Sean Ervin, John Paulson recused themselves from the discussion and vote on this item pursuant to City Ordinance 35.028. D. Petition: CU-015299-2021: Conditional Use Permit for On-sale Alcoholic Beverage Establishment within 500 feet from a sensitive use located at 2408 E 10TH ST. CONSENT AGENDA APPROVAL A motion was made by Kurt Johnson and seconded by Janet Kittams to approve the Consent Agenda. A motion was made by Kurt Johnson and seconded by Larry Luetke to amend by moving Item 2C to the Regular Agenda. Petition: REZ-015272-2021: Rezoning from the RT-1 Single-Family Residential - Traditional district to the C-1, Commercial—Pedestrian-Oriented district located at 100 S GRANGE AVE. Legal Description: W 50' of lots 16, 17, and 18, Block 40 Pettigrew's Addition To City Of Sioux Falls, Minnehaha County Commission Chair Erik Nyberg passed the gavel to Vice-Chair John Paulson at this time. Nyberg recused himself from the discussion and vote on this item pursuant to City Ordinance 35.028. A motion was made by Larry Luetke and seconded by Aaron Norman to approve Item 5A. Voice vote to approve. 6 Yes: Sean Ervin, Kurt Johnson, Janet Kittams, Larry Luetke, Bradyn Neises, Aaron Norman; 0 No: (None). Motion Passed. B. Petition: AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 160: ZONING, SUBCHAPTER DEFINITIONS-SENSITIVE LAND USES Legal Description: A motion was made by Bradyn Neises and seconded by Larry Luetke to approve Item 5B.
