Law Director William Ondrey Gruber stated that the Board of Appeals is comprised of eight members: five regular and three alternate. All of them are appointed to two-year terms which are staggered and must be confirmed by Council. Last year Anne Williams was appointed to fill the unexpired term of Earl Williams upon his departure from Council, and named as chairperson. This appointment is for a regular two-year term. Arun Kottha and Nathaniel Hall have both been members for many years and are willing to serve another term. Patti Barz, Kim Bixenstine and Earl Williams all have terms which expire at the end of next year. Law Director William Ondrey Gruber stated that there are five members of the Fair Housing Review Board and three are citizen members appointed by the Mayor and confirmed by Council to three-year terms. Council member Ms. Carmella Williams is the chairperson and Mayor’s designee so her term is indefinite. Council member Mr. Claytor is the Council representative for a two-year term. Sacara Miller and Earl Williams are the two citizen members. Ann Millette is a long time member who is willing to serve another three-year term. It was moved by Mr. Claytor, and seconded by Ms. Carmella Williams to confirm the Mayor’s appointment to the Fair Housing Review Board of Ann Millette as a citizen member for a three-year term (2025 - 2027). Council Meeting December 16, 2024 Page 218  * * * * Ordinance No. 24-103, by Mr. Claytor, administrative acceptance of the approval of the City Planning Commission and confirmation of the granting of a conditional use permit for the Kingdom Palace Learning Center as a child day care center at 3625 Lee Road, pursuant to Section 1213.05 of the City’s Zoning Code. Planning Director Joyce Braverman stated that this item is for a conditional use permit for Kingdom Palace child day care center. Child day care centers require a conditional use permit and Council confirmation. It was approved by the City Planning Commission with the following conditions: the playground be open during daylight hours only; the parking lot striping be completed per a prior approval; rear landscaping be completed per a prior approval; a rear fence section be added to enclose the playground; the playground fence is four feet tall, open wood picket fence; that evergreen landscaping be provided in front of the fence; and a gravel walkway be repaved with concrete or asphalt. This day care center is proposed to have up to 75 children, infant to school age, Monday thru Friday, from 6:00 a.m. to 12:00 midnight. A variance was also granted for the playground to be in the side yard, which does not require Council action. This item is requested as an emergency with a suspension of the rules so the child day care center may begin the build out of the space. Council member Mr. Malone stated that this item was reviewed and approved by the City Planning Commission. In the last year or two a convenient store was approved in that location which never opened. The landscaping was approved at that time, and this new owner has agreed to do those landscaping improvements. There was discussion about the adjacent school district property to make sure there was adequate access to parking. Some 10 or 15 years ago there was a day care at this same location so there is a precedent. Police Commander John Cole stated that this item is for a grant to be used to assist with personnel and equipment costs. The City applied for this grant as the operator and fiscal agent for First CALL. This has been an awesome program for the Shaker Heights Police Department and the community. Council member Ms. Anne Williams stated that this item was reviewed and unanimously supported by the Safety and Public Works Committee. Council member Mrs. Nancy Moore stated that this item was reviewed and unanimously supported by the Finance Committee. The only question was whether referrals for follow-up are accompanied by a person from the Shaker Heights Police Department. They only go in after everything has been secured for safety. Mayor Weiss added that we continue to find funding for this program which is good news and will continue to pursue funding in the future. Building and Housing Director Kyle Krewson stated that the City has been using CitizenServe since 2019 to modernize processes including customer service; whether it’s for licensing, permitting or other activities. Staff would like to continue the relationship with CitizenServe and expand the platform. This item extends the services for the next three years. There are 4900 members of the community that use the platform currently; and 30 staff members using it almost daily. All Building and Housing functions are on the platform as well as other functions within other departments. We pay $1,200 per user and we are looking to expand the service to other departments. There are also one-time integration costs anticipated for further expansion of the platform. The system has allowed us to streamline processes with a significant benefit to staff and to the community. This item is requested as an emergency with a suspension of the rules in order to immediately integrate the Public Works high grass program in preparation for the upcoming season. Council member Mr. Claytor stated that this item was reviewed and approved by the Neighborhood and Economic Development Committee. They are happy about the improved efficiencies, and having more options for people to access information. Council member Mrs. Moore stated that this item was reviewed and unanimously supported by the Finance Committee. This is important and they are looking forward to bringing Public Works into the operation. Chief Administrative Officer Jeri E. Chaikin stated that Senior Transportation Connection (STC) provides transportation for a number of seniors in Cuyahoga County. Our City has been part of the regionalized program since 