Village Board of Trustees 02-13-2013 P a g e | 31 THREE THOUSAND ONE HUNDRED SEVENTY-FIFTH REGULAR MEETING Rutherford Hall Village Hall February 13, 2013 A regular meeting of the Board of Trustees of the Village of Scarsdale was held in Rutherford Hall in Village Hall on Wednesday, February 13, 2013 at 8:00 P.M. Present were Mayor Flisser, Trustees Brodsky, Eisenman, Harrison, Lee, Mark, and Steves. Also present were Village Manager Gatta, Deputy Village Manager Pappalardo, Village Treasurer McClure, Village Clerk Conking, Acting Village Attorney DeSiena, Assistant to the Village Manager Datino, and Administrative Intern Goodwin. ******** Mayor Flisser introduced Assistant Village Attorney Carolyn DeSiena seated at the dais, joining the Board this evening in the temporary absence of Village Attorney Wayne Esannason. ******** The minutes of the Board of Trustees Regular Meeting of January 22, 2013 were approved on a motion entered by Trustee Mark, seconded by Trustee Brodsky, and carried unanimously. ******** Bills & Payroll Trustee Harrison stated that this is the last time he will be reviewing the bills and thanked Village Treasurer McClure for all her help. Trustee Harrison stated that he had audited the Abstract of Claims dated February 13, 2013 in the amount of $2,262,628.78 which included $22,752.22 in Library Claims previously audited by a Trustee of the Library Board were found to be in order and he moved that such payment be ratified. Upon motion duly made by Trustee Harrison and seconded by Trustee Eisenman, the following resolution was adopted unanimously: RESOLVED, that the Abstract of Claims dated February 13, 2013 in the amount of $2.262.628.78 is hereby approved. Village Board of Trustees 02-13-2013 P a g e | 32 Trustee Harrison further stated that payment of bills made in advance of a Board of Trustees audit totaling $84,755.88 were found to be in order and he moved that such payment be ratified. Upon motion duly made by Trustee Harrison and seconded by Trustee Eisenman, the following resolution was adopted unanimously: RESOLVED, that payment of claims made in advance of a Board of Trustees audit totaling $84,755.88 is hereby ratified. ******** Mayor’s Comments Mayor Flisser stated that she has a few comments to make this evening, and would like to start out with the Crane Road Bridge Project. “Road Closures for the Crane Road Bridge Project began on February 11th, during installation of the formwork for the North Abutment of the Crane Road Bridge, between East Parkway and the tracks. To reach the northern corners, the crane will be positioned on southbound East Parkway between Crane Road and the entrance to the Merchant lot. This work will take place over 4-7 work days. Road closures will take place from 8:00 P.M. and all roads will be open by 6:00 A.M. The road closures include: - the Southbound Exit from the Bronx River Parkway to Crane Road - the Northbound Exit from the Bronx River Parkway to Crane Road - Westbound Crane Road between Chase Road and East Parkway - Southbound East Parkway between Crane Road and Christie Place For the two ramp closures, detours will be posted utilizing Harney Road and Scarsdale Avenue. For the Westbound Crane Road and Southbound East Parkway closures we will detour traffic south on Chase Road and west on Christie Place. A Scarsdale Police Officer will be stationed at the intersection of Fox Meadow/Crane Roads to direct motorists to Fox Meadow Road if they get past the barricades at Chase Road. The Westchester County DPW will send daily advisory notices during the week of February 11th advising of the road closures and these notices will be posted on our website, www.Scarsdale.com. Steel installation for the bridge is planned for April and additional road closures are expected during that time.” ******** Village Board of Trustees 02-13-2013 P a g e | 33 “I have a summary of how the Department of Public Works handled the recent snow storm. Snowfall began at approximately 6:30 a.m. on Friday, February 8, 2013. While this snowfall was not part of the blizzard anticipated for later in the day, this snowfall did accumulate upwards of 3 inches by 3:00 p.m. Snow clearing efforts began from early morning with our Highway and Facilities Maintenance workforce, by applying salt and clearing snow from the downtown walkways. Plowing operations of all roads began at 4:00 p.m., with a total of 23 plow trucks (including 8 salt trucks). Main roads were kept clear and passable, with secondary and dead end streets also being plowed. All DPW personnel were held over and remained on the job plowing and keeping the roadways safe. The snowfall decreased in intensity between 9:00 p.m. to midnight, with little accumulation. Total snowfall at 11:00 p.m. (2/8/13) was measured at 6 inches. All roads were plowed and passable. Most main roads had visible blacktop. By 5:00 a.m. February 9, 2013, an additional 7 inches of snowfall accumulated on all surfaces. There were no reported power outages or tree issues. Only two locations had overhanging branches onto the roadway which were cleared. Three pay loaders and one plow truck began “stacking” snow in the downtown at 5:00 a.m. and by 1:00 p.m. the downtown was mainly cleared of snow along the curb line and approximately 85% of parking spaces were available. Large piles of snow remained at strategic locations along Chase Road, East Parkway, Boniface Circle and Scarsdale Avenue. By 10:00 a.m. of February 9th, all main roads and 40 % of all secondary roads and dead end street were open and cleared. At 1:00 p.m., the west side sidewalks began to be plowed. All sidewalks on the west side of the Village were plowed by 6:00 p.m. All Village Roads were plowed and blacktop was visible by 3:00 p.m. DPW employees were released from duty between 3:00 p.m. and 6:00 p.m. Common problems and concerns associated with a snowfall of this magnitude include: - Snow being deposited in the roadways by private contractors and homeowners causing cleared roadways to have snow and ice packed “strips” to form. Village Board of Trustees 02-13-2013 P a g e | 34 - The Villages’ sidewalk and roadway clearing operation places snow back onto the driveways after they are cleared. But this is unavoidable. - Many sidewalks although plowed are narrow and snow covered, given the fact that the snowfall accumulation (from that which fell and that which was plowed from the roadway) exceeded more than 2 feet in most locations. - Gravel driveways that have been plowed out to the roadway are also an issue. The gravel creates additional hazards. - We also have buried catch basins. Catch basins become blocked as intersection clearing tends to pile snow. DPW workers will be clearing many of these basins during the upcoming days. - Blocked fire hydrants are a key issue that must be mentioned. Residents should avoid placing snow onto hydrants. The Fire Department customarily addresses hydrant clearing with staff and volunteers.” ******** “My final comment continues with: the Village Board continues to work on the budget for the upcoming fiscal year. We began with discussion of the fees and charges schedules (such as Recreation fees, Pool Fees, Fees for building permits and tree removal, etc). The Village's sanitary sewers require extensive repairs and upgrades to maintain structural integrity, and protect the stormwater system from sewage inflow, which can lead to home contamination in the event of flooding. The sewer infrastructure dates from the 1920s in many instances, and the Village Board has considered a fee for sewer usage, based on water usage in the past. All discussions of the budget are open to the public, and our next meeting is on February 14th at 6:30 PM, followed by a meeting on Monday, March 11th at 6:30 P.M. Special public briefing sessions on preliminary Operating and Capital Budgets will be held on February 27th at 7:00 P.M. and March 6th at 7:00 P.M. Balancing the budget under consideration, which currently has a shortfall of about $2.8 Million, may require reduction in programs, layoffs, and consolidation of services. Beside the sewer costs, we are considering reductions in trash pick-ups, and removing the police officer at the Garth Road/Popham intersection. I hope you will join us at these sessions.” ******** Manager’s Comments Village Board of Trustees 02-13-2013 P a g e | 35 Village Manager Gatta recognized Elizabeth Bermel, Director of the Scarsdale Library. Ms. Bermel stated that she would like to present the Library’s role in the aftermath of Hurricane Sandy. She stated that the Library opened an additional 24 hours during the storm. The Library opened a couple of hours late on October 31st. There was no damage to the Library; they had power and working phones. However, there was no internet service or wireless access. The Westchester Library System did have service and they were directed to other libraries for those services. In the meantime, as the weather got colder, the Library was open for additional hours, providing a warming station and charging station for cell phones and other devices. The library was packed with people, some were there for hours. They had impromptu films, and other family activities. Ms. Bermel felt that the residents really appreciated the services of the staff, some of whom had no power at home either. They have received several letters of thanks from the community. One couple even celebrated their 60th Wedding Anniversary in the Conference Room of the Library. Additionally, the Village was able to hold meetings at the library. Should a similar event occur in the future, Ms. Bermel stated that the library staff would be more than happy to accommodate the residents again. ******** Public Comment At this time Mayor Flisser opened the floor for any public comments. Dr. Wayne Johnson, New York City, stated that he has watched the geese and their goslings rounded up all over the country by the USDA and Wildlife Services and gassed to death. He would like to see the geese in Scarsdale stay here. If they must leave the answer must not be death. The carbon based gas that the USDA uses is similar to the Zyclon B that the Nazis used between 1939 and 1945. He suggested geese busters as the better alternative. There should be a