The Council of the City of Schenectady in regular meeting convened, ordains as follows: Section 1. Purpose and Intent: To prevent unlicensed therapeutic services under the guise of health and RA wellness. To properly ensure Massage Parlors are held to required licensing standards and to prevent the exploitation of vague and misleading business classifications that facilitate human trafficking, prostitution and unlicensed therapeutic services. BUSINESS CERTIFCATES OF USE § 183-3Purpose. The purpose of this article is to establish regulatory controls to ensure that certain businesses are operated in accordance with law, do not have a serious negative impact upon surrounding residential neighborhoods or FT do not endanger the health, safety or welfare of persons in the City of Schenectady. Section 2. Section 183-4 of the Schenectady City Code is Amended as follows: § 183-4Definitions. As used in this article, the following terms shall have the meanings indicated: BANQUET FACILITY A premises as defined by § 264-2 of the City of Schenectady Zoning Ordinance. BAR D A premises where alcoholic beverages are sold for consumption on the premises; or a premises operated for profit or pecuniary gain or as a place of assembly where alcoholic beverages are provided by the operator of the premises, their agents or employees, or are brought onto said premises by persons assembling there. BUSINESS A banquet facility, bar, cannabis and/or tobacco retail and consumption business, convenience store, drugstore, massage parlor private club or lodge, restaurant, or second dealer store as defined herein. CANNABIS OR TOBACCO RETAIL AND CONSUMPTION A premises where cannabis, cannabinoid, nicotine, or tobacco products are sold for consumption on the premises; or where these products, or related paraphernalia, are the primary source of income at retail. Such premises include cannabis or tobacco retail stores, smoke 3 shops, vape shops, hookah lounges, consumption lounges and the like. CONVENIENCE STORE A retail outlet with a total floor space less than 10,000 square feet, which stocks a range of everyday items, a list of which may include, but is not limited to, groceries, snack foods, candy, toiletries, soft drinks, and newspapers. DRUGSTORE A premises where prescription drugs are sold at retail, together with dry goods, food or beverages. MASSAGE PARLOR RA A premises as defined by Section 177-1 of the Schenectady City Code PRIVATE CLUB OR LODGE A premises as defined by § 264-2 of the City of Schenectady Zoning Ordinance and where food or alcohol are sold for consumption on the premises, or are provided by the operator of the premises, their agents, or employees, or are brought onto said premises by persons assembling there. RESTAURANT FT A premises where food is sold to be consumed on the premises. This definition shall not include a premises where a nonalcoholic beverage or snack is available but is incidental to the conduct of the business at the premises. SECONDHAND DEALER STORE Any retail outlet which conducts business which requires a secondhand dealer's license, as defined by Chapter 217 of this City Code. § 183-5Certificate of use required. No person shall operate or maintain a business within the City without first having obtained a certificate of use authorizing the operation of said business by said operator at the specific business location D Section 3 Section 264-2 of the Schenectady City Zoning Code is amended to add the following definition: Section 264-2 Massage Parlor premises as defined by Section 177-1 of the Schenectady City Code. Section 4. This Ordinance shall take effect immediately. New language underlined and highlighted. 4  D 5 RA FT Draft Ord: An Ordinance to amend Chapter 183, Article II, Section 183-6 of the Code of Ordinances to Clarify Requested Information and to Delete Certain Background Reports. The Council of the City of Schenectady in regular meeting convened, ordains as follows: Section 1. Purpose and Intent: To update and clarify information requested for owners and operators for the Business Certificate of Use Application. RA Section 2. To Amend Certain Sections 183-6 of the Schenectady City Code are amended as follows: Article II. Business Certificates of Use Section 183-6. Application for Certificate of Use. A. An application for a certificate of use shall be made to the office of the Building Inspector on forms prescribed by the Corporation Counsel. The application shall request relevant information relating to the operator and the business to be conducted at the premises, including but not limited to the existence of FT necessary licenses and permits for the business. For purposes of the application, all contact addresses and telephone numbers provided by the applicant must include the home address and telephone number of the applicant and any managing or operating agent, owner or principal in any partnership or joint venture that will own or operate the business. The application must in every instance include the following: (1) Identity and contact information for the owner of the premises, including street address and telephone number; (2) If the business owner and/or operator is not the owner of the proposed business premises, a lease agreement between the owner and the business operator; (3) Identity and contact information for all business