Councilmember offered the following:
An Ordinance Amending Section 138-30 of the Code of the City of Schenectady
WHEREAS, on January 10, 2022, a public hearing was held regarding amending Section

138-30 of the Code of the City of Schenectady related to structurally unsafe buildings:
NOW, THEREFORE,
BE IT ENACTED by the Council of the City of Schenectady, in regular meeting
convened, Section 138-30 of the Code of the City of Schenectady shall be amended to include
the italicized language and delete any struck language below, as follows:

C-1. Unsafe Structures or Unsafe Equipment. In cases where the Building Inspector or a
Code Enforcement Officer determines that a building, structure, equipment or a portion
thereof is unsafe due to a violation or violations of the Uniform Fire Code (“Uniform
Code”), Fire Code of New York State (“FCNYS”), the Property Maintenance Code of New
York State (“PMCNYS”), any other State law, or the Schenectady City Code, the Building
Inspector or Code Enforcement Officer may, as the case necessitates, condemn part of or all
of said building, structure and/or equipment to protect the life, health, property or safety of
the public or the occupants of the structure, require that such building, structure and/or
D equipment be vacated, and, in the event of condemnation, shall provide notice of such
condemnation as described hereinbelow.
(1) The notice of condemnation shall:
(a)
(b)
Be in writing;
Be dated and signed by the Building Inspector or Code Enforcement Officer;
(c) Specify the condition or activity that serves as the basis for the notice of
condemnation and violates the Uniform Code, FCNYS, PMCNYS, or Schenectady
City Code;
(d) Specify the provision or provisions of the Uniform Code, FCNYS, PMCNYS, or
Schenectady City Code which is/are violated by the specified condition or activity
and serves as the basis for the notice of condemnation;
(e) Specify the period of time which the Building Inspector or Code Enforcement
Officer deems to be reasonably necessary for achieving compliance;
(f) Direct that compliance be achieved within the specified period of time; and
(g) State that an action or proceeding to compel compliance may be instituted if
compliance is not achieved within the specified period of time.
(2) The Building Inspector or Code Enforcement Officer shall cause the notice of
condemnation, or a copy thereof, to be served on the owner of the affected property
personally or by first-class mail. The Building Inspector or Code Enforcement Officer
shall be permitted, but not required, to cause the notice of condemnation, or a copy

thereof, to be served on any builder, architect, tenant, contractor, subcontractor,
construction superintendent, or their agents, or any other person taking part or assisting
in work being performed at the affected property personally or by first-class mail;
provided, however, that failure to serve any person mentioned in this sentence shall not
affect the efficacy of the notice of condemnation.

(3) Posting of notices of condemnation. Whenever the Building Inspector or Code
Enforcement Officer makes a determination pursuant to the provisions of this article, as
may be prescribed by law, or the Schenectady City Code that a structure and/or
equipment is unsafe, unfit for occupancy or must be vacated (the “determination”), the
Building Inspector or Code Enforcement Officer shall place a notice or placard on such
structure and/or equipment stating that the structure and/or equipment is unsafe, unfit for
occupancy or must be vacated (the “notice”), and that notice shall:

Identify with specificity each immediate hazard to life or health that is the basis
for the determination or the posting of the notice;
Identify the date on which the notice was posted on the structure (the “posting
date”);
Identify all conditions that must be repaired, remedied or corrected, the date by
which each condition must be repaired, remedied or corrected, and each and
every penalty for failure to repair, remedy or correct each condition;
(d) State that any owner, tenant or occupant of the structure may challenge the
determination by requesting a hearing before the Mayor’s Designee (the
“hearing”), so long as the hearing is requested no later than 3:00 p.m. on the
third day after the notice is posted and dated if served in person on the
Schenectady City Clerk; or 4:00 p.m. on the third day after the notice is posted
and dated if served by facsimile or email on the Schenectady City Clerk; state that
the written request for the hearing may be delivered by hand, facsimile or email
to the Schenectady City Clerk; identify the address, facsimile number and email
address for service of such request; and shall state that a request for hearing
shall identify the address, telephone number(s) and email address, if any, of the
person requesting the hearing and the reasons or grounds for the appeal.
In addition to posting the notice on the structure, the Code Enforcement Officer
shall provide the notice to all tenants or occupants of the structure by either
affixing the notice to the door of each unit in the structure in which any tenant or
occupant may reside or placing the notice under the door of each such unit; make
an attempt to hand-deliver a copy of the notice to any person who is present in or
at the structure at the time of posting; and mail the notice to the owner(s) of the
structure on the same business day as the notice is posted at the address listed on
the tax roll for the City of Schenectady.