peaceful and non-violent way to settle this issue. Mayor Flisser commented that there has been more response to this than there had been to the initial use of Zyclon gas. Angela Gevard, Yonkers resident and former employee of Scarsdale Parks and Recreation, introduced herself and Kaitlen Tidwell, White Plains, both present this evening on behalf of the Student Animal Legal Defense Fund at Pace Law School. Ms. Gevard spoke to the economical, environmental, and animal welfare negative aspects of killing geese. She stated that she hope that Scarsdale would decide on a plan that was cost efficient, environmentally sound, and ecologically humane. Ms. Tidwell added that as a new member to the community, she would like to see alternatives considered that are respectful of the animals and human rights. Village Board of Trustees 02-13-2013 P a g e | 36 Joan Kaiser, Yonkers, stated that she is an animal activist and a member of several organizations and a representative of Goosewatch. She stated that her organizations feel that the geese bring a real sense of civility and beauty to the community. To kill them does not say much of the human species. There are other ways of dealing with the problem of geese that other speakers have addressed. She stated that the Village just needs to contact Goose watch in New York City or herself at (914)337- 7486. Kylie Blackman, P.O. Box 501, Tuckahoe, stated that in the original minutes where it was decided to do the slaughter references a ‘humane slaughter’. If the Board really believes this would be a humane slaughter, it should be televised. She stated that she viewed Scarsdale children on Channel 12 News having a rally to save the geese. She said they were so charming and intelligent, she was so impressed and called Channel 12 News to thank them for covering this. The Board should be proud of them holding a rally to save the geese, and she asked the Board to not break their hearts. Tatiana Goldman, New Rochelle, submitted written comments to the Board regarding the geese at the Scarsdale Library Pond. She stated that it is very inhumane to kill animals that cannot protect themselves. Mayor Flisser stated that as there are no further public comments, the Board will now move to the Public Hearing portion of the meeting. ******** Public Hearings Mayor Flisser stated that there are two Public Hearings this evening; the first hearing is to hear comments on Chapter 310 of the Village Code, “Zoning” regarding the official zoning map. Mayor Flisser asked for any public comments on this hearing at this time. As no comments were offered, Mayor Flisser closed the public hearing. Trustee Mark then offered a resolution for approval before the Board regarding SEQRA Review and Determination regarding an amendment to Chapter 310-4 of the Village Code Updating the Official Zoning Map. Upon motion entered by Trustee Mark, and seconded by Trustee Brodsky, the above aforementioned resolution was approved by a unanimous vote: WHEREAS, the Village of Scarsdale’s zoning map is dated 1964, however certain amendments have been made since that time which have been properly filed but not included on an updated zoning map; and WHEREAS, the Village retained The MRB Group in 2012 to provide mapping services for the Village, said services including an update of the Village Board of Trustees 02-13-2013 P a g e | 37 Official Zoning Map using the most recent digital tax maps and updated assessment records; and WHEREAS, the updated zoning map does not change the zoning designation of any property, but memorializes existing zoning classifications; now therefore be it RESOLVED, that the Village Board hereby determines that the proposed action, the update of the Official Zoning Map, is a Type II action pursuant to 6NYCRR Part 617.5(c)(17) and no further environmental review is required. ******** Upon motion entered by Trustee Mark, and seconded by Trustee Brodsky, the following Local Law #3, 2013 - Amending Chapter 310-4 of the Village Code Updating the Official Zoning Map, was approved by the vote indicated below: INTRODUCTORY LOCAL LAW #3 OF 2013 A Local Law Amending Chapter 310 Of the Scarsdale Village Code, Entitled “Zoning” A Local Law amending Chapter 310 of the Scarsdale Village Code relative to the adoption of the Official Zoning Map: BE IT ENACTED by the Scarsdale Village Board of Trustees as follows: Section 1. § 310-4. Zoning Map established shall read as follows: A. The boundaries of these districts are hereby established as shown on a map thereof, entitled Official Zoning Map, Village of Scarsdale, Westchester County, New York," dated December 22, 1964 and updated January 21, 2013, a copy of which, identified by the signature of the Village Clerk, is filed in the office of the Village Clerk. B. A copy of said map may be found at the end of this chapter. Said map, which shall be deemed to include all explanatory matter thereon, is hereby declared to be a part of this chapter. Section 2. This local law shall take effect upon filing with the Secretary of State. AYES NAYS ABSENT Trustee Brodsky None None Trustee Eisenman Trustee Harrison Village