A Regular Meeting of the Board of Trustees of the Village of Scarsdale was held in
Rutherford Hall in Village Hall on Tuesday, August 22, 2017 at 8:00 P.M.
Present were Mayor Hochvert, Trustees Callaghan, Finger, Pekarek, Ross, Samwick and
Veron. Also present were Village Manager Pappalardo, Deputy Village Manager Cole,
Assistant Village Manager Richards, Deputy Village Attorney Garrison, Village Treasurer
McClure, Village Clerk Conkling, and Assistant to the Village Manager Ringel.

The minutes of the Board of Trustees Limited Agenda Meeting of Tuesday, August
22, 2017 were approved on a motion entered by Trustee Pekarek, seconded by Trustee
Finger, and carried unanimously.

Bills & Payroll
Trustee Samwick reported that he had audited the Abstract of Claims dated
September 12, 2017 in the amount of $704,669.99 which includes $9,240.46 in Library
Claims previously audited by a Trustee of the Library Board which were found to be in order
and he moved that such payment be ratified.
Upon motion duly made by Trustee Samwick and seconded by Trustee Ross, the
following resolution was adopted unanimously:
RESOLVED, that the Abstract of Claims dated September 12, 2017 in the amount of
$704,669.99 is hereby approved.
Trustee Samwick further reported that he had examined the payment of bills made in
advance of a Board of Trustees audit totaling $983,218.07 which were found to be in order and
he moved that such payments be ratified.
Upon motion duly made by Trustee Samwick and seconded by Trustee Pekarek, the
following resolution was adopted unanimously:

RESOLVED, that payment of claims made in advance of a Board of Trustees audit
totaling $983,218.07 is hereby ratified.

Mayor’s Comments
Mayor Hochvert noted that the summer, with fewer meetings, has afforded him the
opportunity to ‘dig into’ some of the appeals that the Board has had from the Committee for
Historic Preservation; the Cable Television setup in the Mamaroneck community television
area; so he took advantage of that time to get up to speed in some areas that are going to
come before the Board at some point.
Mayor Hochvert noted that he had the pleasure of attending a few events. One as a
promotion ceremony that Trustee Callaghan will talk about for two new Fire Department
Captains. Yesterday, repeating the Village Manager’s comment, “One of the best
ceremonies celebrating our sympathy for those who suffered on 9/11". He thought the
young lady from the high school who sang A Capella and a firefighter’s wife who sang a
song that Tom Paxton wrote that has the repeated line in it something like “we were running
down as the firefighters were running up” both did a marvelous job. It really moved all
those who were in attendance.
Mayor Hochvert noted that he reviewed the work of the New York State
Department of Conservation grant with the Recreation Department Superintendent. The
RFP was opened today and will be revised. The grant is for attacking the knotweed that has
been invading the area along the South Fox Meadow brook.
He noted that he also found time to discuss issues with a new zoning and planning
co-chair of the Forum’s Zoning and Planning Committees. He stated that it is a real
pleasure working with Richard Pinto – forty years ago, he and his younger son Derke were
on a swim team together.
The area of enforcement regarding the Village Code has been discussed often;
however, he feels that the best enforcement comes from friends and neighbors who value
the quality of life in Scarsdale, and the safety of the children. He urged everyone to talk with
their neighbors about being in compliance with the Village Code. If anyone thinks
something should be changed in the Code, they should appear before the Board or write a
note and offer their opinion.
Mayor Hochvert stated that he had always thought the Scarsdale Inquirer
reported those who were fined for using leaf blowers during the time period of June 1st
through September 30th. He only saw three of them; the Court Clerk informed him that in

fact that as of the end of last month there were 62 people who had been fined and they were
almost treated as if they were paying a parking ticket. It seems that some of them are
repeaters, and there was a suggestion from staff that it might be a better way to approach
this problem by having a second offender appear before the Judge. He checked with Village
Justice Alemany, who agreed that would be a good approach. Court Clerk April Fitzpatrick
will alert people who have a first offense next season that should they receive a second
offense they will be required to appear before the Judge in Court.
Mayor Hochvert stated that there are a couple of stopped traffic issues. The first
one is a small celebration. The parking place on the west side of Scarsdale Avenue nearest
Popham Road has been eliminated because when there is a truck in the northbound left
hand lane waiting to make a left hand turn, eastbound traffic, particularly trucks trying to
turn into Scarsdale Avenue could not make it and block that lane of traffic. He commended
who ever fixed that situation by eliminating that parking space. Traffic can now flow
smoothly around that corner. Also, the proposal to add a red light in the right hand lane at
the corner of Chase and Popham on the pole there so that people who say they do not see
‘no turn on red’ will be hard pressed to say that if the RFP comes back with a reasonable
cost to install that light. The Village Manager is arranging a meeting after the traffic
consultant has had an opportunity to look at options to deal with other locations, particularly
at the Popham Road, East Parkway, and Scarsdale Avenue, which is a very difficult corner.
Mayor Hochvert noted that over five miles have been repaved and it is expected to
end up close to six miles paved. If the Village can maintain that level of resurfacing, the
Village will replace roads as fast as they are deteriorating. He gave Village Engineer David
Goessl credit for a new approach to doing the repaving which permitted the Village to get
more miles per dollar. He noted that Governor Cuomo had required all counties to come
up with service sharing plans, and on Friday he will go to vote in favor of the plan that had
been developed for Westchester County with its main focus in the software/IT area – this
seems to have the most value for Scarsdale.
Mayor Hochvert stated that he attended a SNAP meeting last evening, and the
Freightway Steering Committee Chair Jon Mark and our Village Planner made a presentation
on that project to the SNAP representatives and encouraged them to use the survey for that
property to ensure they have input. The other issue concerned a dog run. Some of the
members of SNAP had submitted a draft but the discussion led to the belief that it needed
to be redone so that it focused on additional items that weren’t included in the current draft.
The revised draft will be brought back to the next SNAP meeting.
Tomorrow, Trustee Veron, Assistant to the Village Manager Josh Ringel and he will
be making visits to individual businesses. They are going to try to learn more of the specific
needs of the employees, to see from the employees’ perspective what might be ways to help
them find a place to park so they don’t have to use the metered spaces. Assistant Village

Manager Richards will have the meter test in place shortly and the Village may pick up
additional data from this.

