4. Introduction
T24-01: A request to amend Appendix A, Part 10, Section 10.4, Accessory buildings and uses, of the
City of Slidell Code of Ordinances; to identify regulations relating to unattended collection boxes within
the City of Slidell, and related matters.
Introduced by Chair Reardon. Director McElmurray addressed the Commission, giving them a
description of the upcoming text amendment. This will be up for public hearing at the March 18, 2024
meeting.

A24-01: A request to annex into the City of Slidell property containing 1.004 acres petitioned for
annexation (A24-01), located on the west right-of-way line of East I-10 Service Road (previous Robert
Street), identified as Lot 2A, Square 9, Lindberg Glen Subdivision, by BMA, LLC.
Introduced by Chair Reardon. No one from the public wished to speak. Director McElmurray
addressed the Commission briefly and recommended approval. Commissioner Shives made a motion
to approve and forward to City Council. Commissioner Newton seconded. A vote of 5 YAYS, 0 NAYS,
0 ABSTAIN approved A24-01 for consideration by City Council.
6. Other Business
Director McElmurray announced that a new member, Chad Duffaut, Jr. will be joining the
Commission next month.
7. General and Public Comments. There were none.
8. Adjournment. Meeting adjourned at 7:16 p.m. on motion by Vice Chair Washington, seconded by

CURRENT CONDITIONS
1. The petitioned property contains 1.24 acres and is vacant land (Figures 2 and 3).
2. The petitioned property has:
• No registered voters (Certificate of Registrar of Voters dated November 28, 2023);
• No resident property owners; and
• Two non-resident property owners, all of which signed the Annexation Petition (Certificate of
Ownership and Assessed Valuation dated November 20, 2023).
3. The petitioned property is contiguous with the City’s corporate limits by 100%.
4. For the purpose of the Sales Tax Enhancement Plan, the property is undeveloped commercial or non-
commercial that is more than 90% surrounded by the City. The Parish does not need to concur in the
annexation.

5. City water is available at the southeast corner of the subject property. The city sewer is located within
a utility servitude located at the front of the subject property (Figure 4). Applicants understand any
development of the property will be required to connect to City water and sewer.
6. The property is currently in an X flood zone. The approximate ground elevation at the site is 11.6 feet.
Development of this property should not have a negative impact on the City’s community ratings if
developed meeting the City’s ordinances.
FINDINGS
7. The subject property is zoned by the Parish as NC-1 Professional Offices (Figure 5). The applicants
propose to establish City zoning as C-4 Highway Commercial.
8. The subject property is located on a major roadway (US Highway) – Shortcut Highway (US-190
Business).
9. Nearby properties on Shortcut Hwy are zoned Parish NC-1 and NC-4 Neighborhood Institutional, and
City C-4, C-2 Neighborhood Commercial, and C-1A Fremaux Ave/Shortcut Hwy District (Figures 1 and
4).
10. C-4 allows similar uses as NC-1; it does allow more intense uses.
11. C-4 is appropriate for this location because of its location on a major commercial arterial corridor,
proximity to other properties with the same or similar commercial zoning, and anticipated commercial
corridor zoning map adjustments currently in progress as part of the Unified Development Code
updates to the Municipal Code and zoning regulations.
12. The Planning Department finds the annexation is reasonable for the following reasons:
• Allows for better configuration of municipal boundaries by absorption of isolated parish parcel.
• Improves safety protocols and provisions for residents and visitors.
• Continues to solidify the urbanized character of the corridor.
• Supported by the City’s Comprehensive Plan Future Land Use Map, see Figure 6.
RECOMMENDATION
13. The Planning Department finds the annexation and zoning map amendment requests meet applicable
requirements and are appropriate.

9 An ordinance amending the City of Slidell Code of Ordinances, Part 9, Definitions,
10 and Part 10, Section 10.4 Accessory Uses, to promote the health, safety, and
11 welfare of the public by providing minimum performance standards that support
12 the successful operation of unattended donation/collection boxes (UDCBs) and to
13 limit potential negative impacts to nearby properties and public spaces.

