MINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF THE CITY OF SILOAM SPRINGS, BENTON COUNTY, ARKANSAS, HELD DECEMBER 3, 2024 The City of Siloam Springs, Arkansas, met in regular session at the City of Siloam Springs Administration Building on December 3, 2024. The meeting was called to order by Mayor Judy Nation. Roll Call: Hunt, Blair, Carroll and Long, Rissler, Allen and Wiles— present. City Representatives Present: Allan Gilbert, City Administrator; Jene' Fain, City Clerk; Jay Williams, City Attorney; Scott Miller, Police Chief; Kris Paxton, Community Development Director; Ben Rhoads, Senior City Planner; Maegan Thomas, City Planner; Kevin Moore, City Engineer and Public Works Director; Jason Davis, Public Service Director; Dustin Kindell, Fire Chief; and Christina Petriches, Finance Director. Director Long led the opening prayer. Mayor Nation led the Pledge of Allegiance. Mayor Nation asked if there were any comments from the audience regarding an item not on the City' s agenda. The mayor asked if there were any comments on an item on the Consent Agenda. There were none. Consent Agenda A. Regular Meeting Minutes/ November 19, 2024 B. Resolution 53- 24/ Settlement/ Litigation/ Blake Jones A motion to approve the consent agenda was made by Rissler and seconded by Carroll. Motion passed unanimously. E. Contract/ Washington Street Sidewalk/ Diamond C Construction/$ 260, 760. 54. Kevin Moore briefed the item. Motion to approve was made by Allen and seconded by Rissler. Motion passed unanimously. F. Contract/ Sager Creek Addition Rebuilds/ First Star Construction/$ 1, 997, 586. Kevin Moore briefed the item. Motion to approve was made by Rissler and seconded by Allen. Dustin Kindell briefed the item. Motion to approve was made by Long and seconded by Rissler. Motion passed unanimously. Item H: Ordinance 24- 34/ 1st Reading/ Amending City Municipal Code/ Compensation of the Mayor and Board. Christina Petriches briefed the item. A motion was made by Long and seconded by Blair- Finn, to place Ordinance 24- 34 on its first, second and third readings, suspending the rules and reading title only. Motion passed 5- 2. A motion was made by Allen and seconded by Long to adopt Ordinance 24- 34. Motion passed 6- 1. A motion was made by Allen and seconded by Long to adopt the emergency clause on Ordinance 24- 34. Motion passed 6- 1. Item I: Ordinance 24- 35 /1st Reading/ Amending City Municipal Code/ Chapter 6 Alcoholic Beverages/ Allowing Sunday Alcohol Sales. Kris Paxton briefed the item. A motion was made by Carroll and seconded by Wiles, to place Ordinance 24-35 on its first reading, suspending the rules and reading title only. Motion passed unanimously. Item J: Resolution 54- 24/ Significant Development Permit/ 3879 Highway 412 East McDonalds No. 2). Ben Rhoads briefed the item. A motion to approve was made by Rissler and seconded by Long. Motion passed unanimously. Item K: Resolution 55- 24/ Significant Development Permit/ 4295 Highway 412 East( Jiffy Trip Diesel). Ben Rhoads briefed the item. A motion to approve was made by Rissler and seconded by Long. Motion passed unanimously. Item L: Resolution 56- 24/ Significant Development Permit/ 2000 West University Street( JBU Health Education Addition). Ben Rhoads briefed the item. A motion to approve was made by Rissler and seconded by Allen. Motion passed unanimously. Item M: Resolution 57- 24/ Special Use Development Permit/ 2700 Block of East Kenwood Street( Springs Church of Christ Fourplex). Ben Rhoads briefed the item. Kevin Williams, 2604 Courtney Circle, only one property owned appeared at the Planning Commission meeting with questions regarding a parking lot which was determined to not be an issue. Dustin Perkins, 1260 Sebastian Lane stated he and a business partner are attempting to purchase the property separate from the church. It was indicated that there are no plans to add more homes to the property in question in the future. Cliff Goggans, 304 E. Central, Springs Church of Christ purchased the property from Kenwood Missionary Baptist Church. They do not have any intention of utilizing the property of homes, however, it is a part