Manager’s Comments
Village Manager Pappalardo reported on the Town Board of Assessment Review’s
grievance deliberations and Final Assessment Roll which is due this Friday. With the
issuance of the Tentative Assessment Roll on June 1st of this year, the statutory grievance
period commenced with property owners filing 709 grievances from their 2017 assessments
by the statutory deadline which is the third Tuesday of the month of June annually – this
year being June 20th.
The Town Board of Assessment Review met subsequent to Grievance Day on ten
(10) separate occasions over the summer to review and decide on the individual property
grievances. Their last meeting was on August 23rd. Of the 709 grievances that they
reviewed, the Board reduced assessments on 167 of the properties, which represents 24% of
the total with the balance of 540 – there were two applications that were withdrawn. All
property owners filing grievances, whether their assessments were changed or not, will
receive a letter from the Town informing them of the Assessment Review Board’s
determination. Those letters will be mailed on Friday, September 15th, the same day that the
2017 Final Assessment Roll will be filed with the Clerk and posted on the Village website.
Any homeowner who filed a grievance and is dissatisfied with the Assessment Review
Board’s decision may file a small claims review, aka SCAR appeal or an Article 7 Certiorari
with the Westchester County Supreme Court – the deadline for this is October 16th. These
appeals are usually judicated and dispensed during the balance of the fiscal year and will
most likely be finished prior to the June 1, 2018 Tentative Assessment Roll. All of the
SCAR petitions on the 2016 roll have been decided – 411 or 91% were settled through
stipulated agreements with the Town and the homeowner. Twenty-one (21) or 4.6% were
determined by the Court and 19, or 4% were withdrawn.

Liaison Reports
Village Board of Trustees 09/12/2017 321
Trustee Ross reported on behalf of the Cable Television Commission which met last
Tuesday evening. One of the topics of discussion was the upcoming cable franchise
renewals. The committee is moving forward with its consultant and is now making plans for
one or two sessions to receive input from various stakeholders which is an essential part of
getting the most favorable terms in the agreements with the cable companies.
Trustee Finger noted that a stop sign was recently installed at Wynmor Road/Secor
Road intersection which is something that they have been discussing and he hoped that the
residents of the East Heathcote Neighborhood Association will find it effective to resolve
the traffic issue that they so helpfully pointed out.
Trustee Finger stated that a Law Committee meeting was held this evening
regarding rezoning the commercial sale of firearms. This proposal would restrict the sales of
firearms to a certain area in the Village. If anyone is interested in this matter, they should
attend the Public Hearing when it is scheduled by the Board of Trustees. If you are
supportive or non-supportive the Board would like to hear from you.
Trustee Samwick stated that the Freightway Steering Committee held two walking
tours this morning of the Village Center and the Freightway site. There were approximately
20 people in attendance; there were very good questions and good engagement. There was
also a Metro North representative there who also answered questions. Trustee Samwick
reminded the community that the survey for the Freightway site is still accessible on the
Village’s website and encouraged everyone to complete the survey. He stated that there have
been approximately 400 responses to date. He also noted that the Committee is holding an
interactive public workshop on September 28th at 7:00 p.m. at the Scarsdale Congregational
Church. There is also a Freightway Steering Committee meeting on October 12th at Village
Hall – more details concerning that meeting are forthcoming.
Trustee Veron stated that during the summer, dozens of volunteers have been
actively working on a variety of initiatives. The Communications Committee and Village
staff have been working with CivicPlus, the vendor, looking at website functionality, as well
as power users for best practices. This input will be valuable as we consider ways to
augment the website. A survey was also done to determine the residents preference of
communication – these results will soon be tallied. A survey was done of other
municipalities regarding social media. The committee is working on their recommendations
to the Village Board and those recommendations will be presented at a Committee of the
Whole meeting on October 10th, prior to the Village Board meeting. The Committee
encourages everyone to pay attention, take part, and provide feedback.
Trustee Veron stated that the Library Board and Building Committee have been
working very hard this summer, as well as the Campaign committee. The community will
hear more from the Campaign Committee on September 26th. The Library Building
Committee has met regularly with the architects and Village staff. On October 10th at 8:00

P.M., during the Village Board meeting, the community will have an opportunity to hear
from the architect, see the design as it is currently being drafted and provide feedback before
the Village puts documents out to bid. Dattner Architects has listened very carefully to all
residents at a variety of venues and has really tried to address residents’ interests as they were
developing the design.
Trustee Veron stated that there will be a groundbreaking ceremony at Supply Field
on October 3rd at 9:15 a.m. She thanked Assemblywoman Amy Paulin’s office for securing
the grant to make this possible. Trustee Veron also noted that the last Friends of the Library
book sale that will be happening for a while is ongoing at this time – starting tomorrow
books will be half price.
Trustee Veron stated that she hoped everyone enjoyed the first Farmer’s Market.
The Farmer’s Market will be held on Thursdays in Boniface Circle in the Village Center for
the next seven weeks. There were a dozen vendors last week and they sold out very quickly.
She said that it is a great way to meet your neighbors and support the businesses in the
Village Center.
Trustee Callaghan reported that he attended an August 31st Fire Department
promotion and award ceremony. Two captains were appointed which now gives the Fire
Department their full complement of Fire Captains. He noted that there was also an award
for Rope Rescue, stating that Scarsdale is one of the few municipalities that is certified to
perform a Rope Rescue. It is a very complicated process and the Fire Department
successfully saved a construction worker through this type of rescue. There was also a 9/11
Ceremony that the Mayor spoke to earlier this evening and another firefighter was sworn in.
The Fire Department is now only one short of the complement they need. The new fire
engine is due to come into service in January 2018. This will be a significant addition to the
current fleet.
Trustee Callaghan stated that Firefighter Brian Hughes participated in the
International Firefighter and Police Officer Olympics which are held every two to three
years around the world. He achieved a silver medal in the decathlon.
Trustee Callaghan continued, reporting as liaison to the Board of Appeals. He
stated that they were very busy over the summer. The Advisory Council on Scarsdale Senior
Citizens are having their first meeting back from the summer on Friday – topics of
discussion will be their concerns about the library project and the Girl Scout house.
Mayor Hochvert noted that at the Fire Department promotion ceremony,
present were the families of the Captains, professional firefighters, volunteer firefighters,
retired firefighters, police officers – it was a wonderful interaction to watch.

