The current ordinance is amended to add Section 182-8 to set forth the process of a Sound Permit Application. Section 2. Section 264-4 (Zoning Map of the City of Schenectady), as amended, it is further amended by changing the zoning classification of the following parcels that constitute the former St. Clare’s Hospital to Multiple-Family Residential District (R-3) and that said parcels are identified on the Schenectady Tax Map as follows: 49:36-3-70.11; 50.37-1-49.1; 50.37-1-49.2; 49.36-3-67; 49.36-3-66; 49.36-3-65; 49.44-3-1; 49.44-3-2 and 49.36-3-70.2 (Cushing Center). Councilmember offered the following: A Resolution Authorizing the Mayor to Accept $305,718.00 in Statewide Targeted Reductions in Intimate Partner Violence (STRIVE) Award Monies for the Schenectady Police Department. FT WHEREAS, the New York State Division of Criminal Justice Services (DCJS) has awarded the Schenectady Police Department, in combination with the Schenectady County District Attorney’s Office, the Schenectady County Sheriff’s Department, the Schenectady County Probation Department and the YWCA of Schenectady a Statewide Targeted Reductions in Intimate Partner Violence (STRIVE) award in the total amount of $1,177,640.00 for the contract period of April 1, 2025, through March 31, 2026; and WHEREAS, the Schenectady Police Department, as agreed upon by the parties, will receive $305,718.00 to contribute two (2) dedicated detectives, a half time Crime Analyst, overtime funding, RA and reimbursement for cellular phones per the attached schedule; and WHEREAS, the acceptance of the STRIVE monies will allow for an increase in the amount the Schenectady Police Department’s 2025 budgeted police officer count from 167 to 168 officers; and NOW, THEREFORE BE IT RESOLVED, that the Mayor is hereby authorized to execute any and all agreements necessary to effectuate the acceptance of $305,718.00 in STRIVE award monies from DCJS; and IT IS FURTHER RESOLVED, that the 2025 Operating Budget is amended to reflect the acceptance of STRIVE award monies and to increase the police officer count from 167 to 168 officers. Councilmember offered the following: A Resolution Authorizing authorizing the Mayor to sign the Collective Bargaining Agreement (CBA) (2024-2026) between the City of Schenectady and the International Union of Operating Engineers (IUOE) Local Number 158 FT WHEREAS, the City Council previously authorized a Collective Bargaining Agreement (CBA) between the City of Schenectady and the International Union of Operating Engineers (IUOE) Local number 158 which expired on December 31, 2024; and WHEREAS, the parties have negotiated the terms of a three-year CBA for the period January 1, 2025 through December 31, 2027; and WHEREAS, the terms of the 2025-2027 CBA were memorialized in a Memorandum of Agreement, a copy of which is attached to this resolution and incorporated herein; and RA WHEREAS, the Memorandum of Agreement has been reviewed by the City Council; and WHEREAS, the IUOE Local 158 has ratified the Memorandum of Agreement: NOW, THEREFORE BE IT, RESOLVED, that the City Council approves the CBA, as memorialized in the attached Memorandum of Agreement, which is incorporated herein, and authorizes the Mayor to execute the 2025-2027 CBA on behalf of the City. WHEREAS, the 2024 inaugural season of the City pool in Central Park drew large numbers of FT people wanting to enjoy the pool; and WHEREAS, the Schenectady City Council expects the pool seasons to continue to be very busy in 2025 and beyond; and WHEREAS, the City Council hereby adopts a residency and guest policy for use of the Central Park Pool for the summer of 2025, said policy attached hereto and incorporated by reference; and RA NOW, THEREFORE, BE IT RESOLVED, the Schenectady City Council does hereby adopt the attached residency and guest policy regarding the use of Central Park Pool. Councilmember offered the following: Authorizing the implementation, and funding in the first instance 100% of the federal-aid and State "Marchiselli" Program-aid eligible costs, of a transportation federal-aid project, and appropriating funds therefore for the Schenectady Park Connector Expansion, NYSDOT PIN 1762.37 WHEREAS, a Project for the Schenectady Park Connector Expansion, P.I.N. 1762.37 (the FT “Project") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratio of 80% Federal funds and 20% non-federal funds; and WHEREAS, as provided for by agreement with the NYS Department of Transportation, PE and/or ROW Incidental or ROW acquisition work performed by the municipality for the federal aid- eligible construction project covered by the agreement, the costs of such work that are approved in writing by NYSDOT as applicable to the federal aid and Marchiselli aid construction work (excluding costs applicable to non-federally eligible or non-Marchiselli eligible project elements) shall be credited following FHWA's construction phase closeout audit of the Project to Project costs that are eligible for RA federal aid and Marchiselli aid; and WHEREAS, the City of Schenectady desires to advance the Project by making