Petition: Ordinance Amending Chapter 160: The 2013 Shape Places Zoning Ordinance of the City of Sioux Falls. Legal Description: A motion was made by Erik Nyberg and seconded by John Paulson to defer to the September 6, 2023, Planning Commission Meeting. Voice vote to defer. 5 Yes: Kurt Johnson, Erica Mullaly, Bradyn Neises, Erik Nyberg, John Paulson; 0 No: (None). Motion Passed. 3. CONSENT AGENDA APPROVAL A motion was made by Kurt Johnson and seconded by Bradyn Neises to approve the Consent Agenda. A motion was made by Kurt Johnson and seconded by Bradyn Neises to amend by moving Item 2D to the Regular Agenda. Voice vote to amend. 5 Yes: Kurt Johnson, Erica Mullaly, Bradyn Neises, Erik Nyberg, John Paulson; 0 No: (None). Motion Passed. REGULAR AGENDA APPROVAL A motion was made by Erik Nyberg and seconded by John Paulson to approve the Regular Agenda. REGULAR AGENDA PETITIONS A. Petition: CU-018124-2023: Conditional Use Permit for an On-Sale Alcoholic Beverage Establishment located at 4401 E. 10th St. Legal Description: Lot 1, Block 1, Taggart Addition, City of Sioux Falls, Minnehaha County, SD A motion was made by Kurt Johnson and seconded by Bradyn Neises to approve Item 5A with the condition to: Place a minimum of a 4' high screen fence along the south property line to screen the parking lot from the property to the south.  Voice vote to approve. 4 Yes: Kurt Johnson, Erica Mullaly, Bradyn Neises, Erik Nyberg; 1 No: John Paulson. Motion Passed. B. Petition: REZ-018366-2023: Rezoning from the O Office and RT-1 Single-Family Residential - Traditional Districts to the C-2 Commercial—Neighborhood and Streetcar District located north of E. 18th St. and west of S. 7th Ave. Legal Description: Lot A, Tract 1 (Except Tract 1 of West Egger Steel Addition), Egger’s Addition, City of Sioux Falls, Minnehaha County, SD A motion was made by Bradyn Neises and seconded by Kurt Johnson to withdraw Item 5B. Voice vote to withdraw. 4 Yes: Kurt Johnson, Erica Mullaly, Bradyn Neises, Erik Nyberg; 0 No: (None). Motion Passed. John Paulson recused himself from the discussion and vote on this item pursuant to City Ordinance 35.028. 6. PUBLIC INPUT ON NON-AGENDA ITEMS (5-MINUTE COMMENT PERIOD PER INDIVIDUAL) There was none.