Board of Trustees 02-13-2013 P a g e | 38 Trustee Lee Trustee Mark Trustee Steves Mayor Flisser ******** Mayor Flisser stated that the second public hearing concerns a Local Law authorizing the Board of Trustees to adopt a budget for the 2013-2014 Fiscal Year that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law, Section 3-c. Mayor Flisser opened the public hearing for any comments. Hearing none, the public hearing was closed. She then referred this item to Trustee Steves. Trustee Steves stated that he would like to give some briefing on this proposed local law. He stated that this law the Board is considering for enactment will allow the Village to pass a budget that exceeds the 2% cap imposed by the State of New York. The Board is adopting this Local Law as a safeguard, not as a preliminary step to enacting a larger budget. That process will continue independently of this issue. The ‘cap’ law is so technical that even small changes in our budget could cause us to be fined by the State. Even if the Board had initially passed a budget that we believed was below the ‘cap’. In order to avoid those types of problems due to technicalities and to carry on our budget process independent of this constraint, the Board is proposing to enact this Local Law. Upon motion entered by Trustee Steves, seconded by Trustee Eisenman, the following Local Law #4, 2013 – Authorizing a Real Property Tax Levy in excess of the “2% Cap” , creating a new article to Chapter 269 was adopted by the vote indicated below: INTRODUCTORY LOCAL LAW #4 of 2013 AN INTRODUCTORY LOCAL LAW CREATING A NEW ARTICLE TO CHAPTER 269. ARTICLE XII “TAX CAP OVERRIDE” BE IT ENACTED by the Board of Trustees of the Village of Scarsdale as follows: A local law to override the tax levy limit established in General Municipal Law §3-c. Section 1. Legislative Intent It is the intent of this local law to allow the Village of Scarsdale to adopt a budget for the fiscal year commencing June 1, 2013 –May 31, 2014 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law §3-c. Section 2. Authority This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes a local government’s governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body. Village Board of Trustees 02-13-2013 P a g e | 39 Section 3. Tax Limit Override The Board of Trustees of the Village of Scarsdale, County of Westchester, is hereby authorized to adopt a budget for the fiscal year commencing June 1, 2013 through May 31, 2014 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c. Section 4. Severability If a court of law determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law r in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered. Section 5. Effective date This local law shall take effect immediately upon filing with the Secretary of State. AYES NAYS ABSENT Trustee Brodsky None None Trustee Eisenman Trustee Harrison Trustee Lee Trustee Mark Trustee Steves Mayor Flisser ******** Upon motion entered by Trustee Steves, and seconded by Trustee Eisenman, the following resolution regarding the Transfer of Unclaimed Funds from Trust and Agency Accounts to the General Fund was approved by the vote indicated below: Village Board of Trustees 02-13-2013 P a g e | 41 WHEREAS, in accordance with Village land use board approvals and Village Code requirements for certain construction improvement projects on residential and commercial properties, property owners and contractors must submit certain payments to the Village of Scarsdale as deposits for the protection of Village property disturbed during the construction activity; said deposits held in trust and agency accounts and returned to the owner upon completion of the work and Village inspection; and WHEREAS, the Village Treasurer’s Office staff regularly issues refund checks to various contractors after confirmation from the Building and Engineering Departments that the construction work has been satisfactorily completed and the appropriate inspections conducted, and WHEREAS, during the annual review of these trust and agency accounts, Village staff identified three deposits that were returned to property owners and/or contractors for which the refund checks were never cashed; and WHEREAS, In accordance with the applicable New York State statute, after a period of six years the unclaimed deposits may be considered uncollected and placed in the General Fund after several attempts are made to notify the payees, including through certified mail notices and a legal advertisement placed in the official Village newspaper, said requirements met by the Village for all of the aforementioned three deposits; now therefore be it RESOLVED, that the Village Board herein authorizes the transfer of $12,630.00 from the Trust and Agency Fund to the General Fund from the following accounts: TA 8031-0 Street Opening Deposits $1,800.00 TA 8085.