I. CALL TO ORDER
Commissioner Gleason called the meeting to order at 6:30 p.m.
After calling the meeting to order, Commissioner Gleason explained to the members
of the public how the consideration of the applications would proceed. He stated that
the applicants would have an opportunity to make their presentation to the Board,
followed by any members of the public who would like to speak in favor of the
application. Next, any members of the public in opposition to the application would
be invited to speak, followed by any further discussion or questions the Board
Members wished to put forth prior to the vote. He added that after the initial
presentation of the proposal the applicant would not be given another opportunity to
comment unless directly questioned by a Board Member. The meeting is being
recorded.

V. APPROVAL OF MEETING MINUTES
The minutes were approved for the December 13th, 2023 meeting. The motion was
made by Commissioner Connelly and seconded by Commissioner Lester.
The motion carried unanimously.
IV. Old Business
V. Applications: New Business
A. Michael Boland and Elizabeth Pitt request a use variance for 1592 Union Street
(tax parcel # 50.32-2-11) located in an R-2 Two-Family Residential District to allow
for the conversion of a single family home into a two family home, pursuant to
Section 264 Schedule A.
Ms. Liz Pitt and Mr. Michael Boland came before the Board to discuss the nature of their use
variance request. It was noted that although the property was in an R-2 district, Schedule A of
the zoning code does not allow for the conversion of existing single family homes into two-
family units, which is why a use variance was needed.
Ms. Pitt detailed that there was a mother-in-law suite on the rear of the property. The suite shared
utilities with the rest of the house, and Ms. Pitt planned on living in that section with Mr. Boland
while renting out the remainder of the house.
Commissioner Keller asked if the applicants had any prior knowledge of the zoning rules
regarding this property before purchasing. The applicants stated that they had multiple
conversations with the City’s Zoning Enforcement Officer and Building Department as well as
their own private attorney, all of whom confirmed that the conversion of a two family house
would be permissible in the R-2 zone.
Ms. Pitt showed an email from the Zoning Enforcement Officer received in January of 2023
stating that the conversion would be permissible. Although this email was sent two weeks after
the purchase of the property, the Board believed this spoke to the nature of conversations had
prior to the property being bought.
After internal discussion, the Board determined that this situation was not self-created as they
had received false information from the City, and the property also met the reasonable return
criteria as the property never would have been purchased if conversion was known to be illegal
and the applicants were financially restrained as a result of not being able to rent out the second
unit.
The Board mentioned that most of this section of Union Street was either two family houses or
houses that had businesses, and therefore the character of the neighborhood would be unaffected
by this approval.
Mr. Connelly read a letter into the record from Sarupinder Singh who owns 1590 Union Street,
and stated that there was no objection to the approval of this use variance.
SEQR RESOLUTION
Commissioner Connelly made a motion to declare the application a Type II SEQR.
Commissioner Lester seconded the motion.
The motion was approved unanimously.
USE VARIANCE APPROVAL
Commissioner Connelly made a motion to grant the use variance as requested. The motion was
seconded by Commissioner Keller.
1. The applicant cannot realize a reasonable return with the current allowed uses
2. The alleged hardship related to the property is unique to the district and
neighborhood
3. The granting of the use variance will not alter the character of the neighborhood
4. The alleged hardship has not been self-created

D. AIKMLB Holdings LLC requests an area variance for 557 Summit Avenue “A”
and “B” (tax parcel # 49.31-3-44.1) to allow for a 16’ and 17.3’ rear setback where
25’ is the minimum, pursuant to Section 264 Schedule C.
Mr. Damien Pinto-Martin came forward as the representative for AIKMLB Holdings to
discuss the 77 requested variances. Mr. Pinto-Martin noted for the Board that AIKMLB had
come before the BZA previously for similar variance, but due to changes in their plans they
needed to return.
Mr. Pinto-Martin described that it was important to their project that the houses be subdivided
down the middle, to allow for individual ownership on each half of the house. In working with
the Capital Region Landbank, it became necessary that the properties be subdivided this way
which meant that the front setback variances previously received were no longer applicable.
Additionally, with each parcel being split down the middle only one parcel (557 Summit Avenue
“B”) met the 40 feet of frontage necessary to appease code. Therefore, the rest of the properties
needed frontage variances.
Mr. Pinto-Martin told the Board that subdivision approval had been granted at the most recent
Planning Commission meeting, and besides this one change there were no further differentiations
from the last time the application came before the BZA.
As Commissioner Gleason opened the public comment portion, Ms. Marion Porterfield of 842
Strong Street came forward to ask clarifying questions. Ms. Porterfield identified herself as both
a neighbor to the project as well as President of the City Council, and expressed support for the
project as a whole but questioned the creation of the SBL numbers and when that would happen,
along with the addresses as they were currently listed as “A” and “B” for the subdivided parcels.
Mr. Pinto-Martin said that both of Ms. Porterfield’s concerns were noted and would be addressed
after all approvals were given. The specific mailing addresses had not yet been determined, and
it was likely that the “A” and “B” format would be temporary. Mr. Connelly requested that when
the official addresses were established they be sent to the Department of Development for
official records.
Nobody else from the public spoke, causing Commissioner Gleason to close the public hearing.
As the Board members spoke amongst themselves, they agreed that these requests were no
different from what was previously approved, and there was no reason to deny the requests now.
SEQR RESOLUTION
Commissioner Connelly made a motion to declare the application a Type II SEQR.
Commissioner Lester seconded the motion.
The motion was approved unanimously.
AREA VARIANCE APPROVAL
Commissioner Keller made a motion to grant the area variances to agenda items B-ZZZ as
requested. Seconded by Commissioner Connelly.
1. The changes sought by the applicant will not produce an undesirable change to
the neighborhood
2. The area variance is the only reasonable method of achieving the applicant’s goals
3. The variance is substantial, however will not detract from the character of the
neighborhood
4. There will be no adverse effect on the physical or environmental nature of the
neighborhood
5. The hardship is self-created but should not detract from these variances
The motion was approved unanimously.
VI. Other Business
VII. Adjourn 7:23 p.m. motion made by Commissioner Connelly and seconded by
Commissioner Keller.