Trustee Pekarek reported on a meeting held at 6:00 P.M. of the Joint Law and
Sustainability Committees to review the proposed amendments to the Village Code Chapter
281 - Trees. The proposed amendments were reviewed line by line, change by change, and
there was a robust discussion. Another meeting will be scheduled to continue the
conversation, date and time to be announced.

Public Comment
Jim Pullman, Chairman of the Citizens Nominating Committee Procedure
Committee, introduced the Vice-Chair, Robert Schechter. Mr. Schechter invited all
qualified Scarsdale residents to run for the Citizens Nominating Committee. Three
candidates will be chosen to run for the Village Trustee position in 2018 under the Non-
Partisan Party.
Mr. Pullman stated that the most difficult thing of the process is getting people to
run for the CNC. In soliciting candidates, they ask everyone in this room to find people
who would be willing and able to come to five weeknight meetings in December and January
to choose the new Trustees. This is a very interesting process, not that time consuming and
a lot of fun.
Mayor Hochvert stated that he is also hopeful that people are watching from home
and that Mr. Pullman’s message will get out to the community through the oncoming days
when this meeting is aired several times.
Mr. Schechter stated that it is definitely an exciting and rewarding three year period.
Everyone’s voice is equally heard during the vetting process. If anyone is not sure but
knows someone who might be interested, they can pass this information along to the CNC
and the CNC will reach out to them. They have several people who want to run, but they
would like to have more candidates.
Mr. Pullman stated that the application deadline is September 30th. An application
and petition must be filled out and are available on line. He noted that both Robert and
himself just came off the CNC, so they are speaking from experience. It was a very fun and
rewarding way to participate in the government of the Village of Scarsdale.
Trustee Pekarek asked if there would be applications and petitions available in any
of the public areas. Mr. Pullman responded that they would be available at the Scarsdale
Library and in the lobby of Village Hall.

In a response to a question from Trustee Veron regarding the change of meetings
from Sundays to mid-week, Mr. Schechter stated that more people are available during the
week.
Robert Harrison, 65 Fox Meadow Road, asked if the Board had a scheduled
meeting with the School Board coming up. Mayor Hochvert responded that as far as he
knew, there would not be another meeting with the School Board until next year. Mr.
Harrison stated that when he was on the Village Board, they generally met twice a year and
he recommended that this be done.
Mr. Harrison stated that there was an excellent discussion during this evening’s
earlier meeting concerning the tree law. He complimented Trustee Samwick on his concerns
regarding some of the proposed provisions. He stated that the next time there is a meeting
on this subject that it should be recorded and aired for the community. He noted a
provision that a tree permit would be necessary to remove one or more trees versus the
removal of three or more trees in the existing tree law. Personally, he stated that he was able
to take down two trees without a permit and paying any fees. He was not sure this should
be imposed on the residents; he felt that residents should be permitted to take down one tree
without a permit.
He noted that there was discussion on another section of the proposed tree law
under Applications, #4, eliminating the words ‘where extensive tree removal is planned as
part of a tree removal permit’ before the phrase ‘the Village Engineer may require the
applicant to pay for the retention of a tree expert…’ Again, Mr. Harrison stated that this
would be an extra burden on the residents and he hoped there would be further discussion.
Mr. Harrison stated that he was unable to attend the Farmer’s Market held last
Thursday and asked Trustee Veron if they planned to add to the twelve vendors that were
present last week.
Trustee Veron stated that the list of vendors has been updated and is on the Village’s
website. This listing will also be sent out via the Village’s ‘Notify Me’ system as well as other
avenues through social media.
Mr. Harrison questioned whether the Farmer’s Market created any parking issues
with the loss of parking spaces for the event. Trustee Veron responded that there was much
positive feedback on it being very pedestrian friendly. She noted that they received feedback
from people who frequent the office space in the Harwood Building that it took them longer
to find parking spaces than it usually would. It will be determined whether this is an
awareness issue or a capacity issue. Mr. Harrison thanked Trustee Veron for her response
and noted that it is a pleasure dealing with this Board.

Regarding tennis court management, Mr. Harrison stated that there are people
playing on the Middle School tennis courts that do not have permits. According to the
Recreation Department, there have only been 1,000 permits sold. There is no attendant at
the Middle School tennis courts and he has urged the Recreation Department to at least have
someone rotate and drive by once an hour from one of the other courts. Someone is really
needed to sit there with a list of permit holders and monitor these courts, making sure those
who are playing have permits. Someone needs to be hired for the weekends to do this and
collect fees.
Mr. Harrison stated that he missed the Freightway tour; Trustee Samwick responded
that there is information on the Village website regarding the Freightway Steering
Committee and upcoming meetings. In regard to the public workshop that will be held at
the Scarsdale Congregational Church on September 28th, Trustee Samwick stated that there
will be separate tables set up and it will be an interactive experience. Village Hall did not
have adequate space for this type of meeting format, so it was relocated to the Church.
Mr. Harrison stated that he noticed that there are some additional contributions to
the fund for the Library on this evening’s agenda – he asked how much has come into that
fund. Mayor Hochvert stated that Library Director Elizabeth Bermel will be present at the
next Board meeting with an update on contributions and pledges received to date.
Village Manager Pappalardo stated that it is being tracked very closely and the
Library Director has been scheduled to report to the Village Board on a quarterly basis on
the status of the pledges and contributions. Ms. Bermel will be at the next Board meeting
scheduled for Tuesday, September 26, 2017.
There being no further comments, Mayor Hochvert closed the public comments
portion of the meeting.

