Legal Description: Tract A (Except Lot 1 Thereof) and the Vacated W 17’ of N. Louise Cir Lying Adjacent Thereto, Miller's Addition, City of Sioux Falls, Minnehaha County, SD 3. CONSENT AGENDA APPROVAL A motion was made by Kurt Johnson and seconded by Larry Luetke to approve the Consent Agenda. A motion was made by Kurt Johnson and seconded by Larry Luetke to amend the Consent Agenda by moving Items 2C and 2D to the Regular Agenda. Aaron Norman and Erik Nyberg excused themselves from the meeting and was not present for the vote on this motion. Duluth Ave. Legal Description: All of Lot 7 and the N 1/2 of Lot 8, Block 12, West Sioux Falls Addition, City of Sioux Falls, Minnehaha County, SD A motion was made by Sean Ervin and seconded by Kurt Johnson to approve Item 5A. A motion was made by Sean Ervin and seconded by Larry Luetke to amend with the following condition: that this property is limited to no more than two units or as a duplex. Voice vote to amend. 6 Yes: Sean Ervin, Kurt Johnson, Larry Luetke, Aaron Norman, Erik Nyberg, John Paulson; 0 No: (None). Motion Passed. Roll call vote to approve, as amended. 3 Yes: Sean Ervin, Kurt Johnson, Larry Luetke; 3 No: Aaron Norman, Erik Nyberg, John Paulson. Motion Failed. Commission Chair Kittams broke the tie vote with a 'No' vote. B. Petition: REZ-017718-2023: Rezoning from the O Office District to the S-1 General Institutional District located south of W. Maple St. and east of N. Terry Ave. Legal Description: A Portion of Tract 2, Boyce Park Addition as shown by exhibit, City of Sioux Falls, Minnehaha County, SD A motion was made by Erik Nyberg and seconded by Larry Luetke to withdraw Item 5B. Voice vote to withdraw. 6 Yes: Sean Ervin, Kurt Johnson, Larry Luetke, Aaron Norman, Erik Nyberg, John Paulson; 0 No: (None). Motion Passed. C. Petition: REZ-017720-2023: Rezoning from the O Office District to the I-1 Light Industrial District located at 5120 and 5200 N. Granite Ln. Legal Description: Lots 1 and 2A, Block 1, Roeman Addition, City of Sioux Falls, Minnehaha County, SD A motion was made by Erik Nyberg and seconded by Aaron Norman to approve Item 5C. Voice vote to approve. 5 Yes: Kurt Johnson, Larry Luetke, Aaron Norman, Erik Nyberg, John Paulson; 1 No: Sean Ervin. Motion Passed. 6.
