The Smithfield Board of Historic and Architectural Review held its regular meeting on Tuesday, March 16th, 2021 at the Smithfield Center. The meeting was called to order at 6:30 p.m. Members present: Trey Gwaltney – Chairman Julia Hillegass – Vice Chair Gary Hess Ronny Prevatte Russell Hill Justin Hornback Judith Lally Staff present: William H. Community Development & Planning Director’s Report: Mr. Settle stated that there was no new information to report. Accessory Building/Structure (Fence) – 362 South Church Street – Contributing – Carrie Elzie, applicant: Mr. Settle reported that the applicant is seeking approval for the installation of a wooden dog- eared picket fence. The portions of the fence that will run parallel with the sides of the property will be four feet (4’) tall, while the portion of the fence that will join these two (2) runs of fencing at the rear of the backyard will be three feet (3’) tall. The entire fence will be painted white. Town staff suggested approval as submitted. The applicant, Ms. Elzie, will be living at 362 South Church Street soon. She stated that she would like the fence for her dogs. Mr. Hornback made a motion to approve the fence as presented. Mrs. Hillegass seconded the motion. With no further discussion, Chairman Gwaltney called for the vote. On call for the vote, seven members were present. Mrs. Lally voted aye, Mr. Hess voted aye, Mr. Hill voted aye, Mr. Hornback voted aye, Mr. Prevatte voted aye, Vice Chair Hillegass voted aye, and Chairman Gwaltney voted aye. There were no votes against the motion. The motion passed. Board of Historic and Architectural Review March 16th, 2021 Mr. Hornback stated that the home was an HGTV home. Ms. Elzie stated that her home in Norfolk was also an HGTV home. She is excited to move into the Smithfield home. Amendment of Prior Approval – 330 Main Street – Landmark – Maureen Brines, applicant: Mr. Settle reported that at its Tuesday, October 20th, 2020 meeting, the applicant received an approval from the BHAR to (among other improvements) replace the existing dilapidated wooden fish scale shingle siding with Hardie Board fish scale fiber cement shingle siding of a like color. The applicant is seeking an amendment of this prior approval, and now wishes to paint the existing wooden fish scale shingle siding (which is currently a beige/soft yellow color) and front porch posts (which are currently a faded teal color) “Soft Apricot.” Town staff suggested approval as submitted. Chairman Gwaltney asked Mr. Settle to refresh the BHAR’s memory on the previous application. The picture shows horizontal Hardie Board in “Navajo Beige” that was previously approved. Now, the house will be “Navajo Beige” and “Soft Apricot.” Mr. Settle stated that was correct. The applicant was not present at the meeting. Chairman Gwaltney asked if the white trim would remain white. Mr. Settle stated that the trim would remain white. Mr. Hess expressed concern that originally the applicant was going to replace the fish scale shingle siding with Hardie Board. He asked if the cost was the problem. Mr. Hornback stated that the renovations started this week. Mr. Hess stated that he had no problem with the applicant painting the fish scale siding. His concern was if the wood was still durable enough to last if painted. Chairman Gwaltney stated that the siding would still be Hardie Board. Mr. Settle clarified that the horizontal siding will be replaced with horizontal Hardie Board siding. The fish scale shingle siding will be painted. Mrs. Lally stated that she assumed the decision to retain the fish scale shingle siding was related to the expense, but they could also replace it at a later date. Chairman Gwaltney stated that lumber prices have increased significantly but that Hardie Board prices have not increased very much. Mr. Hill stated that was correct. Interior trim has also remained close to the same price as before. He speculated that the applicant decided against the Hardie fish scale siding because it is hard to come by. It may be the reason the applicant decided against it. Mr. Hess reminded the BHAR that Hardie Board fish scale shingle siding was what was originally approved. Vice Chair Hillegass made a motion to approve the amendment as presented. Mrs. Lally seconded the motion. Chairman Gwaltney called for the vote. On call for the vote, seven members were present. Mrs. Lally voted aye, Mr. Hess voted aye, Mr. Hill voted aye, Mr. Hornback voted aye, Mr. Prevatte voted aye, Vice Chair Hillegass voted aye, and Chairman Gwaltney voted aye. There were no votes against the motion. The motion passed. Accessory Building/Structure (Fence) – 