MINUTES City Council Meeting Tuesday, October 8, 2019 at 7:00 PM Carnegie Town Hall, 235 West 10th St., Sioux Falls, South Dakota 57104 CALL TO ORDER 1. MEETING ROLL CALL Present: Council Member Greg Neitzert, Council Member Curt Soehl, Council Member Pat Starr, Council Member Theresa Stehly, Council Member Janet Brekke, Mayor Paul TenHaken Absent: NoneCouncil Member Rick Kiley, Council Member Marshall Selberg, Council Member Christine M. APPROVAL OF THE CONSENT AGENDA A motion was made by Council Member Neitzert and seconded by Council Member Soehl to approve the Consent Agenda. Roll call vote to approve. 5 Yes: Neitzert, Soehl, Starr, Stehly, Brekke; 0 No: (None). Motion Passed. 6. APPROVAL OF MINUTES  Informational Meeting of Tuesday, October 1, 2019  Regular City Council Meeting of Tuesday, October 1, 2019 COMMUNICATIONS 7. Approval of contracts/agreements on the memorandum dated October 4, 2019. 8. Notice of change orders on the memorandum dated October 4, 2019. 9. Report of Requests for Quotes for Fuel dated: September 25, 2019; 2000 gallons of Unleaded Ethanol and 2000 gallons of E30 Unleaded Ethanol; Harms Oil ($2.0517 Unleaded & $2.1025 E30); Stern Oil ($2.0718 Unleaded & $2.0171 E30); Farstad Oil ($2.046 Unleaded & $1.975 E30); Midway Service ($2.048 Unleaded & $1.89 E30); Howes Oil, CHS Inc., M.G. Oil & Olson Oil, all no bid. Bid awarded to: Midway Service. 10. Report of Requests for Quotes for Fuel dated: September 27, 2019; 2,500 Gallons of Unleaded Ethanol; Midway Service ($2.0985); Cole’s Petroleum, Harms Oil, Howes Oil, Stern Oil, CHS, Inc., Farstad Oil, and Olson Oil, all no bid. Bid awarded to: Midway Service. REGULAR AGENDA 11. APPROVAL OF THE REGULAR AGENDA A motion was made by Council Member Brekke and seconded by Council Member Soehl to approve the Regular Agenda. Roll call vote to approve. 5 Yes: Neitzert, Soehl, Starr, Stehly, Brekke; 0 No: (None). Motion Passed. 12. PUBLIC INPUT Chere Rosa de Sharon expressed her gratitude to the City Council, City employees and others who helped out her and her daughter after their home was destroyed by a tornado. David Zokaites spoke about concerns regarding the City Administration building, changes to the Consent Agenda, and the Hong Kong protest. INTRODUCTION AND ADOPTION OF ORDINANCES ORDINANCE FIRST READINGS 13. 1st Reading: AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY REVISING CHAPTER 111: RESTRICTIONS ON ISSUANCE OF MALT BEVERAGE RETAILER LICENSES. Recommendation: Set a date of 2nd Reading for Tuesday, October 15, 2019. A motion was made by Council Member Brekke and seconded by Council Member Neitzert to set a date of 2nd Reading for Tuesday, October 15, 2019 for Item 13. Roll call vote to set a date of 2nd Reading. 5 Yes: Neitzert, Soehl, Starr, Stehly, Brekke; 0 No: (None). Motion Passed. HEARINGS AND RESOLUTIONS 14. A RESOLUTION AUTHORIZING THE CITY OF SIOUX FALLS TO GIFT CERTAIN UTILITY VEHICLES TO MINNEHAHA COUNTY, SD. A motion was made by Council Member Brekke and seconded by Council Member Neitzert to approve Resolution No. 98-19. Roll call vote to approve. 5 Yes: Neitzert, Soehl, Starr, Stehly, Brekke; 0 No: (None). Motion Passed. RESOLUTION NO. 98-19 A RESOLUTION AUTHORIZING THE CITY OF SIOUX FALLS TO GIFT CERTAIN UTILITY VEHICLES TO MINNEHAHA COUNTY, SD. WHEREAS, the Sioux Falls Public Works Fleet Division has declared as surplus two John Deere Gator utility vehicles identified as follows:  2005 JD Gator CS UTV (small)—SF900032 (SF640262)—2345 hrs.— Asset No. 3008782  2010 JD Gator TS UTV (large)—SF900090 (SF640209)—2172 hrs.— Asset No. 3014188 WHEREAS, Minnehaha County finds it desirable to acquire the above-described surplus property to be provided to the Sioux Empire Fair Association, Inc. for use at the W. H. Lyon Fairgrounds and the Event Center property; and WHEREAS, Minnehaha County is a political subdivision of the State of South Dakota; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: Section 1. That the recitals above are adopted and are incorporated herein by this reference as if set out in full. Section 2. That the hereinafter-described surplus property is no longer necessary, useful, or suitable for the purpose for which it was acquired. Section 3. That the gifting for a public purpose by the City of Sioux Falls to Minnehaha County of the following surplus property:  2005 JD Gator CS UTV (small)—SF900032 (SF640262)—2345 hrs.— Asset No. 3008782  2010 JD Gator TS UTV (large)—SF900090 (SF640209)—2172 hrs.— Asset No. 3014188 is hereby approved. A RESOLUTION AUTHORIZING THE CITY OF SIOUX FALLS TO GIFT SANDBAGS TO MAPLETON TOWNSHIP AND THE CITIES OF DELL RAPIDS AND BRANDON, SOUTH DAKOTA. A motion was made by Council Member Brekke and seconded by Council Member Soehl to adopt Resolution No. 99-19. Roll call vote to adopt. 5 Yes: Neitzert, Soehl, Starr, Stehly, Brekke; 0 No: (None). Motion Passed. RESOLUTION NO. 99-19 A RESOLUTION AUTHORIZING THE CITY OF SIOUX FALLS TO GIFT SANDBAGS TO MAPLETON TOWNSHIP AND THE CITIES OF DELL RAPIDS AND BRANDON, SOUTH DAKOTA. WHEREAS, the City of Sioux Falls has declared as surplus 2,700 filled sandbags; and WHEREAS, the township of Mapleton and the cities of Dell Rapids and Brandon, South Dakota, find it desirable to acquire the above-described surplus property; and WHEREAS, the township of Mapleton and the cities of Dell Rapids and Brandon are political subdivisions of the state of South Dakota; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: Section 1. That the recitals above are adopted and are incorporated herein by this reference as if set out in full. Section 2. That the hereinafter-described surplus property is no longer necessary, useful, or suitable for the purpose for which it was acquired. Section 3. That the gifting for a public purpose by the City of Sioux Falls of the following surplus property:  1,600 filled sandbags to the township of Mapleton, SD  800 filled sandbags to the city of Dell Rapids, SD  300 filled sandbags to the city of Brandon, SD is hereby approved.
