PLEDGE OF ALLEGIANCE APPROVAL OF REGULAR AGENDA A motion was made by Council Member Bob Litz and seconded by Council Member Kenny Anderson Jr. to approve the Regular Agenda. RESOLUTION NO. 103-10 A RESOLUTION APPROVING THE VACATION OF THE RIGHT-OF-WAY OF TED DRIVE ABUTTING TRACTS 10 AND 11 N1/2 SEC 30-101-48 IVERSON TRACTS SEC 21, N1/2 SEC 30, & N1/2 SEC 33-101-48, MINNEHAHA COUNTY, SD. WHEREAS, a petition of the owners of Tract 10 N1/2 Sec 30-101-48 Iverson Tracts Sec 21, N1/2 Sec 30, & N1/2 Sec 33-101-48, Minnehaha County, SD, Tract 11 N1/2 Sec 30-101-48 Iverson Tracts Sec 21, N1/2 Sec 30, & N1/2 Sec 33-101-48, Minnehaha County, SD, has been filed with Minnehaha County, asking that the aforesaid be vacated. Notice of hearing has been given by County, said notice was properly published in compliance with the requirements of SDCL 9-45; and WHEREAS, the hearing was held on November 15, 2010, and the petition has been duly examined and investigated by the County Commission of the Minnehaha County and the County Commission has approved said petition; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That pursuant to SDCL 9-45-13.1 the City approves the vacation of the right-of-way of Ted Drive abutting Tracts 10 and 11 N1/2 Sec 30-101-48 Iverson Tracts Sec 21, N1/2 Sec 30, & N1/2 Sec 33-101-48, Minnehaha County, SD, and that the City Clerk shall cause to be filed with the Register of Deeds, Minnehaha County, South Dakota, a transcript of such duly certified resolution.