15 WHEREAS, the City of Slidell has a need to expand the definitions in the Municipal
16 Code to coincide with current commercial and philanthropic activities which may utilize
17 the operation of unattended donation/collection boxes (UDCBs) and,
18 WHEREAS, the City of Slidell has a responsibility to ensure regulations provide for
19 the health, safety, and welfare of residents and visitors by establishing standards and a
20 permitting process for regulating UDCBs for clothing or other salvageable personal
21 property within the city; and,
22 WHEREAS, the flood hazard areas of the city are subject to periodic inundation
23 which can result in loss of life and property, health and safety hazards, disruption of
24 commerce and governmental services, and extraordinary public expenditures for flood
25 protection and relief, all of which adversely affect the public health, safety and general
26 welfare; and
27 WHEREAS, the City has a responsibility to ensure that UDCBs do not pose a
28 hazard to pedestrian and vehicular traffic; and,
29 WHEREAS, the City has a responsibility nt to ensure that donated or deposited
30 materials are not allowed to accumulate outside of the UDCBs where it can be scattered
31 by adverse weather conditions, animal contacts and human activities; and,
32 WHEREAS, the City has a responsibility to establish criteria that avoid attracting
33 vermin, unsightliness, and public health hazard; and,

34 WHEREAS, the City of Slidell has existing regulations addressing the placement,
35 size, and type of accessory uses which may be allowed on a developed parcel with a
36 primary building; and
37 NOW, THEREFORE, BE IT ORDAINED by the City of Slidell City Council that it
38 hereby amends the the City of Slidell Code of Ordinances, Part 9, Definitions, and Part
39 10, Section 10.4 Accessory Uses, to promote the health, safety, and welfare of the public
40 by providing minimum performance standards that support the successful operation of
41 unattended donation/collection boxes (UDCBs) and to limit potential negative impacts to
42 nearby properties and public spaces, in accordance with the following:

46 Part 9. – Definitions

48 Accessory building and use: Subordinate building or a portion of the main building, the
49 use of which is incidental to that of the primary use, the main building or land,
50 and is not used for a place of habitation or a living room, kitchen, dining room,
51 sitting room, bedroom, or library. An accessory use is incidental to the main or
52 primary use of the premises. A swimming pool is an accessory use.

54 Agent. A person who is authorized by the parcel owner to act on their behalf.

56 Building Official: The Chief Building Official and her/his successor in title and her/his
57 designees.

59 Donated/collected material. Any salvageable personal property, such as clothing and
60 books and household items that is collected for periodic transport off-site for
61 processing or redistribution or both.

63 Mini-warehouse or mini-storage: A building or group of buildings containing individual
64 storage units rented or leased to individuals for the storage of merchandise,
65 commodities or private property.

67 Principal building. A building that is occupied by a principal use.
68 Principal use. A use that fulfills a primary function of an establishment, institution,
69 household, or other entity.
70 Property owner. The owner of a lot or parcel. An entity that only owns a building and not
71 the lot that the building is situated on is the “building owner” not the “property
72 owner” for the purpose of this Code.

74 Unattended donation/collection boxes or UDCB. Unstaffed drop-off boxes, containers,
75 receptacles, or similar facilities that accept textiles, shoes, books and/or other
76 salvageable personal property items that may be used by the operator for
77 distribution, resale, or recycling. Having one or more staff on location for less
78 than eight hours per each 24-hour period is considered unstaffed.
79 Unattended Donation Collection Box (UDCB) Operator. A person or entity who utilizes
80 or maintains an UDCB to solicit donations/collections of salvageable personal
81 property.
82 Unattended Donation Collection Box (UDCB) permit. The City of Slidell's annually
83 renewable permit required to place, operate, maintain, or allow an UDCB within
84 the city limits.
85 Unpermitted unattended donation collection box (UDCB). An UDCB established either
86 without an UDCB permit or with an invalid UDCB permit, such as an UDCB
87 permit that was issued in error or on the basis of incorrect or incomplete
88 information supplied, or in violation of any law, ordinance, rule, or regulation.

