Councilmember offered the following: A Resolution Requesting Governor Hochul Sign into Law Assembly Bill A-1007 and Senate Bill S-2021 Authorizing Municipalities to Reduce the Speed Limit to Twenty-Five Miles Per Hour D WHEREAS, research shows that faster driving speeds correlate to more serious injuries RA and fatalities for pedestrians in the event of an accident; and WHEREAS, the faster a vehicle is travelling, the less time its driver will have to see a pedestrian in the road and stop and the less time a pedestrian will have to react; and FT WHEREAS, according to the AAA Foundation for Traffic Safety, a pedestrian struck by a vehicle going 25 miles per hour has a 25 percent risk of sustaining a serious or fatal injury, a 50 percent risk at 33 miles per hour, and a 75 percent risk at 41 miles per hour; and WHEREAS, a 2018 Insurance Institute for Highway Safety study found that lowering the speed limit by five miles per hour on city streets improves safety outcomes for motorists, pedestrians, and bicyclists by reducing the incidence of speeding; and WHEREAS, since New York City lowered its speed limit in 2014 from 30 miles per hour to 25 miles per hour, the number of traffic related fatalities declined 23 percent overall; and WHEREAS, under current state law, the default maximum speed limit throughout a municipality may not be set lower than 30 miles per hour; and WHEREAS, two bills have been introduced in the New York State Legislature, A-1007 in the Assembly and S-2021 in the Senate, to afford municipalities the option to set its maximum speed limit at 25 miles per hour; and 4  WHEREAS, granting municipalities the authority to lower its speed limits to 25 miles per hour will help decrease fatalities and the severity of injuries that can result from speed- related accidents; and WHEREAS, the New York State Senate passed bill S-2021 and the New York State Assembly passed A-1007, which grants municipalities the authority to lower its speed limits to 25 miles per hour; and WHEREAS, now, the legislation is before Governor Hochul for enactment: NOW, THEREFORE BE IT, RESOLVED, that the City Council declares support for Assembly Bill A-1007/Senate Bill S-2021, which will authorize municipalities, including the City of Schenectady, to reduce their speed limits to twenty-five miles per hour, and requests that Governor Hochul enact the legislation. Corporation Counsel 7  CITY COUNCIL SCHENECTADY, NEW YORK RESOLUTION NO. Councilmember offered the following: A Resolution Allocating $20,000 CDBG-CV3 funding to Feed Albany, Inc. WHEREAS, throughout the COVID-19 pandemic, Feed Albany, Inc. and the Schenectady Police Department have been coordinating to provide food to residents of the City of Schenectady; and WHEREAS, as of June 30, 2022, the funding to provide the meals in the City of Schenectady will be exhausted; and D WHEREAS, on September 11, 2020, the City of Schenectady received $619,061 of CDBG-CV3 funding, and one eligible use of that funding is to provide food and assist with food security within the RA City; and WHEREAS, due to the rapid cost in food and the continued effects of the COVID-19 pandemic, food security is still a serious concern for City residents; and FT WHEREAS, the City of Schenectady has $25,000 in contingency from CDBG-CV3 funding, and the request is for $20,000 of that contingency funding be used to continue the services of providing meals: NOW, THEREFORE BE IT, RESOLVED, that the City Council authorizes the allocation of $20,000 of CDBG-CV3 funds for the purposes stated hereinabove; and be it further RESOLVED, that the City Council authorizes the Mayor or his designee to execute any necessary agreements with Feed Albany, Inc. to effectuate this resolution, the terms of such agreements to be set by Corporation Counsel. WHEREAS, the City of Schenectady has contracted with the Boys and Girls Clubs of Schenectady, Inc. for a number of years for the operation of City-owned swimming pools, which includes the provision of lifeguard staffing; and WHEREAS, the City seeks to again contract with the Boys and Girls Clubs of Schenectady, Inc. WHEREAS, in the 2018-2019 Annual Action Plan, the City of Schenectady allocated $150,000.00 to Miracle on Craig Street of Schenectady, Inc. for the rehabilitation of the former Carver Community Center; and WHEREAS, to advance the rehabilitation project, Miracle on Craig Street of Schenectady, Inc. Councilmember offered the following: A Resolution Authorizing the Issuance of Revocable Permit No. 671 to Bear & Bird Boutique + Gallery LLC for a Sign that Will Encroach the City’s Right-of-Way at 160 Jay Street, Schenectady, New York WHEREAS, Bear & Bird Boutique + Gallery LLC would like to install a sign that will encroach the City’s right-of-way at 160 Jay Street, Schenectady, New York; and D WHEREAS, the City Engineer recommends the issuance of a permit for the sign; and WHEREAS, said revocable permit shall be subject to standard conditions that include, RA but are not limited to, the required indemnification of the City for any and all lawsuits stemming from the installation of these items, securing and maintaining liability and casualty insurance, and the maintenance of the encumbrance on City property; and WHEREAS, said permit shall be subject to revocation at the discretion of the City FT Engineer: NOW, THEREFORE BE IT, RESOLVED, that the City Engineer is hereby authorized to issue Revocable Permit No. 671 to Bear & Bird Boutique + Gallery LLC for the sign that will encroach the City’s right- of-way at 160 Jay Street, Schenectady, New York, subject to the following conditions: 1. Bear & Bird Boutique + Gallery LLC shall hold the City, its employees, or agents harmless for any damage to the sign resulting from their acts in performing their duties; and 2. Bear & Bird Boutique + Gallery LLC shall carry, at their expense, public liability insurance in an amount not less than $1,000,000 for property damage in one accident and $2,000,000 in the aggregate. The liability policy must name the City of Schenectady as additionally insured to be saved harmless for personal liability and property damage and is subject to the approval of the Corporation Counsel of the City of Schenectady; and 3. The City Engineer reserves the power to revoke the permission granted and to require the removal of the sign except in case of a dangerous condition which shall be corrected immediately upon notification; and 15  4. Bear & Bird Boutique + Gallery LLC must comply with all rules, regulations and building permits relating to the erection and maintenance of the sign; and 5. Bear & Bird Boutique + Gallery LLC shall defend, indemnify and hold harmless the City of Schenectady, their officers, agents and employees from, and against, any and all claims, suits, liens, judgments, damages, losses and expenses including reasonable legal fees and costs arising in whole or in part and in any manner from acts, omissions, breach or default of Bear & Bird Boutique + Gallery LLC, or their agents, related to their performance related to this revocable permit; and 6.
