RESOLUTION NO. 63-23
A RESOLUTION APPROVING THE RELEASE OF THE PUBLIC SIDEWALK
EASEMENT LOCATED IN LOT 5A AND 5B IN BLOCK 16 OF DAWLEY FARM
VILLAGE ADDITION TO THE CITY OF SIOUX FALLS, MINNEHAHA COUNTY,
SOUTH DAKOTA, AS SHOWN ON EXHIBIT A.
WHEREAS, the City of Sioux Falls, SD, no longer needs the public sidewalk easement
across the above-described real property, as shown on Exhibit A. Signed approvals
from all public and private utilities are on file with the office of the City Engineer; and
WHEREAS, the public sidewalk easement was established by plat and filed in Book 84
of Plats on page 45 in the office of the Register of Deeds for Minnehaha County, SD,
on February 28, 2022, and was reaffirmed by plat and filed in Book 84 of Plats on page
167 in the office of the Register of Deeds for Minnehaha County, SD, on June 10, 2022,
and again was reaffirmed by plat and filed in Book 85 of Plats on page 137 in the office
of the Register of Deeds for Minnehaha County, SD, on June 29, 2023;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That it approves the release of the public sidewalk easement, as shown on attached
Exhibit A, and affecting the real property described as Lot 5A and 5B in Block 16 of
Dawley Farm Village Addition to the City of Sioux Falls, Minnehaha County, SD, and
that the City Clerk shall cause to be recorded with the Register of Deeds, Minnehaha
County, SD, a duly certified transcript of this resolution.

Sierra Broussard spoke about issues related to and the need for Code Enforcement to
visit apartments rented by Tzadik Management.
Phyllis Arends spoke about Minority Mental Health Month and the upcoming Dancing
with the Sioux Falls Stars event on October 7th.
Terry Bultje spoke about the inconsistency of ordinances related to E bikes.
Justin Gawelle spoke about issues with Tzadik Management and the work that he has
done to inform officials about it.

REGULAR AGENDA
The City Council may adopt the Regular Agenda by a majority vote during “Approval of the Regular
Agenda”. The Council may also change the order of items or remove items, both by amendment. Items up
for consideration are presented and public comment is taken prior to the making of motions.

Background & Objective: This is the first of three agreements that will be brought
forward to assist with completing property transfers between the City, Sioux Falls
Development Foundation and South Dakota National Guard (USA). These transfers will
support the National Guard with their new Readiness Center in Sioux Falls and the
Sioux Falls Development Foundation in acquiring property on Russell Street adjacent to
the City-owned property recently acquired from Minnehaha County.

15. A RESOLUTION APPROVING THE RELEASE OF THE PUBLIC SIDEWALK

Background & Objective: This public sidewalk easement was dedicated on a
pervious plat and now that the property has been sold to another developer, they have
requested to reroute the sidewalk alignment. The new alignment has been established
with new easements and this resolution is needed to remove the old easement from the
properties.
NEW BUSINESS
During consideration of new business, the Mayor or any two City Council members may bring before the
City Council any business that person feels should be deliberated upon by the City Council. These matters
can be added to the agenda by a vote of six City Council members and will be considered under new
business. Formal action on these matters shall be deferred until a subsequent City Council meeting, unless
consideration is necessary for the immediate preservation of the public peace, health or safety of the
municipal government. If the City Council chooses to take immediate action on the newly calendared
agenda item, an affirmative vote of six members of the Council is required for approval. (City Ordinance
§30.014(d)).
GENERAL PUBLIC INPUT
During General Public Input, comments shall last no more than three minutes per person and comments are
limited to topics which do not involve agenda items appearing earlier in the agenda as comments will have
already been received for those items (City Ordinance §30.015).
