Council Meeting – January 21, 2021 Mayor, David B. Eaton called the regular council meeting to order at 6:30 p.m. with the following council members present: Troy Ethington, Pam Carter, Shane Suttor, Mike Zoeller, and Frank Page. Councilmember Hardesty joined the Council Meeting via Zoom. Councilmember Carter introduced Boy Scout James Slone and his father Chris Slone, who were attending the meeting to fulfill a merit badge requirement. City Employees Present: Jennifer Herrell, Fred Rogers, Chief Bruce Gentry and Carla Wainscott. City Attorney: Steven Gregory Minutes - Regular Called Meeting of January 7, 2021 Councilmember Carter moved to approve the minutes of the regular called meeting of January 7, 2021, as read by the council members prior to the meeting. Seconded by Councilmember Zoeller. All voted “aye,” and the motion to approve carried. Municipal Order No. 2021-01-21/Authorizing the Sale of Surplus Property, Steven Gregory Steven Gregory, City Attorney, read a municipal order authorizing the sale of surplus property. The property is a 2011 Ford Crown Victoria and a 2015 Dodge Charger. Councilmember Page moved to approve the order. Seconded by Councilmember Carter. All voted “aye,” and the motion to authorize the sale of surplus property carried. Bid Approval – Jennifer Herrell, City Engineer Mrs. Herrell presented council with a bid approval for a 2021 F550 Bucket Truck to replace the 1995 Bucket Truck. The total cost $135,614.00, using Sourcewell’s contract #012418-ALT with Altec Industries. Councilmember Suttor moved to approve the bid for the bucket truck. Seconded by Councilmember Ethington. All voted “aye,” and the motion to approve the bid carried. Resolution No. 2021-01-21/A Resolution Creating an Energy Project Assessment District (EPAD) within the City Pursuant to the Provisions of KRS 65.205-209, Steven Gregory Steven Gregory, City Attorney, read a resolution creating an Energy Project Assessment District (EPAD) within the city pursuant to the provisions of KRS 65.205-209. This resolution is the creation of the EPAD. Councilmember Page moved to approve the resolution. Seconded by Councilmember Hardesty. All voted “aye,” and the motion carried. Resolution No. 2021-01-21(A)/A Resolution Levying a Special Assessment for the Purpose of Acquiring, Constructing, and Improving Certain Energy Projects in Cooperation With and Upon Request of Shelbyville Partners, LLC, Providing for the Deposit of the Proceeds of the Assessment, Assigning the Assessment to a Designated Lender, Authorizing the Execution of an EPAD Agreement with the Property Owner, Providing for an Adjustment to the Assessments in Any Fiscal Year by the City Council; and, Taking Other Action Related to the Imposition of the Assessment, Steven Gregory Steven Gregory, City Attorney, read a resolution levying a special assessment for the purpose of acquiring, constructing, and improving certain energy projects in cooperation with and upon request of Shelbyville Partners, LLC, providing for the deposit of the proceeds of the assessment, assigning the assessment to a designated lender, authorizing the execution of an EPAD agreement with the property owner, providing for an adjustment to the assessments in any fiscal year by the City Council; and, taking other action related to the imposition of the assessment. Councilmember Zoeller moved to approve the resolution. Seconded by Councilmember Suttor. All voted “aye,” and the motion to approve the resolution carried. Ordinance No. 2021-01-21/An Ordinance Amending Chapter 60 of the City of Shelbyville Code of Ordinances to Include Occupational Tax Rebates Under an Economic Development Incentives Program – 2nd Reading, Steven Gregory Steven Gregory, City Attorney, read an ordinance amending Chapter 60 of the City of Shelbyville Code of Ordinances to include occupational tax rebates under an economic development incentive program. Councilmember Suttor moved to approve the ordinance. Seconded by Councilmember Carter. Upon Roll Call: Councilmember Hardesty, Councilmember Ethington, Councilmember Carter, Councilmember Suttor, Councilmember Zoeller and Councilmember Page. All voted “aye,” and the motion to approve the ordinance carried. Public Comments No Public Comments. City Attorney’s Report, Steven Gregory Mr. Gregory reported that he will be working on a Municipal Order for the next agenda regarding the road closure of Williamsburg Road. City Clerk’s Report, Carla Wainscott No Report. Department Reports Mrs. Jennifer Herrell, Engineer - Public Works, reported that the department is extremely busy, and all construction sites are progressing. Chief Bruce Gentry, Shelbyville Police Department, stated simulator training will be in a couple of weeks and encourages everyone to participate. Fred Rogers, City Administrator, indicated that City Hall is incredibly busy with different projects. Mayor’s Report Mayor Eaton advised council that Fred Rogers and himself are working on the budget for 2021/2022. The Conference Center now has the roof on. Mayor Eaton thanked Councilmember Suttor for an exceptional interview on WDRB TV News regarding the incentives Shelbyville is offering to businesses. Council Reports Councilmember Carter thanked Councilmember Suttor for his interview on WDRB. She also thanked Mrs. Herrell for her continuous work within the community.
