minimum clearance of 14.5' on the front of the building at 50 North Jay Street, Schenectady, NY.
b) Hunters On Jay shall hold the City, its employees or agents harmless for any damage to the Sign
resulting from their acts in performing of their duties.
c) So long as the Sign remains in the City right-of-way, Hunters On Jay shall carry, at THEIR expense
public liability insurance in an amount not less than $l,000,000/$1,000,00O for personal liability
and not less than $1,000,000 for property damage in one accident and $2,000,000 in the
aggregate. The liability policy must the name City of Schenectady as additionally insured to be
saved harmless for personal liability and property damage and is subject to the approval of the
Corporation Counsel of the City of Schenectady.
d) The City Engineer of the City of Schenectady reserves the power to revoke the permission
granted and to require the removal of the Sign except in case of a dangerous condition which
shall be corrected immediately upon notification.
e) Hunters On Jay complies with all rules, regulations and building permits relating to the erection
and maintenance of the Sign.
f) Hunters On Jay agrees to defend, indemnify and hold harmless the City of Schenectady, their
officers, agents and employees from any and against any and all claims, suits, liens, judgments,
damages, losses and expenses including reasonable legal fees and costs arising in whole or in
part and in any manner from acts, omissions, breach or default of Dr. Todd Periera, Optometrist,
or their agent, related to their performance related to this revocable permit.

SUBJECT: Outstanding Emergency Demolition Costs
Background Information:
There have been several instances wherein a privately-owned building catches
fire; leaving unsafe structures that constitute a danger to the public. In order to fulfill its
obligations to the public welfare, the City orders the demolition of the property and pays
for it directly. However, under General Municipal Law $78-b, the City has a cause of
action to pursue the costs of the demolition against the owner of the property at the time
of the fire.
Under General Municipal Law $78-b, the City Council, as the governing body of
the City, must decide to allow for the initiation of legal proceedings against the property
owners, a decision which must be expressed through a formal resolution
Recommendation:
The Law Department recommends that the City Council immediately draft
legislation that provides the Corporation Counsel's Office with the authority to litigate
these claims under General Municipal Law $78-b.

Back~roundInformation:
The NYS Division of Homeland Security and Emergency Sen7ices(DHSES) provides
fiinding to municipalities through the State Homeland Security Grant Program (SHSP),
The grant application was prepared by the Capital District Urban Area Working Group
(UAWG) which represents Albany, Rensselaer, and Schenectady Cities and Counties.
The City of Schenectady Police Department is the recipient of a portion of the grant in
the amount of $127,294. The funds are to be used for the refkrbishing of the Department's
former Communications room into an Emergency Operations Center (EOC). The EOC
shall also house the Cities/Counties neighborhood camera program.
Funding will be used to purchase such items as teleconference computer technology;
camera monitoring system (LCD rnonitors/camera projection system); SMART podium
& screen; computers and related equipment.
The hnding period is 9/1/2014 through 8/31/2016. There is no match required by the
City.
Recommendation/Action
The Police Department recommends acceptance of this Homeland Security grant award.

1am pleased to inform you that City of Schenectady has been awarded $1 27,294 under the FY2014
State Homefand Security Program (SHSP). As per Federal guidelines, 25 percent of the total awarded to
the Albany-Scheneetady-Troy urban area must be directed towards law enforcement terrorism
prevention activities as outlined in your consensus agreement letter dated April 30,2014 (attached).
These activities should be consistent with the efforts of your 1oca.I Counter Terrorism Zone (CTZ).
In my letter to you on April 9,2014 1outlined the following State priorities these grant funds are
intended to sustain or enhance: Sustainment and Advancement of Effective Programs and Systems;
Sustainment and Advancement of Regional Partnerships; Development of Catastrophic Planning
Capabilities; Sustainment and Advancement of Interoperable Comrnuaications Systems; and
Development of Citizen Preparedness Capabilities.
The performance period for this grant is 24 months (September 1,2014 through August 3 1,201 6).
Given this short period of performance on this grant, it is imperative that you execute your projects as
quickly as possible. My grants management staff have prepared the contract for these funds which will
be transmitted to you electronically via our E-Grants System I ask that you expedite your local
administrative process to be able to accept the f h d s and request that the contract is electronically signed
in a timely manner.