(4) Mandated procedures upon posting of a notice.
(a) The hearing will be held at the Schenectady City Hall, 105 Jay Street,
Schenectady, New York, within five business days of the City Clerk’s receipt of the
request for the hearing, unless adjourned for good cause or the person requesting

the hearing and the Mayor’s Designee agree otherwise. Persons requesting the
hearing shall be notified of the date and time of the hearing at least 24 hours in
advance of the hearing date by a notice sent to the person requesting the hearing
at the address provided by said person pursuant to Subsection C-1(3)(d) above.
If the Building Inspector or Code Enforcement Officers explains the
circumstances requiring posting at the hearing, he/she shall provide any person
requesting the hearing with all available documentation or information

concerning the determination. The person requesting the hearing will be afforded
an adequate opportunity to present statements and other evidence regarding the
need for the posting and to suggest alternatives. Persons attending the hearing
may be represented by counsel.
No determination that the structure is unsafe, unfit for occupancy or must be
vacated will be confirmed unless the Mayor’s Designee determines that it has
been demonstrated that the determination is necessary to protect owners, tenants
or occupants from an immediate threat to health or safety. Absent confirmation by
the Mayor’s Designee who is present for the duration of the hearing, the
determination shall be vacated. Upon a confirmation of the determination, the
Mayor’s Designee shall also issue written findings and conclusions confirming,
modifying, or otherwise setting forth all conditions that must be repaired,
remedied or corrected, and the date by which each condition must be repaired,
remedied or corrected, which findings and conclusions shall be mailed to the
owner of the structure at the address provided to the City taxing authority and to
the person requesting the hearing at the address provided in the request for a
hearing.
(d) Neither the City of Schenectady nor any of its Building Inspector or Code
Enforcement Officers shall order or direct the removal of any personal property
from a structure to which a notice has been posted unless the Building Inspector
or Code Enforcement Officer makes a determination that such personal property
constitutes a hazard to any owner, tenant or occupant of the structure. The City is
not responsible for any property remaining in the structure.
(e) Notwithstanding the provisions of this Subsection C-1, all occupants, tenants,
landlords or their agents shall comply with any and all federal and State laws and
local municipal laws or regulations, including but not limited to the Uniform
Code and the Schenectady City Code.
(f)
FT
The procedures set forth in this Chapter, shall apply to any action of the Code
Enforcement Officer under §137-3 of the Code of the City of Schenectady
requiring a structure to be vacated as being unsafe or unfit for occupancy,
pursuant to §138-30.

Councilmember offered the following:
A Resolution Declaring the City Council as the Lead Agency for the State Environmental
Quality Review (SEQR) and Opening a Thirty-Day Public Comment Period Regarding the
Rezoning of Barrett Street and South Avenue
WHEREAS, the Department of Development is requesting the rezone of approximately
3.91 (+/-) acres of land from “R-2” Two-Family to the “C-4” Downtown zoning district. The

area encompasses the land between Barrett Street and Seward Place with the northern boundary
being South Avenue; and
WHEREAS, the area is currently zoned as “R-2” Two-Family, which restricts the ability
to use said land through the allowable uses and dimensional constraints related to density and
setbacks. This area is directly adjacent to the “C-4” Downtown and shares many of the same
characteristics of the neighboring zoning district; and
RA
WHEREAS, of the existing properties in this area, seven of them do not conform with
the allowed uses, six of them are vacant land, and 23 parcels comply with the allowed uses.
Regarding dimensional requirements and lot standards, only six parcels currently comply, while
24 parcels do not. Changing the zoning from “R-2” to “C-4” would bring these properties into
compliance and would allow for properties that are currently vacant land to be built on and
enhance the development of the area; and
WHEREAS, the current zoning district changes mid-block, which can lead to confusion

