MINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF THE CITY OF SILOAM SPRINGS, BENTON COUNTY, ARKANSAS, HELD JUNE 4, 2019 The Board of Directors of the City of Siloam Springs, Arkansas, met in regular session at the City of Siloam Springs Administration Building on June 4, 2019. The meeting was called to order by Mayor John Turner. Roll Call: Sappington, Smiley, Burns, Hunt, Rissler, Coleman, Carroll —All Present City Representatives Present: Phillip Patterson, City Administrator; Jay Williams, City Attorney; Renea Ellis, City Clerk; Jim Wilmeth, Police Chief; Jeremey Criner, Fire Chief; Ben Rhoads, Senior City Planner; Don Clark, Community Development Director; and Phil Stokes, Electric Director. Opening prayer was led by Director Sappington. Mayor Turner led the Pledge of Allegiance. A copy of the May 21, 2019, minutes of the regular meeting had previously been given to each Director. A motion was made by Smiley and seconded by Coleman to approve the minutes. Turner called for a voice vote. Motion passed unanimously. Public Input: Kelsey Howard, 312 S. College, with Main Street Siloam Springs, gave thanks to all the Directors for the support shown to the Memorial Park project. It was a great grand opening of the Farmer' s Market at the new location. Has heard a lot of great comments from the public. It was a great example of the partnership of the City and the Farmer' s Market and Main Street. Item A: 1 St Amendment / Power Purchase and Sale Agreement / Grand River Dam Authority GRDA). Phil Stokes briefed the item. A Motion was made by Smiley and seconded by Coleman to approve the item. Motion passed unanimously. Item B: Mutual Aid and Assistance Agreement / Arkansas Municipal Power Association ( AMPA). Phil Stokes briefed the item. A Motion was made by Coleman and seconded by Smiley to approve the item. Motion passed unanimously. 1St Item C: Ordinance 19- 14 / Reading / Amending Municipal Code Section 6- 10 / Sunday Sales of Beer, Malt Beverages, and Hard Cider for Off -Premise Consumption by Breweries and Microbrewery Restaurants. Phillip Patterson briefed the item. Casey Letellier, 61.0 E. Delaware, one of the owners of Ivory Bill Brewing Company, thanked the Board for adding this item to the agenda. 1St A Motion was made by Smiley and seconded by Burns to place Ordinance 19- 14, on its reading, suspending the rules and reading title only. Motion passed unanimously. An Ordinance entitled: An Ordinance Amending Section 6- 10 of the Siloam Springs City Code to Provide for Sunday Sales of Beer, Malt Beverages and Hard Cider for Off -Premises Consumption by Certain Establishments where Permitted by State Law; was read on its first reading. Board ofDirectors Meeting Minutes Page 12 June 4, 2019 Item D: Resolution 15- 19 / Amending the Master Street Plan. Ben Rhoads briefed the item. There was discussion surrounding questions/ comments from Director Sappington regarding private driveway lengths, use of the words " may" and " shall" in the city' s code, and emergency access roads being able to withstand fire equipment. A Motion to approve Resolution 15- 19 was made by Smiley and seconded by Carroll. Motion passed unanimously. Item E: Resolution 18- 19 / Final Plat Development Permit / East Siloam Commercial Subdivision / 3500 Block of Hwy. 412 E. Ben Rhoads simultaneously briefed Items E. and F. A Motion to approve Resolution 18- 19, with staffs recommended condition, was made by Burns and seconded by Rissler. Motion passed unanimously. Item F: Resolution 19- 19 / Significant Development Permit / Mabo Investments, LLC / 3500 Block of Hwy. 412 E. A Motion to approve Resolution 19- 19, with staff' s recommended condition, was made by Burns and seconded by Rissler. Motion passed unanimously. Item G: Resolution 20- 19 / Significant Development Permit / FFC Midwest, LLC / 3500 Block of Hwy. 412 E. Ben Rhoads briefed the item. A Motion to approve Resolution 20- 19, with staffs recommended conditions, was made by Smiley and seconded by Burns. Motion passed unanimously. Item H: Resolution 21- 19 / Transportation Alternative Program Grant Application / West Harvard Street Sidepath. Don Clark briefed the item. A Motion to approve Resolution 21- 19 was made by Burns and seconded by Rissler. Motion passed unanimously. Item I: April Financials. Patterson pointed out that a copy of the financials had been provided to each director. Item J: Administrator' s Report. Patterson reported on the Grand Opening of Memorial Park. He thanked both present and past board members for their