-85 Sidewalk & Curb Deposits $10,830.00 To the following account: A-1000-030-2838-08 Transfer from Agency Fund. They met in Executive Session and came up with the following candidate for this opening. Upon motion entered by Trustee Harrison, and seconded by Trustee Mark, the following resolution regarding an appointment to the Advisory Council on Technology was approved by a unanimous vote: WHEREAS, the Village Board of Trustees created an Advisory Council on Technology (Council) in 1997 to assist and guide the Village in the adoption and integration of new technologies; and WHEREAS, upon completion of this mission, the term of the Council expired in 2001 and the Village Board, via resolution of July 10, 2001, re- established the Council under a modified constitution with a purpose to advise the Board on the use of technology to improve the quality of community life and the efficiency and effectiveness of Village government; and WHEREAS, in accordance with the Council’s constitution, the Village Board may appoint no fewer than five (5) or more than eleven (11) members to serve on the Council for two year terms; and WHEREAS, currently there are ten (10) members on the Council, providing an opportunity for one (1) additional interested and qualified resident to serve; and WHEREAS, the Village Board’s Personnel Committee met on January 28, 2013 to discuss potential candidates to fill the one (1) vacancy and reviewed and discussed the resume of Kamal Mehta to fill said vacancy and herein recommends to the Full Board that Mr. Mehta be appointed to the Council; now therefore be it RESOLVED, that Kamal Mehta, 12 Rochambeau Road, Scarsdale is hereby appointed to serve on the Advisory Council on Technology for a term ending on April 7, 2014. ******** Trustee Harrison stated that the community may have seen the article on page 4 of last Friday’s Scarsdale Inquirer discussing volunteers needed for the Village’s Boards and Councils. The Personnel Committee, consisting of Trustee Brodsky and himself have been diligently going through the list of future vacancies. There are currently 70 Village Board of Trustees 02-13-2013 P a g e | 43 volunteers who are up for reappointment or may retire creating a number of openings on the Boards and Councils. All positions are important, and there are several key positions that need applicants: the Board of Architectural Review needs to fill two open positions, preferably with architects; the Town Board of Assessment Review has one five-year term open; the Committee for Historic Preservation has one three-year term open, and the Associate Village Historian position is open for a one-year term. There is an application deadline of Friday, March 1st, so they are encouraging residents to apply as soon as possible so that the Personnel Committee has time to do its review of all applicants. The applications may be sent via the Scarsdale Village website, www.Scarsdale.com, or can be delivered physically to Village Hall at 1001 Post Road. If there are residents that need a printed application, they may contact Robert Harrison at (914) 725-0962. via email at proscars@aol.com, or through the Village Clerk, Donna Conkling. The seventeen Boards, Councils, and Committees are discussed on the website. There are over 150 Village residents who serve as volunteers on these Boards and Councils. By volunteering, Scarsdale residents have the opportunity to be involved in the community. ******** Recreation Committee Upon motion entered by Trustee Lee, and seconded by Trustee Eisenman, the following resolution regarding authorization to conduct an Annual 15K/4M Road Race was adopted by a unanimous vote: WHEREAS, for the past 43 years the Village of Scarsdale Recreation Department and the Scarsdale Antiques Running Club have co- sponsored an Annual 15K/4 Mile Run in the Fox Meadow and Greenacres neighborhoods; and WHEREAS, this annual event is planned again for this year and has been scheduled for April 7, 2013; and WHEREAS, the Village of Scarsdale Parks, Recreation, and Conservation Department has submitted an application to the Scarsdale Police Department for use of the public roadways to conduct the road race; and WHEREAS, the Scarsdale Police Department recently reviewed and approved the road race application pending intra-departmental coordination of traffic control and notification to all affected residents of the race day detours as well as Village Board approval; now therefore be it Village Board of Trustees 02-13-2013 P a g e | 44 RESOLVED, that the Board of Trustees of the Village of Scarsdale hereby grants permission to the Village of Scarsdale Recreation Department to conduct the Annual 15K/4 Mile Run on Sunday, April 7, 2013 in the Fox Meadow and Greenacres neighborhoods. ******** Other Committee Reports None. ******** Liaison Reports Trustee Harrison reported as liaison to the Cable Television Commission and they recently held a meeting on January 22nd. They met again on February 12th. They are organizing with particular emphasis in developing programming for our cable channel, channel 75 on Cablevision and channel 43 on Verizon. They are open to hearing from any Scarsdale residents who are interested in developing programs. They will be requesting some funding for this programming, perhaps $10,000 to $20,000. Whether or not this request will fit into the upcoming budget remains to be discussed.
