HEARINGS AND RESOLUTIONS 31. A RESOLUTION APPROVING THE COST RECOVERY ROLL FOR CONSTRUCTION OF THE BASIN 13 SANITARY SEWER SYSTEM. A motion was made by Council Member Kenny Anderson Jr. and seconded by Council Member Dean Karsky to adopt said Resolution No. 122-14. RESOLUTION NO. 122-14 A RESOLUTION APPROVING THE COST RECOVERY ROLL FOR CONSTRUCTION OF THE BASIN 13 SANITARY SEWER SYSTEM. WHEREAS, following Notice and Hearing, the City of Sioux Falls adopted its Resolution of Necessity to Construct the Basin 13 Sanitary Sewer System in northwest Sioux Falls (Res. No. 116-06); and WHEREAS, the City of Sioux Falls has now financed and constructed the Basin 13 Sanitary Sewer System extending from the City of Sioux Falls collection system to serve the property listed in the Cost Recovery Evaluation, which is attached hereto and incorporated herein by reference; and WHEREAS, the sanitary interceptor sewers may serve areas benefited thereby, and the cost has been apportioned against such property; and WHEREAS, the City has determined that it is appropriate that such benefited property pay its proportionate share of the cost of such construction on a per acre basis, without interest, according to the benefits that may accrue to such property, with payment to be made before such property is platted for development, or if already platted, before it is served by the Basin 13 improvements; and WHEREAS, the City has determined that it is appropriate that benefited property already connected to the City sewer system following completion of the Basin 13 improvements pay its proportionate share of the cost of such construction, without interest, according to the benefits that accrue to such property in order to continue being served by the Basin 13 improvements; and WHEREAS, the governing body has determined the amount to be paid and the apportionment thereof among the benefited properties; and WHEREAS, such benefited property owners have been notified of the hearing on this Resolution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: 1. That the owner(s) of benefited property listed in Table 1 of the attached Cost Recovery Evaluation is required to pay the Basin 13 Sanitary Sewer Cost Recovery at the time of plat approval on a per acre basis for the land being platted. 2. That in the event the property described in Table 1 is already platted, the benefited property owner(s) are required to pay the Basin 13 Sanitary Sewer Cost Recovery amount shown in Table 1 prior to connection to the City sanitary sewer system. 3. That in the event the property described in Table 1 is subdivided and sold to a new owner(s), each new owner is required to pay the Basin 13 Sanitary Sewer Cost Recovery applicable to the area to be developed on a per acre basis if such cost recovery has not been previously paid on the land involved. 4. That in the event the property described in Table 1 platted and/or connected to the City sanitary sewer system following completion of the Basin 13 improvement, the property owner(s) will be billed for the Basin 13 Sanitary Sewer Cost Recovery amount shown in Table 1 after approval of the final Cost Recovery Roll and must pay the sums due. 5. That in the event property was connected to and receiving benefit from the City sanitary sewer system prior to completion of the Basin 13 Sanitary Sewer improvements, the property owner(s) will not be billed for the Basin 13 Sanitary Sewer Cost Recovery. This amount will be paid for by the City. 6. That the Clerk shall cause to be filed with the Register of Deeds, Minnehaha County, South Dakota, a duly certified transcript of this resolution for recording. Date adopted: 10/20/14 . Mike T. ANNEXATION 2013-07–20—SE CORNER: W. 85TH ST. AND S. MINNESOTA AVE. A motion was made by Council Member Rex Rolfing and seconded by Council Member Michelle Erpenbach to adopt said Resolution No. 123-14. A motion was made by Council Member Dean Karsky and seconded by Council Member Christine M. WHEREAS, on June 17, 2014, the City Council of the City of Sioux Falls adopted Resolution No. 68-14 to include certain contiguous territory within the corporate limits of the city of Sioux Falls, South Dakota; WHEREAS, on June 17, 2014, the City Council of the City of Sioux Falls adopted Resolution No. 68-14 to correct an error in the legal description; WHEREAS, the annexation map boundaries have been approved by the City Council; WHEREAS, the legal description as set forth in Resolution 68-14 was not accurate; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the legal description as set forth in Resolution 68-14 hereby is amended to read as follows: Tract 2A and Tract 3, Akerson’s Addition in the NW1/4 of Section 23, Township 100 North, Range 50 West of the 5th P.M., Lincoln County, South Dakota And that the City Clerk shall cause to be filed with the Register of Deeds, Lincoln County, South Dakota, a duly certified transcript of this resolution. A RESOLUTION INCLUDING CERTAIN CONTIGUOUS TERRITORY WITHIN THE CORPORATE LIMITS OF THE CITY OF SIOUX FALLS, SOUTH DAKOTA. WHEREAS, there has been presented to the City Council of the City of Sioux Falls and filed with the City Clerk, a Petition in writing signed by the owners and otherwise in compliance with the provisions of SDCL Chapter 9-4, requesting that the territory hereinafter described be included within the municipality; WHEREAS, there has been an analysis completed in regard to the territory hereinafter described and it has been found that: 1. The property has been properly described and is contiguous to the current city limits. 2. The proposed land uses and densities are generally consistent with the Shape Sioux Falls 2035 Comprehensive Plan. 3. There is access to the major street network and adequate provision for municipal utilities when the following occur: a. The site will have water extended from the north and sewer from the existing main running through the central portion of this property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the following described properties are and the same hereby are included within the corporate limits of the city of Sioux Falls, Minnehaha County, and the boundary of the city is hereby extended to include such territory: The E1/2 of the NE1/4 of Section 30, T101N-R48W (except County Auditor Lot H-2 in the NE1/4 of the NE1/4 of Section 30, T101N-R48W), but including all Six Mile Rd. right-of- way adjacent thereto, Minnehaha County, South Dakota And that the City Clerk shall cause to be filed with the Register of Deeds, Minnehaha County, South Dakota, a duly certified transcript of this resolution.
