Evaluation/Analysis: Recommendation: LEGISLATION WILL BE PREPARED BY_____ ________________ 15  CITY COUNCIL SCHENECTADY, NEW YORK ORDINANCE NO. _________________ Councilmember offered the following: An ORDINANCE amending Chapter 186 of the Administrative Code of the City of Schenectady regarding a permit to serve alcohol in Central Park. BE IT ENACTED by the Council of the City of Schenectady, in regular meeting convened, as follows: § 186-6. Disorderly conduct; use of alcoholic beverages. A. No drunken, noisy, disorderly or publicly offensive person shall be allowed to remain in the parks, and no intoxicating or spirituous liquors shall be allowed in the parks except by special permit or lease of the Central Park Casino and in no event other than between the hours of 1:00 p.m. to 9:00 p.m., except as may be permitted or allowed in the hours of operation of the Casino by its lease. [Amended 5-6-1996 by Ord. No. 96-26] B. Special permits allowing alcoholic beverages in the parks may be issued at the discretion of the Mayor and only to charitable and not-for-profit organizations as specified by Section 501(c)(3) of the Internal Revenue Code, or to anyone seeking to hold a private celebration, where there is no charge to attend, which is not open to the public, and pursuant to the applicable rules and regulations of the New York State Liquor Authority and upon evidence of adequate insurance and such other conditions as may be required as to protect the health, welfare and safety of the public., as determined by Corporation Counsel. The fee for a permit under this subsection shall be set from time to time by resolution. C. An applicant shall be entitled to only one such permit in any calendar year. 16 This Ordinance shall take effect upon its execution by the Mayor. Evaluation/Analysis: Recommendation: LEGISLATION WILL BE PREPARED BY_____ ________________ 18  CITY COUNCIL SCHENECTADY, NEW YORK ORDINANCE NO. _________________ Councilmember offered the following: An ORDINANCE amending Chapter 228 of the Administrative Code of the City of Schenectady regarding a permit to close a public street to hold an event where alcohol will be sold. BE IT ENACTED by the Council of the City of Schenectady, in regular meeting convened, as follows: § 228-1. Use of streets and sidewalks in front of places of business. Except in formal action of the Council of the City as hereinafter stated or the Signage and Sidewalk Merchandise Review Committee as set forth in Chapter 223, no owner or occupant of any premises in the City shall erect or suffer to remain in or upon the street or sidewalk in front of or on any side of such premises any sign poles, bootblack stand, bicycle rack, stepping block or canopy, nor shall anyone be permitted to carry on any business or trade upon any sidewalk, stoop or porch in said City, nor shall any sign or advertisement be inserted in or placed on the surface of any sidewalk. A. An owner or operator of a business may apply for a permit to temporarily operate their business in the street or sidewalk, for the purpose of selling alcohol or for a purpose related to the sale of alcohol. Permits under this subsection require compliance with all the applicable rules and regulations of the New York State Liquor Authority, evidence of adequate insurance, and such other conditions as may be required as to protect the health, welfare and safety of the public, as determined by the Corporation Counsel. The fee for a permit under this subsection shall be set from time to time by resolution.
