Council Minutes – September 21, 2017 The Regular Council Meeting of the City of Shelbyville was called to order by Mayor, Thomas L. Hardesty at 6:30 pm with the following councilmembers present: Bob Andriot, Troy Ethington, Donna Eaton, Jon Swindler, Mike Zoeller and Frank Page. City Attorney: Steven Gregory City Employees Present: Jennifer Herrell, Fred Rogers, Sgt. Patrick Donahoe and Carla Wainscott. Invocation: Jeremy Cloninger, Youth Minister at Living Waters Church All present pledged allegiance to the flag. Minutes/Regular Council Meeting on September 7, 2017 A motion was made to approve the regular minutes of September 7, 2017, as read by the councilmembers prior to the meeting, by Councilmember Swindler, and seconded by Councilmember Page. All voted “aye” and the motion carried. Ordinance 2017-09-21/ An Ordinance Enacting and Adopting a Supplement to the Code of Ordinances of the City of Shelbyville, Kentucky-2nd Reading, Steven Gregory. Steven Gregory, City Attorney, read an Ordinance Enacting and Adopting a Supplement to the Code of Ordinances of the City of Shelbyville, Kentucky which contains all ordinances of a general nature enacted since the prior supplement to the Code of Ordinances. A motion was made to approve the ordinance by Councilmember Ethington and seconded by Councilmember Andriot. Upon roll-call, the following councilmembers voted “aye”: Andriot, Eaton, Ethington, Page, Swindler, and Zoeller. The motion carried. Ordinance 2017-10-12/An Ordinance Creating and Establishing for Bid a Non-exclusive Electric Franchise for the Placement of Facilities for the Transmission, Distribution and Sale of Electrical Energy within the Public Right-of-Way of the City of Shelbyville for a Ten (10) Year Duration – 1st Reading, Steven Gregory Steven Gregory, City Attorney, read an Ordinance of the City of Shelbyville creating and establishing for bid a non-exclusive electric franchise for the placement of facilities for the transmission, distribution and sale of electrical energy within the public right-of-way of the City of Shelbyville for a ten (10) year duration. A motion was made to approve the ordinance by Councilmember Zoeller and seconded by Councilmember Page. All voted “aye” and the motion carried. Ordinance 2017-10-12(A)/An Ordinance Creating and Establishing for Bid a Non-Exclusive Natural Gas Franchise for the Placement Of Facilities for the Transmission, Distribution and Sale of Natural Gas within the Public Right-Of-Way of the City of Shelbyville for a Twenty (20) Year Duration -1st Reading, Steven Gregory. This Ordinance will be discussed later, due to a missing clause. Ordinance 2017-10-12(B)/An Ordinance of the City of Shelbyville Levying Annual Assessment for the Clear Creek Subdivision Public Improvement Bonds-1st Reading, Steven Gregory. Steven Gregory, City Attorney, read an Ordinance of the City of Shelbyville Levying Annual Assessment for the Clear Creek Subdivision Public Improvement Bonds. Councilmember Zoeller proposed that the City waive the Administrative Fees due to it being the last year of the bond assessment. Discussions were heard on the ordinance, and the fees will be waived. A motion was made by Councilmember Zoeller and seconded by Councilmember Page to make a payment to the Bank of New York Mellon in the amount of $81,933.74. The homeowner’s payment will be $1,545.92. All voted “aye” and the motion carried. Recognition Mayor, Thomas L. Hardesty, wanted to recognize Troop 271 for attending the Council Meeting. Public Comments Stacy Rockaway, Field Representative for Rep. Tom Massie, indicated that their office is there to answer any questions citizens may have. She also presented the mayor with a marketing brochure for the Congressional Award for Youth. Department Reports Jennifer Herrell, City Engineer, wanted to thank everyone for attending the MS4 workshop held on September 19th at City Hall. All roads are done with the current paving of streets. Third Street will be closed for 2-3 weeks. The Household Hazardous Waste Program will be held on October 14, 2017, at Midland Square. Fred Roger, City Administrator, wanted to extend his appreciation to everyone who attended the Brownfield Grant Meeting held at the Library on September 19, 2017. Mayor’s Report The Kentucky Association of Economic Development conference was held on September 21, 2017 at the Stratton Center, and September 22, 2017 will be the KAED Golf Scramble at Weissinger Hills Golf Course. On September 23, 2017, the NAACP will hold their State-Wide Convention at Shelbyville Clay Street Baptist Church and a Banquet at Claudia Sanders Dinner House. Also, the Denhart Re-Enactment will be from 4pm – 7pm this Saturday. The Employee Banquet will be held on Thursday, September 28, 2017, at Red Orchard Park. On the 30th of September will be a Street Party Concert. Roll Forming is celebrating their 70th Anniversary at 1:30 pm on October 1, 2017. On October 3rd – October 6th, 2017 is the KLC Convention in Covington. On October 14, 2017, the Squire Boone Statue will be unveiled. Council Reports Councilmember Ethington talked about the animal ordinance regarding Urban Poultry. Chief Code Enforcement Officer Barry Edington and Councilmember Ethington have met on this and at this time they are going to recommend not to take any further action. Councilmember Swindler advised that they need a larger participation on this to be considered. Councilmember Zoeller made a motion to adjourn and seconded by Councilmember Ethington.
