I am very fortunate to have such a dedicated and talented board and village staff to work with over the coming two years. There will be much to do and all of it will be driven by you, our residents. Our priorities are community priorities, and we will meet in the coming weeks to discuss and review what is ahead. I am appreciative of the civic volunteers who have sat on this dais and on whose shoulders we stand. This board hopes to continue this important work to better our community. I want to send warm wishes to all our friends and neighbors of different faiths, as we celebrate the many important religious holidays in April including Passover, Easter, Ramadan, and Ram Navami. May this season of renewal and hope bring us together in unity and peace. Happy holidays! There has been a lot of attention on the housing compact proposed by Governor Hochul. The board is very appreciative of the comments made by our elected representatives including State Senator Shelly Mayer, County Executive George Latimer, County Legislator Ben Boykin and especially our Assembly Member, Amy Paulin. We have been and continue to be in touch with our local elected representatives and appreciate their efforts to achieve an outcome where the interests of the state and local municipalities are not mutually exclusive on everything from environmental and aesthetic issues to ensuring that schools are provided the resources necessary to handle any increase in enrollment. With good intentions the Governor has proposed what may amount to an overly determinative approach for a complicated issue. What’s needed is greater thought and discussion — and acknowledgement — regarding the complexity of the issues involved. Writ large, proposals that contemplate stripping local zoning review from the development process could result in unintended consequences for the local communities we call home. There are many issues that will need to be studied including but not limited to the potential impact of greater density around the village and particularly in our village center on our schools, water and sewer systems, and our roads and public transportation. But, and I want to be clear, just having concerns is not a reason to stand in the way of development. It is the limits on local control and environmental review that are being proposed, which make it unsurprising that so many municipalities are strenuously opposed. This proposal could more than triple the number  Village Board of Trustees Meeting 04/11/2023 3 of housing units in Scarsdale alone. Our hope is that the Governor pivots to an incentive-based approach that will provide the resources to allay many of the legitimate concerns and allow local governments and their communities to make decisions to preserve what is worth preserving while at the same time responsibly increasing the housing stock. We all hope to make New York State a more attractive place to live in, invest in, and ultimately reverse its recent population loss. Thank you.” ******** Mayor Arest later added that Michelle Sterling, Chair of the Conservation Advisory Council was going to attend the meeting and speak about a program which she and the mayor both participate in. May Arest mentions that it is nothing that the village has anything to do with specifically, but it's quite a cost savings for anyone that may have an electric vehicle. It's called Smart Charge New York. They recently announced that there are quite a number more vehicles that are eligible to participate. The way it works is if you charge at night during off peak hours, they’ll reimburse you 10 cents per kilowatt hour that you charge. Also, after you participate for 3 months, there is a $25 credit. There are also additional savings during really peak times, such as during the summer, if you don't charge within peak times (i.e. during the day). Mayor Arest encourages residents who maybe aren't aware of it, to visit scny.ev.energy to sign up and look into it.” ******** Manager’s Comments Village Manager Cole provided the following updates from Department Heads: Police Department Consistent with their status as an accredited police department through the Commission on Accreditation for Law Enforcement Agencies - only 1 of 6 law enforcement agencies in the State of New York and the only in Westchester County to maintain such high standards - the Scarsdale Police Department, under Chief Matturro’s leadership is among the best law enforcement agencies in the State of New York. Among other training and exercises, the Scarsdale Police Department conducts periodic tabletop and field exercises. Such efforts often involve partners, including faith-based institutions, Scarsdale schools, and others. Our training and exercises may involve other entities as well, including our Scarsdale Fire Department and Scarsdale Volunteer Ambulance Corp, and sometimes public safety agencies from outside of our community. On the evenings of Wednesday, April 19, 2023, and Thursday, April 20, 2023, Scarsdale Police will be conducting advanced law enforcement rapid response training, also called alert training, involving active shooter scenarios at the Greenacres School. This particular event will exercise new public safety technology that improves first responder communication and navigation during emergency events. Other events occurring through the year will involve this Scarsdale Fire Department and SVAC, including rescue task force training.  