MINUTES  Regular City Council Meeting of Tuesday, January 2, 2018, at 7 p.m. COMMUNICATIONS 1. Approval of contracts/agreements on the January 5, 2018, memo. 2. Approval of notice to change orders on the January 5, 2018, memo. 3. Report of Requests for Quotes for Fuel dated December 28, 2017; Dyed Diesel #1 and #2; 3,750 gallons for each (7,500 gallons total); Cole's Petroleum ($2.376 for #1 and $2.094 for #2); Midway Service, Stern Oil, Harms Oil, Howes Oil, CHS, Inc., and Olson Oil, all no bid. Bid awarded to: Cole's Petroleum. 4. Report of Requests for Quotes for Fuel dated: January 2, 2018; E-10 Unleaded Ethanol/87 Octane; 8,500 Gallons; Cole's Petroleum ($1.9662); Harms Oil, Stern Oil, CHS, Inc., Howes Oil, Midway Service, and Olson Oil, all no bid. Bid awarded to: Cole's Petroleum. REGULAR AGENDA ITEMS APPROVAL OF REGULAR AGENDA A motion was made by Council Member Rick Kiley and seconded by Council Member Michelle Erpenbach to approve the Regular Agenda. Vote to approve: Roll Call: Yeses, Greg Neitzert, Rex Rolfing, Marshall Selberg, Pat Starr, Theresa Stehly, Christine M. Erickson, Michelle Erpenbach, Rick Kiley, 8. Noes, 0. Motion Passed. PUBLIC INPUT Steven Siano spoke about his physical ailments; the VA; and the impending possibility of not having a place to stay due a threat of having his income reduced. Scott Ehrisman spoke about the Event Center siding report. Catherine Riffle spoke about caring for the homeless. Bruce Meyer spoke about the Bishop Dudley House and bicycle policy. David Zokaites spoke about how people should behave when having discussions and the new parking ramp. Justin Wallen spoke about the Falls, the beginnings of Sioux Falls, preserving the City's history, positive things about the City, and the need for respect towards people, animals and the river. Tim Stanga spoke about street lights and cars in his neighborhood, the siding report, parking ramp, City Council meetings, and election by plurality. Bruce Danielson spoke about the Events Center and siding report. HEARINGS AND RESOLUTIONS 5. A RESOLUTION VACATING A PORTION OF THE E. ARROWHEAD PARKWAY RIGHT-OF-WAY LYING ADJACENT TO LOT 2 OF TRACT A OF REDROCK PARK 2ND ADDITION. A motion was made by Council Member Rex Rolfing and seconded by Council Member Michelle Erpenbach to adopt said Resolution No. 3-18. Vote to adopt: Roll Call: Yeses, Greg Neitzert, Rex Rolfing, Marshall Selberg, Pat Starr, Theresa Stehly, Christine M. Erickson, Michelle Erpenbach, Rick Kiley, 8. Noes, 0. Motion Passed. RESOLUTION NO. 3-18 A RESOLUTION VACATING A PORTION OF THE E. ARROWHEAD PARKWAY RIGHT- OF-WAY LYING ADJACENT TO LOT 2 OF TRACT A OF REDROCK PARK 2ND ADDITION. WHEREAS, a petition to vacate city right-of-way has been filed by the owner of the following described property: Lot 2 of Tract A of Redrock Park 2nd Addition to the City of Sioux Falls, Minnehaha County, SD WHEREAS, the hearing was held on January 9, 2018, and the petition has been duly examined and investigated by the City Council of the City of Sioux Falls. Testimony in support of said petition has been heard, and no opposition hereto was voiced. Said property, as shown upon the plats attached to and made a part of said petition, has been used as a street, alley, or public ground but no longer serves a useful public purpose. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the E. Arrowhead Parkway right-of-way, described as Lot H1 on Exhibit A, be and the same hereby is declared vacated, and that the City Clerk shall cause to be filed with the Register of Deeds, Minnehaha County, SD, a duly certified transcript of this resolution. ARROWHEAD PARKWAY RIGHT-OF-WAY LYING ADJACENT TO BLOCK 65, CAPITOL HILL ADDITION. A motion was made by Council Member Greg Neitzert and seconded by Council Member Rex Rolfing to adopt said Resolution No. 4-18. Testimony in support of said petition has been heard, and no opposition hereto was voiced. Said property, as shown upon the plats attached to and made a part of said petition, has been used as a street, alley, or public ground but no longer serves a useful public purpose. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the E. Arrowhead Parkway right-of-way described as Lot H1 on Exhibit A, be and the same hereby is declared vacated, and subject to a 10' Utility Easement reserved by the City of Sioux Falls in, over, and upon such vacated property as shown on Exhibit A for drainage, sewer, water and gas mains, electric, telephone lines, cable TV, and all public utility uses required or authorized by the City of Sioux Falls, and that the City Clerk shall cause to be filed with the Register of Deeds, Minnehaha County, SD, a duly certified transcript of this resolution. WHEREAS, a petition to vacate city right-of-way has been filed by the owner of the following described property: Lot 2, Lot 1B, and Lot 1A Red Rock Park Second Addition in the SW1/4 of the SE1/4 of Section 13-T101N-R49W, 5th P.M., Minnehaha County, SD WHEREAS, the hearing was held on January 9, 2018, and the petition has been duly examined and investigated by the City Council of the City of Sioux Falls. Testimony in support of said petition has been heard, and no opposition hereto was voiced. Said property, as shown upon the plats attached to and made a part of said petition, has been used as a street, alley, or public ground but no longer serves a useful public purpose. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the E. Arrowhead Parkway right-of-way, described as Lot H4 on Exhibit A, be and the same hereby is declared vacated, and subject to a 10' Utility Easement reserved by the City of Sioux Falls in, over, and upon such vacated property as shown on Exhibit A for drainage, sewer, water and gas mains, electric, telephone lines, cable TV, and all public utility uses required or authorized by the City of Sioux Falls, and subject to a 70' Sanitary & Storm Sewer Easement as shown on Exhibit A, and that the City Clerk shall cause to be filed with the Register of Deeds, Minnehaha County, SD, a duly certified transcript of this resolution.
