RESOLUTION NO. 80-22
A RESOLUTION APPROVING THE RELEASE OF THE STORM SEWER EASEMENT
LOCATED IN LOT B1 SANDY CREEK ADDITION TO THE CITY OF SIOUX FALLS,
MINNEHAHA COUNTY, SD.
WHEREAS, the City of Sioux Falls, SD, no longer needs the storm sewer easement
across the above-described real property, as shown on Exhibit A. Signed approvals
from all public and private utilities are on file with the office of the City Engineer.
WHEREAS, the storm sewer easement was established by permanent storm sewer
easement, filed in Book 219 of Miscellaneous on page 13-14 in the office of the
Register of Deeds for Minnehaha County, SD, on July 26, 1994, and was reaffirmed by
plat and filed in Book 58 of Plats on page 179 in the office of the Register of Deeds for
Minnehaha County, SD, on September 12, 1996, and again reaffirmed by plat and filed
in Book 58 of Plats on page 278 in the office of the Register of Deeds for Minnehaha
County, SD, on December 18, 1996.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That it approves the release of the storm sewer easement, as shown on attached
Exhibit A, and affecting the real property described as Lot B1 Sandy Creek Addition to
the City of Sioux Falls, Minnehaha County, SD, and that the City Clerk shall cause to
be recorded with the Register of Deeds, Minnehaha County, SD, a duly certified
transcript of this resolution.

LOT 1 IN BLOCK 5 OF WESTERN HEIGHTS IN NE1/4 OF SECTION 35-T101N-
R50W OF THE 5TH P.M., MINNEHAHA COUNTY, SOUTH DAKOTA.
WHEREAS, the City of Sioux Falls, SD, no longer needs part of the permanent
easement area across the above-described real property, as shown on Exhibit A.
Signed approvals from all public and private utilities are on file with the office of the City
Engineer; and
WHEREAS, the permanent easement was established by Resolution #89-09 and filed
in Book 263 of Miscellaneous on page 605 in the office of the Register of Deeds for
Minnehaha County, SD, on October 19, 2009;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That it approves the release of part of the permanent easement, as shown on attached
Exhibit A, and affecting the real property described as vacated S. Cambridge Ave. lying
adjacent to Lot 1 in Block 5 of Western Heights in NE1/4 of Section 35-T101N-R50W of
the 5th P.M., Minnehaha County, South Dakota, and that the City Clerk shall cause to
be recorded with the Register of Deeds, Minnehaha County, South Dakota, a duly
certified transcript of this resolution.

WHEREAS, Arbor’s Edge Homeowners Association, Inc. (hereinafter, “Arbor’s Edge”),
is the fee owner of the following described real property consisting of approximately
2.16 acres located at 8901 East Black Walnut Street, Sioux Falls, SD 57110, to wit:
LOT 2 BLOCK 24 ARBOR’S EDGE AN ADDITION TO THE CITY OF SIOUX FALLS,
MINNEHAHA COUNTY, SOUTH DAKOTA (hereinafter, “Property”); and
WHEREAS, Arbor’s Edge owns and maintains a stormwater detention facility
(hereinafter, “Facility”) on the Property that provides stormwater detention storage and
water quality benefits for the contributing residential area, and drains into a tributary of
the Big Sioux River; and
WHEREAS, the Facility conveys, in part, stormwater that flows over the public right-of-
way from a contributing residential area including Arbor’s Edge and areas outside of
Arbor’s Edge; and
WHEREAS, the Property is adjacent to municipal City streets that contribute sediment
to the Facility; and
WHEREAS, Arbor’s Edge and the City have identified several inadequacies affecting
the functionality of the Facility, necessitating near-term construction improvements and
long-term maintenance; and
WHEREAS, the City and Arbor’s Edge desire to enter into an Agreement to account for
all near-term construction improvements necessary to ensure the functionality of the
Facility, as well as subsequent long-term maintenance of the Facility;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That the Agreement attached to and part of this resolution is hereby approved.
That the Mayor is authorized to sign such Agreement.