support in making Memorial Park happen; it is a wonderful long- term addition to the City; city staff will be notifying everyone that we will be having a ribbon cutting at City Lake at the bike park; there will also be a ribbon cutting for the Training Tower at Fire Station 1; he thanked everyone again for making all of these projects happen. He gave a brief update on the recent storms. He stated that the City is having an All -Employee Meeting this Friday, the 7th, scheduled at 6: 30 and being held at the Family Aquatic Center. He mentioned that if the weather is a factor, the meeting will be moved to Fire Station 1. The summer convention for the Arkansas Municipal League is June 12 - 14th. Last Friday we had the City auction; it was relatively small, but the City cleared just under $ 17, 000. Lastly, he asked that we all remember the families in Oklahoma and in Arkansas who were affected by the flooding, and he would also ask that our prayers and thoughts got out to the City of Virginia Beach. Mayor Turner questioned the median on Highway 412 being overgrown. Patterson stated we were a bit behind because of all the weather. June 17th at the Compass Church, the West Benton County Republican Women will be meeting to prepare for the 4th of July community singing, their meeting starts at 6: 30 and this portion will start by 7: 00, and all are invited. He commented on Memorial Park and the kids enjoying the water feature and the success of the Farmer' s Market. Directors' Reports: Hunt said it would be nice to have the events scheduled in Memorial Park posted somewhere; congratulated the success of the Farmer' s Market in its new location; and thanked the Board ofDirectors Meeting Minutes Page 13 June 4, 2019 Fire Department for doing the fire demonstration. Burns encouraged people to visit the new park and the flow to Twin Springs Park, the gazebo with Memorial Park; mentioned some historical billboards were posted at the Amphitheater and it would be nice to see those permanent; spoke on the recent storms and thanked staff; and reminded the audience that June 6th is the 75th anniversary of D - Day. Sappington thanked staff for answering her questions and said many are questions that have been asked of her; Memorial Park opening was a good time for all; asked about the mosquito fogging; mentioned the 61St Annual Siloam Springs Rodeo starting off with the street dance on Wednesday night, June 19th and the following 3 nights of the rodeo, and encouraged support. Rissler thanked staff on their efforts with the storms; she has heard great things about Memorial Park; has had lots of compliments on the Fire Department demo, some comments included they wish they would do it on a Saturday; movies in park start this Friday night, June 7th; Girls Night Out will be downtown, Thursday, June 13th from 5- 8; Kid' s Day at the Farmer' s Market is this Saturday, June 8th; and reminded everyone the Library has a lot of activities this summer for the whole family. Carroll stated how glad he was for Memorial Park; seeing some finishing touches on Kenwood; Fire Station 2 is looking incredible and is looking forward to it being finished; commend City on response to storm last week and forward thinking; so many things we as a community have access to; very glad to be a part of Siloam Springs. Smiley thanked staff for storm response; said Memorial Park was touching watching all the families having an evening out and that is what she envisioned for Siloam Springs; Siloam Springs High School has a drone program and their team of four students won several awards at UAFS drone day; La -Z -Boy foundation has donated $ 20, 000 to Bright Futures and Panther Health Center, and also donated $ 54, 000 to other non- profit organizations in Siloam Springs; said she appreciated the display of the Fire Department. Coleman echoed the previous director' s reports; said at the opening of Memorial Park there was one casualty when the Butler Brothers were getting ready to play, a beautiful bass fiddle fell over and the top of it broke off; several people volunteered to fix and provided a replacement for it, and as of Sunday morning, it had been repaired and was being played. He thanked staff for the fantastic job on Memorial Park and Main Street; would recommend to everybody on the board to attend the summer meeting this Friday and thank staff for the job that they are doing. A Motion to adjourn was made by Coleman and seconded by Smiley. A voice vote was called. Motion passed unanimously. Meeting adjourned.
