CITY COUNCIL CHAMBERS SIOUX CITY, IOWA MAY 22, 2023 1. The Regular Meeting of the City Council was held on May 22, 2023, at 4:00 p.m. The following Council Members were present on call of the roll: Moore, O’Kane, Schoenherr, Scott, and Watters. Absent: None. Staff members present: Robert K. Padmore, City Manager, Nicole M. DuBois, City Attorney, and Heidi Farrens, Deputy City Clerk. 2. Wastewater Treatment Plant Reconstruction and Design Advisory Committee: William Bradbury CONSENT AGENDA Motion by Scott, seconded by Moore, to adopt the Consent Agenda, all voting aye. Items 3 through 17C are approved unanimously unless specifically noted after the item. 3. Reading of the City Council minutes of May 15, 2023. Reading of the minutes of May 15, 2023, was waived and as part of the consent agenda the minutes were approved as presented. 4. U.S. BANK - Resolution authorizing staff to proceed with negotiations with U.S. Bank of Minneapolis, Minnesota for Banking and Ancillary Services for the City of Sioux City for five (5) years, with the possibility of three (3) one (1) year extensions. 2023-0497 5. URBAN RENEWAL FUNDS - Resolution approving advances of funds for repayment from the City’s urban renewal tax increment revenue funds and directing the filing of certification under Iowa Code Section 403.19. 2023-0504 Kelli Hill, City Treasurer, and Teresa Fitch, Finance Director, provided information on the item. B. TREASURY REGULATION - Resolution declaring an official intent under Treasury Regulation 1.150-2 to issue debt to reimburse the City for certain original expenditures paid in connection with specified projects. 2023-0505 12. ACTIONS RELATING TO STREET CLOSURES A. LEEDS COMMUNITY DAYS - Resolution temporarily closing the north/south alley between Central Street, Tyler Street, 41st Street, and Floyd Boulevard beginning at 5:00 p.m., June 10, 2023 and ending at 12:30 a.m. June 11, 2023 and temporarily closing Floyd Boulevard from Harrison Street to Tyler Street beginning at 8:00 a.m. and ending at 1:00 p.m. June 11, 2023 to promote Leeds Community Days Street Dance and Car Show. 2023-0506 B. HEBERT CONSTRUCTION - Resolution awarding and approving a contract to Hebert Construction Co., Inc. in the amount of $390,500 for the Demolition of 722 Nebraska Street Project. 2023-0511 Darrel Bullock, Code Enforcement Manager, provided information on the item. B. SUBSURFCO - Resolution awarding and approving a contract to SuBSurfco, LLC of South Sioux City, Nebraska in the amount of $1,756,205.35 for the construction of the Well No. 2 Replacement Project. EMS MANAGEMENT - Resolution approving Addendum No. 1 to the Billing Services Agreement with EMS Management & Consultants, Inc. formerly Life Line Billing Systems LLC doing business as LifeQuest Services to ensure compliance with the Privacy and Security Rules of the Health Insurance Portability and Accountability Act of 1996 (HIPAA Privacy and Security Rules) (45 C.F.R. SERGEANT BLUFF/COUNTY - Resolution authorizing and approving an Intergovernmental Agreement with the City of Sergeant Bluff, Iowa and Woodbury County, Iowa in connection with the I-29 Interchange Project. 2023-0515 F. OTIS ELEVATOR - Resolution awarding a Service Provider Agreement to Otis Elevator Company of Sioux City, Iowa in the amount of $56,113.51 for the Wilbur Aalfs Library Elevator Project. Resolution awarding a contract to Nelson Commercial Construction in the amount of $2,205,000 for the Sioux Gateway Airport Northeast T-Hangar Development Project (Project No. 7340-749-133/IDOT Project No. 9I220SUX400, Contract No. CNTRT-00004239) at the Sioux Gateway Airport/Brigadier General Bud Day Field. 2023-0516 2. Resolution awarding a contract to Nelson Commercial Construction in the amount of $1,130,000 for the Sioux Gateway Airport Northeast T-Hangar Development Project (Project No. 7340-749-133/IDOT Project No. 9I220SUX400, Contract No. CNTRT-00004239) at the Sioux Gateway Airport/Brigadier General Bud Day. Motion by Scott, seconded by Moore, to delete the item, all voting aye. 15. ACTIONS RELATING TO PERSONNEL A. BENEFITS MANAGER - Resolution amending the Position Classification Manual adopted by Resolution No. 91/T-9972 and the Salary Schedule adopted by Resolution No. 2021- 0509 by adding thereto the position, title and job description of Human Resources Benefits Manager, Class Code 1473 and authorizing said position in the Human Resources Department. 