The IBEW Labor Agreement authorizes retroactive payments back to 2013. The City had contemplated settlement of its open Labor Agreements when developing its 2015 Budget based on the progress of negotiations known when the 2015 Budget was being developed. Final settiements differed from the projected Payroll Contingency 2015 Budget amounts, therefore, after recowition of the CSEA and Trades 2015 pay increases, the 2015 Payroll Contingency Accounts have been exhausted. However. at the end of 2014 certain payroll liabilities were set up in each Fund wherein IBEW salaries exist that will help support any payment made to IBEW members as a result of the newly executed agreement. IBEW employees exist in the City's General Fund and its Sewer Fund. The value of the Signing Bonus, 2013 and 2014 Retro payments due IBEW employees is $12,089.19 -- $8,166.50 in General Fund and $3,922.69 in Sewer Fund. The award is granted by New York State through the Department of Criminal Justice Services (DCJS). The grant application is a partnership between the Schenectady Police Department, Schenectady County District Attorney's Office, Schenectady County Probation Department and the Schenectady County Sheriffs. The total grant award is $8 18,654, with the Schenectady Police Department receiving $365,028. Please see the attached budget summary for a detailed breakdown of funding received by the Police Department, as well as fbnding received by our partner agencies. The grant requires no match by the City of Schenectady. Recommendation: The Police Department recommends acceptance of the GIVE grant. WITNESSETH WHEREAS, the Federal Gov ent has enacted the National Affordable Housing Act (NAHA), the primary ob~ectiveof which is to increase the supply of decent affordable housing to low and very low income families, which created the Home Investment Partnerships Program (HOME Program) administered by the U.S. Department of Housing and Urban Development (HUD) through regulations at Title 24, Code of Federal Regulations, Part 92 (HOME reelationsj; and WHEREAS, said regulations allow units of general local governments to fitm consortia for the purposes of obtaining funds under the HOME Progam; and WHEREAS, Schenectady, Troy, and Colonie are geographically contiguous units of local government and, thereby, eligible to form a consortium under said regulations; and WHEREAS, the Parties have statutory authority under the laws of the State of New York and sufficient administrative capabilities to carry out the purposes of the HOME program on behalf of their respective ju~sdietions;and WHEREAS, in Au~wst1991, the Palrlies detemined that continuing as a consortium would increase the level o f HOME Program hnds potentially available for use within their combined ju~sdictions,and thereby increase the coanbined ability of the blunicipal Gorl~orationsto assist in meeting the afhrdable housing needs of the population; and WHEREAS, the Federal Law allows for the Pafiles to enter into a consoaium agreement for each thee-year qualification period and to agree to automatically renew that relationship prior to the successive qualification period: and WHEREAS, the Parlies desire to continue to receive the benefits o f a Consortium Ageement: XOiV THEREFORE, the parties agree as foliowrs: 31 SECTION I: GENERAL PROVISIONS a. The Members agree to cooperate to undertake housing assistance activities in compliance with the Federal HOME stabte and regulations as identified in Title 24, Part 92 of the Code of Federal Regulations. b. The Members agree to direct their activities to the alleviation of housing problems within their respective jurisdictions. e. The Members agree to undertake the efforts to affirmatively advance the cause of fair housing. d. Troy and Colonie hereby authorize Schenectady to act as the Consortium's Representative Member and/or Lead Entity for the purposes of administer;ing the HOME progam. e. Scbenectady, as a metropolitan city defined by the GDBC statute? has the administrative capacity to carry out the purposes of the HOME program. f. Schenectady, as the lead entity, assumes the overall responsibility for ensuring that the Consortium's HOME program is carried out in compliance with the requirements of the HOME proGarn, including requirements concerning the Consortium Agreement. g. The Parties agree to distribute all hnds obtained under this program using the foIlowing formula: Schenectady 5096, Troy 40%, and Colonie 10%, representing the annual HOME consortium allocation. h. For the purposes of this Agreement, the Program Year begins on July 1,2015 and ends on June 30, 2016, and continues on annual basis from those dates for the duration of this Agreement. h. SECTION 3: TERLCZ OF AGREEhlENT a. This Agreement shall remain in full force and effect &om the date of execution and approval by HUD for the period necessary to carry out all activities knded during the three (3) federal fiscal years: 2015, 2016, and 2017. Members are prohibited &om withdrawing from this Agreement during the fbll three (3) year period. b, The Consortium Agreement must, at a minimum, remain in effect until the HOME h n d s received during each of the federal fiscal years of the qualification period, and each successive qualification period for which the Ageement i s renewed, are eqended on eligible activities or returned to HUD. 6. Automatic Renewal Provisions: I. The Parties agree that this ageement shall be renewed, automatically, for b e Consortium's participation in successive qualification periods of three (3) federal fiscal years each after the expiration of the current qualification period and continuing hereafter. 2. If a Consortium MernberiParty to this Agreement decides not to participate in the Consortium for the next qualification period, the Consortium Member shall notify Schenectady at least 60 days prior to the beginning of the new qualification period Schenectady will notify the I-IUD Field Office prior to the beginning of the new qualification period. 3. Before the beginning of each new qualification period, Schenectady shall submit to the HUD Field Office a statement of whether or not any amendments have been made to this Agreement, a copy o f each amendment to this Ageement. and, if the Consofiiurn's rnerrnbership has changed, the slate eefiifieakion required under 224 CFR Part 9 20 2 The Gonsclrlium shall adopt any arnmdments to this Agreement that are necessary to meet HHUD requirements for consortium ageements in successi.ye qualification pedods. 4. The decision to add new consortium members shall be underlaken based on the unanimous input and consent of all Members. b. Amendment to this Consortium Ageement shall be accomplished only based on the unanimous consent and agreement of its Members. c. The members agree to jointly develop the lanmage of amendments for approval by the governing body of each Member.