95 Unattended donation/collection boxes.
96 (a) Purpose. The purpose of these regulations is to promote the health, safety,
97 and/or welfare of the public by providing minimum performance standards
98 that support the successful operation of unattended donation/collection
99 boxes (UDCBs) and to limit potential negative impacts to nearby properties
100 and public spaces.
101 (b) Conflicting provisions. Where a conflict exists between the regulations or
102 requirements in this section and applicable regulations or requirements
103 contained in other chapters of the Code, the more restrictive regulations or
104 requirements shall prevail.
105 (c) Permit required for UDCBs.
106 (1) It is unlawful to place, operate, maintain, or allow an UDCB on any
107 real property unless the parcel owner/agent and/or operator first
108 obtains an annually renewable UDCB permit from the city.
109 (2) A separate UDCB permit is required for each UDCB.
110 (3) Only one UDCB is allowed per parcel.
111 (4) The UDCB permit applicant must be the UDCB operator and the
112 permit cannot be transferred, conveyed, or otherwise assigned to
113 another person or entity without first submitting an updated UDCB
114 permit application.
115 (5) The Planning Director is hereby granted the authority to review and
116 perform all decision-making regarding the issuance and renewal of
117 UDCB permit applications, and Code Enforcement officials are

118 hereby authorized to perform investigative actions regarding UDCB
119 permit applications on behalf of the city.
120 (d) Application requirements. The UDCB permit application must be made on
121 a form provided by the Department of Planning. All applications and fees
122 shall be filed with the Department of Building Safety & Permits and must
123 include:
124 (1) A signed agreement stating that the parcel owner and the UDCB
125 operator will abide by all the processes and requirements described
126 in this section;
127 (2) A non-refundable application fee as listed in Appendix F of this Code;
128 (3) A signed authorization from the parcel owner, or their designated
129 agent, to allow placement of the UDCB. To be considered an agent
130 for the purpose of an UDCB permit, a person must be given express
131 written authorization from the parcel owner on a form provided by the
132 city to apply specifically for an UDCB permit. For the purpose of this
133 section, a person who is given general authorization to act on the
134 behalf of a parcel owner for various activities and transactions in
135 regard to a property is not an agent;
136 (4) A signed acknowledgement of responsibility from the parcel owner,
137 or their authorized agent, and the UDCB operator for joint and
138 several liability for violations of conditions or regulations, and/or
139 nuisance correction, including the responsibility for removal of
140 graffiti, trash, litter, and debris relating to the UDCB;
141 (5) Proof of current general liability insurance held by the property
142 owner, a property tenant, or the UDCB operator of at least
143 $1,000,000 covering the applicant's UDCB and naming the City of
144 Slidell as additional insured;

145 (6) For nonprofit operators, evidence that the nonprofit is registered as
146 a non-profit organization with the State of Louisiana, is recognized
147 by the Internal Revenue Service as such, and complies with
148 Louisiana Revised Statues as amended;
149 (7) For UDCBs applications by for-profit operators, proof of a valid
150 occupational license with the City of Slidell;
151 (8) The name, office physical address, email, website (if available) and
152 telephone number of the UDCB operator and parcel owner, including
153 24-hour contact information. For purposes of this section, an
154 answering machine or service unrelated to the person or entity does
155 not constitute a bona fide office;
156 (9) A vicinity map showing:
157 i. The proposed location of the UDCB, and
158 ii. The distance between the site and all existing UDCBs within
159 1,000 feet of the proposed UDCB location;
160 (10) Photographs of the location and adjacent properties;
161 (11) A site plan containing:
162 i. Location and dimensions of all parcel boundaries;
163 ii. Proposed UDCB location;
164 iii. Identification of the primary structure to which the UDCB is
165 accessory;
166 iv. Location of applicable zoning district front and side yard
167 required setbacks;
168 v. Location of all buildings;
169 vi. Distance between the proposed UDCB, setbacks, parcel
170 lines, and buildings; and

