MINUTES City Council Meeting Tuesday, June 11, 2024, at 6:00 PM Carnegie Town Hall, 235 West 10th St., Sioux Falls, South Dakota 57104 CALL TO ORDER 1. Notice of Contracts/Agreements under $100K and Change Orders over $100K through May 31, 2024. 7. Approval of contracts/agreements over $100K on the memorandum dated June 7, 2024. 8. Approval of a request pursuant to SDCL 35-1-5.5 from Jenna King to consume, but not sell, alcoholic beverages at the Mary Jo Wegner Arboretum, 1900 S. Perry Pl., on June 22, 2024. The City Council concurs with the Minnehaha County Commission's recommendation for approval of the following abatements: 9. Parcel #37381, for 2021 property taxes in the amount of $92.36. Reason: An error has been made in any identifying entry or description of the real property, in entering the valuation of the real property or in the extension of the tax, to the injury of the complainant. 10. Parcel #37381, for 2022 property taxes in the amount of $733.66. Reason: An error has been made in any identifying entry or description of the real property, in entering the valuation of the real property or in the extension of the tax, to the injury of the complainant. 11. Parcel #37381, for 2023 property taxes in the amount of $991.49. Parcel #37419, for 2023 property taxes in the amount of $126.36. Reason: The property is exempt from the tax. 13. Parcel #38022, for 2023 property taxes in the amount of $341.20. A RESOLUTION APPROVING TRANSIT ROUTE MODIFICATIONS. Sponsor: Mayor A motion was made by Council Member Barranco and seconded by Council Member Basye to adopt Resolution No. 60-24. Roll call vote to adopt. 7 Yes: Cole, Merkouris, Sigette, Spellerberg, Thomason, Barranco, Basye; 0 No: (None). Motion Passed. RESOLUTION NO. 60-24 A RESOLUTION APPROVING TRANSIT ROUTE MODIFICATIONS. WHEREAS, the Public Transit Advisory Board (PTAB) facilitated public input on proposed fixed transit route modifications and an expanded microtransit route boundary (collectively, “transit route modifications”), including hosting a public input meeting on April 22, 2024, as well as a public hearing on May 20, 2024; and WHEREAS, Via Transportation, the City’s transit provider, hosted a public engagement opportunity regarding the transit route modifications on May 6, 2024; and WHEREAS, PTAB, at its May 20, 2024, meeting unanimously recommended approval of the transit route modifications; and WHEREAS, following PTAB’s May 20, 2024, meeting, notice of the proposed transit route modifications was published in the official Sioux Falls, SD, newspaper on May 24, 2024, wherein the public was advised they could request another public meeting if so desired, and thereafter no member of the public requested another public meeting; and NOW, THEREFORE, BE IT RESOLVED: Section 1. That the transit routes identified on the maps attached hereto and made part of this resolution are hereby adopted. Section 2. That the adopted microtransit route boundary shall be implemented no later than August 30, 2024. Section 3. That the adopted fixed transit routes shall be implemented in their entirety no later than September 30, 2024. Section 4. That the City shall publish this resolution, without attachments, after its passage. The attachments are on file and available for inspection in the office of the City Clerk. Date adopted: 06/11/24 . Sponsor: Mayor A motion was made by Council Member Sigette and seconded by Council Member Barranco to adopt Resolution No. 61-24. RESOLUTION NO. 61-24 A RESOLUTION DISSOLVING TAX INCREMENT DISTRICT NO. 15. WHEREAS, on March 19, 2012, the City adopted Resolution No. 14-12 creating the Sioux Falls Tax Increment District No. 15 pursuant to SDCL 11-9; and WHEREAS, on March 19, 2012, the City adopted Resolution No. 15-12 approving the Project Plan for the Sioux Falls Tax Increment District No. 15 pursuant to SDCL 11-9; and WHEREAS, the development and improvements occurred as outlined within the Project Plan; and WHEREAS, a total reimbursement of $7,345,293.38 was remitted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That Sioux Falls Tax Increment District No. 15 is hereby dissolved. RESOLUTION NO. 62-24 ANNEXATION 019410-2024—VETERANS PARKWAY ROW A RESOLUTION INCLUDING CERTAIN CONTIGUOUS TERRITORY WITHIN THE CORPORATE LIMITS OF THE CITY OF SIOUX FALLS, SOUTH DAKOTA. WHEREAS, there has been presented to the City Council of the City of Sioux Falls and filed with the City Clerk, a Petition in writing signed by the owners and otherwise in compliance with the provisions of SDCL Chapter 9-4, requesting that the territory hereinafter described be included within the municipality; and WHEREAS, there has been an analysis completed regarding the territory hereinafter described and it has been found that: 1. The property has been properly described and is contiguous to the current city limits. 2. The proposed land uses and densities are generally consistent with the Shape Sioux Falls 2040 Comprehensive Plan. 3. Annexation ensures an orderly transition of service responsibilities from the County level to the City level. WHEREAS, there has been presented to the City Council of the City of Sioux Falls and filed with the City Clerk, a Petition in writing signed by the owners and otherwise in compliance with the provisions of SDCL Chapter 9-4, requesting that the territory hereinafter described be included within the municipality; and WHEREAS, there has been an analysis completed regarding the territory hereinafter described and it has been found that: 1. The property has been properly described and is contiguous to the current city limits. 2. The proposed land uses and densities are generally consistent with the Shape Sioux Falls 2040 Comprehensive Plan. 3. There is access to the major street network, through subdivision, along 69th Street. 4. Sanitary sewer is available, upon a completed capacity study for the proposed annexation area. 5. City water is currently available for the proposed annexation area. Publicly financed sanitary sewer is available for the proposed annexation area; sewer lines need to be extended to the sites. 4. Publicly financed water is available for the proposed annexation area; water lines need to be extended to the sites. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the following described properties are and the same hereby are included within the corporate limits of the city of Sioux Falls, Lincoln County, SD, and the boundary of the city is hereby extended to include such territory: Lot 1A in Van Deest Tract 1 in the South 1/2 of the Southwest 1/4 of Section 18, Township 100 North, Range 50 West of the 5th P.M., all in Lincoln County, South Dakota; and the abutting public right-of-way. GENERAL PUBLIC INPUT Chester Deyoung spoke about his and his family's business background; and issues with the Engineering Department. Sierra Broussard spoke about Code Enforcement issues with a house at 235 South Euclid Avenue, which experienced a fire; issues with a bar in the Northeast District; and security concerns with Pave bar. Steven Siano provided a brief background of himself; spoke about a request to provide public input without having to personally attend meetings; issues with Paratransit; and COVID. Tim Stanga spoke on the closing of the eastside branch drop off during Project Trim; replacing sidewalks; the condition of the city's streets; and the recent vote of the Council for the new Sanford building. Sponsor: Mayor Background & Objective: The Sioux Falls Public Transit Advisory Board recommended approval of route modifications and service expansion throughout the Sioux Area Metro transit system. The changes include adding citywide SAM On Demand on weekdays, replacing the 12 weekday bus routes with 9 new direct and frequent routes, and expanding weekday and Saturday service hours. These changes will allow every resident within the city of Sioux Falls to access the public transit system and are expected to be implemented this fall. 20.
