filed in the City Finance Office.
SECTION 2. The assessment may be paid in one annual installment and shall be collected under
Plan One--Collection by County Treasurer as provided in SDCL 9-43.

to substitute the motion to reduce the assessment for property at 912 East 70th by half of the said
amount of $205.85 (approximately $103.00).

BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
SECTION 1. That the special assessment roll for the assessment of the property assessable for
construction of grading, gravel, asphalt surfacing, curb and gutter, storm sewer, sidewalk, and
streetlights on West Benson Road from Interstate 29 to North Career Avenue and on North
Career Avenue from West Benson Road to 350' South pursuant to a contract entered into with
Runge Enterprises on the 23rd day of April, 2009, be and the same is hereby approved and the
assessment as set out in the special assessment roll approved this date is hereby levied against the
property described therein and becomes a lien against such property upon filing of the special
assessment roll in the City Accounting Office.
SECTION 2. The assessment may be paid in five annual installments and shall be collected under
Plan One-Collection by County Treasurer as provided in SDCL 9-43.

BUSINESS IMPROVEMENT DISTRICT IN THE CITY OF SIOUX FALLS, SOUTH DAKOTA.
BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the special assessment roll for the Main Street Business Improvement District in the
City of Sioux Falls, South Dakota, is hereby approved and the assessment as set out in said special
assessment roll approved this date is hereby levied against the property described therein and
becomes a lien against such property upon filing of said special assessment roll in the City Finance
Office.
Section 2. Industrial property shall be exempt from assessment. Single-family and two-family
dwelling units shall also be exempt. Residential rental property whose sole use is residential and
which contains more than two units, will be assessed one-half the set amount.
Section 3. Said assessment may be paid in one annual installment based on the assessed valuations of
the property adjusted each year and shall be collected under Plan One-Collection by County Treasurer
as provided in SDCL 9-43.

NOTICE TO PROPERTY OWNERS
Notice is hereby given that assessments levied under the above resolution will become due and
payable at the office of the County Treasurer in one installment, together with interest for the
quarterly rate each year in accordance with SDCL 9-43. The first installment, with interest, will
become due with general taxes and will be payable at the County Treasurer’s Office on
January 1, 2011.
Notice is further given that the special assessment roll approved in the above resolution was filed with
the City Finance Office on the 9th day of August 2010, and that the whole of said assessment may be
paid without interest to the City Finance Office on or before 30 days after said filing.

A RESOLUTION VACATING THE PUBLIC RIGHT-OF-WAY ON A PORTION OF
S. GRANGE DR. FROM S. MINNESOTA AVE. TO S. DULUTH AVE. AS SHOWN ON
EXHIBIT A.
WHEREAS, a petition of the owners of Tract 6B and Tract 7 of Park South Addn. to the City of
Sioux Falls, County, SD has been filed with the City Clerk, asking that the aforesaid be vacated.
Pursuant to SDCL, notice of hearing has duly been given, and said notice was properly published;
and
WHEREAS, the hearing was held on August 9, 2010, and the petition has been duly examined
and investigated by the City Council of the City of Sioux Falls. Testimony in support of said
petition has been heard, and no opposition thereto was voiced. Said public right-of-way, as shown
upon the plats attached to and made a part of said petition, has been used as a street and no longer
serves a useful public purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That the public right-of-way on a portion of S. Grange Dr. from S. Minnesota Ave. to S. Duluth
Ave., as shown on Exhibit A, to the City of Sioux Falls, County, SD, be and the same hereby is
declared vacated, subject to an easement reserved by the City of Sioux Falls in, over, and upon
that portion of the vacated public right-of-way as shown on Exhibit A for drainage, sewer, water
and gas mains, electric, telephone lines, Cable TV, and all public utility uses required or
authorized by the City of Sioux Falls, and that the City Clerk shall cause to be filed with the
Register of Deeds, County, SD, a duly certified transcript of this resolution.

A RESOLUTION AUTHORIZING USE OF CONSTRUCTION MANAGER AT RISK FOR
GREAT PLAINS ZOO IMPROVEMENTS.
WHEREAS, in an effort to minimize any inconvenience to the public at the Great Plains Zoo &
Delbridge Museum, the City’s Director of Public Works recommends that the Great Plains Zoo
improvements be accomplished using the Construction Manager at Risk project delivery method;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That it is in the best interest of the public to utilize the Construction Manager at Risk project
delivery method for the Great Plains Zoo improvements and that the construction manager be
allowed to submit bids on portions of the work.
This resolution shall become effective upon passage and publication.
