ANNOUNCEMENT OF ADJOURNED APPLICATIONS:
#2747 CONGREGATION & YESHIVA PARDES DORMITORY, 1 Veterans Way, area variance for expansion of the
existing school including construction of an approximate 10,000 square foot residential building; seeking relief from
the maximum principal building coverage in the UR-1 district.
#2746 TEAKWOOD BUILDERS, INC. RENOVATION, 79 Henry Street, area variance to construct parking area
for the proposed renovation of an existing agriculture supply store for office and retail uses; seeking relief from
the minimum parking aisle width requirement.
NEW BUSINESS:
1. #2708 CELLCO/VERIZON WIRELESS TELECOMMUNICATIONS FACILITY, 2202 Route 50 South, use
and area variance for a new telecommunications facility including a 110' high stealth tower; seeking relief for the
use and from minimum setback to the tower in a Highway General Business District.
Proposed telecommunications facility, including a 110' high stealth monopine tree tower and 12' x 30' equipment shelter.
Host parcel includes H&V Auto Enterprise and is located within the Highway General Business (HGB) District.
The property is located within the Gateway Design District 1. The intent of the district is to encourage appropriate
development while preserving and maintaining a rural "Country" Saratoga Spa State Park. The property is adjacent
to INST-PR district including lands of Spa State Park.
SEQRA:
- The Planning Board deferred Lead Agency Status to the ZBA on September 25, 2013.
- The DRC deferred Lead Agency Status to the ZBA on September 18, 2013.
- The ZBA initiated Coordinated SEQR review and sought Lead Agency Status on September 9, 2013.

PROJECT HISTORY:
- Use variance application submitted April, 2013 for a 95' high tower.
- September 9, 2013 ZBA meeting the Board requested the wetland delineation report referenced in the EAF and
a completed visual EAF addendum. As well as a balloon float that could be witnessed by the Boards and staff.
- October, 2013 balloon float, "determined that a 95' tall structure would not sufficiently clear the existing surrounding
trees”.

Mr. Olsen stated this application is an amended application. The applicant is requesting an increase in the height of the
tower to 110 feet. The application indicates that the project is necessary to provide adequate and safe public
utility/personal wireless service to this portion of the City, for use by emergency personnel and the general public. The
application states the project will increase the applicant's wireless communications capacity and coverage which will help
ensure that adequate levels of service exist for emergency and non-emergency wireless communications in the service
area. This proposal is for a tree tower. A visual presentation was provided to the Board. Due to the location of wetlands
and a creek the applicant will use liquid propane to operate the systems generator. There is room for co-location on
tower for other facilities.
Discussion ensued among the Board regarding this current location and if alternative design options were pursued.
The Board also questioned the Canadian Pacific tower which is located nearby and if there is an opportunity for
collocation. It was the consensus of the Board to request an Advisory Opinion from the Design Review Commission
regarding the height of the monopine and the visual impact.
Bill Moore, Chairman made a motion to request an Advisory Opinion from the Design Review Commission regarding the
monopine or alternate design.

Bill Moore, Chairman asked if anyone in the audience would like to comment on this application.
Paul Charon, owns five acres to the south of this property. He has concerns regarding the current location and if the
site will need to be backfilled as well as the proximity to the wetlands.
Walter Klikocki, presented the Board with a petition from 90% of the neighbors who live in the area of the proposed cell
tower location.
Bill Moore, Chairman stated the public hearing will remain open. We will await a response from the Design Review
Commission on their Advisory Opinion and we will see you following the submission of requested information.
2. #2750 SARATOGA ACQUISITION, LLC SINGLE-FAMILY, 20 Fifth Avenue, area variance for installation of a
pool and front porch addition to an existing single-family residence; seeking relief from the maximum principal
and accessory building coverages and minimum side yard setback requirements of the Urban Residential-1
District.

The applicant is requesting the installation of a pool and front porch addition to their existing single family residence.
The relief may be considered substantial however the front porch addition only increased the exiting coverage by 2.5%.
The side yard setback is preexisting nonconforming with the district requirement. The proposed front porch addition
expansion will not extend beyond the existing encroachment. The applicant would like to attach the screen porch and
the front porch. Historic photographs indicate that an extended front porch and a pool existed at one time. A visual
presentation was provided to the Board outlining landscaping plans to provide privacy screening to the pool area. The
percent of permeability will be met. There will be more green space when this application is complete.