Finance Committee
Upon motion entered by Trustee Finger, and seconded by Trustee Samwick, the
following resolution regarding the Acceptance of a Gift for the Scarsdale Library Addition and
Renovation Project was approved by a unanimous vote:
WHEREAS, the Scarsdale Library Board completed a Master Plan dated June 10,
2013, which identifies a number of building renovations and
additions that will increase the capacity of the library to provide a
broader range of rapidly evolving library services while maintaining
popular traditional collections and programs by offering a more
balanced utilization of the building space within a safe, attractive and

inviting comfortable environment, said master plan supported by the
Scarsdale Village Board of Trustees via resolution dated April 8, 2014
(attached); and
WHEREAS, the improvements identified in the Master Plan will transform the
Library into a multi-purpose community asset for future generations,
maintain its preeminent status among free public libraries in the
County and State, enhance its technological capacity to further library
services and create a physical environment that will be a welcoming
and versatile learning center; and
WHEREAS, the Scarsdale Public Library Board, at their October 21, 2013
meeting, authorized the retention of the fund raising consulting firm
of Plan A Advisors, P.O. Box 165, Thornwood, NY 10594, to design
and conduct a capital campaign to implement such a project,
subsequently identified in the July 20, 2015, Schematic Design Report
prepared by Dattner Architects, at an estimated construction cost of
$16,500,000 and total project cost of approximately $19,500,000; and
WHEREAS, in accordance with a Village Board request at a March 07, 2016,
Committee of the Whole meeting, the Library Board and Architect
value engineered the schematic design plans, reducing the total
project cost to $17,900,000, as identified in Option A-1 (attached),
which the Architect presented at the July 19, 2016, Committee of the
Whole meeting; and
WHEREAS, on December 13, 2016, the Village Board of Trustees authorized a
$9,900,000 bond to pay part of the $17,900,000 addition and
renovation of the existing Scarsdale Public Library Building, with the
remainder of the $17,900,000 to be paid by private donations and
grants; and
WHEREAS, on January 09, 2017, and with thanks to Assemblywoman Amy
Paulin, the New York State Dormitory Authority awarded the Village
of Scarsdale a $500,000 State and Municipal Facilities Program grant
in support of the project, with the execution of a grant agreement
pending upon completion of various program review requirements;
and
WHEREAS, the following donations have been offered to the Scarsdale Public
Library Addition and Renovation Capital Improvement Project:
Friends of the Scarsdale Library - $84,000; Leona Kern - $10,000; and

WHEREAS, pursuant to Policy #106: “Gifts to the Village of Scarsdale” of the Village
of Scarsdale Administrative Policies & Procedures Manual,
acceptance of all gifts valued at $500 or greater must be approved by
the Village Board of Trustees; now, therefore, be it
RESOLVED, that the Village Board hereby accepts the following gifts toward the
Scarsdale Public Library Master Plan Improvement Project: $84,000
from the Friends of the Scarsdale Library; and $10,000 from Leona
Kern; and be it further
RESOLVED, that the Village Treasurer take the necessary steps to complete the
transaction and accept these financial gift totaling $94,000 and
deposit said funds into the Library Capital Campaign Account; and
be it further
RESOLVED, that the Board of Trustees hereby extends their heartfelt thanks and
great appreciation to the Friends of the Scarsdale Library and Leona
Kern for their generosity and commitment to the Scarsdale Public
Library and the community it serves.

Land Use Committee
Upon motion entered by Trustee Samwick, and seconded by Trustee Pekarek, the
following resolution regarding a Subdivision Recreation Fee – 19 Griffen Avenue, Section
24, Block 1, Lot 4A.1 was approved by the vote indicated below:
WHEREAS, Section 7-730-4 of New York State Village law authorizes planning
boards to reserve land in a subdivision for park, playground, or other
recreational purposes, and to accept payment in lieu of land in cases
where suitable parklands of adequate size cannot be properly located
on a subdivision plat, the amount of said payment to be established
by the Village Board of Trustees; and
WHEREAS, on June 28, 2017, the Planning Board approved the two-lot
subdivision of 19 Griffen Avenue, creating one additional buildable
lot, after finding the proposed subdivision would not have a
significant negative environmental impact pursuant to SEQRA; and
WHEREAS, on August 9, 2017, the Planning Board recommended a payment in
lieu of contribution of land, as the dedication of land for park,
playground, or recreation purposes is not feasible in view of the small

amount of land available in this two-lot subdivision; and
WHEREAS, the Village Department of Parks, Recreation and Conservation
provides a variety of facilities to meet the interests and needs of the
community, including parks, playgrounds, ballfields, and an outdoor
pool, and has a Five-Year Capital Plan which calls for the
replacement of facilities and equipment, as well as additional facilities
that will be needed in the future; now, therefore, be it
RESOLVED: that in association with the creation of one new buildable lot resulting
from the subdivision of property at 19 Griffen Avenue, identified on the Village
tax map as Section 24, Block 1, Lot 4A.1, the Board of Trustees hereby accepts
the recommendation of the Planning Board that the applicant, Brite Avenue
Development Corp., remit to the Village an amount equal to 5.0% of the
$1,350,000 Guideline Value of a lot in the A-2 zoning district pursuant to the
2007 Subdivision Recreation Fee Schedule, or $67,500, in lieu of a contribution
of land for park, playground, or other recreational purposes.

