Council Meeting – December 15, 2022 Mayor, David B. Eaton called the council meeting to order at 6:30 p.m. with the following council members present: Tom Hardesty, Troy Ethington, Pam Carter, Shane Suttor, Mike Zoeller and Frank Page. City Employees Present: Fred Rogers, Chief Bruce Gentry, Barry Edington, Jennifer Herrell, Bryan Sloane, Trace Kirkwood, Assistant Chief Tiger Tucker, Shannon Darst and Carla Wainscott. City Attorney: Steven Gregory All present pledged allegiance to the flag Minutes – Regular Called Meeting of December 1, 2022 Councilmember Carter moved to approve the minutes of the regular called meeting of December 1, 2022, as read by the council members prior to the meeting. Seconded by Councilmember Page. All voted “aye” and motion carried. Appointments – Mayor David B. Eaton Mayor David B. Eaton asks for council’s approval to appoint Mannie Stone to the Human Rights Commission to fill the unexpired term of Tre Hagler to expire June 30, 2023. Councilmember Ethington moved to approve the appointment. Seconded by Councilmember Carter. All voted “aye” and the motion carried. Municipal Order No. 2022-12-15/An Order Declaring Real Property Owned by the City of Shelbyville to be Surplus Property and Providing for Donation and Transfer of Said Property, Steven Gregory Steve Gregory, City Attorney, read an Order Declaring Real Property Owned by the City of Shelbyville to be Surplus Property and Providing for Donation and Transfer of Said Property. Mr. Andrew Page discussed the donation of said property to Habitat for Humanity located on Bradshaw Street to build houses for two families within Shelbyville, Kentucky. Councilmember Page moved to approve the Municipal Order. Seconded by Councilmember Zoeller. All voted ‘aye” and the motion carried. Ordinance No. 2022-12-15/An Ordinance of the City of Shelbyville Creating the Position of Greenskeeper - Steven Gregory, Second Reading Steve Gregory, City Attorney, read an ordinance of the City of Shelbyville Creating the Position of Greenskeeper. Councilmember Suttor moved to approve the Ordinance. Seconded by Councilmember Hardesty. Upon Roll Call: Councilmember Hardesty, Councilmember Ethington, Councilmember Page, Councilmember Zoeller, Councilmember Suttor and Councilmember Carter. All voted “aye” and the motion carried. Ordinance No. 2022-12-15(A)/An Ordinance Authorizing the Issuance of Up to $200,000,000.00 Principal Amount of Industrial Building Revenue Bonds, Taxable Series 2022 (IJW Project), in One or More Series for the Purpose of Financing an Industrial Building Project; Approving and Authorizing the Execution and Delivery of: (I) A Deed From IJW Whiskey Company, LLC to the City of Shelbyville, (II) a Lease Agreement Between the City and IJW Whiskey Company, LLC, (III) a Mortgage, (IV) a Bond Purchase Agreement, (V) a Letter Agreement, and (VI) Any and All Other Related Documents; and Taking Other Related and Incidental Action - Steven Gregory, Second Reading Steve Gregory, City Attorney, read an ordinance authorizing the issuance of up to $200,000,000.00 principal amount of Industrial Building Revenue Bonds, Taxable Series 2022 (IJW Project), in one or more series for the purpose of financing an industrial building project; approving and authorizing the execution and delivery of: (I) a deed from IJW Whiskey Company, LLC to the City of Shelbyville, (II) a lease agreement between the City and IJW Whiskey Company, LLC, (III) a mortgage, (IV) a bond purchase agreement, (V) a letter agreement, and (VI) any and all other related documents; and taking other related and incidental action. Steve Gregory, City Attorney, reiterated that the City of Shelbyville will not be liable for any funds, only the City’s credit will be used to secure the bonds. Mr. Jeff McKenzie was present representing IJW Whiskey Company. Councilmember Page moved to approve the ordinance. Seconded by Councilmember Hardesty. Upon Roll Call: Councilmember Hardesty, Councilmember Ethington, Councilmember Carter, Councilmember Suttor, Councilmember Zoeller and Councilmember Page. All voted “aye” and the motion carried. Ordinance No. 2022-12-15(B)/An Ordinance Creating a New Article and Section in Chapter 66 of the Shelbyville Code of Ordinances, and Codifying and Amending the Provisions Pertaining to the Transient Room Tax – Steven Gregory, Second Reading Steve Gregory, City Attorney, read an ordinance creating a new article and section in Chapter 66 of the Shelbyville Code of Ordinances, and codifying and amending the provisions pertaining to the transient room tax. Mayor David B. Eaton recapped that the changes to this ordinance were to reflect recent changes made regarding the legislative session. It does not change the rate. Councilmember Zoeller moved to approve the ordinance. Seconded by Councilmember Page. Upon Roll Call: Councilmember Hardesty, Councilmember Ethington, Councilmember Carter, Councilmember Suttor, Councilmember Zoeller and Councilmember Page. All voted “aye” and the motion carried. Public Comments – No Public Comments City Attorney’s Report, Steven Gregory – No report. City Administrator’s Report, Fred Rogers – No report. City Clerk’s Report, Carla Wainscott – No report. Department Reports Jennifer Herrell, City Engineer, reported they are prepping and are preparing for the upcoming winter season. The safety grant Mrs. Herrell applied for we received $3,000. Ryan Libke, Shelby County Planning and Zoning, indicated that there have been a tremendous amount of zone changes, and the housing data is in line with permits. Tom Doyle, Water and Sewer, discussed the sales tax rate regarding utilities. You can download form 380-381 online to be exempt. Chief Bruce Gentry, Shelbyville Police Department, reported that we have a new police officer that was sworn in, Angel Lopez. The department has 2 interviews for laterals on Friday, December 16, 2022. Starting February 2023, recruitment class will begin. Officer Kenny Graham will continue to work in a part-time capacity once he retires early in 2023. Bryan Sloane, Weissinger Hills Golf Course, reported the department is completing their winter preparation and looking forward to the spring. Janette Marson, Shelby County Tourism, reported that they have not received restaurant tax from Door Dash and inquiring about this. The conference center is hitting its budget and the new visitor guide will be arriving soon. Assistant Chief Willard Tucker, Shelbyville Fire Department, stated the department is down on personnel, and current staff is working hard and putting in overtime to compensate. Trace Kirkwood, Historic District, thanked everyone for their hard work on 6th Street, Stargazer Plaza, and the historic district downtown. Darlene Snow, Shelby Main Street, reported that Shelbyville has 11 new businesses within the year. There have been 25 major events that took place in 2022. Each city department and the city attorney spoke to Mayor Eaton, Councilmember Suttor and Mayor-Elect Councilmember Ethington on what it has meant to them to have worked with the mayor and Councilmember Suttor and wished the mayor-elect well. Council Reports – Each councilmember extended heartfelt messages and well wishes for retiring Mayor David B. Eaton. Every member also wished Councilmember Suttor good luck on his next endeavors and congratulated our Mayor-Elect Councilmember Ethington on his election. Mayor’s Report Mayor David B. Eaton gave his last report as the Mayor of Shelbyville. Mayor Eaton focused on the accomplishments, the interlocal agreements and the most significant interlocal agreement, tourism restaurant tax, that he and the council had achieved over the last 4 years for the community. Mayor Eaton personally reached out to each department head and city employee present and acknowledged them for their hard work, excellence, and most of all friendship.