and makes creating a comprehensive development strategy more difficult. The area proposed for
a zoning change is directly adjacent to the following zoning districts: “C-4” Downtown to South
and West, “R-2” Two-Family to the North and “I” Institutional to the East (Union College
Campus):
NOW, THEREFORE BE IT,
RESOLVED, that the City Council hereby designates the City Council of the City
Schenectady as the Lead Agency for the purpose of completing the State Environmental Quality
Review; and be it further
RESOLVED, that upon the filing of a Short Environmental Assessment Form, a thirty-
day public comment period shall be commenced allowing all concerned parties and members of
the public to offer their comments to the Lead Agency.

A Resolution Accepting $13,000 Grant Award to Create Historic Design Guidelines
WHEREAS, New York State Office of Parks, Recreation & Historic Preservation
(OPRHP), through the Certified Local Government program, awarded the City a grant of
$13,000 to procure services for the creation of the Historic Design Guidelines; and

WHEREAS, these guidelines will provide information and guidance for residents in any
of the five (5) locally designated historic districts on: general information of the architectural
styles present in each district, the types of projects that require review and approval by the
Historic District Commission, the process for applying to the Historic District Commission for
approval, and the types of physical building treatments considered appropriate or prohibited as
they relate to the standards of historic preservation; and

WHEREAS, the required match of $1,685 will come in the form of staff and
commissioner time contributed to the project:

WHEREAS, the purchase of four (4) Packers (6 wheel/16 yard) and a Street Sweeper is

WHEREAS, delaying the purchase of said equipment until the sale of the 2022 BAN to
place the orders for this equipment, may delay the delivery of the equipment for at least 18 months;

Councilmember offered the following:
A Resolution Authorizing the Mayor to Enter into an Agreement with Saratoga Associates
for Design Services Related to the Construction of a New Pool at Central Park
Implementing American Rescue Plan Act (ARPA) Funds
WHEREAS, in 2021, the City received American Rescue Plan Act (ARPA) funds from
the federal government. A portion of this funding is requested to be used for the replacement of a
pool at Central Park; and
FT
WHEREAS, the existing 56,300 square feet pool within Central Park, adjacent to
Iroquois Lake does not meet current code compliance and has become a complex maintenance
facility for the City. Additionally, given the pool’s size and geometry, it is difficult for lifeguards
to monitor, thereby creating a potential liability; and
RA
WHEREAS, the City seeks to contract with Saratoga Associates Landscape Architects,
Architects, Engineers, and Planners, P.C. (Saratoga Associates) to evaluate and design a new
pool complex at Central Park in a location at or adjacent to the former tennis stadium; and
WHEREAS, the process will include coordination to determine the size, shape, and
features desired at the new pool facility, as well as pool amenities including a bathhouse,
grounds, access ways, parking, and integration into Central Park as a whole. For these services,
the City has received a design proposal from Saratoga Associates in the amount of $450,000:

enter into an agreement with Saratoga Associates in the amount of $450,000 for the design of a
new pool complex at Central Park, using ARPA funds, the terms of said agreement to be set by

A Resolution Authorizing a 2021 Budget Reallocation Related to an Agreement between
City of Schenectady and CSEA for Retroactive Payments for 2020 and 2021
WHEREAS, in October 2021, the City Council authorized a collective bargaining
agreement with City CSEA Local 1000 AFSCME, AFL CIO Unit # 8501 that contained
retroactive payments back to 2020 and 2021. The City did not appropriate settlement of this
contract in the 2021 Budget; and

