Councilmember offered the following: RESOLVED, that the City Council will conduct a public hearing in relation to: Amending Section of Section 228-19 of the Schenectady City Code Regarding Notices Requiring Sidewalk Repairs or Corrections. FT Said Public hearing shall be held on Monday, December 9, 2024, at 7:00 p.m. at Council Chambers, Room 209, Schenectady City Hall, 105 Jay Street, Schenectady, New York – for the purpose of receiving public comment relative to the proposed amendment to Section 228-19, Chapter 228 of the Schenectady City Code to include the Building Inspector and their designees to inspect sidewalks; and be it further RESOLVED, that the City Clerk shall have the following notice published in the appropriate manner: RA NOTICE OF PUBLIC HEARING Amending Section 228-19 of the Schenectady City Code Regarding Notices Requiring Sidewalk Repairs or Corrections. On Monday, December 9, 2024, at 7:00 p.m., the Schenectady City Council shall conduct a public hearing in relation to the above-referenced matter. Corporation Counsel FT RA D 6 CITY COUNCIL SCHENECTADY, NEW YORK RESOLUTION NO. Councilmember offered the following: FT A Resolution Supporting an Application for the RESTORE NY Round 9 Grant WHEREAS, the New York State Legislature in the 2024 State budget included the "Restore New York's Communities Initiative" grant program ("RESTORE NY"); and WHEREAS, such program provides municipalities with financial assistance for the revitalization of commercial and residential properties and further encourages community RA development through the elimination and redevelopment of blighted structures; and WHEREAS, the City of Schenectady is in support of the submission of a funding application to Empire State Development Corporation (ESDC) requesting $1.5 million in RESTORE NY funding for the proposed rehabilitation of a vacant 400,000 square foot building located at 600 McClellan Street, to provide housing and childcare, (the "Project"); and WHEREAS, since matching funds are being provided by the private developers involved in the project and the proposed combination of private and public financing is appropriate for the Project; and D WHEREAS, a properly noticed and advertised public hearing was held on November 12, 2024, and all comments and testimony submitted have been duly considered by this Council; and WHEREAS, it is hereby determined to be in the best interest of the City of Schenectady to apply for funds from the RESTORE NY program for rehabilitation, reconstruction and demolition projects to eliminate blight and spur economic development in our City; and WHEREAS, the City Council does hereby support the findings of facts as completed by Metroplex Development Authority: l. The proposed Project is consistent with the goals of the City's 2020-2024 Comprehensive Plan; 2. The proposed financing is appropriate for the Project; 7 3. The Project facilitates effective and efficient use of existing and future public resources to promote both economic development and preservation of community resources; 4. The Project develops and enhances infrastructure and other facilities in a manner that will attract, create, and sustain employment opportunities. THEREFORE, IT IS HEREBY RESOLVED, that the Schenectady City Council authorizes the Mayor to take the necessary actions and execute all documents necessary to apply for available RESTORE NY Communities Initiative grant funding in an amount not to exceed $1.5 million; and be it further RESOLVED, that the Chairman or his designee of the Metroplex Development Authority is authorized to take all actions and execute all documents necessary to effectuate the foregoing resolution. Councilmember offered the following: A Resolution Authorizing the Sale of 28 Moyston Street for $25,000.00. FT WHEREAS, it is in the best interest of the City of Schenectady to sell parcel numbered SBL # 49.34-2-21; and WHEREAS, there is no municipal use for the property: NOW, THEREFORE BE IT, RESOLVED, the City Council authorizes the Mayor to enter into a contract to transfer RA the title of parcel numbered SBL # 49.34-2-21 to Rajindra and Chandra Kumar and/or assign for the sum of Twenty Five Thousand Dollars ($25,000.00); and be it further RESOLVED, that the terms of the contract for sale to an Owner-Occupant Buyer shall contain a clause requiring that purchaser pay $500 at closing for building, electrical, plumbing and other applicable permits, that rehabilitation of the property begin within thirty days of the purchase, and that total rehabilitation of the property, requiring compliance with the State Building Code and securing appropriate building permits with necessary inspections be completed within