Municipal Services Committee
Upon motion entered by Trustee Veron, and seconded by Trustee Samwick, the
following resolution to Set a Public Hearing on the Number of Taxicabs to be Licensed in
2018 was approved by the vote indicated below:
RESOLVED, that a Public Hearing is hereby called by the Board of Trustees of the
Village of Scarsdale to be held in Rutherford Hall at Village Hall on
Tuesday, September 26, 2017, at 8:00 pm to determine the number of
2018 Scarsdale taxicab licenses to be authorized pursuant to Section
272-3 of the Village Code.
RESOLVED, that the Village Clerk is directed to advertise said Public Hearing.

following resolution regarding an Amendment Extending an Agreement with the Scarsdale
Arts Council for an Art Exhibit in Chase Park was approved by a unanimous vote:
WHEREAS, the Scarsdale Arts Council (Council) is a not-for-profit organization
that works to instill a sense of civic pride in Scarsdale’s artistic and
cultural amenities, and to raise public awareness and participation in
local arts programs; and
WHEREAS, to generate interest, excitement, and vitality in the Village Center, and
pursuant to a May 23, 2017, Village Board resolution approving an
agreement (attached) with the Council and a local artist, Simone
Kestelman, the Council sponsored a temporary art exhibit in Chase
Park featuring an oversized Pearl Necklace to be draped from a tree,
as well as an array of five boulders to be painted by Scarsdale
community members; and
WHEREAS, the art exhibit has been well received by the community and enjoyed
by those frequenting Chase Park during the display period, from
Memorial Day, May 29, 2017, through until September 8, 2017, as
conditioned in the agreement; and
WHEREAS, due to the success of the art exhibit and in accordance with further
discussions amongst the parties, it is recommended that the art
exhibit remain in Chase Park until January 10, 2018, to be included as
part of the Village Center holiday season decorations; now, therefore,
be it
RESOLVED, the Village Board of Trustees hereby authorizes the Village Manager
to execute the attached amendment to the May 18, 2017, agreement
with the Scarsdale Arts Council and local artist Simone Kestelman
authorizing the display of the “Pearl Necklace” and five boulder

beyond such date if mutually agreed by all parties.

Upon motion entered by Trustee Callaghan, and seconded by Trustee Pekarek, the
following resolution Rescinding Previous Award and Re-Awarding Items A, C, I, and J of
VM Contract #1219 – Assorted Trash and Recycling Bins and Lids was approved by the
vote indicated below:
WHEREAS, by Resolution dated May 9, 2017, the Village Board awarded Items A,
C, I, and J of VM Contract #1219 – Assorted Trash and Recycling
Bins and Lids to the lowest bidder, Trashcans Unlimited, 1114 Texas
Palmyra Hwy, Ste. 153, Honesdale, PA 18431, in the amount of
$22,130.65 (Resolution attached); and
WHEREAS, a condition of the contract award is that the vendor file with the
Village a certificate of liability insurance; however, despite multiple
attempted contacts by email and telephone following the contract
award, Trashcans Unlimited has neither responded to Village
contacts nor provided the required certificate of insurance, thus
disqualifying their bid; and
WHEREAS, the next lowest responsible bid for Items A and C was submitted by
Janitorial Supplies, 665 New Britain Ave., Newington, CT 0611, at a
combined price of $20,410.65; and
WHEREAS, the next lowest responsible bid for Items I and J was submitted by
Recycle Away LLC, 45 Flat Street, PO Box 1757, Brattleboro, VT
05301, at a combined price of $5,802.30; now, therefore, be it
RESOLVED, that the Village Board’s award of VM Contract #1219 Items A, C, I,
and J on May 09, 2017, to Trashcans Unlimited, 1114 Texas Palmyra
Hwy Ste. 153, Honesdale, PA 18431, is hereby rescinded due to the
vendor having failed to provide the required insurance document;

following resolution regarding Acceptance of a Gift – Portable Lights at Supply Field for
Youth Tackle Football Program was approved by a unanimous vote:
WHEREAS, the Parks, Recreation and Conservation Department conducts a
Youth Football Program for children in grades 3 through 8, which
includes both tackle and flag football, with approximately 75 to 100
children anticipated to enroll; and
WHEREAS, limited daylight during the months of October and November make
it challenging for volunteer parents and coaches to conduct tackle
football practices and games; and

WHEREAS, the Village Board of Trustees has authorized the temporary annual
use of two portable lights at Supply Field from mid-October through
mid-November, three days a week until 7:30PM, since 2011, said use

WHEREAS, these portable lights have been donated to the Village of Scarsdale by
resident Sam Blakley, who has again offered to donate the units for
the 2017 program, with said units to be used under the same terms
and conditions as the previous years; and
WHEREAS, temporary use of the portable lights is valued in excess of $500.00;
and
WHEREAS, pursuant to Policy #106: “Gifts to the Village of Scarsdale” of the Village
of Scarsdale Administrative Policies & Procedures Manual,
acceptance of all gifts valued at $500 or greater must be approved by
the Village Board of Trustees; now, therefore, be it
RESOLVED, pursuant to the Village of Scarsdale Policy #106, the Village Board of
Trustees hereby accepts the gift donation of two portable lights for
temporary use at Supply Field in conjunction with the Scarsdale
Youth Recreation Football Program for the 2017 season, to be used