Village Board of Trustees Meeting 04/11/2023 4 Fire Department Chief Mytych and the Scarsdale Fire Department want all of Scarsdale residents to be aware that the combination of warm temperatures, low humidity, and wind, combined with dry conditions can increase the risk of wildland fire spread. Please note that outdoor burns are prohibited and be careful with outdoor fires, such as fire pits, making sure that embers are contained, and the fire is properly extinguished before retreating indoors. In related news, the Scarsdale Fire Department responded to a fire that burned approximately one acre of brush within Saxon Woods Park on Saturday evening. Our team in responding to that event, was assisted by SVAC, Westchester County Police Department, and the Armonk Fire Department who provided UTVs to transport personnel and equipment across a half mile of unblazed trails in the wooded area. Fortunately, there are no injuries and that fire’s cause is still under investigation. Department of Public Works East Parkway, Christie Place, and the commuter parking lot on Scarsdale Avenue are all scheduled for resurfacing next week. The work schedule is for nights after 7 pm and we anticipate 3 to 5 days of paving, weather permitted. Once the village center is completed, our paving crews will transition to residential areas and continue with projects in the Overhill, Old Scarsdale, Arthur Manor, West Quaker Ridge, and Fox Meadow neighborhoods, as well as other locations. We have approximately 6.5 miles scheduled for paving before the end of this calendar year. Note, the 23-24 tentative budget includes funding for our standard paving target of 5 miles per year plus an approximate 5 extra miles to be completed as part of our three-year pavement condition catch up plan. Building Department Gas-powered leaf blowers are presently prohibited through September 30, 2023. The building department does continue to enforce the law, and following a flurry of summonses is earlier in the season, they are reporting that they have substantially improved compliance, and would like to thank Scarsdale residents for adhering to that local law, and our landscapers as well. ******** Upon motion made by Trustee Gruenberg and seconded by Trustee Brew, the agenda was amended to add a resolution, after annual resolutions, to adopt a revised Village of Scarsdale Board of Trustees Rules of Procedure for Public Meeting. ******** Public Comment Kaare Weber; 51 Crossway, mentions that there is a plan to install pickleball courts at the Crossway field and he is disappointed in prior discussions at the village board level around lights and now the pickleball courts. Mr. Weber has spoken on this issue in the past and send a letter asking additional questions back in March 2022. He recently followed up and in his recent  Village Board of Trustees Meeting 04/11/2023 5 communications he found out that the pickleball courts are going out to bid with a planned completion of August 2023. Mr. Weber indicates that he is confused and disappointed in the lack of response to his inquiries and lack of transparency on the village’s part. He also remarks that there is a national debate on the placement of pickleball courts in residential neighborhoods with ongoing litigation across the nation. Mr. Weber and his neighbors will engage with an independent pickle ball expert. Their concerns include sound, traffic, driveways being used as turnarounds, cars idling, other drivers going around double yellow to get through traffic, the parking lot not being big enough, and water/mitigation. Mr. Weber would like to explore alternative locations and a more comprehensive plan from the Village on how it will work. Finally, Mr. Weber states that as the Director of Surgery and Associate Medical Director at White Plains Hospital, he is a part of the emergency management team, and would like folks to explore the ‘Stop the Bleed’ program. Carl Finger; 38 Butler Road, mentions that a recreation planning study that was supposed to happen was never conducted. Mr. Finger feels that more planning needs to be done before pickleball courts are installed. The proposed courts are adjacent to a water course and are in an environmental area that should be further assessed from an environmental standpoint. Mr. Finger also mentions that paddle tennis courts on Brite Avenue and at the high school are severely underutilized and pickle ball courts have been painted there. Mr. Finger suggests that these locations are a sensible alternative for the proposed pickleball courts. Sari Canell; 121 Carthage Road, indicates that she is surprised to find out that proposals were accepted and as a resident of the neighborhood, she hadn’t heard anything about it. Ms. Canell states that residents should have the opportunity to understand what options have been considered, including alternative locations. Ms. Canell mentions that Carthage Road serves as a conduit road between Mamaroneck Road and Heathcote Road – cars consistently use these roads to bypass traffic lights. Ms. Canell also says that safety needs to be considered in terms of vehicle traffic and kids on bikes, especially considering Heathcote School being nearby. Mario Barraza; 54 Crossway, lives directly in front of the planned pickleball court area and voices the same concerns as fellow resident who spoke before him. Mr. Barraza has two young children and often sees cars speeding down their road and using their road to cut through