owners(s), operator(s), principal(s), agent(s) and manager(s), including street address and telephone number for each such person; (4) A detailed description of the nature and scope of the business, including but not limited to the number of D anticipated employees and patrons on a daily basis, the provisions being made for firesafety, security, parking, deliveries and waste disposal; (5) Copies of documentation identifying all owners and operators of the business[,]: including passport[,] or driver's license[,]or immigration or citizenship records[,]. [tax registration and identification certificates for the business and any owner or operator;} (6) Certified copies of any relevant business status filing, including doing business as or assumed name certificates, certificate of incorporation, limited-liability partnership or corporation certificates and filings; (7) [(Reserved)] Tax registration and tax identification certificates for the business and any owner or operator. 6 (8) Evidence of liability insurance in a sum not less than $500,000; (9) The identity, address and account number for all bank accounts utilized in the operation of the business; (10) The name, address and telephone number of two references; (11) [Authorizations permitting the City to conduct background, credit, Dun & Bradstreet, immigration and criminal history checks for any owner or operator;] (Reserved) (12) Documentation required by § 161-21F; (13) A diagram of the premises to be occupied, providing the square footage devoted to the proposed business, the general layout of the business operations, and the location of all emergency and nonemergency RA entrances and exits; (14) Such other information as the Corporation Counsel shall deem relevant and necessary to ensure the protection of the public and the lawful operation of the business and the enforcement of applicable provisions of the City Code. B. The Corporation Counsel shall have the authority to modify and/or waive the application contents of any application for a business certificate of use submitted by any publicly traded corporation or to safeguard proprietary information of an applicant. FT C. Any changes to the information submitted by the applicant shall be reported to the Building Inspector within 30 days of the change. Section 3. This section will take effect immediately. Councilmember offered the following: A Resolution to Install Stop Signs for Up to Two Locations on Kings Road. RA WHEREAS, the City Engineer is authorized pursuant to Schenectady City Code Section 248-11 to install traffic control signs, signals and devices; and WHEREAS, pursuant to Schenectady City Code Section 248-11(N) the Schenectady City Council has identified Kings Road as a roadway in need of traffic control devices, in particular, Stop Signs; and WHEREAS, the City Council has reviewed neighborhood petitions, citizen complaints and on- going traffic studies and traffic enforcement efforts regarding excessive speed on Kings Road; FT NOW, THEREFORE BE IT, RESOLVED, that the Schenectady City Engineer, pursuant to the authority in Section 248-11, “Traffic Regulations, Matters Under the Authority of the City Engineer” will install Stop Signs for up to two locations on Kings Road and that such locations are to be at the determination of the City Engineer. RA Councilmember offered the following: A Resolution Authorizing Settlement of a Mortgage on 39 Robinson Street. WHEREAS, Rajeshwarrie Nankishore-Matadin (“purchaser” herein) purchased 39 Robinson Street as an Owner-Occupied property from the City on June 19, 2018; and WHEREAS, as part of the sale, the purchaser agreed to live on the property for five years; FT WHEREAS, the purchaser is unable to produce sufficient evidence to prove such mandated residency occurred; WHEREAS, in order to avoid litigation, the Schenectady City Council wishes to resolve the amount due on the relevant mortgage for $10,000 in settlement of the $20,000 plus interest owed; The settlement will include releases of any claims against the City of Schenectady by the parties involved; and NOW, THEREFORE BE IT, RESOLVED, that the City Council hereby authorizes the Corporation Counsel to sign all documents to effectuate the above-identified settlement. RA Councilmember offered the following: A Resolution Amended Resolution No. 2025-165 Extending the Time for Redemption and Withdrawal of 1409 Fifth Avenue from Foreclosure. WHEREAS, on September 8, 2025, the Schenectady City Council passed Resolution No. 2025-165 to authorize the redemption and withdrawal of 1409 Fifth Avenue (SBL# 49.54-1- 13) from a foreclosure action filed by the City, having Index No. 2024-1194; and FT WHEREAS, the current owner is trying to sell the property and wishes to pay the taxes, interest, invoices, and other charges including a $1,000 administrative charge (collectively, the “funds for redemption”) at closing to redeem the property. The settlement also includes releases of any claims against the City of Schenectady by the parties involved; and WHEREAS, said resolution includes a deadline of October 10, 2025 for payment and closing; WHEREAS, the property owner asked for an extension of time to obtain financing; NOW, THEREFORE BE IT, RESOLVED, that the City Council hereby amends Resolution No. 2025-165 to authorize the Office of Corporation Counsel to withdraw the property from the