Minutes – December 15, 2016 Mayor Thomas L. Hardesty called the regular council meeting to order at 6:30 pm with the following council members present: Jon Swindler, Shane Suttor, Donna Eaton, Mike Zoeller, Bob Andriot. Absent: Frank Page City Employees Present: Candice Selph, Chief Danny Goodwin, Tom Doyle City Attorney: Steven Gregory, present Invocation – Rev. Tex Selph, Pastor, Waddy Baptist Church All present pledged allegiance to the flag. Minutes/ Special Called Meeting – December 12, 2016 Correction to minutes -Councilmember Shane Suttor expressed a correction needed to be made to the spelling of his last name on the minutes. Councilmember Suttor moved to approve the minutes of the Special Called Meeting of December 12, 2016 as read by the council members prior to the meeting. Seconded by councilmember Swindler. All voted “aye” and the motion carried. Ordinance No. 2016-12-15/An Ordinance Establishing a Revised Schedule of Charges for the Use of the Consolidated Municipal Waterworks and Sewer System of the Shelbyville Water and Sewer Commission- 2nd Reading, Steven Gregory An Ordinance establishing a revised schedule of charges for the use of the consolidated municipal waterworks and sewer system of the Shelbyville Water and Sewer Commission, 2nd Reading, City Attorney Steven Gregory, revising the rate billed beginning March 2017, and that are charged for water and sewer usage beginning in mid- January 2017 to assist the water and sewage commission in the increasing of operating and maintenance costs. Motion for approval of the ordinance for 2nd reading – Councilmember Swindler and 2nd by Councilmember Zoeller. All “aye” and the motion carried. Resolution No. 2016-12-15/A Resolution Authorizing the City of Shelbyville to enter into a Franchise Agreement with Fiber Technologies Network, LLC, Granting a Ten (10) Year, Non- Exclusive Franchise for a Telecommunications System within the City Limits of Shelbyville, Steven Gregory A resolution, read by City Attorney Steve Gregory, authorizing the City of Shelbyville to enter into a franchise agreement with Fiber Technologies Network, LLC, granting a ten (10) year, non-exclusive franchise for a telecommunication system within the city limits of Shelbyville. FiberTech Representatives present: Rebecca Hussey, Mike Prather. Also present was Linda Ain, Outside Council, for the City of Shelbyville. Per Mr. Prather and Ms. Hussey, a 3.5 mile high speed fiber network would run down 7th street and through the city with a couple of cell towers. Councilmember Suttor questioned the financial stability of the company. Based on no financial statements received as of yet from FiberTech, a motion was made by Councilmember Suttor and 2nd by Councilmember Swindler to table. All councilmembers agreed to table the resolution awaiting financial statements for past 3 years and Dun –Bradstreet number which will be submitted to Fred Rogers. This should be on the agenda by next council meeting if information is received timely and reviewed. Ordinance No. 2017-01-05/An Ordinance of the City of Shelbyville Updating the Position Description of City Clerk-1st Reading, Steve Gregory 1st reading of an ordinance updating the job description of the position of City Clerk, removing the financial responsibilities from the position which will be moved to the CFO position was read by Candice Selph, Human Resource Director. Motion for approval of first reading of the ordinance by Councilmember Zoeller, and 2nd by Councilmember Swindler. All voted “aye” and the motion carried. To be placed on the agenda for the January 5 meeting for 2nd reading. Ordinance No. 2016-12-15(A)/An Ordinance of the City of Shelbyville Creating the Position of Chief Financial Officer-2nd Reading, Steven Gregory An ordinance of the City of Shelbyville creating the position of Chief Financial Officer. 2nd reading of the CFO requirements of the position and why this position is being created, explained by Candice Selph, Human Resource Director. The reason for the creation of this position is to have someone able to take care of bank reconciliations, tax management, financial statements, budgets etc. The motion was moved to approve by Councilmember Suttor and 2nd by Councilmember Andriot. All voted “aye” and the motion carried. Ordinance No. 2016-12-15(B)/An Ordinance Amending Chapter 62 of the City of Shelbyville Code Of Ordinances Relating to Alcoholic Beverages-2nd Reading, Steven Gregory An ordinance amending Chapter 62 of the City of Shelbyville Code of Ordinances relating to alcoholic beverages, a 2nd reading, to allow sales of alcohol on Sundays. Chief Goodwin with ABC is present for any questions. Having no questions, a motion is made to approve the ordinance by Councilmember Zoeller and 2nd by Councilmember Swindler. Nays: Councilmember Andriot and Councilmember Eaton. Ayes: Councilmembers Zoeller, Suttor, Swindler. The ordinance passes. Re-appointments, Mayor Hardesty Councilmember Swindler recused himself because of re-appointment to Shelbyville Municipal Water and Sewer Commission Howard Griffith to the Board of Ethics for a 3 year term ending December 31, 2019 Mike Harrod to the Joint City/County Recreation Board for a 4 year term ending December 31, 2020 Jon Swindler to the Shelbyville Municipal Water and Sewer Commission for a 3 year term ending December 31, 2019 Motion to approve the re-appointments by Councilmember Zoeller, 2nd by Councilmember Eaton. All voted “aye” and the motion carries. Clerk will let members know of reappointment. After a 5 minute recess, the meeting reconvened. The Mayor gave special recognition to Shane Suttor for 10 years of service on the city council. He was presented a certificate and named an Ambassador to the City of Shelbyville. Public Comments – None Departmental Reports Candice Selph, Human Resources, said the Christmas Reception went well. 2 new Police Laterals were hired, Holsten and Riner. The process will begin for hiring the new CFO, and will be posted on-line. Police Chief Goodwin said the Celebration of Lights went well. Nativity traffic went smoothly. The three new recruits have 1 month left on their training. There were 1256 dispatched calls for November, crime rate reports down. Staffing is now at 100%. Overtime going down as far as shift coverage. There are 28 officers on staff at this time. Mayor’s Report – The mayor said City government will be closed December 23rd and 26th and also January 2nd. Shelby County Fire Department breakfast is tomorrow morning. On a positive note: School kids went to local businesses for a field trip which was a very positive for the city. Councilmember Suttor expressed his thanks to everyone and the support of the council in his time of serving. A motion to adjourn was made by Councilmember Suttor. 2nd by Councilmember Swindler.