traffic. He is concerned about the safety of his children who walk to school and play in the yard often. Mr. Barraza indicates that sound and quality of life are also a concern. Bob Harrison; 65 Fox Meadow Road, comments on the interest earnings on village funds. He mentions that the Federal Reserve is worried about inflation and the numbers on CPI are expected tomorrow - Mr. Harrison guesses will be between 5% and 6%. Their goal is to get rates down to 2%. There will be higher interest rates for the next few months, or even the next couple years, to control inflation. Mr. Harrison states that if money was invested properly, we would be able to invest in fully marketable one-year treasury bills. The budget should be revised to reflect the difference of about $1 million in extra interest income and the excess should be used to reduce the tax rate. ******** Liaison Reports  Village Board of Trustees Meeting 04/11/2023 6 Deputy Mayor Whitestone Deputy Mayor Whitestone reports that April is Sexual Assault Awareness Month. Next week, domestic violence advocate, investigative journalists, and author Rachel Louise Snyder, will participate in a virtual discussion with the Scarsdale community on Tuesday, April 18th at 7 pm, focusing on her award-winning 2019 publication, “No Visible Bruises: What We Don't Know About Domestic Violence Can Kill Us”. The event is sponsored by Scarsdale-Edgemont Family Counseling Services and the Scarsdale SAFE Coalition, in partnership with the Scarsdale Public Library, Friends of the Library, and Hitchcock Presbyterian Church. The SAFE Coalition members work with all sectors of the Scarsdale community to raise awareness about the multiple forms of violence facing Scarsdale families, communicate resources, and strengthen the delivery of inner community services. Scarsdale-Edgemont Family Counseling Services serves as the lead agency for the Coalition. In addition, two weeks from tonight at the Board Meeting on April 25th, Deputy Mayor Whitestone and some of his board colleagues will choose to mark a denim day, which is the following day on April 26th, but community members who attend the meeting are invited to join in wearing denim and marking Denim Day, which is in awareness of domestic violence, but ******** Trustee Mazer Trustee Mazer reported on behalf of the Advisory Council on Scarsdale Senior Citizens regarding some activities that are being sponsored by the Scarsdale-Edgemont Family Counseling Services. On Thursday, April 13th, from 12:30 to 1:30 pm at the Girl Scout House, there will be a Passover celebration open to all Seniors of all faiths. Interested members of the community must RSVP Stacey Cook (914) 723-3281. A week later, on April 20th, there is another celebration for Easter and again, Seniors of all faiths are invited to come and RSVP with Stacey Cook. ******** Trustee Gans Trustee Gans used his liaison report to welcome our new mayor and new Trustee, Dara Gruenberg, to the Board that are both friends of his and whom are both partially responsible for some of his involvement in village government. was approved unanimously: WHEREAS, all conditions precedent to the financing of the capital purpose hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act, to the extent required, have been performed; and WHEREAS, it is now desired to authorize the financing of such capital purpose; NOW THEREFORE BE IT RESOLVED, by the Board of Trustees of the Village of Scarsdale, Westchester County, New York (the “Village”), as follows: Section 1. For the specific object or purpose of paying the cost of the acquisition of a fire truck and apparatus, including incidental expenses in connection therewith, in and for the Village, there are hereby authorized to be issued $1,150,000 bonds of said Village pursuant to the provisions of the Local Finance Law. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is twenty years under subdivision twenty-seven of paragraph a of Section 11.00 of the Local Finance Law. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of said Village, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 6. Such bonds shall be in fully registered form and shall be signed in the name of the Village by the manual or facsimile signature of the Village Treasurer and a facsimile of its corporate seal shall be imprinted or impressed thereon and may be attested by the manual or facsimile signature of the Village Clerk. Section 7. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Village Treasurer, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as the Village Treasurer shall deem best for the interests of said Village provided, however, that in the exercise of these delegated powers, the Village Treasurer shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Village Treasurer shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 8. All other matters, except as provided herein, relating to such bonds, including determining whether to issue such bonds having substantially level or declining annual debt service and all matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the name of the Village by the facsimile signature of the Village Treasurer, providing for the manual countersignature of a fiscal agent or of a designated official of the Village), the date, denominations, maturities and interest payment dates, place or places of payment, and also including the consolidation with other issues, shall be determined by the Village Treasurer. It is hereby determined that it is to the financial advantage of the Village not to impose and collect from registered owners of such bonds any charges for mailing, shipping and insuring bonds transferred or exchanged by the fiscal agent, and, accordingly, pursuant to  Village Board of Trustees Meeting 04/11/2023 21 paragraph c of Section 70.00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by Section 52.00 of the Local Finance Law, as the Village Treasurer shall determine. