Keith Kaplan, Vice Chairman stated this application is taking two areas of relief that were previously granted, minimum
side yard setback 10 ft. is required, previously approved to go to 4 ft., the applicant is now requesting 3.6 ft. Minimum
total side yard setback 20 ft. is required, previously approved to go to 14 ft. the applicant is now requesting 13.6 ft. This
application is exempt from SEQRA review.

Applicant: Dr. James DeMasi
Dr. DeMasi stated that he made an error in computation when applying for the original variance. His request is to modify
two areas of relief previously granted. Minimum side yard setback 10 ft. is required, previously approved 4 ft., now
requesting 3.6 ft. Minimum total side yard setback 20 ft. is required, previously approved to go to 14 ft. now requesting
13.6 ft. Maps were submitted to the Board the one which was originally filed with the application and the current one.

Mr. Parthemos stated all improvements requiring relief have already been built. In applying for a building permit it was
determined that constructed improvements do not meet setback requirements. All constructed improvements are in the
rear and do not change the look of the house from the street. The existing deck and enclosed porch are 35 ft and 43 ft
respectively from the side property lines. The shed at the rear of the property is on City property and needs to be
relocated. The minimum of 25% of the site will remain permeable. The location of the rear property line was assumed or
erroneously identified by the previous owner. Building permits were issued for the improvements but the associated plot
plans used inaccurate lot dimensions.
Mr. Shaw provided some background information concerning the applicant’s application.

Agent: Daniel Roicki, Adirondack Sign Company
Mr. Roicki, the applicant, is before the Board requesting relief for two parcels. They are allowed 2 free standing signs,
one for each parcel. The applicant is looking to combine both signs into one freestanding sign 24 sq ft. at the
entranceway. Also Mr. Roicki stated the request from relief is for 8 total signs. 7 wall signs and 1 freestanding.
Mr. Roicki explained the signage proposed and the proposed locations.
Discussion ensued among the Board concerning proposed signage, number of signs proposed, size of signs and the
placement of second story signs.

It was the consensus of the Board a representative from Beechwood Prime Company appears before the Board
concerning the proposed signage. The Board also discussed the second story signage be eliminated. The Board
requested a revision of the sign package and submit to staff for dissemination to the Board members. The applicant will
return before the Board in two weeks.

Ms. Yasenchak stated the applicant owns an Executive Raised Ranch in Geyser Crest. Most of the homes in this area
are about 30 years old. She is proposing an addition to the side of her home for a main level living space. These homes
are similar to a split level home. The home as it exists currently has 2 bedrooms. Part of the addition would be over the
garage so the main level would be renovated for the living space and an addition on top. Ms. Yasenchak reviewed the
proposed variances requested as well as parking for one vehicle on the addition side. Side setbacks are an issue and
the reason we are here. The addition over the garage increases the non-compliance. Ms. Yasenchak reviewed the
siting of the home on the lot. The shed on the lot is preexisting nonconforming. Recently a contractor redid the deck
area on this tree house. This was there when she did purchase the home. Ms. Yasenchak reviewed the reasoning for
the request as well as additional alternatives/options to the project which were entertained but not feasible. No

additional land is available for sale. This will not produce an undesirable change to the neighborhood. The permeability
will remain well before the 30% minimum permeability.
Discussion ensued concerning the shed on the property, and the proposed variances requested.

maintain residential use on the first floor level of the building in the Transect-6.

PARCEL HISTORY:
Area variance for conversion of a mixed use building to a single-family residence, approved February 8, 2010. No
building permit was issued and the variance expired.

Mr. Hover stated they purchased the property in 2013 with plans to live on the second floor and rent out the first floor.
They are looking to rehab the building fully and maintain a two story residence. The first floor has been vacant.
Former owner had a variance for the property but allowed it to lapse. The neighborhood is predominately large business
offices with frontage on Broadway and Woodlawn. The property only has frontage on Long Alley and is physically
smaller in square footage than adjacent buildings. This will not create an undesirable change to the character of the
neighborhood.
Susan Steer questioned parking. Discussion ensued concerning original desire to convert to a one family. Questioned
the desire to rent out the lower floor during track season.
Mr. Hover described the renovations planned for this property which were approved by the DRC.

7.#2909 GASLIGHT APARTMENTS, LLC MULTI-FAMILY, 69-71 Hamilton Street/10 South Federal Street, area
variance to maintain conversion of a portion of existing interior space to an additional residential unit; seeking relief from
the minimum lot size per dwelling unit and from the minimum parking requirement in the Urban Resieential-5 District.
SEQRA:

Mr. Burns stated they purchased Gaslight Apartments in 2001. Mr. Burns provided some background information on the
project and the site and how the apartments have gone from 70 to 71 apartments. The unit in question was formerly
storage space which was converted to a small studio apartment due to the demand. In refinancing the property recently
it was determined that the complex is currently non compliant due to the additional unit. The variance is not substantial
because the structure itself will remain unchanged on the exterior. There will be no undesirable change to the
neighborhood or district. The requested variance is consistent with the prevailing pattern of development in the
neighborhood and zoning district. The additional unit adds only one or two possible vehicles at most to the currently
available off-street parking areas. These parking areas are sufficient for the Gaslight apartment complex and are
seldom, if ever, full or near full. The site currently conforms to lot coverage density requirements for buildings in the UR-
5 district with principal building coverage at 22.7%. Existing permeable surface on the lot is 41% with the minimum
requirement is 15%.

Mr. Toohey provided a visual presentation of the site which is 1.6 acres and encompasses 6 tax parcels with 105 sq. ft.
of frontage as well as two zoning districts. The site fronts on the TRB District and the back of the parcel is the RR zone.
In the Tourist Related Business District we can have an animal clinic and in the RR we can have an animal kennel. The
applicant is proposing to construct a pet lodge for the boarding and grooming of pets as well as an animal day care
center. It will be open 7 days a week. Mr. Toohey reviewed the allowable uses. The building will be located 285 ft from
the roadway. No land was available for purchase.
Discussion ensued among the Board concerning SEQRA Lead Agency and Coordinated Review.
Bill Moore, Chairman made a motion to defer SEQRA Lead Agency to the Planning Board should they choose to accept
it.

NOTE:
Board Alternate Cheryl Grey stated she did view the webcast of the previous meeting. She does feel confident
and able to vote this evening.
This application was heard at the July 18, 2016 meeting and adjourned to July 25, 2016. The Board requested that the
applicant submit a survey. The survey was provided. The public hearing was opened and remains open.

Mr. McGuire stated there was some incorrect information added to the survey by the surveyor. It should read as

Mr. McGuire stated other options were considered, however if we were to expand the porch, this is the only place it could
be done as the current exit from our kitchen is located on the back side of the property. We could make the porch long
and thin along the back of the property but our laundry room exhaust and window would be inside the porch, which
would create an issue.

Mr. Jones stated the original timeframe was not sufficient because the approval process has taken longer

Based on the submitted evidence that the application for an extension of a granted variance does not differ from the
original application and approval, and there have been no significant changes in the subject property or neighborhood,
the board moves that the application for National Retail Properties, Inc., dba Rite Aid, for an extension for the premises
at 90 West Avenue/242 Washington Street, and identified as tax parcel 165.14-2-2.2 and 165.14-2-1, originally granted
on January 26, 2015 and filed on February 3, 2015 be approved. The board specifies that the variance approval be
extended for an additional 18 months, with a new expiration date to be February 3, 2018.