WHEREAS, in accordance with Governmental Accounting Standards, the 2020 and
2021 payments must be disclosed and charged to the 2021 fiscal year; and
WHEREAS, the 2020 and 2021 payments were recently disbursed, pursuant to the
collective bargaining agreement with CSEA. In accordance with Governmental Accounting

Standards, it is recommended that that the attached budget re-appropriation be approved using
ARPA Loss revenue:

A Resolution Authorizing a 2022 Budget Reallocation Related to an Agreement between

WHEREAS, in October 2021, the City Council authorized a collective bargaining
agreement with City CSEA Local 1000 AFSCME, AFL CIO Unit # 8501 that contained
payments back to 2020 through 2024 the City did not appropriate settlement of this contract in
the 2022 Budget; and

WHEREAS, in accordance with Governmental Accounting Standards, the 2022
payments must be disclosed and charged to the 2022 fiscal year; and
WHEREAS, the 2022 payments are being disbursed, pursuant to the CSEA Agreement.

Program Funds of $40,000.00 from Prevention and Rapid Rehousing ESG-CV2 to
Emergency Shelter ESG-CV for YWCA NorthEasternNY
WHEREAS, HUD Emergency Solutions Grants COVID-19 (ESG-CV) Programs funds

are authorized by Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public
Law 116-136; and
WHEREAS, these special ESG-CV funds are to be used to prevent, prepare for, and
respond to the coronavirus pandemic (COVID-19) among individuals and families who are
homeless or receiving homeless assistance, and to support additional homeless assistance and
homelessness prevention activities to mitigate the impacts of COVID-19; and
RA
WHEREAS, the City of Schenectady, Cares of New York, Inc., and YWCA
NorthEasternNY (YWCA) agree to work together for this project. This request is to increase
funding of $40,000.00 to Emergency Shelter for domestic violence victims; and
WHEREAS, due to COVID-19, there has been an increase in stress-related violence and
a staffing crisis at the YWCA. The YWCA will use ESG-CV Emergency Shelter funds for
personnel cost and on-call rotation to support direct care staff at the shelter, a main point of entry
for clients receiving services:

A Resolution Recognizing Black History Month 2022
WHEREAS, this year’s theme for Black History Month is Black Health and Wellness; and
WHEREAS, Black History Month first originated as part of an initiative by writer and educator Dr. Carter
G. Woodson, who launched Negro History Week in 1926. During Black History Month and throughout the year,
we reflect on more than 400 years of Black American history in communities across the country; and
FT
WHEREAS, the 2022 theme focuses on the importance of Black Health and Wellness. This theme
acknowledges the legacy of not only Black scholars and medical practitioners in Western medicine, but also other
ways of knowing including, doulas, midwives, naturopaths, herbalists, etc., throughout the African Diaspora; and
WHEREAS, in an effort to foster good health and wellness, Black people embarked on self-
determination, mutual aid and social support initiatives and built hospitals, medical and nursing schools like
Meharry Medical College, Howard University College of Medicine, Provident Hospital and Training School and
RA
Morehouse School of Medicine, to name a few. Community clinics were established by individuals and grassroots
organizations including Carver Health Center in Schenectady, now known as Hometown Health Center; and
WHEREAS, initiatives to help decrease disparities have achieved several outcomes, including having
more diverse practitioners and representation in all segments of the medical and health programs; and
WHEREAS, the COVID-19 pandemic has underscored the social and racial injustice and inequity of
public health. It has shown that health equity is still not a reality as COVID-19 has unequally affected Black

people and many racial and ethnic minority groups; and
WHEREAS, the CDC has stated that by ensuring health equity is integrated across all public health
efforts, all communities will be stronger, safer, healthier, and more resilient:
NOW, THEREFORE BE IT,
RESOLVED, that the Mayor, Gary R. McCarthy, and the Schenectady City Council do hereby pause in
their deliberations to recognize the month of February 2022 as “Black American History Month” in the City of
Schenectady and are committed to supporting public health policies and programs centered around specifically
promoting health equity and to work together to eliminate any disparities which impact the health of all ethnic
minority groups.
