A RESOLUTION APPROVING THE VACATION OF THE PUBLIC RIGHT-OF- WAY FOR A PORTION OF 264TH ST. IN SECTION 17-T101N-R50W AND A PORTION OF 468TH AVE. IN SECTIONS 16-T101N-R50W AND 17-T101N- R50W, MINNEHAHA COUNTY, SD. A motion was made by Council Member Michelle Erpenbach and seconded by Council Member James Entenman to adopt said Resolution 88-11.  Vote: Roll Call: Yeses, Sue Aguilar, Vernon Brown, James Entenman, Michelle Erpenbach, Greg Jamison, Dean Karsky, Rex Rolfing, 7. Noes, 0. Motion Passed. RESOLUTION NO. 88-11 A RESOLUTION APPROVING THE VACATION OF THE PUBLIC RIGHT-OF-WAY FOR A PORTION OF 264TH ST. IN SECTION 17-T101N-R50W AND A PORTION OF 468TH AVE. IN SECTIONS 16-T101N-R50W AND 17-T101N-R50W, MINNEHAHA COUNTY, SD. WHEREAS, a petition has been filed with Minnehaha County asking that the aforesaid be vacated. Notice of hearing has been given by the County, and said notice was properly published in compliance with the requirements of SDCL 31-3-7; and WHEREAS, a hearing was held on October 17, 2011, and the petition has been duly examined and investigated by the County Commission of Minnehaha County and the County Commission has approved said petition; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That pursuant to SDCL 9-45-13.1, the City approves the vacation of the right-of-way of that portion of 264th St. beginning at 467th Ave. and continuing east to 468th Ave., and lying adjacent to the SE1/4 NE1/4 in Section 17-T101N-R50W and the NE1/4 NE1/4 (ex. W 120' S 438') and NW1/4 NE1/4 and W 120' S 438' NE1/4 NE1/4 and SW1/4 NE1/4 (ex. Tract 1 Cooch Addition) and Tract 1 Cooch Addition all in Section 17-T101N-R50W and the NE1/4 NW1/4 in Section 17-T101N-R50W and the NW1/4 NW1/4 in Section 17-T101N-R50W and the S1/2 NW1/4 in Section 17-T101N- R50W of the 5th P.M., Minnehaha County; and That portion of the statutory section line highway named 468th Ave. beginning at 264th St. and continuing south to Sands St., and lying adjacent to SE1/4 NE1/4 in Section 17-T101N-R50W and the NW1/4 (ex. C.M. Tract 1 Addition) in Section 16-T101N-R50W of the 5th P.M., Minnehaha County; and that the City Clerk shall cause to be filed with the Register of Deeds, Minnehaha County, South Dakota, a transcript of such duly certified resolution.
