The Smithfield Board of Historic and Architectural Review held its regular meeting on
Tuesday, January 19th, 2021 at 6:30 p.m. at the Smithfield Center.

Chairman Gwaltney welcomed everyone to the meeting.
Community Development & Planning Director’s Report:
The Community Development & Planning Director congratulated Vice Chair Julia
Hillegass and Justin Hornback on their reappointments to the BHAR. Now that the Smithfield
Comprehensive Plan update is underway, Town staff are in need of public input. The consultants,
Summit Design & Engineering Services, PLLC, have prepared a citizen survey to assist in
gathering this input. The survey was mailed in the Town’s fall newsletter to all recipients, and is
available in hard copy at Town Hall upon request. It is also available online via survey monkey
and the Town’s website. Input is requested no later than Thursday, February 4th, 2021. Following
conversations with the consultants, it was determined that extending the survey period would assist
the Town in expanding public input. Town staff would like to congratulate Board of Zoning
Appeals (BZA) member Gene Monroe for obtaining his certified BZA member certificate last
month. Town staff would also like to congratulate staff members Tammie Clary and John Settle
for obtaining both their certified BZA member certificates, as well as their certified Planning
Commissioner certificates.

The Community Development & Planning Director explained that he checked the bylaws.
The bylaws state that elections are held at the first meeting of every even-numbered year.
Color & Material Change – 207 Main Street – Non-Contributing – Vernon Ray & Linda
Edwards, applicants:
The Community Development & Planning Director reported that the applicant is seeking
approval to change the color of the existing awnings on the front of the building from burgundy
and white to navy blue and white. Town staff recommended approval as submitted.
Chairman Gwaltney asked if they stated why they wanted to change the color.
The Community Development & Planning Director stated that they had not indicated why
they wanted to change the color. Mr. Settle did not notice any signs of dilapidation on the awning
when he went by the property.
Mr. Hess indicated that he did not see white in the illustrations provided for the new
awnings.
Mr. Settle stated that you have to look closely in order to see it.
Mr. Hornback made a motion to approve the application as presented. Mr. Hill seconded
the motion. With no further discussion, Chairman Gwaltney called for the vote.
On call for the vote, seven members were present. Mrs. Lally voted aye, Mr. Hess voted
aye, Mr. Hill voted aye, Mr. Hornback voted aye, Mr. Prevatte voted aye, Vice Chair Hillegass
voted aye, and Chairman Gwaltney voted aye. There were no votes against the motion. The motion
passed.
Accessory Structure – (After-the-Fact) 259 James Street – Contributing - Stephanie Pressley,
applicant:
The Community Development & Planning Director explained that the applicant requested
attendance at the meeting via phone. Mr. Settle called and she was available by phone for questions
from the Planning Commission. Mr. Settle gave the staff report and explained that the applicant
already erected a freestanding “little library” at the Luter Family YMCA. The little library is a
wooden rectangular box resembling a building and suspended at breast height by a wooden pole
that can be moved if needed. It is located at the front entrance of the building, facing the Goose
Hill Creek subdivision. The applicant will place books in the little library that are free of charge
and available to all. Town staff recommended approval as submitted.
The applicant, Ms. Pressley, explained that it was a project started by first grade students
last year. Project based learning is unique to Isle of Wight County Public Schools. It is a first grade
student effort and Covid put a damper on the project. The central question of the project is “how
do we build the love of reading?” There is a video in circulation highlighting the project’s
endeavors. Some students are still virtual learners due to Covid and are utilizing the little libraries
in the community; specifically, the one at the YMCA. Interestingly, in this project, the adults are
the helpers and the children are the ones who do the work.
Chairman Gwaltney stated that he thought it was a nice project.
Mr. Hill made a motion to approve the application as presented. Vice Chair Hillegass
seconded the motion. With no further discussion, Chairman Gwaltney called for the vote.

