It is the applicant’s hope to receive a Special Use Permit tonight allowing the project to move forward. Jaclyn Hakes, MJ Engineering provided a visual presentation of the site plan. West Avenue will be treated as the frontage, per Transect Zone regulations. A review of all elevations was provided to the Board. We have been working with staff. So this site plan is a work in progress, looking to reflect the transect zone requirements and we will continue to refine the design and working on the entrance which will be placed closer to the handicap parking area. Ms. Hakes reviewed the two drive-thru lanes which will be provided for pharmacy drop off and pick up. The delivery area has been engineered to accommodate the largest type of delivery vehicle used, which will make once a week deliveries early in the morning. Buffering and landscaping was also reviewed. Parking requirements were reviewed and we will be providing 60 parking spaces. A second floor level to the building is providing 700 square feet of space. Mechanicals will be housed here as well as a manager’s offices. The intent is to have the building look like it has two levels. DISCLOSURE: Clifford Van Wagner stated as the Director of Pharmacy at Wesley he has no conflict with this project and can be objective in his decision. Matthew J. Jones reviewed the six criteria for a Special Use Permit - The extent to which the use is in harmony with an promotes the general purposes and intent of the Comprehensive Plan and this Chapter. - The density, intensity and compatibility of the use with the neighborhood and community character. - Safe and efficient pedestrian and vehicular access, circulation and parking. - Existing and future demand on infrastructure, public facilities and services. - The environmental and natural resources of the site and neighboring lands including any potential erosion, flooding or excessive light, noise, vibration and the like. - The long-term economic viability of the site, neighboring properties and districts. Discussion ensued regarding the second floor of the building. Mark Torpey, Chairman questioned noise mitigation, light mitigation and storm water management. Jacklyn Hakes reviewed the landscape buffering proposed and lighting will be shielded. A full lighting plan is to be submitted. Concern regarding the shared driveway and the safety of bicyclists and pedestrians. due to the proximity of the buildings to the street. Should be in compliance with the complete street policy. John Casey, West Hill Shopping Plaza Owner. Employees of Rite Aid park in this shopping plaza. Parking should be checked. Ken Schooley, concern regarding truck traffic entering and making deliveries. The Board reconvened at 8:44 P.M. 15.007 FASIG-TIPTON/MAZZONE CATERING, 251 East Avenue, Special Use Permit review for non-horse Related events in the Institutional Horse Track Related (INST-HTR) District. SEQRA: Action appears to be unlisted. BACKGROUND: Kate Maynard, Principal Planner stated the following correspondence was received by the Board: - Email from Kathryn Gallien and Kenneth Hapeman, 46 Ludlow Street received March 20, 2015. - Letter from Natalie Walsh, 29 Madison Avenue, dated March 20, 2015. NOTIFICATIONS/APPROVALS/CONDITIONS OF APPROVAL: - Saratoga County Planning Board referral was also received stating no countywide or intercommunity impact. We recognize the application for Special Use Permit to address issues of a local nature more than any countywide impact. The issues appear similar to the history of the discussion Siros had for City of Saratoga Springs – Planning Board Meeting – March 25, 2015 - Page 7 of 12 their Special Use Permit recognizing the temporary nature of any permit and the need for re-issuance we assume safeguards will be written into the Special Use Permit which specifically address noise, security, property clean up and local enforcement measures. Applicant: Fasig Tipton and Mazzone Management Inc. Agent: Michael Toohey, Attorney; Michael Ingersoll, LA Group Mr. Toohey provided a visual presentation of the area of consideration. The history of the pavilion is it was used by Fasig Tipton for horse sales. Several years ago Fasig-Tipton has been used for not for profit affairs. We are here this evening is to obtain a one year permit to host 10 already approved contracted events and 3 cocktails parties. In 2016 there will be no events planned on this property. Angelo Mazzone is renowned in this area as a caterer. He did obtain a license from the Health Department to allow an outdoor eating and drinking establishment which allows for 90 days within a year which alcohol can be served. He did receive permission from the City for two years to host these events. This area was inspected for code enforcement. No one informed the applicant a Special