171 vii. Location and dimension of all existing and proposed
172 driveways, garages, carports, parking spaces, maneuvering
173 aisles, pavement, and striping/marking;
174 (12) Elevations showing the appearance, materials, and dimensions of all
175 sides and top of the UDCB, including the information required in this
176 section to be placed on the UDCB and notice sign;
177 (13) A description and/or diagram of the proposed locking mechanism of
178 the UDCB;
179 (14) A maintenance plan (including graffiti removal, pick-up schedule, and
180 litter and trash removal on and around the UDCB) that is sufficient to
181 prevent/eliminate trash and debris in the vicinity of the UDCB;
182 (15) A severe weather acknowledgement that it shall be the responsibility
183 of the owner of the property upon which the UDCB is located and the
184 UDCB operator to remove or properly secure the UDCB in the event
185 of any of the following National Weather Service Advisories,
186 Watches, and Warnings for St Tammany Parish: Wind Advisory,
187 Severe Thunderstorm Watch, High Wind Watch, Tornado Watch,
188 High Wind Warning, Severe Thunderstorm Warning, Tornado
189 Warning, Tropical Storm Warning, Hurricane Watch, and Hurricane
190 Warning; and
191 (16) Any other reasonable information regarding time, place, and manner
192 of UDCB operation, placement, and/or maintenance that the
193 Planning Director requires to evaluate the proposal consistent with
194 the purpose and intent of this section.
195 (e) UDCB permit expiration and renewal.
196 (1) Unless renewed, each UDCB permit will expire and become null and
197 void annually on the anniversary of its date of issuance.

198 (2) An UDCB operator must apply for permit renewal by submitting a
199 renewal application to the Department of Planning at least one month
200 prior to the expiration of the active UDCB permit. The UDCB permit
201 renewal application must be made on a form provided by the
202 Department of Planning. All applications shall be filed with the
203 Department of Building Safety & Permits and must include all
204 information listed in 10.404(d).
205 (3) The Planning Director or their designee may either approve or deny
206 the renewal of an UDCB permit within 30 days of receipt of the
207 complete renewal application and payment of the renewal fee. The
208 failure of the Department of Planning to act within this timeframe will
209 constitute approval of the UDCB permit renewal.
210 (4) The Planning Director or their designee is hereby authorized to
211 disapprove the renewal of an UDCB permit if they find circumstances
212 existed during the term of the UDCB permit or existed at any time
213 during the review of the application for renewal that are inconsistent
214 with any criteria required for approval of a new UDCB permit, or that
215 would justify the revocation of the UDCB permit.
216 (f) Requirements for the approval and renewal of an UDCB permit. The
217 Planning Director may only issue an UDCB permit or renewal when all of
218 the following conditions are true:
219 (1) The applicant has submitted a complete and accurate application
220 accompanied by the applicable fee;
221 (2) There are no open citations, unpaid fines or unresolved violations or
222 complaints related to any UDCB managed by the proposed operator;
223 (3) All existing unpermitted UDCBs that are managed by the proposed
224 operator have been removed;

225 (4) Any verified litter, trash, or debris on the subject property has been
226 abated and any case of a complaint to the city regarding litter, trash,
227 or debris on the subject property have been addressed; and
228 (5) The proposal is consistent with all the requirements of this section.
229 (6) For UDCB renewals, the site does not have a history of nuisance
230 violations or complaints, even if trash, debris, or litter incidents were
231 abated. For the purpose of this subsection, a history of nuisance
232 violations or complaints means three verified property maintenance
233 complaints in the previous 12 months.
234 (g) Time limit for final decision. The Planning Director or their designee will
235 provide a written decision regarding the placement of an UDCB within 30
236 days of the submission of a complete application for an UDCB permit.
237 (h) Appeal and petition processes.
238 (1) For applicants desiring to appeal a decision by the Planning Director
239 on an UDCB permit or a renewal application, to be considered valid
240 such appeal must be filed by the applicant within ten calendar days
241 after the date of the decision.
242 (2) The appeal must be made to the Board of Adjustment as per
243 Appendix A, Part 7.
244 (i) Location.
245 (1) Every UDCB must be located at least 1,000 feet away from any other
246 UDCB, measured in radial distance.
247 (2) UDCBs are only permitted within the C-2, C-4, C-6, M-2, and Airport
248 zoning districts.
249 (3) Each UDCB is only permitted on a lot that also contains a principal
250 building that contains at least one operating business or other
251 ongoing activity with a current occupational license issued by the city.
252 No UDCB shall be located on an unimproved parcel or lot.