Chairman Gwaltney congratulated Ms. Pressley and the first grade students on helping
Smithfield become an even better place.
Ms. Pressley thanked the BHAR for their approval. She stated that the students would be
excited to hear it. She thanked everyone for their help; specifically, Tammie Clary for help with
the application.
Chairman Gwaltney asked if Mr. Settle could come up with a congratulatory certificate to
send to the students. The children could have something to hang on the wall for their achievement.
Mr. Settle stated that he would be happy to do that.
Mr. Hill stated that there are little libraries throughout the Town of Smithfield; one on
Hayden’s Lane, two in Jersey Park, one at the YMCA, and other locations.
HPO Map and Inventory Amendment – Town of Smithfield, applicant:
The Community Development & Planning Director explained that, pursuant to Smithfield
Zoning Ordinance (SZO) Section 3.M.D.6, Town staff must update and amend the Historic
Preservation Overlay (HPO) district map and inventory from time to time to reflect changes that
occur within the HPO in real time, with the review and approval of the Board of Historic &
Architectural Review (BHAR). On Friday, October 23rd, 2020, Town staff approved a lot
consolidation plat for 215 Cary Street (TPINs 21A-04-002 & 21A-04-003A). The plat was
recorded later that day, resulting in the vacation of the lot line that separated the two properties,
and the elimination of Lot 2, Cary Street (TPIN 21A-04-002). Consequently, the classification of
215 Cary Street (TPIN 21A-04-003A), a contributing property under Article 3.M of the SZO, now
prevails over the area of land that formerly comprised Lot 2, Cary Street (TPIN 21A-04-002),
which was a non-contributing vacant lot prior to the recordation of the plat. This map amendment
seeks to achieve two items:
(1) To illustrate 215 Cary Street (TPIN 21A-04-003A) as a single, contributing property on the
HPO district map.
(2) To eliminate Lot 2, Cary Street (TPIN 21A-04-002) from the HPO district property inventory.
An updated version of the HPO district map and property inventory has been attached to
this staff report for the convenience of the BHAR. A copy of the recorded lot consolidation plat
has also been included. Town staff recommended approval as submitted.
Chairman Gwaltney stated that the color-coded map is nice to look at. He felt that staff had
done a great job on it. It is a clear indication of all properties and a good reference point for the
BHAR members.
Vice Chair Hillegass made a motion to approve as presented. Mr. Hess seconded the
motion. Chairman Gwaltney called for the vote.
On call for the vote, seven members were present. Mrs. Lally voted aye, Mr. Hess voted

The Smithfield Board of Historic and Architectural Review held its regular meeting on
Tuesday, December 15th, 2020 at 6:30 p.m. at the Smithfield Center.

There was one (1) citizen present. Chairman Gwaltney welcomed everyone to the meeting.
Community Development & Planning Director’s Report:
The Community Development & Planning Director reported that the Smithfield
Comprehensive Plan update is underway. He explained that the Town is in need of public input.
Consultants, Summit Design & Engineering Services, PLLC, have prepared a citizen survey to
assist us in gathering this input. The survey was mailed in the Town’s fall newsletter to all
recipients and is available in hard copy at Town Hall upon request. It is also available online via
survey monkey and the Town’s website. Input is requested no later than Sunday, December 20th,
2020. At its Tuesday, December 1st, 2020 meeting, the Town Council approved the text
amendment to Article 3.M of the Smithfield Zoning Ordinance that was favorably reviewed and
recommended by the BHAR at its Tuesday, August 18th, 2020 meeting. Among other things, this
text amendment finalized the BHAR’s 2017 Historic Preservation Overlay property classification
evaluation. At its Tuesday, December 1st, 2020 meeting, the Town Council approved the BHAR
appeal and demolition as a matter of right applications for 502 Grace Street.

plan update survey. She stated that she had shared the links to the survey via her own personal

Assorted Exterior Changes – 315 S. Church Street – Contributing – Phillip & Sharon Frix,
applicants:
Mr. Settle explained that the applicant is seeking approval to undertake the following
changes on the premises:
(1) The repair and replacement of all damaged bricks and their repainting in a gray
“Morning Fog” (SW6255) color. The bricks are currently painted white.
(2) The repair and replacement of all damaged wooden trim and its repainting in a white
“Pure White” (SW7005) color. The trim is currently painted beige.
(3) The repainting of the front door in a red “Poinsettia” (SW6594) color. The front door
is currently painted green.
(4) The replacement of the existing dilapidated teal-colored operable wooden louvered
shutters with eighteen-inch (18”) black-colored operable fiberglass louvered shutters. The
applicant suggests that the existing shutters do not fit the windows properly, and that eighteen-
inch (18”) shutters will frame the windows in a more aesthetically pleasing manner.
(5) The replacement of the existing dilapidated inoperable vinyl six-over-six double-hung
sash windows of a beige color with fiberglass six-over-six double-hung sash windows of a white
color. Only the windows on the front and sides of the primary building are to be replaced. One
replacement window will be of a four-over-four single-hung sash style, and two replacement
windows will be of a single-pane casement style. In all three cases, these replacement windows
will not be located on the primary façade. All replacement windows will be Pella Impervia
windows.
(6) The replacement of the existing dilapidated white-colored vinyl and aluminum front
storm door with a six-panel storm door constructed of wood and glass. The style, color, and
polished brass hardware of the storm door will match that of the front door behind it.
(7) The expansion of the existing black-colored aluminum fence surrounding the ancient
tree in the front yard of the property to accommodate the tree’s westward growth, which has
gradually grown into the fence.
Town staff recommended approval as submitted.
Phillip Frix resides at 315 S. Church Street in Smithfield. He stated that he purchased the
property in October 2020 and planned upgrades to improve the aesthetics of the home. He was
available for questions.
Chairman Gwaltney asked if there was any special significance of the tree in the front yard.
The Town Attorney could not recall if there was any historical significance affiliated with
the tree, but noted that this property was a part of the property formerly known as the “ice plant
lot,” a name given based upon the property’s previous occupation by such a building.
Mrs. Lally stated that it is an Osage Orange tree, and may in fact be the oldest one of its
kind in Virginia.
Mr. Frix explained that there is a cinderblock wall inside the fence surrounding the tree
which was constructed from the natural grade of the property. He speculated that when the property
was regraded, they protected the tree with the barrier around it. The fence keeps people from falling
in since it drops down about six feet.