Use Permit was indicated. According to zoning requirements this is a permitted use in this zone for 90 days, 30 of which have to be within the racing meet. It also specifically states that entertainment cannot be provided from midnight until 8:00 am. Neighbors are requesting sound mitigation since it interferes with the enjoyment of their homes. A visual presentation was provided of the proposed tenting materials and what is being proposed for sound mitigation. The proposed decibel level will be at 70 decibels at the property limit, which is the City’s code. Staff and security will be on site with decibel meters to assure this level is met. Mr. Toohey provided the following information regarding issues with the events on site: - Ms. Lindsey Ruoff – 1-603-731-3684 – on site at all events – contact person - Chris Kohl – Chief of Security will be on site at all events along with the event manager - Music will end at 10:00 P.M. - Events will end at 11:00 P.M. - Valet parking will be available for all events on the south side of George Street at the southwest Corner of George Street and East Avenue for 150 cars. Mr. Toohey reviewed the Criteria for Special Use Permits, and requested a waiver of Site Plan review. Kate Maynard, Principal Planner reviewed the noise ordinance of the City Code. - Residential zoning district - 11pm – 7 am – 60 dba. - Non residential zoning district – 12 midnight to 8 am – 90 dba. - Non residential zoning district within 250 feet to a residential district - 70 dba. Mr. Toohey stated the sound attenuation proposed will reduce the decibel level 25 decibels lower down to 45 decibels at the property boundary. At no time will the decibel level exceed 70 decibels. Staff and security will be taking measurements several times over the evening at all events. Site staff will self monitor. Mr. Toohey stated that this one year permit will not be used in any way as a precedent. If the applicant should return before this Board for any type of permit it will be judged using independent criterion. Mark Torpey, Chairman questioned the dates of the proposed events. Mr. Toohey stated copies have been provided to all neighbors as well. Mark Torpey, Chairman asked if there were any further questions or comments from the Board. Clifford Van Wagner stated the applicants have addressed each and every issue. This is a permit for one year only. The applicants have been honest and have obtained all the necessary permits. City of Saratoga Springs – Planning Board Meeting – March 25, 2015 - Page 8 of 12 PUBLIC HEARING: Mark Torpey, Chairman opened the public hearing at 9:28 P.M. Mark Torpey, Chairman asked if anyone in the audience wished to comment on this application. Eleanor Mullaney, attorney for four families in this area. These clients stated that Fasig-Tipton has been a wonderful neighbor. There have not been issues with not for profit events. The weddings are another issue. We are in a residential neighborhood. Music is an issue. These are old homes, windows are open, they enjoy sitting on their porches and this is an intrusion every weekend in the summer. My clients are pleased there are no weddings in 2016. The decibel issue is a problem. We all thought it was a 60 decibel limit. Clients are requesting monitoring start when the band starts. Also a request that the PA system remain off during these events. Cindy June property owner in the area requested all property owners be provided with a listing of all events. Patrick Peppino, 28 Lexington Rd. Chairman of Saratoga County Convention and Tourism Bureau. Mr. Peppino stated how hard Saratoga has worked to make it a destination for weddings. It is a revenue driver for the City. If the applicants are not granted this Special Use Permit it will decimate the City’s reputation going forward. I empathize with the neighbors. Todd Garafano, President of the Saratoga Convention and Tourism Bureau. Saratoga has become a year round destination for weddings. These destination weddings bring significant business to the hotels, restaurants, and other businesses. The impact economically is significant. Sherri Gray, 38 5th Avenue. The not for profits also amplify. I have personally been to an affair where the microphones were used for the not for profits as well. It is not just the weddings. Requested testing of the sound mitigation prior to the event. Mr. Toohey stated the use of the PA system will not be used for any functions. Kelly Chabeau, 140 George Street. Voiced sound concerns. Also, questioned if the street will be closed. Mark Lawson, employee of Mazzone Hospitality stated they have never closed the street during an event nor would we. Nancy Coleman, Madison Avenue. My family has lived here for 25 years. Concern regarding weddings, noise and crowd activity. Cannot enjoy their home, porch