3. #2749 569 NORTH BROADWAY, LLC EXPANSION, 569 North Broadway, use and area variance for expansion
of an existing medical office use; seeking relief to convert a portion of the second floor space from residential to
medical office and from the minimum parking requirement in the Urban Residential-4 District.
SEQRA:
-Action appears to be a Type I action.

spaces. Two residential units would remain (one on the second floor and one in the carriage house requiring 3 parking
spaces (1.5 per unit in UR-4 ) Existing parking requirement is 13 spaces and proposed is 16.

Agent: Todd Drake, Empire Real Estate Management.
Mr. Drake explained this change is to accommodate an operatory and waiting room on the second floor. This will entail a
change to apartment #1. Schematics were provided to the Board. Space does not currently allow for new
equipment/technology on the first floor. This is not to expand the practice just to update with modern up to date
equipment to better serve current patients. This area will be used one day per week. The modifications will be made to
the interior space no change to the outside of the building. The practice does not require any additional parking.
The Board reviewed the four tests for an area variance. Financial information was requested from the applicant
to fulfill the application requirements.
Bill Moore, Chairman suggested the applicant meet with staff to assist in completing the application and providing the
Board with the level of detailed information requested.

4. #2751 JAMES TWO-FAMILY, 24 York Avenue, area variance to maintain an existing two-family residence;
seeking relief from the minimum lot area and average lot width requirements of the Urban Residential-3 District.
SEQRA:
Action appears to be a Type II action, and therefore exempt from further SEQRA review.
PARCEL HISTORY:
It appears that the two-family use was established prior to 1961 per the City tax rolls of that year. Some documentation
indicates that the two-family was maintained in the 1970's and 80's. The application indicates that the current property
owner purchased the property in 1990 as a two family and continued the use until it was suspended for a time.
The property currently is assessed as a one family. A non-conforming use shall be deemed discontinued if it is not
operated for at least 30 days in a calendar year.

Ms. James stated she is here for an area variance to maintain an existing two family residence. Ms. James is looking to
sell the home. Ms. James assumed it was a two family, it was purchased as a two family and used as a two family. At
one time while her children were young they used this home as a one family.
Discussion ensued regarding homes in the neighborhood. The Board did request additional information from the
applicant. Review of the tax maps denoting two families and one family homes in this neighborhood and submit
to the Board.
Bill Moore, Chairman stated we will prepare and present a resolution at the next Zoning Board of Appeals meeting
on March 10, 2014.
5. #2748 422 BROADWAY, LLC, SIGNS, 422 Broadway, area variance to install two wall signs on the side of the
building, seeking relief to extend more than 6" from the face of the building in a Transect-6 District.

Mr. Roicki stated the applicant is looking to install two perpendicular signs to the building which protrude into the
alleyway of 422 Broadway. They will be constructed of high density urethane and are approximately 2 ft x 3 ft in size.
This will clean up the alleyway and it will look better. There are currently no signs in town which look like this. The signs
will be constructed for two tenants in this building. The first is Around the Corner Café, and Next Summer is the second
tenant.
Discussion ensued among the Board with regard to requesting an Advisory Opinion of the Design Review Commission
since these are the first type of this type of signage in the City.
Bill Moore, Chairman made a motion to request an Advisory Opinion of the Design Review Commission, since these
signs will extend further than what is permitted and the fact that there is no like type signage in the City.

The appellant having applied for an area variance for wall signs; seeking relief to permit placement above the first
floor level and to exceed the maximum size for street address identification in the Transect-6 District and public notice
having been given of a hearing on said application on February 10 and February 24, 2014.
In consideration of the balance between the benefit to the applicant with respect to the detriment to the health, safety

detriment to nearby properties. The applicant states that the “subtle brushed aluminum letters…will be very pleasing to
the eye.” The proposed sign is similar to the sign across the street at the Hampton Inn and Suites that received relief.
3.) The applicant has demonstrated that the physical and environmental effect on the neighborhood will not be adversely
affected by the sign. The sign is proposed to be lit by goose-neck fixtures mounted just above the sign.
4.) The relief may be considered substantial at 100% placement above the second floor and 41% for the size of the
numbers.
5.) The request for relief may be considered a self-created hardship. However, self-creating is not necessarily fatal to the
application.