Chairman Gwaltney asked if the gutters are still copper.
Mr. Frix explained that they are a painted copper which is more like a powder-coated finish
meant to look like copper. They are not true copper gutters. The gutters will stay just as they are.
Mr. Hill made a motion to approve the application as presented. Vice Chair Hillegass
seconded the motion.
Chairman Gwaltney asked about the shutters they were purchasing.
Mr. Frix explained that the current shutters do not fit the size of the window. They are
changing the size to an eighteen-inch wide shutter with functional pintles. The project will be
done in the spring.
With no further discussion, Chairman Gwaltney called for the vote.
On call for the vote, seven members were present. Mrs. Lally voted aye, Mr. Hess voted
aye, Mr. Hill voted aye, Mr. Hornback voted aye, Mr. Prevatte voted aye, Vice Chair Hillegass
voted aye, and Chairman Gwaltney voted aye. There were no votes against the motion. The motion
passed.
Accessory Structure – 382 S. Church Street – Contributing – Jenifer Byrd, applicant:
The applicant is seeking approval to erect a forty-two inch tall white-colored wooden
picket fence on the premises. The fence will extend from the rear-right corner of the primary
building across the existing driveway to the property’s western boundary line. The fence will have
a central gate to accommodate vehicles traversing the driveway. Town staff recommended
approval as submitted.
The applicant was not present at the meeting.
Chairman Gwaltney asked if the gate would part in the middle, and swing open in two
parts. Mr. Settle answered in the affirmative.
Mr. Hess made a motion to approve the application as submitted. Mr. Hill seconded the
motion. With no further discussion, Chairman Gwaltney called for the vote.
On call for the vote, seven members were present. Mrs. Lally voted aye, Mr. Hess voted
aye, Mr. Hill voted aye, Mr. Hornback voted aye, Mr. Prevatte voted aye, Vice Chair Hillegass

Assorted Exterior Changes – 120 Cockes Lane – Contributing – Dana Ormbrek, applicant:
The applicant is seeking approval to undertake the following changes on the premises:
(1) The replacement of the windows enclosing the sunroom located on the
northwest side of the building with black vinyl ProVia one-over-one
double-hung sash windows. The existing windows enclosing the
sunroom are a combination of colors (white and black), materials (vinyl
and wood), and styles (one-over-one and four-over-one sash).
(2) The replacement of all remaining windows on the building with black
vinyl ProVia four-over-one double-hung sash windows. These
windows, as they currently exist, are a combination of colors (white,
black, and off-white), materials (vinyl and wood), and styles (one-over-
one, six-over-six, and four-over-one sash).