a commitment of 100% of the non-federal share of the costs of Preliminary Design & Detailed Design. further NOW, THEREFORE, the City Council, duly convened does hereby RESOLVE, that the City Council hereby approves the above-subject project; and it is hereby RESOLVED, that the City Council hereby authorizes the City of Schenectady to pay in the first instance 100% of the federal and non-federal share of the cost of Preliminary Design & Detailed Design D work for the Project or portions thereof; and it is further RESOLVED, that the sum of $190,000.00 (One hundred, ninety thousand dollars) is hereby appropriated from select capital budget codes and made available to cover the cost of participation in the above phase of the Project; and it is further RESOLVED, that in the event the full federal and non-federal share costs of the project exceeds the amount appropriated above, the City of Schenectady shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the NYS Department of Transportation thereof; and it is further RESOLVED, that the Mayor of the City of Schenectady be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or Marchiselli Aid on behalf of the City if Schenectady with the New York State Department of Transportation in 55 connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and permanent funding of the local share of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible; and it is further RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project; and it is further RESOLVED, this Resolution shall take effect immediately Approved as to form this ___ day of April 2025. __________________________ Maxine L. Councilmember offered the following: A Home Rule Message Requesting the State of New York Allowing the City of Schenectady to Implement a Red-Light Camera Demonstration Program (Senate Bill S. 5676 and Assembly Bill A. 7690). FT WHEREAS, an area of significant concern to the City and its inhabitants is public safety, especially that safety related to travel on our City streets – be it by vehicle, by bicycle, by foot, or other legal means; and WHEREAS, the City is seeking to stop drivers who tear down our City streets at speeds far in excess of the posted limits and who fail to stop at red lights; and RA WHEREAS, an effective solution is for the City to use red light cameras; and WHEREAS, a study by the Insurance Institute for Highway Safety found that cameras reduced the fatal red light running crash rate of large cities by 21% and the rate of all types of fatal crashes at signalized intersections by 14%; and WHEREAS, studies by the Insurance Institution for Highway Safety indicate that six to eight D months after cameras were introduced on roadways in Maryland, Arizona, and the District of Columbia, the proportion of drivers exceeding speed limits by more than 10 mph declined by 70%, 88%, and 92%, respectively; and WHEREAS, for the City to implement these devices under the current state legislative scheme, the State legislature must pass legislation to explicitly allow the City of Schenectady to use these devices for these purposes. In the past, State legislation has been structured as “demonstration programs” for 83 specific cities; and NOW, THEREFORE BE IT, RESOLVED, the Schenectady City Council and the Mayor, Gary R. Councilmember offered the following: A Home Rule Message Requesting Amendments to the New York State Real Property and Proceedings Law Requiring Compliance with the City Code related to Rental Residential Property Registration for Eviction Proceedings. (Senate Bill S. 5675 and Assembly Bill A. 7653). FT WHEREAS, the Schenectady City Code prohibits the owner of a rental unit to allow occupancy unless the rental unit has a valid rental certificate or a temporary rental certificate, which may be obtained through submission of an application and the unit passing a safety inspection to ensure code compliance; and RA WHEREAS, enforcement of the provisions of the City’s rental registration requirements is challenging since it is difficult for the City’s code enforcement officers to determine when a residential unit is occupied by someone other than the owner; and WHEREAS, many times, tenants of rental units may withhold rent to get their landlords to remediate unsafe conditions. This may lead to landlords seeking eviction in court; and WHEREAS, to better protect renters by ensuring their housing is safe through more effective D enforcement of the rental certificate provisions of the City Code, the City is seeking enactment of state legislation requiring lessors seeking to evict tenants from premises to allege proof of compliance with a local law requiring the registration of the premises as a condition of legal rental; and WHEREAS, state legislation similar to that found in New York State Real Property Actions and Proceedings Law Section 741, will support compliance with the City Code for landlord registration and rental certificates, thus better protecting tenants from unsafe and unhealthy living conditions: 85  NOW, THEREFORE BE IT, RESOLVED, the Schenectady City Council and the Mayor, Gary R.
