Council Meeting – February 15, 2024 Mayor H. Troy Ethington called the council meeting to order at 6:30 p.m. with the following council members present: Tom Hardesty, Pam Carter, Sally Pollett Zaring, Amy Smitha, Mike Zoeller and Frank Page. City Employees Present: Jennifer Herrell, Major William White, Chief Rob Rothenburger and Carla Wainscott. City Attorney: Steven Gregory All present pledged allegiance to the flag. Minutes –Regular Called Meeting of February 1, 2024 Councilmember Carter moved to approve the minutes of the regular-called meeting of February 1, 2024, as read by the council members prior to the meeting. Seconded by Councilmember Zaring. All voted “aye” and the motion carried. Re-Appointments, Mayor Ethington BJ Andriot and Melvin Moffett to the Tree Board for a 3-year term to expire on March 1, 2027 Councilmember Page moved to approve the appointments. Seconded by Councilmember Hardesty. All voted “aye” and the motion carried. Appointment, Mayor Ethington Alan Zaring to the Tree Board for a 3-year term to expire on March 1, 2027. Councilmember Zaring recused herself. Councilmember Smitha moved to approve the appointment. Seconded by Councilmember Carter. All voted “aye” and the motion carried. Annexation & Zoning of Real Property: Review of and Action on the Findings of Fact Pertaining to the Zoning of Real Property Located on Each Side of Hwy 55, South of Interstate 64 at Exit 32, Steven Gregory. Steven Gregory, City Attorney, explained how the process began with owners of these properties that are of tonight’s subject, approached the City and asked to be annexed. The City prepared an ordinance and made a request to Triple S Planning and Zoning for those properties. The hearing with Triple S Planning and Zoning occurred in October 2023. A recommendation from Triple S Planning and Zoning came to the City in December of 2023. The report, transcript, and records have been provided to the property owners and to the City Council. The council has had several discussions regarding these properties. The Council in January 2024, decided to proceed on their own. No additional information could be received at that point. There are two findings of facts that will be read and voted on tonight. The vote on this matter must have the majority (four) votes from the council for one of these motions to pass. In the case of a zoning matter, the mayor does not have a tie voting cast. If you have a 3-3 vote on both neither will pass, then it will pass by time with Triple S Planning and Zoning. Steven Gregory, City Attorney, read in summary a review of and action on the Findings of Fact pertaining to the zoning of real property located on each side of Hwy 55, south of Interstate 64 at Exit 32. Findings of Fact Overruling Adverse Recommendation of Planning Commission (Z-470-23, Z-471-23, & Z-472-23) Councilmember Hardesty made a motion to Findings of Fact Overruling Adverse Recommendation of Planning Commission (Z-470-23, Z-471-34, & A-472-23). Seconded by Councilmember Zoeller. Upon Roll Call: Councilmember Hardesty, Councilmember Zoeller and Councilmember Smitha all voted “Yea”. Councilmember Carter, Councilmember Page, and Councilmember Zaring all voted “Nay”. This vote results in a tie. The measure does not pass. Findings of Fact Accepting, Approving and Affirming the Adverse Recommendation of Planning Commission (Z-470-23, Z-471-23, & Z-472-23) Councilmember Page made a motion to Findings of Fact Accepting, Approving and Affirming the Adverse Recommendation of Planning Commission (Z-470-23, Z471-23, and Z-472 -23). Seconded by Councilmember Zaring. Upon Roll Call: Councilmember Hardesty, Councilmember Zoeller and Councilmember Smitha all voted “Nay”. Councilmember Carter, Councilmember Page, and Councilmember Zaring all voted “Yea”. This vote results in a tie. The measure does not pass. Public Comments Mr. Coleman Groves, 5957 Brunerstown Road thanked the council for not accepting the recommendation. Mr. John Talbott, representing Doug Langley, thanked the council for their time and thought regarding the annexation. Mr. John Sames, Logan Station, stated his concerns about Hwy 55 South. City Attorney’s Report, Steven Gregory No report. City Administrator’s Report, Fred Rogers No report. City Clerk’s Report, Carla Wainscott No report. Department Reports Jennifer Herrell, Engineer, Shelbyville Public Works, reported the bullpens at Shelbyville/Shelby County Parks are being constructed by Public Works. Mrs. Herrell is working on the Household Hazardous Waste Grant and MS4 Report. The department is combining this year’s and next year’s budget to do paving. Spring clean-up is the week of April 8, 2024. Chief Rob Rothenburger, Shelbyville Fire Department, reported that the new Fire Department Rescue Pumper has arrived and is at Shelbyville Fire Department Station #2. Darlene Snow, Shelby Main Street, reported that a film crew will be at Stargazer Plaza on Monday, February 19, 2024, from noon to 1:00 a.m. Also, the chocolate walk was a success. Matt Mattingly, Shelbyville/Shelby County Parks, wanted to express his thankfulness to the Mayor and Council for getting things accomplished at the parks. Mayor’s Report Mayor Ethington reported that the Chamber will be holding Shelby Night Fever at the Gatsby on February 17, 2024. The NAACP will be having their Soul Food Dinner on February 23, 2024, at 6:30 p.m. The Rotary Club will be holding a Chili dinner on Thursday, February 22, at Stratton Center from 5:00 p.m. to 7:00 p.m. KLC City Day/Night will be on Wednesday, February 28, 2024, in Frankfort, KY. Main Street will be holding its 40th year anniversary from 4:30 p.m. – 7:00 p.m. on Friday, March 1, 2024 at the courthouse. Council’s Report Councilmember Hardesty indicated that tonight’s vote on annexation and zoning is democracy at its best, along with transparency. Councilmember Carter stated the Habitat for Humanity’s Dinner will take place on Saturday, March 2, 2024. A motion was made to adjourn the regular-called council meeting at 7:23 p.m. by Councilmember Zaring.