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150 - 2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 10. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Village is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution of the State of New York. Emanuel Village Clerk RESOLUTION RE: SUBDIVISION RECREATION FEE 28 ASPEN ROAD; SECTION 19, BLOCK 2, LOTS 539 & 540 WHEREAS, Section 7-730-4 of New York State Village law authorizes planning boards to reserve land in a subdivision for park, playground, or other recreational purposes, and take money in lieu of land in cases where suitable park lands of adequate size cannot be properly located on a subdivision plat, the amount of said money to be established by the Village Board of Trustees; and WHEREAS, on January 25, 2023, the Planning Board approved the two-lot subdivision of 28 Aspen Road, creating one new lot, after finding the proposed subdivision would not have a significant negative environmental impact pursuant to the State Environmental Quality Review Act (SEQRA) and Chapter 152 of the Village Code SEQRA; and WHEREAS, on March 22, 2023, the Planning Board recommended a payment in lieu of contribution of land after finding that the dedication of land for park, playground, or recreation purposes is not feasible in view of the small amount of land available in this two-lot subdivision; and WHEREAS, the Village initiated a study of Village athletic facilities in 2000, conducted by Ward Associates, for an inventory of existing facilities and an analysis of existing and future needs, which identified improvements to existing Village and School facilities for increased use and a plan for increasing the inventory to meet the community needs; and WHEREAS, the Village Department of Parks, Recreation and Conservation provides a variety of facilities to meet the interests and needs of the community including parks, playgrounds, ball fields, and an outdoor pool; and WHEREAS, the Village Department of Parks, Recreation and Conservation develops a Five-Year Capital Plan that calls for the replacement of facilities and equipment as well as additional facilities that will be needed in the future; and WHEREAS, the Village Board, in May 2018, adopted the Guidelines and Fee Schedule for monetary payment in lieu of land for new building lots and determined the Recreation Fee for new lots is a range from 4% to 6% of the 2018 lot value as estimated by the Village Assessor and verified by an independent analysis; and WHEREAS, the fee charged to the applicant in lieu of land being conveyed for recreational purposes bears a substantial relationship to the cost of providing recreational facilities and the acquisition of land for recreational purposes; now therefore be it RESOLVED, the Board of Trustees hereby accepts the recommendation of the Planning Board that the applicant, Frank Grande, pay to the Village an amount equal to 5.0% of the Guideline Value of a lot in the A-2a zoning district, pursuant to the 2018 Subdivision Recreation Fee Schedule, or $60,000 in lieu of a contribution of land for park, playground, or other recreational purposes for the one new buildable lot resulting from the subdivision of property at 28 Aspen Road, identified on the Village tax map as Section 19, Block 2, Lots 539 & 540. The property, located in the A-2a (15,000 sq. ft.) zoning district, is shown in the Assessor’s records as .5 and .38 acres. The property was improved with a home built in 1956. New York State Village Law 7-730 authorizes a planning board to require payment of a sum of money in lieu of setting aside land for recreational purposes if it determines that a suitable park or parks of adequate size cannot be properly located on such subdivision plat. On March 22, 2023, the Planning Board recommended that the applicant, Frank Grande, pay to the Village a recreation fee in lieu of a contribution of land for park, playground, or other recreational purposes in accordance with the Subdivision Recreation Fee Schedule adopted by the Village Board in May 2018. The Planning Board recommended that the Village Board consider a subdivision recreation fee equal to 5.0 % of the Guideline Value for lots in the A-2a zoning district, or $60,000, for the one new lot created by the subdivision. Attached please find the March 22, 2023, Planning Board resolution, and the proposed April 25, 2023, Village Board resolution accepting the Subdivision Recreation Fee. Planning Board March 22, 2023 CASE #19 OF 2022 Frank Grande 28 Aspen Road Sec. 19, Blk. 2, Lot 539 & 540 Recommendation to the Village Board regarding the amount of the recreation fee The Board considered a recommendation to the Village Board regarding the amount of the recreation fee to be assessed to the applicant, of Frank Grande, in lieu of the dedication of parkland for a two lot subdivision creating one additional lot at 28 Aspen Road and, upon motion duly made and seconded, unanimously adopted the