2023-0517 B. INDIANA AVE - Resolution proposing to grant a temporary easement. W 19TH ST - Resolution proposing to grant an Underground Electric Easement. Resolution proposing to sell certain real property and rescinding all conflicting resolutions. (A vacated portion of Swift Avenue abutting property commonly known as 1421 South Fairmount Street) (Petitioner: Laverne C. Schossow and Sheila R. Schossow) (Purchase Price: $3,145.38 plus costs) 2023-0527 Motion by Scott, seconded by Moore, to adopt the proposed resolution, all voting aye. 19. Hearing and Ordinance amending Ordinance No. 2023-0127 relating to the vacation of West 22nd Street lying between Everett Street and Kellogg Street to correct the reference to West 22nd Street to West 21st Street. 2023-0528 Motion by Scott, seconded by Moore, to open the hearing and pass first consideration of the ordinance, citizen comments were not offered, and the hearing was closed, all voting aye. On motion by Scott, seconded by Moore, the ordinance passed second and third considerations, all voting aye. ORDINANCES 20. Ordinance amending Chapter 15.04 entitled “City Cemeteries” of the Sioux City Municipal Code by adding provisions for the trusteeship, establishment of trust fund, and perpetual care registry for Graceland Cemetery, Floyd Cemetery and Logan Park Cemetery pursuant to Iowa Code Chapter 523I. 2023-0529 The ordinance was considered on motion by Scott, seconded by Moore, to pass first consideration, all voting aye. On motion by Scott, seconded by Moore, all voting aye, the Statutory Rule requiring that an ordinance be considered at three separate meetings was suspended. On motion by Scott, seconded by Moore, the ordinance passed second and third considerations, all voting aye. 21. Ordinance amending Chapter 2.12 of the Sioux City Municipal Code entitled “Employee Residency Requirements” by expanding the mileage requirement in which employees of the city may reside. The ordinance was considered on motion by Moore, seconded by Schoenherr, to pass first consideration, Moore, O’Kane, and Schoenherr voting aye; Scott and Watters voting nay. DISCUSSION 22. Discussion of City Council Representation on the Wastewater Treatment Plant Recon- struction and Design Advisory Committee 23. CITIZEN CONCERNS There were no citizen concerns. 24. COUNCIL CONCERNS O’Kane asked citizens to support the Warming Shelter by participating in a tip night fundraiser on May 23rd, 4:30 to 8:30 p.m. at Pizza Ranch, 3116 Floyd Blvd. Schoenherr discussed the cost, importance, immensity, and necessity of the Wastewater Treatment Plant Reconstruction and Design project and how she feels the City is moving in the right direction with the project. Watters stated he has noticed an increase of loud, moped-like vehicles on trails and sidewalks and has reported them to the Chief of Police and Parks and Rec, and feels a need for enforcement to prevent this behavior. Watters also stated he and Schoenherr attended the Police Officers Recognition and Promotion Banquet, it was an extraordinarily powerful event, and thanked the Police for their service. Watters mentioned the passing of Delbert Christensen and all he did for sports and softball in Sioux City and suggested having a memorial and asked Mayor to speak to the board. (May 22, 2023 - Regular Meeting Minutes) Page 5 Moore thanked Roger Posey, Cemetery Supervisor, and the Parks and Recreation Department for working on the cemeteries to get them mowed and cleaned up for Memorial Day. Moore wished everyone a safe and happy Memorial Day weekend. Scott discussed the poor condition of Memorial Park Cemetery, which is a private enterprise, and inquired about an organization that could be contacted about it. Scott stated the Police Department inquired about starting the Morningside Days Parade at a different location next year and requested Padmore discuss it with staff. Scott gave a “shoutout” to Jeremy Dunkirk because his art tries to teach kids about participation in art and community. Scott also stated Parks and Recreation needs help with installing poles at Hubbard Park; Padmore stated he would contact them. 25.
