Smith SUBJECT: Outstanding Emergency Demolition Costs Background Information: There have been several instances wherein a privately-owned building catches fire; leaving unsafe structures that constitute a danger to the public. In order to fulfill its obligations to the public welfare, the City orders the demolition of the property and pays for it directly. However, under General Municipal Law $78-b, the City has a cause of action to pursue the costs of the demolition against the owner of the property at the time of the fire. Under General Municipal Law $78-b, the City Council, as the governing body of the City, must decide to allow for the initiation of legal proceedings against the property owners, a decision which must be expressed through a formal resolution Recommendation: The Law Department recommends that the City Council immediately draft legislation that provides the Corporation Counsel's Office with the authority to litigate these claims under General Municipal Law $78-b.