Upon motion duly made by Trustee Pekarek and seconded by Trustee Samwick, the

RESOLUTION RE: ACCEPTANCE OF A GIFT FOR THE
SCARSDALE PUBLIC LIBRARY ADDITION AND
RENOVATION PROJECT
WHEREAS, the Scarsdale Library Board completed a Master Plan dated June 10, 2013,
which identifies a number of building renovations and additions that will
increase the capacity of the library to provide a broader range of rapidly
evolving library services while maintaining popular traditional collections
and programs by offering a more balanced utilization of the building space
within a safe, attractive and inviting comfortable environment, said master
plan supported by the Scarsdale Village Board of Trustees via resolution
dated April 8, 2014 (attached); and
WHEREAS, the improvements identified in the Master Plan will transform the Library
into a multi-purpose community asset for future generations, maintain its
preeminent status among free public libraries in the County and State,
enhance its technological capacity to further library services and create a
physical environment that will be a welcoming and versatile learning
center; and
WHEREAS, the Scarsdale Public Library Board, at their October 21, 2013 meeting,
authorized the retention of the fund raising consulting firm of Plan A
Advisors, P.O. Box 165, Thornwood, NY 10594, to design and conduct a
capital campaign to implement such a project, subsequently identified in
the July 20, 2015, Schematic Design Report prepared by Dattner
Architects, at an estimated construction cost of $16,500,000 and total
project cost of approximately $19,500,000; and
WHEREAS, in accordance with a Village Board request at a March 07, 2016,
Committee of the Whole meeting, the Library Board and Architect value
engineered the schematic design plans, reducing the total project cost to
$17,900,000, as identified in Option A-1 (attached), which the Architect
presented at the July 19, 2016, Committee of the Whole meeting; and
WHEREAS, on December 13, 2016, the Village Board of Trustees authorized a
$9,900,000 bond to pay part of the $17,900,000 addition and renovation of
the existing Scarsdale Public Library Building, with the remainder of the
$17,900,000 to be paid by private donations and grants; and
WHEREAS, on January 09, 2017, and with thanks to Assemblywoman Amy Paulin, the
New York State Dormitory Authority awarded the Village of Scarsdale a
$500,000 State and Municipal Facilities Program grant in support of the
project, with the execution of a grant agreement pending upon completion
of various program review requirements; and
WHEREAS, the following donations have been offered to the Scarsdale Public Library
Addition and Renovation Capital Improvement Project: Friends of the
Scarsdale Library - $84,000; Leona Kern - $10,000; and
WHEREAS, pursuant to Policy #106: “Gifts to the Village of Scarsdale” of the Village
of Scarsdale Administrative Policies & Procedures Manual, acceptance of
all gifts valued at $500 or greater must be approved by the Village Board
of Trustees; now, therefore, be it
RESOLVED, that the Village Board hereby accepts the following gifts toward the
Scarsdale Public Library Master Plan Improvement Project: $84,000 from
the Friends of the Scarsdale Library; and $10,000 from Leona Kern; and
be it further
RESOLVED, that the Village Treasurer take the necessary steps to complete the
transaction and accept these financial gift totaling $94,000 and deposit
said funds into the Library Capital Campaign Account; and be it further

19 GRIFFEN AVENUE, SECTION 24, BLOCK 1,
LOT 4A.1
WHEREAS, Section 7-730-4 of New York State Village law authorizes planning
boards to reserve land in a subdivision for park, playground, or other
recreational purposes, and to accept payment in lieu of land in cases where
suitable parklands of adequate size cannot be properly located on a
subdivision plat, the amount of said payment to be established by the
Village Board of Trustees; and
WHEREAS, on June 28, 2017, the Planning Board approved the two-lot subdivision of
19 Griffen Avenue, creating one additional buildable lot, after finding the
proposed subdivision would not have a significant negative environmental
impact pursuant to SEQRA; and
WHEREAS, on August 9, 2017, the Planning Board recommended a payment in lieu of
contribution of land, as the dedication of land for park, playground, or
recreation purposes is not feasible in view of the small amount of land
available in this two-lot subdivision; and
WHEREAS, the Village Department of Parks, Recreation and Conservation provides a
variety of facilities to meet the interests and needs of the community,
including parks, playgrounds, ballfields, and an outdoor pool, and has a
Five-Year Capital Plan which calls for the replacement of facilities and
equipment, as well as additional facilities that will be needed in the future;
now, therefore, be it
RESOLVED: that in association with the creation of one new buildable lot resulting
from the subdivision of property at 19 Griffen Avenue, identified on the
Village tax map as Section 24, Block 1, Lot 4A.1, the Board of Trustees
hereby accepts the recommendation of the Planning Board that the
applicant, Brite Avenue Development Corp., remit to the Village an
amount equal to 5.0% of the $1,350,000 Guideline Value of a lot in the A-
2 zoning district pursuant to the 2007 Subdivision Recreation Fee
Schedule, or $67,500, in lieu of a contribution of land for park,

Re: Subdivision of Property –19 Griffen Avenue: Monetary Contribution in Lieu of Land
Dedicated for Recreational Purposes
The Planning Board approved this two lot subdivision at its June 28, 2017 meeting, creating one new
lot. The property, located in the A-2 (20,000 sq. ft.) zoning district, is shown in the Assessor’s
records as 3.3 acres and is improved with a house built in 1975. The Committee for Historic
Preservation recently approved a Certificate of Appropriateness permitting the demolition of the
house. The subdivision plat shows two lots: Parcel 1, the easterly lot, with 1.609 acres and 124 ft.
of frontage and Parcel 2, the westerly lot, with 1.635 acres and 124 ft. of frontage.
New York State Village Law 7-730 provides for the reservation of parkland on subdivision plats with
residential units or, in the alternative, funds in lieu of the dedication of land.
On August 9, 2017, the Planning Board recommended the applicant, Brite Avenue Development
Corp., pay to the Village a recreation fee in lieu of a contribution of land for park, playground or
other recreational purposes, in accordance with the Subdivision Recreation Fee Schedule adopted
by the Village Board on February 27, 2007. The Planning Board recommended that the Village
Board consider a subdivision recreation fee equal to 5.0 % of the $1,350,000 Guideline Value of
a lot in the A-2 zoning district, or $67,500 for the one new lot created by the subdivision.
Attached please find the June 28, 2017 and August 9, 2017 Planning Board resolutions and the
Subdivision Recreation Fee Schedule.

