Restore NY funding can be used for demolition, removal of hazardous materials, and rehabilitation. The intended reuse for all funded properties is strategically placed commercial and residential development that will attract residents and businesses, increase the tax base, and align with the City’s local economic development plans. As required by ESD, properties were selected through a property assessment process to identify parcels and projects that support the City’s Comprehensive Plan and revitalization efforts, and for which site control is secured and financing is in place. The list of proposed project properties will be published in the local paper and will be the topic of a public hearing held on November 13th to assure an opportunity for public comment on the proposed project. Evaluation/Analysis: The Schenectady Restore New York project will expedite redevelopment of the urban core, which is the primary objective of this ESD program. The proposed application will request $2 million in Restore NY funding, and leverages significant public and private investment. Schenectady County Metroplex Development Authority (Metroplex) and private developers will provide required matching funds. Technical assistance and project administration support will also be provided by the Metroplex. Recommendation: It is recommended that the City Council schedule the Call for Public Hearing for the Restore NY project to be held on November 13th, 2017 in anticipation of acting upon a resolution at the regular City Council meeting to be held on November 27th to approve application submission. Smoking: inhaling, exhaling, burning, or carrying any lighted or heated bidis, cigar, cigarette, cigarillos, hookah, kreteks, little cigar, or any other lighted or heated tobacco or plant product intended for inhalation, in any manner or in any form. The act of smoking includes the use of any Electronic Nicotine Delivery System. Tobacco Product: any manufactured product containing tobacco or nicotine, including but not limited to cigarettes, cigars, pipe tobacco, snuff, chewing tobacco, dipping tobacco, bidis, snus, dissolvable tobacco products, and Electronic Nicotine Delivery Devices. However, "Tobacco Product" does not include any product that has been approved by the U.S. Food & Drug Administration, pursuant to its authority over drugs and devices, for sale as a tobacco use cessation product or for other medical purposes and is being marketed and sold solely for that approved use. Section 2: Prohibition of Tobacco Product Use in Outdoor Areas (A) The use of tobacco products is prohibited within 50 feet of buildings owned or operated by the City of Schenectady which are open to the public. Section 3: Other Requirements and Prohibitions (A) No ash can, ashtray, or other smoking waster receptacle shall be placed in any area in which smoking is prohibited by this Chapter. Section 4: Penalties and Enforcement (A) Each instance of Smoking or tobacco product use in violation of this chapter shall constitute a separate violation. For violations other than smoking or tobacco product use, each day of a continuing violation of this chapter shall constitute a separate violation. (B) Causing, permitting, aiding, abetting, or concealing a violation of any provision of this chapter shall also constitute a violation of this Chapter. (C) Each violation of this chapter constitutes a violation subject to a fine of $50. The property is a 1-family, 1.5 story residence. Evaluation/Analysis: The house was sold to petitioner in 2017 for $90,000. A bank assessment was done on June 14, 2017, which assessed the property at $90,000. Considering comparable properties, the Assessment Department Valuation is $110,000.