of their loan with Legacy Bank. They would like to sell the property and pay it in toward their loan. Katie Rennard, 702 E. Delaware, These mini homes were a partnership between Kenwood Missionary Baptist Church and Genesis House. They kept up the houses as interim housing for families in need. A motion to approve was made by Carroll and seconded by Rissler to table Resolution 57- 24 until December 17, 2024. Motion passed unanimously. Item N: Resolution 58- 24/ Significant Development Permit/ 22000 Block of Highway 16 Cabinet Warehouse). Maegan Thomas briefed the item. A motion to approve was made by Allen and seconded by Rissler. Motion passed unanimously. Item 0: Resolution 59- 24/ Significant Development Permit/ 2600 Block of North Country Club Road( Banff Commercial Mixed- Use Center). Maegan Thomas briefed the item. A motion to approve was made by Allen and seconded by Rissler. Motion passed unanimously. Item P: Resolution 60- 24/ Special Use Development Permit/ 2600 Block of North Country Club Road( Banff Large Impact Commercial). Maegan Thomas briefed the item. A motion to approve was made by Allen and seconded by Rissler. Motion passed unanimously. Item Q: Resolution 61- 24/ Significant Development Permit/ 2600 Block of North Country Club Road( Banff Townhomes. Maegan Thomas briefed the item. A motion to approve was made by Allen and seconded by Rissler. Motion passed unanimously. Item R: October Financials. Item S: Administrator' s Report is attached. Gilbert gives a shout out to the fire department for their rescue at the West Siloam Springs Water Tower. Directors Reports— Mayor— She wants to thank the fire department for the excellent job they did and continue to do. She is thankful for the police department as well. She hopes everyone can attend the parade and light up Siloam on Saturday evening. Hunt— She hopes everyone had a good Thanksgiving. Thank you, fire, police and city staff for all that you do. She wants to wish everyone an early Merry Christmas. Wiles— No comments. Blair- Finn— The home decorating contest has been taken over by Parks and Recreation. They will provide an update. It is cold outside, remember to bring your pets inside. The animal shelter can always use donations. Genesis House has extended hours right now. Rissler — She has had questions regarding Black Hills Energy and their rate increase. They are entirely separate from the City. She hopes everyone had a Happy Thanksgiving. Carroll— Board of Directors Meeting Minutes Page 1 4 December 3, 2024 Long— No comment. Allen— Thank you to Arthur at the Chamber of Commerce for all he does for the City. Thank you for acknowledging the City' s Christian heritage. Thank you, Mary Nolan for making everyone aware of the Toyland exhibit at the museum prior to the parade. He only voted on the Sunday Alcohol Sales ordinance because it was voted on by the citizens. He does not feel that it is best for the City. He states there are zoning definitions for a reason. The photographs of the rescue at the West Siloam Springs Water Tower were amazing. He is proud of the City employees and fire department. He had questions regarding the grant for revitalization of Sager Creek. Thank you to the City' s grant writer. He hopes everyone had a Happy Thanksgiving and a Merry Christmas. Ate`\., oAq/NGS P  CITY 01 Snoam pri ri Vs Administrator' s Report December 3, 2024 Expenditures: In excess of$ 30, 000 None Per Resolution 07- 24 None 1. The Siloam Springs Police Department was awarded $ 72, 760. 78 by the Arkansas Department of Public Safety through the Public Safety Equipment Grant program. There is no match requirement. This grant will fund new and improved ballistic vests for every patrol officer and every SWAT officer in the department. Grant acceptance will go before the Board on December 17, 2024. 2. This Saturday marks the Light Up Siloam Springs festivities. The Siloam Springs High School choir begins caroling at the Chautauqua Amphitheater at 4: 00 PM. At 5: 30 PM, the parade begins on Tulsa Street and winds its way through downtown. At 6: 00 PM Mayor Nation will lead the official lighting ceremony from Twin Springs Park.