(3) The installation of a forty-two inch (42”) tall white vinyl picket fence
no closer than twenty feet (20’) to Cockes Ln and extending from the
northwest side of the building to the northwest boundary line of the
adjacent vacant lot under common ownership.
Town staff recommended approval under the condition that, pursuant to page sixty-three
of the Smithfield Historic District Guidelines, all existing wooden windows be repaired or replaced
with windows of a like style and material.
The applicant, Dana Ormbrek, was available by phone for questions. She is currently living
at 613 W Constance Rd in Suffolk, Virginia. She did not want to attend in person due to COVID.
She loves the house on 120 Cockes Lane; but it needs a lot of work. She restored five of the
windows that face in the direction of Main St; but all other windows had parts missing. She does
not have enough pieces to restore all of the other windows. She plans to paint the house white. She
is refinishing the front door. Eventually, they would like to build a small barn with a green space.
She would like it to be similar to a small farm; but in the Town limits. She stated that the house is
sinking due to termites and the basement is a mess. The foundation is being rebuilt with new bricks.
The interior is gutted. Everything will be redone. The windows are a priority at the moment. She
explained that the ones she selected have simulated muntins on the exterior so they could look as
original as possible. She also stated that the windows present on the side porch were originally
without muntins, while the remaining windows all originally featured muntins.
Mr. Hess asked if the owner planned to retain the rebuilt wooden windows on the porch.
He asked if the other replacement windows would be wood or vinyl.
Ms. Ormbrek stated that the new windows have a wood exterior with the interior being
vinyl. They will match the windows she restored on the porch. Eventually, she will have to replace
the ones on the porch since they are so old. She is trying to keep the house as original as she
possibly can.
Chairman Gwaltney stated that she is replacing wooden windows with black vinyl double-
hung sash windows.
Mr. Hill stated that they have a wooden exterior and a vinyl interior.
Mr. Hornback inquired if the muntins would be built into the sash, or if they would be
removable to allow for easier cleaning?
Ms. Ormbrek confirmed that the outside would be wood with exterior grids. They would
be painted black. She believes the grids are built into the exterior sash. She explained that she did
a lot of research to find windows as close in appearance to the original ones as possible. She was
raised restoring homes.
Chairman Gwaltney asked about the fence.
Ms. Ormbrek wants to have a parking area for the property and her neighbors. She would
like a fence to delineate the parking area.
Mrs. Lally stated that there was a recent approval for a six-foot wooden fence at the rear of
the property, whereas the presently-proposed fence elsewhere on the property is of vinyl
construction.
Chairman Gwaltney explained that the property has sold and now has a new owner. He
asked the Community Development & Planning Director if the application was still valid.

Mr. Settle explained that the new owner has to request an extension to Town staff within a
year of approval. Staff can extend it for one year. The previous approval is still valid.
The Town Attorney explained that approvals follow the property and not the owner.
Vice Chair Hillegass stated that the previous approval was for a six-foot wooden, dog-
eared privacy type fence. It was also in a different location than the one requested by Ms. Ormbrek.
Chairman Gwaltney stated that the applicant is asking for a different fence in a different
location. He asked the applicant if she was aware that there is an existing application for a different
fence in a different location on the property.
Ms. Ormbrek explained that she applied for the fence but has not built it yet. It only goes
around the back of the house. She stated that she could do wood if the Board members preferred
wood. She indicated that she still plans to install the six-foot tall fence.
Chairman Gwaltney explained that the BHAR prefers wooden fences.
Vice Chair Hillegass made a motion to approve the application under the condition that the
fence be constructed of wood and painted white or stained. Mrs. Lally seconded the motion. With
no further discussion, Chairman Gwaltney called for the vote.
On call for the vote, seven members were present. Mrs. Lally voted aye, Mr. Hess voted
aye, Mr. Hill voted aye, Mr. Hornback voted aye, Mr. Prevatte voted aye, Vice Chair Hillegass
voted aye, and Chairman Gwaltney voted aye. There were no votes against the motion. The motion
passed.
The Town Attorney stated that he does not remember a vinyl fence ever being approved.
Mr. Settle explained that after reviewing the guidelines, he found that the guidelines do not
say anything about the materials that fences should be constructed of. He explained the guidelines
state that painted, wooden pickets are the most common fence style.
Mr. Hornback ask if it specifically prohibited vinyl fences.
Mr. Settle stated that the guidelines do not prohibit vinyl.
The Town Attorney explained that it does not prohibit vinyl; but it does not endorse it
either.
Chairman Gwaltney stated that it is specific for vinyl on a house. He believes that could be
translated to apply to other structures on the property.
Approval of the Tuesday, October 20th, 2020 Meeting Minutes:
The Town Attorney recommended the minutes be approved as presented.
Mr. Hess made a motion to approve the minutes and Mrs. Lally seconded the motion.
Chairman Gwaltney called for the vote.
On call for the vote, seven members were present. Mrs. Lally voted aye, Mr. Hess voted
aye, Mr. Hill voted aye, Mr. Hornback voted aye, Mr. Prevatte voted aye, Vice Chair Hillegass
abstained, and Chairman Gwaltney voted aye. There was one abstention. The motion passed.