SUBJECT: Taxicab Licenses - 2018
Pursuant to Section 272-3 of the Village Code, the Board of Trustees must determine the number
of taxicabs to be licensed each year.
For your information, the following number of taxicab licenses have been issued by the Village
of Scarsdale during the last 10-year period:

For 30+ years, the Village Board has annually authorized the issuance of 25 taxicab licenses.
The Village has issued an average of 23 taxicab licenses over the past decade, with the maximum
authorized number of 25 taxicab licenses issued once (in 2008). The U.S. Census estimates the
2016 Scarsdale population to be 17,909. Based on that estimate, the Village’s population has
increased 4.33% since the 2010 U.S. Census count of 17,166.
Metro North reports that the 2016 weekday train ridership at the Scarsdale train station was
4,631 boardings – an increase of 134 (3%) weekday boardings compared to the 2015 ridership
rate of 4,497. The 2016 ridership is an overall increase of 476 over the 2010 number of 4,155.
Weekend ridership in 2016 of 2,876 showed a significant increase of 810 boardings, or 32.9% as
compared to the 2015 weekend ridership of 2,066.
Based on the foregoing information, in consideration of the slight increase in population and
weekday ridership over the last 5-6 years, the current maximum allowance of 25 taxicab licenses
should continue to be adequate to meet the needs of the community on weekdays and weekends.
In considering the number of taxicab licenses for 2018 we considered the presence of Uber and
Lyft whose authority to operate in Westchester County commenced on June 29, 2017. Both
Uber and Lyft were contacted to obtain ridership information. Uber was unwilling to divulge
this information, stating that they have “hundreds of drivers and thousands of riders.” A
representative from Lyft advised me that they did not have the numbers available yet on a local
level as they have only been in operation in Westchester County for approximately eight (8)
weeks. However, Lyft advised me that they also have had thousands of riders in Westchester
County.
I respectfully request that a public hearing on this matter be scheduled for the September 26,
2017 Village Board meeting.

On August 22, 2017, P.O. Boggi completed inspections on 22 of the 24
taxicabs from Central Taxi of Scarsdale, New York. All of the taxicabs inspected
passed inspection and copies of the inspection reports are attached to this memo.
All of the drivers provided the appropriate paperwork needed.
Taxi #44 and #63 could not be inspected at this time. Both of those
vehicles are out of service for repairs. Mr. Pat Desantis of Central Taxi stated that
he will contact P.O. Boggi when those vehicles return to service, so that they can
be inspected. A supplementary memo and inspection forms will be forwarded to
the clerk’s office upon completion.
RESOLUTION RE: AMENDMENT EXTENDING AN AGREEMENT
WITH THE SCARSDALE ARTS COUNCIL FOR
AN ART EXHIBIT IN CHASE PARK
WHEREAS, the Scarsdale Arts Council (Council) is a not-for-profit organization that
works to instill a sense of civic pride in Scarsdale’s artistic and cultural
amenities, and to raise public awareness and participation in local arts
programs; and
WHEREAS, to generate interest, excitement, and vitality in the Village Center, and
pursuant to a May 23, 2017, Village Board resolution approving an
agreement (attached) with the Council and a local artist, Simone
Kestelman, the Council sponsored a temporary art exhibit in Chase Park
featuring an oversized Pearl Necklace to be draped from a tree, as well as
an array of five boulders to be painted by Scarsdale community members;
and
WHEREAS, the art exhibit has been well received by the community and enjoyed by
those frequenting Chase Park during the display period, from Memorial
Day, May 29, 2017, through until September 8, 2017, as conditioned in
the agreement; and
WHEREAS, due to the success of the art exhibit and in accordance with further
discussions amongst the parties, it is recommended that the art exhibit
remain in Chase Park until January 10, 2018, to be included as part of the
Village Center holiday season decorations; now, therefore, be it
RESOLVED, the Village Board of Trustees hereby authorizes the Village Manager to
execute the attached amendment to the May 18, 2017, agreement with the
Scarsdale Arts Council and local artist Simone Kestelman authorizing the
display of the “Pearl Necklace” and five boulder exhibits in Chase Park to
be extended until January 10, 2018, or beyond such date if mutually
agreed by all parties.

Items A, C, I and J of VM Contract #1219 were awarded by way of Village Board resolution on
May 9, 2017, to Trashcans Unlimited. The contract terms and conditions require the vendor to file
a certificate of insurance with the Village; however, following multiple attempted email and
phone contacts, Trashcans Unlimited has neither provided the required certificate of insurance nor
responded to any of our efforts to contact them. Consequently, their bid must be disqualified and
rejected.
The next lowest bidder for VM #1219, Items A Items C, was Janitorial Supplies, 665 New Britain
Ave. Newington, CT 06111, for a total of $20,410.65, while the next lowest bidder for Items I and
J was Recycle Away, LLC, 45 Flat Street, Brattleboro, VT 05301, for a total of $5802.30.
Cumulatively, these bids result in an increase of $4,082.30 over the prior lowest bid for the same
Items. However, thereThere are adequate funds available in the Parkland Deposit Account, TE93-
.46, to cover the additional cost. As such, I recommend the Village Board approve the attached
resolution rescinding and re-awarding these items at tis September 12, 2017 meeting.

