Councilmember offered the following: A Resolution Authorizing an Amendment to the Collective Bargaining Agreement (2019-2024) between the City of Schenectady and Firefighters Local 28 IAFF, AFL CIO Related to Step 8 and Step 10 WHEREAS, the City Council previously authorized a collective bargaining agreement between the City of Schenectady and Firefighters Local 28 IAFF, AFL-CIO (“Local 28”) for the period January 1, 2019 through December 31, 2024 (2019-2024 CBA); and D WHEREAS, prior to execution of the 2019-2024 CBA, the parties discovered a typographical RA error in the longevity for Step 10; and WHEREAS, a discrepancy in the 2015-2018 CBA caused a need for further negotiating between the City and Local 28; WHEREAS, the proposed amendments to the 2019-2024 CBA were memorialized in a FT Memorandum of Agreement, a copy of which is attached to this resolution and incorporated herein; and WHEREAS, the Memorandum of Agreement has been reviewed by the City Council; and WHEREAS, the Local 28 has ratified the Memorandum of Agreement: NOW, THEREFORE BE IT, RESOLVED, that the City Council approves the amendment to the 2019-2024 CBA, as memorialized in the attached Memorandum of Agreement, which is incorporated herein, and authorizes the Mayor to execute the 2019-2024 CBA as amended on behalf of the City. Berlant to the Board of Directors of the Land Reutilization Corporation of the Capital Region WHEREAS, the City of Schenectady is a member of the Land Reutilization Corporation of the Capital Region, also known as the Capital Region Land Bank; and WHEREAS, Schenectady City Code Section 72-3 states that the Board of Directors shall consist of an odd number of members, not less than five nor more than 11, serving three-year D terms; and RA WHEREAS, said section also requires that individual members of the Board must be residents of the City of Schenectady and either a member, employee, or contractor of the City or a community leader with appropriate experience in banking, finance, real estate, community or economic development, law, or a related field; and FT WHEREAS, a vacancy currently exists that may only be filled in the same manner as the original appointment, namely appointment by the City Council; and WHEREAS, after careful deliberation and consideration, the City Council wishes to reappoint Joseph T. Councilmember offered the following: A Resolution Authorizing the Mayor to Enter into a Revocable License Agreement with Indira Persaud and Sewnarine Persaud for Erection and Maintenance of a Handicapped Accessible Ramp and a Patio within the City’s Right-of-Way at 1570 State Street WHEREAS, Indira Persaud and Sewnarine Persaud have been rehabilitating the building on the corner of State Street and Myrtle Avenue and identified as SBL 50.77-1-21; and D WHEREAS, in order to comply with the Americans with Disabilities Act (ADA) RA requirements, Indira Persaud and Sewnarine Persaud seek a long-term license from the City to erect and maintain a handicapped accessible ramp for building access and for a patio, all located in the City’s right-of-way: WHEREAS, the revocable license agreement will provide the use of approximately five FT (5) feet of the City’s right-of-way on both State Street and Myrtle Avenue; and NOW THEREFORE BE IT, RESOLVED, that the City Council authorizes the Mayor to enter into an agreement with Indira Persaud and Sewnarine Persaud granting a revocable license for the erection and maintenance of a handicapped accessible ramp and a patio in approximately five (5) feet of the City’s right-of-way along State Street and Myrtle Avenue; and be it further RESOLVED, the location and form of the erection of the ramp and patio in the City’s right-of-way is subject to approval by the City Engineer; and be it further RESOLVED, that the revocable license agreement shall provide a 50-year term with the ability of license renewal, a requirement that the licensee restore the area for which the license was granted to the condition the area had been at the time of the agreement’s execution upon any revocation or expiration of the license agreement, insurance and indemnification provisions for the benefit of the City, and any other such terms, conditions, and restrictions as may be justified in the City Engineer’s expert professional opinion, or the Corporation Counsel. 13 Approved as to form this 11th day of July 2022. __________________________ Andrew B.
