Assembly members Eisenbeisz (re-elected), Miyasato, and Wein were sworn in at the beginning of New Business and presided through the remainder of the meeting. Present: 9 - Swanson, Miyasato, Eisenbeisz, Guevin, Potrzuski, Hunter, Knox, Bean, and Wein IV. CORRESPONDENCE/AGENDA CHANGES No agenda changes. 17-173 Reminders, Calendars and General Correspondence V. CEREMONIAL MATTERS Mayor Hunter thanked Library Commission member, Jane Eidler, for her service. VI. SPECIAL REPORTS: Government to Government, Municipal Boards/Commissions/Committees, Sitka Community Hospital, Municipal Departments, School District, Students and Guests (five minute time limit) Kathy Hope Erickson, Sitka Tribe of Alaska Council Chair, spoke to upcoming events. CITY AND BOROUGH OF SITKA Page 1 City and Borough Assembly Minutes - Final October 10, 2017 Library Commission member, Darryl Rehkopf, thanked Sitka Public Library staff for their work and Maite Lorente for filling in as Acting Library Director. VII. PERSONS TO BE HEARD Tammy Judd Jenny, representing Sitka Bahai Community, spoke to the upcoming celebration planned for the 200th anniversary. Kendall Folkert stated he has been living at the Halibut Point Recreation Area cabin and maintaining it. He spoke to recent changes in oversight and that he had been requested to leave. He asked the Assembly for their support for him to stay. VIII. REPORTS a. Mayor, b. Administrator, c. Attorney, d. Liaison Representatives, e. Clerk, f. Other Mayor - Hunter relayed he had met with Governor Walker and his staff and reminded the 2017 Alaska Chamber Fall Forum was being held in Sitka this week. Administrator - Brady reviewed the recent local purchase report, thanked employee Maite Lorente for filling in as Acting Library Director over the summer, and extended appreciation to Fire Chief Dave Miller and staff for hosting the Alaska State Firefighters Association Fall Conference. Brady provided an update on the Lake Street road project. In addition, he reported on his attendance at the Indigenous Peoples' Day event at the University of Alaska Southeast. Liaisons - Knox reported on the Parks and Recreation Committee meeting and Eisenbeisz on the Hospital Board meeting. Potrzuski spoke of the Indigenous Peoples' Day event and told of the powerful speeches given by Lieutenant Governor Byron Mallott and Dionne Brady-Howard. Clerk - Peterson announced the November 14th Assembly meeting had been moved to November 7th. IX. CONSENT AGENDA A 17-166 Approve the minutes of the September 26 Assembly meeting A motion was made by Swanson that the Consent Agenda consisting of item A be APPROVED. The motion PASSED by the following vote. Yes: 7- Swanson, Eisenbeisz, Guevin, Potrzuski, Hunter, Knox, and Bean Non-voting: 2- Miyasato, and Wein X. BOARD, COMMISSION, COMMITTEE APPOINTMENTS None. UNFINISHED BUSINESS: CITY AND BOROUGH OF SITKA Page 2 City and Borough Assembly Minutes - Final October 10, 2017 B 17-167 Approve the Municipal Clerk's Certification of Election A motion was made by Swanson to formally ACCEPT the Certification of Election for the October 3, 2017 Regular Municipal Election according to the results set forth in the attached election certification prepared by the Municipal Clerk and request that the official tally be included in the minutes as part of the permanent record. The motion PASSED by the following vote. Yes: 7- Swanson, Eisenbeisz, Guevin, Potrzuski, Hunter, Knox, and Bean Non-voting: 2- Miyasato, and Wein C 17-168 Recognize outgoing Assembly members - followed by a short recess Mayor Hunter recognized Aaron Swanson and Tristan Guevin for their service. Guevin, participating by phone, read a statement. He thanked City staff, fellow Assembly members, and the citizens of Sitka. XII. NEW BUSINESS: D 17-169 Swearing in of the newly elected officials Dr. Richard Wein and Steven Eisenbeisz were sworn in as Assembly members for three-year terms. Benjamin Miyasato was sworn in as an Assembly member for a one-year term. Mayor Hunter shared his intentions on how the meetings would be conducted and rules for