400 Main Street – Landmark – Clarence Shuler, applicant: 2 Board of Historic and Architectural Review March 16th, 2021 Mr. Settle reported that the applicant is seeking approval for the installation of a six foot (6’) tall wooden privacy fence in the yard to the left of the house. The entirety of the proposed fence will be stained with clear Thompson’s water seal. Town staff suggested approval as submitted. The applicant was not present at the meeting. Mr. Hornback stated that the area is hard to see since it is down a hill. Chairman Gwaltney explained that the area is pretty much hidden by vegetation. Mr. Settle agreed that the area is very difficult to see due to vegetation. Chairman Gwaltney stated that the application meets the criteria and is not seen. However, if the vegetation were to be cleaned up it would be visible from the street. He was curious if the growth and vegetation needed to be addressed. Chairman Gwaltney explained that he has received letters about his grass height from Codes Compliance. Mr. Settle stated that the area is woods. The tall grass ordinance refers only to tall grass and weeds. Mr. Hill asked if the Town owns the lot adjacent to 400 Main Street. Mr. Settle stated that it is a Town parking lot. The Town Attorney explained that the property is surrounded on two sides by, basically, a privet hedge. The Town trims it on a regular basis. By the house, there is a lot of wisteria. The Town does not tell people they cannot have wisteria or privet hedges. Since the property goes down a hill, no one can see anything. Mr. Settle stated that Town staff speculates that the slope is greater than 30%. Overgrowth is encouraged for slopes that severe to stifle erosion. Mr. Hess asked why they would need the fence with all of the overgrowth. Mr. Hill stated that the property owner has large dogs. Mr. Hill made a motion to approve the application as presented. Mr. Hess seconded the motion. Chairman Gwaltney called for the vote. On call for the vote, seven members were present. New Business: 111 Cary Street – Contributing – Steven & Hannah Wingfield, applicants: Chairman Gwaltney explained that there are roof repairs that need to be done and there is some urgency for the repairs. The tin roof is causing some problems. The applicant would like to remove the tin and replace it with architectural asphalt shingles to match the rest of the house. A picture was provided showing the house. Mr. Settle reported that the applicant recently discovered that the roof was leaking. They are only looking to replace the metal section of the roof behind the main massing of the house. They would like, in the long run, to replace all of the existing metal roofing with architectural asphalt shingles to match the ones already present on two parts of the house. At this time, the applicant is seeking emergency approval from Town staff to replace the leaking portion of the roof. In these situations, Town staff would normally authorize the repair and then bring it to the BHAR the following month. Because it is a contributing property, and because they are replacing original metal roofing material with architectural asphalt shingles, Town staff would bring the application to the BHAR. Mr. Settle stated that Town staff is only asking for the blessing of the BHAR for the emergency zoning permit waiver to replace the back (leaking) portion of the roof. 3

Accessory Structure – 318 Main Street – Contributing – KOTA of Smithfield, LLC, c/o Gary Brooks, applicant: The Community Development & Planning Director reported that the applicant is seeking approval to erect a twelve foot (12’) by twenty foot (20’) shed. The shed will be sided in white horizontally-lapped wooden shiplap siding (six inches (6”) in height) with white trim. The roof will be side-gabled with dark-gray metal. A set of solid white double doors with panels will be centered on the long side of the shed. The shed will be fenestrated by two windows, one on either side of the doors, which will be bordered by inoperable black shutters. The overall appearance of the shed is intended to emulate the appearance of the primary building. Town staff recommended approval as submitted. Board of Historic and Architectural Review February 16th, 2021 Mr. Gary Brooks resides at 11170 Olde Town Place in Smithfield, Virginia. He explained that the shed will be used for storage. It will match as closely as possible to the existing primary structure. Chairman Gwaltney stated that the picture of the gray building is the style of the shed. The pictures of the doors are the doors the applicant will be using on the building. The color scheme of the house, white