2005. When we joined the services and stopped providing them ourselves we saved $150,000 in staffing costs plus the costs of buying vans and making repairs although this is still not an inexpensive program. STC has just gone through a strategic planning process and starting this year will be working to upgrade technology, their vans and staffing particularly, providing a decent wage to the van drivers so the organization can keep van drivers. This agreement proposes a 3% increase for next year although we are going to look to increase marketing services to seniors. We find it hard to believe that only 100 Shaker residents take advantage of this program. We have many seniors in the City who could be using this service. Ms. Chaikin stated that she is the chair and a board member of STC appointed by the Cuyahoga County Mayors and Managers Association, and as approved by Council resolution a number of years ago. The Recreation Committee suggested increased marketing of the program. Council member Mr. Malone stated that this item was reviewed and unanimously approved by the Recreation Committee. The hope is in future years we will see an expansion of this program to some other surrounding cities which don’t currently participate that could reduce costs for our residents in addition to serving more people in the community. Finance Director John Potts stated that this item is a clean-up ordinance to amend appropriations for 2024. Throughout the year we keep an eye on all funds in addition to all expenditures for departments. At the end of the year it may be necessary to adjust some appropriations to ensure funds are positive at year’s end. If there are changes needed within individual departments between personal services or other expenses this ordinance will address it. It is budget neutral so it will have no impact on what was approved by Council at this time last year. There are some additional transfers we would like to make in 2024, like the $1.7 million capital fund transfer, which resulted from the surplus this year. Internal service funds usually require some advances which will be paid back after the beginning of the year. This item is requested as an emergency with a suspension of the rules. Human Resources Director Sandra Middleton stated that this item is to adopt a 2025 classification and pay plan for non-bargaining employees. Exhibit 1 outlines the full complement of positions within the City and Exhibit 2 is the pay plan which was updated for 2025 to include a 2.25% cost of living adjustment (COLA) as part of the 2025 General Fund operating budget. In 2024 several positions were added, a few were modified to reflect the current work being done in a particular position, and three positions were eliminated being confident we no longer need those positions. The pay plan also continues the 6% separation between each range. This item is requested as an emergency with a suspension of the rules so that non-bargaining employees may receive their well-deserved COLA on January 1, 2025. Human Resources Director Sandra Middleton stated that this item is to adopt a classification and pay play for seasonal employees who are primarily working in the Recreation Department. A base pay is proposed to comply with the Ohio minimal wage that is increasing to $10.70 from $10.45. A lot of jobs were added and we increased wages to stay competitive coming out of the pandemic. We still feel competitive so we only adjusted salaries according to the minimum wage. This item is requested as an emergency with a suspension of the rules so the pay plan may be implemented on January 1, 2025. Finance Director John Potts stated that this item is to appropriate funds for City facilities. The original proposed budget included a solar project within the Police Department for $440,000 and a total construction cost for Fire Station No. 2 of $2.6 million. We reduced the Fire Department private quarters construction and deferred $1.6 million to 2026; removed the solar project from the Police Department; and merged the City Hall/Annex construction to $1.05 million, although it may not be used for the Annex. This item is requested as an emergency with a suspension of the rules to take effect on January 1, 2025. Mayor Weiss clarified that after the last budget meeting, we will re-evaluate whether we still think the Annex is the correct place for additional expansion of office space or whether to build a new building there, or an addition to City Hall. We have combined the items that have been separated out for construction, design, tuckpointing, and the generator to be a placeholder for whatever we decide. It will come back to Council for further conversation before any funds are expended. It was easier to keep the funds in the budget while we continue our analysis. Director Potts stated that the allocation is not in any specific ordinance. However, the funds are currently in the capital budget. The roof will come before Council with the contract, and the appropriation and the solar would come to Council with the contract and appropriation. We transferred enough funds in the capital budget to cover everything proposed tonight and $1.8 million to cover that project. It will be put in an ordinance when it comes before Council. Part of the Fire Department project was pushed to 2026. It is earmarked for the Public Works Service Center roof and solar project. Mayor Weiss expressed thanks and appreciation for everyone involved in this process led by Director Potts. He thanked all the directors for their efforts to put this together, and Council for the lively conversation with completion of another budget by the end of the year. * * * * Motion for Liquor Permit Chic N Batter LLC 20132 Chagrin Blvd. Law Director William Ondrey Gruber stated that this item is for a liquor permit where a former bicycle shop was located on the south side of Chagrin.
