ZONING BOARD OF APPEALS MINUTES MONDAY, DECEMBER 3, 2012 7:00 P.M. CITY COUNCIL ROOM CALL TO ORDER: Keith Kaplan, Vice Chairman, called the meeting to order at 7:00 P.M. SALUTE TO THE FLAG PRESENT: Keith Kaplan, Vice Chairman; Adam McNeill, Secretary; George "Skip” Carlson; Gary Hasbrouck; Shirley Poppel; Oksana Ludd ABSENT: Bill Moore, Chairman STAFF: Susan Barden, Senior Planner ANNOUNCEMENT OF RECORDING OF PROCEEDING: The proceedings of this meeting are being taped for the benefit of the secretary. The minutes are not a verbatim record of the proceedings, therefore, the minutes are not a word-for-word transcript of the recording. NEW BUSINESS: 1. HERMAN RESIDENCE, 83 Nelson Avenue, area variance for construction of a garage with second-story temporary accessory dwelling to be attached to the existing single-family residence, seeking relief from the minimum side yard setback requirement in the UR-2 District. SEQRA: Action appears to be a Type II action, and therefore exempt from further SEQRA review. Agent: Tonya Yasenchak, Engineering America Applicant: David Herman DISCLOSURE: Ms. Yasenchak disclosed that Jason Tommell of Tommell and Associates did perform the survey on this property. Mr. Tommell is an alternate on the Design Review Commission. Ms. Yasenchak gave a brief overview of the project. The Herman's are looking to downsize and live in this structure part of the year and in warmer weather a part of the year. Ms. Yasenchak, stated the drawings have been revised to comply with the requirement that "Access shall only occur through a building entrance that serves both the principal dwelling and the temporary accessory dwelling and through a living area in the primary dwelling". Ms. Yasenchak reviewed with Board the five questions for consideration for an area variance. AREA VARIANCE CONSIDERATIONS: REQUIRED PROPOSED TOTAL RELIEF REQUESTED Minimum side yard setback 8 feet 5.5 feet 2.5 feet (31.25%) PUBLIC HEARING: Keith Kaplan, Vice Chairman opened the public hearing at 7:20 P.M. Keith Kaplan, Vice Chairman asked if anyone in the audience would like to speak regarding this application. None heard. Keith Kaplan, Vice Chairman stated the public hearing will remain open. A resolution will be prepared and presented at the December 17, 2012 meeting. APPROVAL OF MINUTES: Approval of meeting minutes was deferred until the next meeting. UPCOMING ZONING BOARD OF APPEALS MEETING: Zoning Board of Appeals Meeting is scheduled for Monday, December 17, 2012 at 7:00 P.M. MOTION TO ADJOURN.