following resolution: WHEREAS: The property, located in the A-2a (15,000 sq. ft.) zoning district, is shown as .5 and .38 acres in the Assessors records and is improved with a home from 1956; and WHEREAS: the Planning Board, on January 25, 2023, approved the subdivision of the property into two lots; and WHEREAS: The subdivision plat shows the proposed subdivision of the property, creating two lots (one additional lot): proposed Lot “539A” with 21,528 sq. ft. and 124.1 ft. of street line frontage and proposed Lot “540B” with 17365.58 sq. ft. 100.43 ft. of street line frontage; and WHEREAS: chapter 77-1 of the Village Code authorizes the Planning Board to make recommendations to the Village Board on monetary payments in lieu of land in new subdivisions pursuant to Village Law 7-730; and WHEREAS: Village Law 7-730 authorizes a planning board to require payment of a sum of money in lieu of setting aside land for recreational purposes if it determines that a suitable park or parks of adequate size cannot be properly located on such subdivision plat; and WHEREAS: the Planning Board finds that dedication of land for park, playground or recreation purposes is not feasible in view of the small amount of land available in this two lot subdivision; and WHEREAS: the Village initiated a study of Village athletic facilities in 2000, conducted by Ward Associates, for an inventory of existing facilities and an analysis of existing and future needs which identified improvements to existing Village and School facilities for increased use and a plan for increasing the inventory to meet the community needs; and Planning Board March 22, 2023 WHEREAS: the Village Department of Parks, Recreation and Conservation provides a variety of facilities to meet the interests and needs of the community which includes parks, playgrounds, ball fields and an outdoor pool; and WHEREAS: the Village Department of Parks, Recreation and Conservation develops a Five Year Capital Plan that calls for the replacement of facilities and equipment as well as additional facilities that will be needed in the future; and WHEREAS: the Village Board, in May 2018, adopted the Guidelines and Fee Schedule for monetary payment in lieu of land for new building lots and determined the Recreation Fee for new lots is a range from 4% to 6% of the 2018 lot value as estimated by the Village Assessor and verified by an independent analysis; and WHEREAS: the fee charged to the applicant in lieu of land being conveyed for recreational purposes bears a substantial relationship to the cost of providing recreational facilities and the acquisition of land for recreational purposes; now therefore be it RESOLVED: the Planning Board recommends to the Village Board that the applicant, Frank Grande, be required to pay a monetary fee in lieu of the dedication of parkland in the amount of 5.0 percent of the Guideline Value for properties in the A-2a zoning district, or $60,000 for the one new lot created as a result of the two lot subdivision at 28 Aspen Road, identified on the Village tax map as Sec. 19, Blk. 2, Lots 539 and 540. Date: April 25, 2023  To: Robert Cole, Village Manager MEMORANDUM From: Brian Gray, Superintendent of PRC Department of Parks, Recreation and Conservation Date: April 13, 2023 Re: Award of VM Contract #1302 - Travel Camp Coach Bus The Department of Parks, Recreation and Conservation offers a Teen Travel Camp experience for children entering grades 6th through 8th, which requires coach bus service for a total of 24 trips. Prior to the 2022 camp season, the Department of PRC had limited enrollment to 40 campers necessitating one coach bus. Due to elevated demand from residents for this program for the 2022 season, the Department was able to accommodate an additional 40 campers, totaling 80, thus requiring two buses. The Department of PRC prepared VM Contract #1302 - Travel Camp Coach Bus to obtain pricing for both one and two buses, dependent on the need based off ongoing program registration. Accordingly, the Department of PRC advertised for VM Contract #1302 on March 31, 2023, with a bid opening date of April 11. In addition, bid packets were emailed directly to 14 companies and PRC staff contacted each prospective firm to ensure they received the packet and answer any questions. On the bid opening date of April 11, one bid was received from Hudson Valley Charter Service of 6 Dogwood Road, Cortlandt Manor, NY 10567 with the following result: • Total price for one bus for all 24 trips = $35,500 • Total price of two buses for all 24 trips = $71,000 Understanding registration for Travel Camp is currently ongoing, department staff will continue to monitor program registration and contract the appropriate number of buses per camp session in accordance with need. In the event a different quantity of buses is required, itemized pricing per trip has been obtained (attached), and the Village will be charged according to those bid prices. I recommend awarding VM Contract #1302 Travel Camp Coach Bus to Hudson Valley Charter Services of 6 Dogwood Road, Cortlandt Manor, NY 10567. The Department of PRC has contracted with this vendor in the past in the same scope of work and found that they provided these services in a satisfactory manner. Expenses will be charged to FY23/24 Acct: A.7020.CAMPS.TRAVL.400.463, where sufficient funds are available. I have prepared the attached resolution awarding VM Contract #1302 Travel Camp Coach Bus.
