New York State Archives requires local governments to adopt the LGS-1 between August 1st, 2020 and January 1, 2021 to continue to legally destroy records. The LGS-1 indicates the minimum length of time that local government officials must retain their records before they may be disposed of legally. It consolidates and revises Records Retention and Disposition Schedules CO-2, MU-1, MI-1, and ED-1. It has been prepared and issued by the State Archives, State Education Department, pursuant to Section 57.25 of the Arts and Cultural Affairs Law, and Part 185, Title 8 of the Official Compilation of Codes, Rules and Regulations of the State of New York. The purposes of this Schedule are to:  ensure that records are retained as long as needed for administrative, legal and fiscal purposes;  ensure that state and federal record retention requirements are met;  ensure that records with enduring historical and other research value are identified and retained permanently; and  encourage and facilitate the systematic disposal of unneeded records. The LGS-1 provides a single, consolidated resource for all types of local governments to consult to determine the retention period for records they create. There are no longer separate retention schedules for different types of local governments. By consolidating 6 7 multiple, disparate retention schedules, this schedule helps to ensure consistent retention and disposition guidance for records that are common to multiple types of local governments. This consolidated Schedule also facilitates modifications to retention periods when there are changes to laws, regulations or other mandates that affect retention. LGS-1 supersedes and replaces Schedules CO-2, MU-1, MI-1, and ED-1, previously issued by the State Archives. The consent of the Commissioner of Education to use these schedules is withdrawn, and they may not be used to dispose of records. The governing body must utilize this Retention and Disposition Schedule for New York Local Government Records in order to dispose of any records. Evaluation/Analysis: On October 5, 2020, The Capital Region Land Bank received bids for demolitions in the City of Amsterdam and the City of Schenectady. This bid included two properties, 1052 Barrett Street and 1062 Barrett Street, totaling $53,000. Due to funding limits, The Capital Region Land Bank requested that the City of Schenectady provide CDBG funds to assist in covering the cost of these demolitions. Utilizing the Capital Region Land Bank will save the city the cost of Air Monitoring and will ensure the both properties get demolished in a timely manner. Recommendation: The City Council authorizes the Mayor to enter into an agreement with the Capital Region Land Bank for $53,000 to utilize CDBG Demolition funds for the demolition of 1052 Barrett Street and 1062 Barrett Street. Evaluation/Analysis Recommendation Friday, October 16, 2020 25 26 26 27 27 28 28 29 29 30 30 31 CITY OF SCHENECTADY LEGISLATIVE REQUEST FORM COMMITTEE ASSIGNMENT: DATE: October 19, 2020 TO: City Council FROM: Andrew Koldin, Corporation Counsel SUBJECT: Amending City Code §167 Background Information: In conjunction with the Mayor’s Office, Building Department, and Development Department, along with legal recommendations from outside counsel, the Law Department is proposing changes to those portions of §167 of the Schenectady City Code related to the vacant building registration. The proposed changes better addresses practical issues for determining who is required to register a vacant building, when a vacant building is required to be registered, and what is required for the registration. Since a change to the City Code is required for the proposed request, the Law Department is seeking that the Committee pass the legislative request for a call for a public hearing in order for the public to review the proposed changes to the City Code and provide feedback on those proposed changes. Evaluation/Analysis: The proposed changes will allow the involved Departments to be better address the issues related to vacant properties across the City which have a negative impact on the neighborhoods in which they are located. Amendments to the City Code require a public hearing to allow members of the public to review the proposed changes and provide feedback of those proposed changes. Recommendation: Pass the legislative request for the City Council to call for a public hearing on amendments to Schenectady City Code §167. Included in the Cooperation Agreement was a property located at 1058 Crane Street. Evaluation/Analysis: The Land Reutilization Corporation of the Capital District has invested significant resources into the Crane Street Cooridor. To support these investments and to assist with the continued development of the Crane Street Cooridor the Land Reutilization Corporation of the Capital District has requested for 1058 Crane Street to be transferred to them.