one year of purchase, as well as any other terms deemed necessary by the Corporation Counsel. FT WHEREAS, it is in the best interest of the City of Schenectady to sell parcel numbered SBL # 49.40-4-42; and WHEREAS, there is no municipal use for the property: NOW, THEREFORE BE IT, RESOLVED, the City Council authorizes the Mayor to enter into a contract to transfer RA the title of parcel numbered SBL # 49.40-4-42 to Kevin Lall and/or assign for the sum of Eighty Five Thousand Dollars ($85,000.00); and be it further RESOLVED, that the terms of the contract for sale to an Owner-Occupant Buyer shall contain a clause requiring that purchaser pay $500 at closing for building, electrical, plumbing and other applicable permits, that rehabilitation of the property begin within thirty days of the purchase, and that total rehabilitation of the property, requiring compliance with the State Building Code and securing appropriate building permits with necessary inspections be completed within one year of purchase, as well as any other terms deemed necessary by the Corporation Counsel. FT WHEREAS, it is in the best interest of the City of Schenectady to sell parcel numbered SBL # 49.40-1-24.1; and WHEREAS, there is no municipal use for the property: NOW, THEREFORE BE IT, RESOLVED, the City Council authorizes the Mayor to enter into a contract to transfer RA the title of parcel numbered SBL # 49.40-1-24.1 to Yadho N. Khamai and Shelly Mahadavie Khamai and/or assign for the sum of Five Thousand Dollars ($5,000.00); and be it further RESOLVED, the terms of the contract for sale to an Investor Buyer shall contain a clause requiring that purchaser pay $500 at closing for building, electrical, plumbing and other applicable permits, that construction of a home on the property begin within thirty days of the purchase, and that total rehabilitation of the property, requiring compliance with the State Building Code and securing appropriate building permits with necessary inspections be completed within one year of purchase, as well as any other terms deemed necessary by the Corporation Counsel. FT WHEREAS, it is in the best interest of the City of Schenectady to sell parcel numbered SBL # 39.81-3-21; and WHEREAS, there is no municipal use for the property: NOW, THEREFORE BE IT, RESOLVED, the City Council authorizes the Mayor to enter into a contract to transfer RA the title of parcel numbered SBL # 39.81-3-21 to Raed Alzindani and/or assign for the sum of Seven Thousand Dollars ($7,000.00). Councilmember offered the following: A Resolution Approving Issuance of Change Order No. 2 and the Increase of Jiwan Construction Inc.’s Current Contract with the City of Schenectady for the Steinmetz Lake Wall Restoration FT WHEREAS, the City Council approved a contract with Jiwan Construction, Inc. in the amount of $158,001 for the work of installing new precast concrete panels and repointing sections of the Steinmetz Lake Wall; and WHEREAS, the City’s purchasing policy all change orders above 25% value of the original contract must be approved by City Council and the two (2) change orders combined for Jiwan’s contract are over the 25% threshold; and NOW, THEREFORE BE IT, RA RESOLVED, the City is authorized to approve change order no. 2 for the Steinmetz Lake Wall Restoration, in the amount of $38,280.00 to bring the total amount of this contract to $217,694.00; and be it further RESOLVED, that the Commissioner of Finance charge the cost and expense of this extra work to the ARPA code set up for the Steinmetz Park improvements. Councilmember offered the following: A Resolution Awarding the Bid and Contract for the Rental of Portable Toilets and Showers. FT WHEREAS, this there is a construction project at the City of Schenectady Police Department Headquarters that requires the rental of Portable Toilet and Shower Trailers during the construction process; and WHEREAS, the City of Schenectady’s Purchasing Agent solicited and received two bids for “Portable Toilet and Shower Rentals” with TentSouth LLC, 3242 Glenn McConnell Parkway, Suite 107, Charleston, South Carolina, submitting the low bid in the amount of $5,934.00 per month for a term of four months with the option to extend at the same price for an additional four months for a total of eight months; RA NOW THEREFORE BE IT, RESOLVED, that the City Council, acting as a Board of Contract and Supply under C5-9 of the City Charter, confirms and ratifies issuance of a contract to TentSouth LLC; and IT IS FURTHER RESOLVED, that the Mayor or his designee is authorized execute the contract identified hereinabove, the terms of which shall be set by the City Purchasing Agent in cooperation with the Corporation Counsel.