RESOLUTION: ACCEPTANCE OF A GIFT – PORTABLE LIGHTS
AT SUPPLY FIELD FOR YOUTH TACKLE
FOOTBALL PROGRAM
WHEREAS, the Parks, Recreation and Conservation Department conducts a Youth
Football Program for children in grades 3 through 8, which includes both
tackle and flag football, with approximately 75 to 100 children anticipated
to enroll; and
WHEREAS, limited daylight during the months of October and November make it
challenging for volunteer parents and coaches to conduct tackle football
practices and games; and
WHEREAS, the Village Board of Trustees has authorized the temporary annual use of
two portable lights at Supply Field from mid-October through mid-
November, three days a week until 7:30PM, since 2011, said use having
occurred without incident or complaint from abutting neighbors; and
WHEREAS, these portable lights have been donated to the Village of Scarsdale by
resident Sam Blakley, who has again offered to donate the units for the
2017 program, with said units to be used under the same terms and
conditions as the previous years; and
WHEREAS, temporary use of the portable lights is valued in excess of $500.00; and
WHEREAS, pursuant to Policy #106: “Gifts to the Village of Scarsdale” of the Village
of Scarsdale Administrative Policies & Procedures Manual, acceptance of
all gifts valued at $500 or greater must be approved by the Village Board
of Trustees; now, therefore, be it
RESOLVED, pursuant to the Village of Scarsdale Policy #106, the Village Board of
Trustees hereby accepts the gift donation of two portable lights for
temporary use at Supply Field in conjunction with the Scarsdale Youth

Re: Portable Lights Usage on a Temporary Basis by the Youth Football Program
The Recreation Department’s fall youth football program, assisted by parent volunteers, is
conducted from August to November each year. The overall program is features two leagues, one
for flag football and the other for tackle football. Practices and games for the tackle football
program are conducted on Supply Field.
Limited daylight hours during the months October and November necessitate the use of artificial
lighting in order to facilitate youth tackle football practices and games on weeknights.
The Village Board adopted a Resolution on September 27, 2011, authorizing use of portable lights
by the youth football program at Supply Field for the 2011 season. Since that time, the Village
Board has approved the usage of portable lights at Supply Field for the Recreation Youth Football
Program in 2012, 2013, 2014, 2015, and 2016 without incident. The same request to use portable
lights at Supply Field is being made again for the 2017 season.
From 2011 through 2016, two portable lights were used at Supply Field for the youth tackle
football program, which serves 3rd through 8th graders. Two portable lights are both necessary
and adequate to support the 2017 tackle football program, as well. The units will be secured in
locations that are a safe distance from the playing field and orange fencing will be installed around
them.
Consistent with past practice, the lights will be used three days per week up until 7:30 PM for the
2017 season, which runs from October 15th thru November 20th. The lights are easily turned-on
by coaches using the field, and are turned-off and lowered each night by the same coaches.
Mr. Sam Blakley, a Scarsdale resident that uses portable lighting for his business, has again
offered to donate temporary use of the lighting equipment for youth football purposes. Staff
recommends acceptance of the gift temporary lighting and I welcome any associated questions.

Dan,
Thank you for your e-mail below and explanation. It has been a summer of quite a few trips abroad, so my
apologies for not getting back to you sooner.
However, preservation efforts are not improving in Scarsdale.
It is with dismay and sorrow I read the other day that the VB will be meeting on September 25 to discuss 12
Dolma and 26 Cooper. Both houses should be preserved. A lack of initiative on the part of past VB’s has led us
to come to this juncture. There is no reason why these houses should not be preserved and the land they are on
kept as well, so huge monsters are not built. Legislation should have been passed along time ago. Of course it is
easier to destroy and rebuild. But how do you get 100 years’ character ? Good things take time and effort.
Beautiful houses just as much. The results are sublime and cannot be bought for any pitiful sum.
I thought I read a while ago that the VB was to meet with the various land use boards, the BAR, CHP, ZBA,
Planning etc., to discuss this. However, nothing that I know of has been scheduled. In the meanwhile Scarsdale
is losing it s character. You need to place a moratorium to stop this plague.
We are becoming a series of houses built to maximize greed in disrespect to the environment or architectural
heritage. All mechanisms were put in place to avoid just this, but all is failing thanks to untamed greed: the wild
horse in Scarsdale.
I am trying to demonstrate this and provide support for preservation efforts on my website: Save-Scarsdale.org.
I get many visitors from the whole world all day, and yet I cannot document progress in Scarsdale. In fact, I
would like to stop and close this site and waiting for legislation to be passed so that my site will become
obsolete. Unfortunately not yet…
I know you care more about these issues, maybe more than any other past Mayor and I know can and will stop
this invasion.

general, notice is usually on the website well before the meetings of the CHP. I looked at several

or August. In these summer months many residents do go away on holidays and therefore this is
not a good time to get right representation.
I hope you agree and will pass this legislation effective immediately.

WHEREAS, On August 20, 2017, the Credit Shelter Trust of the Abramowitz Irrevocable
Trust, Petitioner and owner of the property situated at 0 Crane Rd, identified as
Section 02, Block 02, Lot 10A on the official tax map of the Town of Scarsdale,
filed an Application for Refund and Credit of certain 2017 Real Property Taxes;

resulting in certain 2017 taxes paid above fair market value; and
WHEREAS, in an August 31, 2017, letter from the Executive Director of the Westchester
County Tax Commission, as attached hereto, it was determined that the errors
constitute correctable clerical errors, as defined in RPTL §550.2(a) and
recommended that the application for a refund of the excess 2017 County and
Village taxes paid by the property owner, as further detailed in the attached
worksheet, as well as correction of the 2016 and 2017 assessment rolls be
approved by the assessing body, the Town of Scarsdale; now, therefore, be it
RESOLVED, that the Town Board acknowledges and agrees with the findings of the
Executive Director of the Westchester County Tax Commission that the
assessment errors constitute correctible errors, necessitating the refund of excess
2017 County and Village taxes already paid, as well as correction of the 2016
and 2017 assessment rolls; and be it further
RESOLVED, that the Petitioner’s application for a refund of the excess 2017 County and
Village real property taxes for the 2017 tax year are herein approved and that the
Town Manager is directed to communicate the Town Board’s determination to
the Petitioner and to effectuate the refund of said taxes set forth and described
herein, as well as the correction of the 2016 and 2017 assessment rolls.