and yard. Values of homes are decreasing. Please uphold the zoning. James Simon, 24 Madison Avenue. It is not the horse sales we are upset over. It is the events and weddings are loud. We are upset over the noise and we cannot enjoy our homes. Miriam Scarborough, 26 Madison Avenue. My property borders Fasig-Tipton. Concern regarding noise. Cannot rent out homes due to the noise from these events. These events have changed the character of the neighborhood. Kathryn Gallien, 46 Ludlow Street. Requested the applicant stop advertising the Fasig-Tipton as a wedding destination. Angelo Mazzone, owner Mazzone Hospitality. I have had an untarnished reputation in the Capital District. We have verbal contracts with the venues we work with. If they want us there we are there, if they do not want us there we are not there. I spoke with the President of Fasig-Tipton and we decided we do not want to be there in 2016. We do have brides which were booked for this year. Fasig- Tipton has been there for four years. The first City of Saratoga Springs – Planning Board Meeting – March 25, 2015 - Page 9 of 12 year we had 6 weddings. The second year 18 weddings. The third year we had 26 weddings, and we had a lot of complaints from the neighbors. Mr. Browning and I wrote a letter to each and every neighbor apologizing. With the letter we enclosed a gift card to use at any of our restaurants. We did not get any of those back. We did go to code enforcement and did what we thought we had to do. We want to be good neighbors. It is part of our core values. Thank you for your time. Ken Schooley, landlord of Ludlow Street apartments. Calls from the tenants regarding noise. Monetary impact with empty apartments. Ken Gray, 38 5th Avenue. Concern regarding the character of the neighborhood. Ken Aikeman, corner of Madison and Ludlow Streets and have lived here for 40 years. Language in the zoning schedule is limited to 5 days per year. Weddings are outdoor entertainment. Tom L. Lewis stated he was a disc jockey in the past and has a good idea of decibel levels. Everything that I have heard by the neighbors are legitimate concerns. If this were a permanent applicant I would feel differently than I do now. Mr. Lewis reviewed the issues the neighbors had with Siros. The applicant is being reasonable for the 13 events. Clifford Van Wagner stated the message is clear. The neighbors are upset. The solution is more than fair. The applicants have made good compromises. Dan Gaba requested the applicant police the area following events for trash. Mark Torpey, Chairman reviewed the terms set forth in the Special Use Permit. - 70 decibels at the property limit. Monitor and measure at the complete event – 10 weddings and 3 not for profit. Measurements will be at the property limit taken during the entire event. - Ms. Lindsey Ruoff – 1-603-731-3684 – on site at all events – contact person. - Internal PA system is turned off. - In no way will set a precedent. - Number of guests limited to 160 people during weddings. - No advertising for Fasig-Tipton as a wedding venue. - After event policing for trash in the area and adjacent to the property. - Valet parking – 150 spaces. - Fixed set of dates for events which will not change. - Music will end at 10 PM – event to end at 11 PM. - Special Use Permit expires on September 20, 2015. The Board reconvened at 10:35 P.M. 15.003 BRODWIN PROPERTY, 131 Lincoln Avenue, Lot line adjustment to the in the Urban Residential-2 District. BACKGROUND: The applicant purchased both lots in 2006. Lot 32, 131 Lincoln – house lot, and lot 30 5’ x 260’. In 2013 lot 32 – 131 Lincoln – house lot was transferred from Eric Brodwin to Eric and Emma Brodwin. These same two lots were the subject of the two-lot subdivision in 2007. The applicant has now reapplied as a lot line adjustment request on the basis of two independent parcels under their ownership. Variances issued by the ZBA on February 23, 2015. AREA VARIANCE CONSIDERATIONS: REQUIRED PROPOSED TOTAL RELIEF REQUESTED Minimum mean lot width: 55 feet 5 feet (8%) Parcel A (existing house lot) 60 feet Minimum mean lot width: Parcel B 60 feet 56.58 feet 3.42 feet (6%) Mr. Toohey stated we have two tax parcels, legal pre-existing non-conforming lots. We would like to merge the two lots and maximize the lot. There has always been a single family lot which has exited onto Murphy Lane. We are not introducing any more traffic onto Murphy Lane than what currently exists. What we would like to do is to rotate the two larger lots and with the variance will be larger than other parcels in the neighborhood. The will comply now with all requirements in the zoning code. These are compatible single family lots that comply with the zoning code. Discussion ensued regarding creating a principal structure on the parcel.