debate. E 17-172 Approve an agreement for payment of remediation costs between the City and Borough of Sitka and the Sitka Community Land Trust for 1306 Halibut Point Road (possible executive session) Knox suggested the Assembly go into Executive Session to inform the new Assembly members of the legal matter affecting the Municipality with respect to the land conveyed by the Municipality to the Sitka Community Land Trust. A motion was made by Knox to go into Executive Session, pursuant to Sitka General Code 2.04.020.D.4, to communicate with the Municipal Attorney concerning a legal matter affecting the Municipality with respect to the land conveyed by the Municipality to the Sitka Community Land Trust. The motion PASSED by the following vote. Yes: 7- Miyasato, Eisenbeisz, Potrzuski, Hunter, Knox, Bean, and Wein Non-voting: 2- Swanson, and Guevin The Assembly was in Executive Session from 7:05pm to 7:30pm. A motion was made by Miyasato to reconvene as the Assembly in regular session. The motion PASSED by a unanimous voice vote. Lillian Owens, a member of the Sitka Community Land Trust (SCLT) Board, urged the CITY AND BOROUGH OF SITKA Page 3 City and Borough Assembly Minutes - Final October 10, 2017 Assembly to support the agreement. Assembly members Potrzuski, Knox, and Miyasato spoke in support of the agreement. Potrzuski reminded the SCLT was asking for help in order to keep the housing project affordable for the buyers. Knox felt the City was responsible for the contamination and therefore responsible for the clean up costs. Miyasato, when serving on the Assembly in 2015, supported the Ordinance which authorized the transfer/sale of the "Old City Shops" property to the SCLT. He spoke to the importance of affordable housing and wished to continue with the support he offered in 2015. Hunter while supportive of the project did not want to set a precedent and reminded the SCLT had stated the project would continue without financial support from the City. While supportive of affordable housing, Assembly members Bean and Eisenbeisz, reminded of the support the City had given to the SCLT to date. In addition, they spoke to the original agreement and reminded the SCLT had stated they were prepared to deal with contamination issues. Dr. Wein, referenced the original agreement, and offered that a transfer of funds represented a precedent that should not be allowed. A motion was made by Potrzuski to approve an agreement for payment of remediation costs between the City and Borough of Sitka and the Sitka Community Land Trust for 1306 Halibut Point Road and authorize the Municipal Administrator to execute these documents. The motion FAILED by the following vote. Yes: 3- Miyasato, Potrzuski, and Knox No: 4- Eisenbeisz, Hunter, Bean, and Wein Non-voting: 2- Swanson, and Guevin F ORD 17-34 Adjusting the FY18 Budget (Donations-Operations: Sitka Community Land Trust) first reading **no action taken** There was no need for Assembly action because item E failed. G 17-170 Assignments: Deputy Mayor, Vice-Deputy Mayor and Assembly Liaisons Steven Eisenbeisz was nominated and appointed as Deputy Mayor. Bob Potrzuski was nominated and appointed as Vice Deputy Mayor. A roll call vote was taken. Voting for Eisenbeisz: Eisenbeisz, Hunter, Potrzuski, Knox, and Miyasato. Voting for Wein: Bean and Wein. Eisenbeisz prevailed with 5 votes. H 17-171 Scheduling: Assembly Visioning Session (December 2 or 9) For the date of the Visioning Session, the Assembly selected December 9th from 9am to noon at Harrigan Centennial Hall. Mayor Hunter suggested having a facilitator and the following possible agenda items: budget/infrastructure needs, a plan for Sitka Community Hospital, and Assembly subcommittees. XIII. PERSONS TO BE HEARD: Charles Bingham announced the Sitka Health Summit was planned for October 11-13. Arthur Kinnan spoke to concerns he had with the Sitka Police Department. Shirley Robards inquired about the amount of money the City spent at Amazon.com. XIV. EXECUTIVE SESSION See item E. XV. ADJOURNMENT A motion was made by Miyasato to ADJOURN.