253 (4) UDCBs may not be placed within the following locations:
254 i. Within 100 feet from a residentially zoned district;
255 ii. Within 300 feet of a historic district, public park, or school
256 playground boundary;
257 iii. Within the public right-of-way;
258 iv. Within 50 feet of any street or public thoroughfare;
259 v. Within the required front and side yard setback, or ten feet
260 from any property line, whichever is further;
261 vi. Any required site features, parking spaces, site and/or parking
262 lot landscaping areas; or
263 vii. Within 300 feet of any place that stores or sells fuel or other
264 flammable liquids or gases.
265 (5) UDCBs cannot block or impede access to:
266 i. Required parking or driveways;
267 ii. Sight triangles;
268 iii. Pedestrian routes;
269 iv. Emergency vehicle routes;
270 v. Building ingress and egress;
271 vi. Required handicapped accessibility routes;
272 vii. Required easements; or
273 viii. Trash enclosure areas or access to trash bins/trash
274 enclosures.
275 (6) UDCBs cannot impede the functioning of exhaust, ventilation, or fire
276 extinguishing systems.
277 (7) No more than one UDCB will be permitted per parcel. Should an
278 increased volume of items be delivered to the site, operators must
279 make accommodations to the collection schedule and frequency to
280 avoid an overfilled UDCB.

281 (8) The donation/collection area must be visible from the principal
282 building and be no more than ten feet from a continually operating
283 light source.
284 (j) Physical attributes. UDCBs shall:
285 (1) Be fabricated of durable and waterproof materials;
286 (2) Be placed on ground that is paved with impermeable material;
287 (3) Have a collection opening that has a tamper-resistant locking
288 mechanism;
289 (4) Not cover more than 25 square feet in floor area and a maximum of
290 84 inches in height;
291 (5) Not be electrically or hydraulically powered or otherwise
292 mechanized;
293 (6) Not be a fixture of the site or considered an improvement to real
294 property; and
295 (7) Have the following information conspicuously displayed on a
296 minimum of two (2) sides with all lettering in at least two-inch (2”)
297 type clearly visible on the UDCB:
298 i. The name, address, 24-hour telephone number, and, if
299 available, the Internet Web address, and email address of the
300 owner and operator of the UDCB and the parcel owner or their
301 agent;
302 ii. Address and parcel number of the site;
303 iii. Instructions on the process to register a complaint regarding
304 the UDCB to the City’s Code Enforcement Division;
305 iv. The type of material that may be deposited;
306 v. A clear notice stating that all material must be deposited within
307 the UDCB;
308 vi. The pickup schedule for the UDCB;

309 vii. A city approved identification system that identifies the box as
310 being properly permitted by the city;
311 viii. If the UDCB is owned by a nonprofit organization:
312 a. A statement describing the charitable cause that will
313 benefit from the donations and the donation
314 percentage the nonprofit will receive;
315 b. The Federal Tax identification number of the nonprofit
316 organization operating the UDCB; and
317 c. The statement "This collection box is owned and
318 operated by a nonprofit organization."
319 viii. If the UDCB is owned by a for-profit entity:
320 a. "This donation is not tax deductible." and
321 b. "This collection box is owned and operated by a for-
322 profit organization."
323 (k) Maintenance.
324 (1) No litter, trash, or debris can be within 20 feet of the UDCB including,
325 but not limited to donation/collection overflow and other dumped
326 material.
327 (2) UDCBs must be maintained and in good working order. Items to be
328 repaired, removed, and/or abated include, but are not limited to
329 graffiti, removed or damaged signs and notifications, peeling paint,
330 rust, and broken collection operating mechanisms.
331 (3) No major repairs or overhaul work on such collection bin shall be
332 made or performed on the site, (or any other work performed thereon
333 which would constitute a nuisance under existing ordinances);
334 (4) UDCBs must be serviced not less than weekly between 7:00 a.m.
335 and 7:00 p.m. on weekdays and 10:00 a.m. and 6:00 p.m. on