with white trim, will be the color scheme of the shed. Vice Chair Hillegass stated that shutters would be added that are black like the ones on the house. The applicant explained that the shutters were included with the contract. They will be black. Vice Chair Hillegass made a motion to approve the application as presented. Mr. Hess seconded the motion. With no further discussion, Chairman Gwaltney called for the vote. He stated that they were first class people, professional, courteous, friendly, and very helpful. Vice Chair Hillegass stated that they are amazing. *Discussion Item* Invitation to Comment – 19514 Casper Circle – Tower Engineering Professionals, Inc., c/o Ryan Malek, agent: The Community Development & Planning Director reported that on Thursday, January 28th, 2021, Town staff received the enclosed letter from Ryan Malek, of Tower Engineering Professionals, Inc. The letter concerns the proposed increase in height of the existing cellular base station tower at 19514 Casper Cir (TPIN 32-01-102) from 148 feet to 168 feet. Specifically, the letter requests comments from the Board of Historic & Architectural Review (BHAR), pursuant to the applicable federal laws, rules, and regulations noted in the letter, in response to the proposed project with the following questions in mind: (1) Do any historic properties exist within the vicinity of the proposed project? (2) If so, does the proposed project cause an adverse effect to such properties? The tower, which is located well outside of the Town’s corporate limits, is visible from positions within the Town. However, the nearest cultural and/or historic resource located within the Town limits, the circa. 1848 Edwards house at 13453 Benn’s Church Blvd (TPIN 32-01- 096A1), does not appear to be adversely impacted by the proposed project. The proposed enlarged tower is not currently, nor will it be, visible from the Historic Preservation Overlay (HPO). Town staff have enclosed a photograph of the existing Tower taken from a position located behind the Tractor Supply Company at 13500 Benn’s Church Blvd (TPIN 32-01-005A), which is located one- quarter (1/4) of a mile closer to the tower than the aforementioned Edwards house. It is the opinion of Town staff that a twenty-foot (20’) extension in the tower’s height will not adversely impact the cultural and/or historic significance of the Edwards house, any other cultural and/or historic resource in the Town, and/or the HPO. Town staff encourages the BHAR to discuss the potential 2 Board of Historic and Architectural Review February 16th, 2021 adverse impacts, if any, of the proposed project on any of the Town’s cultural and/or historic resources. All comments generated on the proposed project will be conveyed to Mr. Malek in writing. Chairman Gwaltney explained that there could be comments only. The tower is not an item that the BHAR would vote on. If there is no objection to the tower, the BHAR would provide a statement to Mr. Malek. He asked if the invitation to comment also went to the Isle of Wight County historic Board. The tower is located near St. Luke’s. Mr. Settle explained that the letter would go to the Isle of Wight County Planning Commission as well as Isle of Wight County’s Board of Historic and Architectural Review, as the tower is located in or near one of the County’s beautification districts. Vice Chair Hillegass explained that the Planning Commission addressed the tower at their last meeting. The Planning Commission thought that this should be relayed to St. Luke’s as well as Benn’s Church since they are the most historic properties in the area. It is only a twenty-foot increase. The Planning Commission did not feel it was a significant issue for the Town of Smithfield. Mr. Hess stated that he did not think anyone would notice an additional twenty feet on the tower since it is so far off of the road. Chairman Gwaltney stated that the BHAR is okay with the change to the tower and asked Mr. Settle to reply to Mr. Malek. For clarification, Mr. Settle asked for confirmation that the BHAR had reached a general consensus consistent with staff’s findings in the staff report for this agenda item. Vice Chair Hillegass stated that she wanted to make sure that Benn’s Church and St. Luke’s would be able to comment on the tower height or produce recommendations on the matter to the county. Mr. Settle stated that staff would follow-up and make certain the information had been conveyed to appropriate County staff. Approval of the Tuesday, January 19th, 2021 Meeting Minutes: Chairman Gwaltney asked Mr. Settle if Mr. Riddick had indicated any recommended changes to the meeting minutes.
