TO BE PLACED ON COUNCil AGENDA OF: January 9, 2017 Background Information: Reynolds Tax Service has an existing planter and would like to replace the sign that will hang over the City right-of-way with a minimum clearance of 8' at 406 Union Street, Schenectady, New York (please see the attached application, picture, and an email from the Planning Dept. and the Historic Commission). Evaluation/Analysis: Attached please find the Revocable Permit Application and the pictures submitted for an awning on the face of the building located at 406 Union Street, Schenectady, NY. Recommendation: Authorize the Issuance of Revocable Permit No. 611 to Reynolds Tax Service for an existing Planter and a Sign that will hang over the City right-of-way with a minimum clearance of 8' at 406 Union Street, Schenectady, New York. Mayor City Engineer REVOCABLE PERMIT NO. 611 The City of Schenectady hereby grants Revocable Permit No. 611 to Reynolds Tax Service for an existing planter and the replacement of a sign that will hang over the City right-of-way with a minimum clearance of 8' at 406 Union Street, Schenectady, New York. a) There is an existing Planter in addition to the replacement of a Sign that will hang over the City right-of-way with a minimum clearance of 8' on the face of the building at 406 Union Street, Schenectady, New York b) Reynolds Tax Service shall hold the City, its employees or agents harmless for any damage to the existing Planter and Sign resulting from their acts in performing of their duties. c) So long as the existing Planter and Sign remains in the City right-of-way, Reynolds Tax Service shall carry, at THEIR expense public liability insurance in an amount not less than $1,000,000/$1,000,000 for personal liability and not less than $1,000,000 for property damage in one accident and $2,000,000 in the aggregate. The liability policy must the name City of Schenectady as additionally insured to be saved harmless for personal liability and property damage and is subject to the approval of the Corporation Counsel of the City of Schenectady. d) The City Engineer of the City of Schenectady reserves the power to revoke the permisSion granted and to require the removal of the existing Planter and the Sign except in case of a dangerous condition which shall be corrected immediately upon notification. e) Reynolds Tax Service complies with all rules, regulations and building permits relating to the erection and maintenance of the existing Planter and the Sign. f) Reynolds Tax Service agrees to defend, indemnify and hold harmless the City of Schenectady, their officers, agents and employees from any and against any and all claims, suits, liens, judgments, damages, losses and expenses including reasonable legal fees and costs arising in whole or in part and in any manner from acts, omissions, breach or default of Reynolds Tax Service, or their agent, related to their performance related to this revocable permit. 3 Office REVOCABLE PERMIT 4 5 6 Sent: #61 fax. 518-382-1050 cell. 518-986-7396 7 CITY OF SCHENECTADY LEGISLATION REQUEST FORM COMMITTEE ASSIGNMENT: (111~v-~~~DATE: December 22, 2017 TO: COUNCIL MEMBERS FROM: Rachael Ward SUBJECT: Amend Resolution #2015-120 Background Information: Schenectady Hardware and Electric Co. was approved to purchase 35 Waldorf Place.