RECUSAL:

This application was heard at the February 10, 2014 meeting and adjourned to February 24, 2014. The public hearing
was opened and remains open. The applicant was asked to provide approximate existing building coverages for
neighboring properties. The applicant has provided the requested information.
Bill Moore, Chairman informed the applicants that the Board was short two members at tonight's meeting and Mr. Kaplan
has recused himself. It is the applicant's choice if they prefer to adjourn the application for two weeks in anticipation of a
full Board's attendance.
The applicants decided to proceed with the application.
James Helicke stated that the lot coverage is on the high end and questioned how would the applicant feel about
removing the deck in the rear of the property. This will help decrease the lot coverage and keep it right within that of the
other properties. One of our tasks is to grant the least amount of variance possible.
Discussion ensued among the Board regarding lot coverage and the removal of the deck.
The applicant asked if they could discuss the removal of the deck in private.
The Board adjourned at 9:04 P.M.

The applicants have agreed to the removal of the rear deck so the amount of lot coverage is reduced.

Springs, New York, being tax parcel number 166.14-1-27 in the Inside Tax District, on the Assessment Map of said City.
The appellant having applied for an area variance for construction of residential additions, seeking relief from the
minimum front yard setback and lot coverage requirements in the Urban Residential-1 District and public notice having
been duly given of a hearing on said application on February 10 and February 24, 2014.
In consideration of the balance between the benefit to the applicant with detriment to the health, safety and welfare of
the community, I move that the following variance for the following amount of relief:

1.) The applicant has demonstrated this benefit cannot be achieved by other means feasible. The application states that
alternative “design proposals involved increased mass on top of the existing structure that did not complement
functionality or the existing character of the neighborhood.”
2.) The applicant has demonstrated that granting this variance will not create an undesirable change in neighborhood
character, or detriment to nearby properties. The application states the “proposed addition will enhance the aesthetic
qualities of the current property and remain consistent in scope and scale with existing architectural and landscape
design encompassing the surrounding neighborhood.” A property map provided by the applicant shows a substantial
number of nearby properties exceed the 20% maximum principal building coverage requirement.
3.) The variance may be considered substantial; however, the existing front yard setback and maximum principal building
coverage are preexisting nonconforming. The application states: “All other UR-1 zoning requirements in terms of
permeability and setbacks to property lines have been met.”
4.) The applicant has demonstrated that granting this variance will not have an adverse physical or environmental effect
on the neighborhood. The applicant has estimated that 59% of the site would remain permeable, adhering to the district’s
30 % permeability requirement.

of a two family residence, parking structure and parking area associated with the redevelopment of a nonconforming
multi-family residential use; seeking relief to allow more than one principal building on a lot, maximum principal building
coverage, minimum site to remain permeable, minimum side (two) yard setback to parking area, minimum rear yard
setback to two-family residence in the Urban Residential-3 District.
This applicant was heard at the January 13, 2014 meeting. The public hearing was opened and the application was
adjourned pending the SEQRA determination.

Mr. Ingersoll stated the application was heard at the February 12, 2014 Planning Board and received a SEQRA Negative
Declaration at that meeting. Mr. Ingersoll gave a brief overview of the proposed project. Reconstruction is anticipated
for the Spring. A visual presentation was provided to the Board. Mr. Ingersoll stated the main structure has a right to be
built in its original footprint. We will now provide 13 units and one unit carriage house to accommodate the parking
needs. There is an opportunity to remake this into a unique urban setting as it is built out under new zoning regulations.
A zoning map was provided to the Board indicating the placement of the property and current zoning which exists in this
area. There are parking regulations required in the UR-3 District. Mr. Ingersoll reviewed the plan to meet these
regulations. We have reduced the amount of lot coverage to 42%. We have come up with a way to contribute to the
water supply situation. We have committed $15,000 to get the seed money to upgrade these improvements.

meeting with minor corrections as submitted.