foreclosure action so long as the closing and the funds for redemption are received by November 3, 2025. Councilmember offered the following: A Resolution Recognizing October as Breast Cancer Awareness Month ` WHEREAS, Breast Cancer Awareness Month, held every October, is a global campaign to raise awareness for breast cancer, increase screenings, and provide critical support for patients and survivors. Since 1989, increased awareness through campaigns like this has helped reduce breast cancer deaths in the United States by 44%; and FT WHEREAS, according to the Centers for Disease Control and Prevention, breast cancer is the most common form of cancer among women and the second highest cause of cancer death among women. Although not as common, men can get breast cancer as well. In 2024, an estimated 310,720 women and 2,800 men will be diagnosed with invasive breast cancer; and WHEREAS, while breast cancer incidence rates among Black and white women are similar, mortality rates are markedly different, with Black women having a roughly 40 percent higher death rate from breast cancer. Among women under 50, the disparity is even greater: While young women have a higher incidence of aggressive cancers, young Black women have double the mortality rate of young white women. Advances in early detection and treatment have dramatically reduced breast cancer’s ability to take lives overall, but these breakthroughs have not benefited all groups equally—and this disparity has remained unchanged for more than a decade; and WHEREAS, within October, there are also specific dates designed to raise awareness of D specific groups within the breast cancer community; and WHEREAS, Metastatic Breast Cancer Awareness Day, October 13, is nationally recognized in the U.S. as Metastatic Breast Cancer Awareness Day. About 168,000 women in the U.S. are estimated to have metastatic breast cancer (cancer that spreads beyond the breast to other parts of the body). Researchers estimate that about 30% of early-stage breast cancers eventually metastasize. The day, which began in 2009, is meant to educate the public about the need for more money to go to the study of metastatic breast cancer and the development of new metastatic cancer treatments; and 12  WHEREAS, National Mammography Day is observed annually on the third Friday of every October, during Breast Cancer Awareness Month. This year, it was celebrated on October 17, 2025. National Mammography Day is important because it serves as a reminder and encouragement to women to get screened for breast cancer through receiving a mammogram. When detected early, in the localized stage, the 5-year relative survival rate for breast cancer is 99%, and mammograms are key to the early detection of breast cancer; and WHEREAS, while much more common in women, breast cancer affects men, too. In 2021, President Joe Biden designated October 17 to October 23 as Men’s Breast Cancer Awareness Week. Lack of awareness and stigma can be barriers to detection and care in men, trans men, and RA non-binary people; and WHEREAS, the American Cancer Society says people can help reduce risk of cancer by making healthy choices like eating right, staying active, and not smoking. It is also important to follow recommended screening guidelines, which can help detect certain cancers early; and WHEREAS, there is hope. When caught in its earliest, localized stages, the 5-year relative survival rate for breast cancer is 99%. Advances in early detection and treatment methods have significantly increased breast cancer survival rates in recent years; FT NOW, THEREFORE BE IT, RESOLVED, that the Schenectady City Council and Mayor Gary R. McCarthy, hereby pause in their deliberations to recognize the month of October as Breast Cancer Awareness Month in remembrance of those who have lost their lives to breast cancer and in support of those who are currently fighting this disease and of the more than 4 million breast cancer survivors in the United States. Councilmember offered the following: A Resolution Accepting the Bid and Awarding the Contract for “Craig Street RA Water Main Replacement” to DeJong Brothers Companies, LLC in the amount of $1,472,075.00 WHEREAS given the upcoming multi-million-dollar complete streets project expected to commence in Spring of 2026 on Craig Street, the City examined all underground utilities within the corridor; and WHEREAS, upon examination it was recommended that the existing watermain be replaced prior to the start of the complete streets project; and FT WHEREAS, the City of Schenectady’s Engineering Department solicited and received bids for the “Craig Street Water Main Replacement” with a low bid in the amount of $1,472,705.00 received from DeJong Brothers Companies, LLC of Broadalbin, NY. NOW THEREFORE BE IT, RESOLVED, that the City Council, acting as a Board of Contract and Supply under Section C5-9 of the City Charter, confirms and ratifies the acceptance of the bid and the awarding of the contract to DeJong Brothers Companies, LLC of Broadalbin, NY, for the “Craig Street Water Main Replacement” in the amount of $1,472,075.00; and IT IS FURTHER RESOLVED that the Mayor or his designee is authorized to execute the contract identified hereinabove, the terms of which shall be set by the City Engineering Department in cooperation with the Corporation Counsel.
