Call to Order and Roll Call. Pledge of Allegiance 3. Minutes. Motion by Commissioner Shives to approve minutes of November 18, 2024 as written; Vice Chair Washington seconded. A vote of 7 YAYS, 0 NAYS, 0 ABSTAIN approved the minutes. 4. Public Hearing a. There were no public hearings scheduled for this meeting. 5. Other Business a. Election of Chair and Vice Chair for 2025 Introduced by Chair Reardon. Commissioner Green made a motion to re-elect Richard Reardon as Chair and Landon Washington as Vice Chair of the Planning Commission for 2025. Commissioner Newton seconded. Richard Reardon was re-elected as Chair and Landon Washington was re- elected as Vice Chair of the Planning Commission for 2025 on a vote of 7 YAYS, 0 NAYS, 0 ABSTAIN. b. Adoption of the 2025 Meeting Calendar Introduced by Chair Reardon. Vice Chair Washington made a motion to adopt the 2025 Meeting Calendar. Commissioner Shives seconded. A vote of 7 YAYS, 0 NAYS, 0 ABSTAIN approved the adoption of the 2025 Meeting Calendar. c. Unified Development Code Update Director McElmurray and Evelyn Campo of Desire Line provided the Commission with an update on the UDC and there was discussion. 6. General and Public Comments. Planning & Zoning Commissions Public Hearing: January 13, 2025 City Council (tentative) Consent Agenda: January 14, 2025 Public Hearing: January 28, 2025 RECOMMENDATIONS Planning Department Planning & Zoning Commissions Approval To be determined FINDINGS 1. The petitioned property contains approximately 0.5 acres and is developed with a commercial structure (Figures 3 and 4). 2. The petitioned property has: • Three registered voters (Certificate of Registrar of Voters dated November 14, 2024). • One of these registered voters (33%) signed the Annexation Petition. • Two non-resident property owners, all of which signed the Annexation Petition (Certificate of Ownership and Assessed Valuation dated October 29, 2024). 3. The petitioned property is contiguous with the City’s corporate limits, with 300 feet or approximately 50% of its boundary being contiguous. 4. The subject property is currently zoned by the Parish as NC-2 Neighborhood Commercial (Figure 5). The applicants propose to establish City zoning as C-4 highway commercial. PC & ZC Page 1 of 5 A24-09 Distributed January 6, 2025 Prepared by A. Sysoiev 5. C-4 allows similar uses as NC-2 and is more appropriate for the current use; it does allow more intense uses. 6. For the purpose of the Sales Tax Enhancement Plan, the property is developed commercial. The Parish needs to concur in this annexation; the Planning Department forwarded the request to concur on November 14, 2024 and the annexation item is on January 9, 2025 agenda. 7. The subject property is located Tyler Drive at Manzella Drive, on the south side of Gause Boulevard East. (Figure 5) 8. Other nearby properties on Tyler Dr are zoned Parish NC-2 and City C-4 (Figures 1 and 5). 9. City sewer and water are immediately adjacent to the property (Figure 6). Applicants understand any development of the property will be required to connect to City water and sewer. 10. The annexation of this property is not expected to negatively impact the City’s CRS rating. With a 0.2% chance of flooding, its location outside the Base Flood Elevation (BFE), and an approximate ground elevation of 16.4 feet, the property poses minimal flood risk. The property lies outside the Special Flood Hazard Area (SFHA) and does not significantly contribute to the floodplain; annexation will neither increase the SFHA’s size nor reduce the proportion of open space within it. 11. The Planning Department finds the annexation is reasonable for the following reasons: • Ease of extension of City services. • Configuration of municipal boundaries to fill in gaps, follow natural boundaries. • Character of the area as commercial extended. • Supported by the City’s Comprehensive Plan for increased economic activity and by enclosing City boundaries. 12. The Planning Department finds the annexation and zoning map amendment requests meet applicable requirements and are appropriate. The petitioned property contains approximately 3 acres and is developed land with a single-family residence with detached garage (Figures 3 and 4). 2. The petitioned property has: • The petitioned property has 3 registered voters (Certificate of Registrar of Voters dated December 9, 2024). Two of these registered voters (66%) signed the Annexation Petition. • The petitioned property has 2 resident property owners (Certificate of Ownership and Assessed Valuation dated November 26, 2024), of which both resident property owners (100%) signed the De-Annexation Petition. • The petitioned property has an assessed value of $46,075.00. Resident property owners representing $46,075.00 (100%) of the assessed value of the petitioned property signed the Annexation Petition. 3. The petitioned property was annexed by previous owners of the property by Ordinance No. 3861 on May 9, 2017. 4. This property is contiguous with the City’s corporate limits along Bayou Bonfouca, approximately 570 feet (42% contiguous to City jurisdiction; 58% contiguous to Parish jurisdiction). The subject property has a City zoning classification of A-2 Single-family residential; the previous Parish zoning for the property was A-3 Suburban District (Figure 5). 6. The applicants propose to re-establish Parish zoning as L-2 Large Lot Residential, the Parish’s new designation for this property. Other nearby properties on Chamale Dr are zoned Parish L-2 (Figure 5). 6. Petitioners are requesting to de-annex the petitioned property because they do not receive any benefit from being within the City limits. The Parish maintains the current infrastructure. 7. City water and sewer service are not available to this property. 8. The Planning Department finds the de-annexation is reasonable for the following reasons: • There currently are no plans for extension of City services to this location. • Reconfiguration of municipal boundaries will remove an “island” of City property surrounded by Parish zoned property. • The City’s 2040 Comprehensive Plan will not be impacted. • The City cannot provide the needs of the residents of the annexed area. 9. The Planning Department finds the de-annexation request meets applicable requirements and are appropriate. 10.