336 weekends. Servicing includes the removal of donated/collected
337 material and removal of graffiti, trash, litter, or other dumped debris.
338 (5) The UDCB operator must maintain an active email address and a
339 24-hour telephone service with recording capability for the public to
340 register complaints.
341 (6) UDCBs cannot be used for the collection of solid waste and/or any
342 hazardous materials.
343 (7) UDCBs cannot be used for camping, living, or other residential
344 activity.
345 (l) Compliance process.
346 (1) Whenever the Building Official determines that an UDCB with a valid
347 permit does not conform to any requirement in this section, they shall
348 promptly notify the parcel owner and the UDCB operator through
349 electronic mail of the violation. The violation must be abated and
350 proof of such submitted to the city within 24 hours after receipt of
351 such notification.
352 (2) If an unpermitted UDCB is not within a permissible geographic area
353 according to Section 10.404(i), then both the UDCB and any graffiti,
354 trash, debris, or dumped materials within 20 feet of the UDCB must
355 be removed within 72 hours after the parcel owner is notified of the
356 violation.
357 (3) If an unpermitted UDCB is within a permissible geographic area
358 according to Section 10.404(i), then any graffiti, trash, debris, or
359 dumped materials within 20 feet of the site must be removed and the
360 parcel owner or UDCB operator shall either: 1) apply for all UDCB
361 permits required by this section; or 2) remove the UDCB. This
362 requirement must be met within 72 hours after the parcel owner is
363 notified of the violation.

364 (4) The operation or maintenance of an unpermitted UDCB may be
365 abated or summarily abated by the city in any manner authorized by
366 this Code or otherwise by law for the abatement of nuisances. All
367 costs incurred by the city in connection with any action to abate a
368 UDCB nuisance will be borne by the property owner.
369 (m) Revocation of permits, removal of a UDCB and liability.
370 (1) The Planning Director or their designee has the authority to revoke
371 any UDCB permit issued hereunder if the permit holder fails to
372 comply with the provisions of this article, this Code, or other law.
373 (2) The Planning Director shall provide a written notification to the permit
374 holder stating the specific grounds for revocation.
375 (3) Upon revocation, the UDCB must be removed from the property
376 within ten calendar days and, if not removed within this time period,
377 the city shall remove, store, and dispose of the UDCB at the permit
378 holder's sole cost and expense.
379 (4) Upon revocation, a permit holder will be prohibited from applying for
380 a UDCB permit for a period of one year.
381 (5) The property owner or owner's agent has the right to rescind consent
382 for an UDCB to be placed on their property.
383 (n) Penalties.
384 (1) Any violation of the provisions of this article is a public nuisance
385 subject to abatement pursuant to this Code or as otherwise permitted
386 by law.
387 (2) Each day that a violation of a requirement of this section is not abated
388 constitutes a new and separate offense.
389 (3) Whoever violates the provisions of this section will be fined up to five
390 hundred dollars ($500.00) per day for each violation.

391 (4) If a UDCB operator is found to violate the requirements of this section
392 repeatedly, the UDCB operator may have all business licenses
393 revoked by the city in addition to the above-stated penalties.
394 (p) Severability. Should any provision of this section be deemed illegal or
395 otherwise unenforceable by a court of competent jurisdiction, only that
396 specific provision shall not be enforced, and all other sections and
397 provisions shall remain in full force and effect.

1. The petitioned property is developed property with an existing 1,500 sq ft building and concrete
parking, located on the south side of the Old Spanish Trail at the intersection with Frank Pichon Drive
(Figure 2).
2. In September 2023, the City Council annexed the subject property by ordinance, No. 4141, approving
the zoning as C-4.
3. The property is currently zoned C-4. (Figure 3).
4. The property has two public accesses to the 0.991-acre Parcel, one from Old Spanish Trail
approximately 80 feet from the intersection with Frank Pichon Rd; the second access is along Frank
Pichon Rd, approximately 100 feet south of the intersection.
5. There is public water available to the property; a 6-inch water line runs along the Old Spanish Trail
frontage, with a 4-inch sewer force main approximately 110 feet southwest from the rear property
line along Frank Pichon Road. (Figure 4).
6. The property is within a Special Flood Hazard Area in Flood Zone AE, with a Base Flood Elevation of 13
ft; the approximate ground elevation is 7.6 feet.
FINDINGS
7. The applicant proposes to combine the 5 lots into one lot (Lot 5A) containing 39,690 square feet (0.911
acres) (Figure 5) and Table 1.

1. The petitioned property is developed property with an existing shopping center and concrete parking

6. The property is not located within a Special Flood Hazard Area or flood zone and has an approximate
ground elevation is 13.8 feet.
