ACTION ITEMS There being no objections, Council Chair Dunn took the agenda out of order to consider Agenda Item #6 first on the agenda. Heidi Beazizo, Senior Legislative Analyst, provided a staff report and explained the two proposed amendments to the ordinance. Council Chair Dunn opened the hearing for public testimony. The following individuals provided testimony: 1. John Hall, Everett Gospel Mission, testified in opposition to the ordinance. 2. Representative Lauren Davis, 32nd Legislative District, testified in opposition to the ordinance. 3. Carolyn Strong, resident of Edmonds, testified in support of the ordinance. 4. Tamara Nelson, testified in support of the ordinance. 5. Mark Smith, resident of Lynnwood, testified in opposition to the ordinance. 6. Randy Hayden, resident of Darrington, testified in opposition to the ordinance. 7. Erik Nelson, owner of Lynnwood Honda, testified in support of the ordinance. 8. Brett Kinney, resident of Stanwood, testified in support of the ordinance. 9. Sharon Damoff, resident of Mukilteo, testified in support of the ordinance. 10. Donna Vago, resident of Mukilteo, testified in support of the ordinance. 12. Pam Felt, resident of unincorporated Snohomish County, testified in support of the ordinance. 13. There being no further persons present wishing to testify, she closed the testimony portion of the hearing calling for a motion or discussion of the Council. Council Chair Dunn noted that the Council received a memorandum from the Executive's Office and Department of Human Services relating to questions and answers regarding the operation of the motels that the County proposes to provide emergency bridge housing for homeless individuals. ACTION: Councilmember Nehring made a motion to approve Ordinance 22-033. Councilmember Low seconded the motion. Discussion ensued as Councilmembers spoke to the proposed ordinance and amendment. The vote was called and the motion to approve Amendment 2 failed by a vote of two to three, with Council Chair Dunn, Council Vice-Chair Mead, and Councilmember Peterson opposing. The clerk called the roll on the main motion to approve Ordinance 22-033 and it failed by a vote of two to three, with Council Chair Dunn, Council Vice-Chair Mead, and Councilmember Peterson opposing. Council Chair Dunn resumed the order of the agenda. PRESENT: Council Chair Dunn Council Vice-Chair Mead (remote) Councilmember Low Councilmember Nehring Councilmember Peterson Deb Bell, Council Staff Viggo Forde, Department of Information Technology Director Elena Lao, Asst. Clerk of the Council 1. Ordinance 22-040, related to the 2022 budget; making an 2022-0829 emergency appropriation in the Information Technology Fund 505 to provide additional expenditure authority for the Enterprise Technology Program and Customer & Workstation Program Council Chair Dunn opened the hearing and the clerk read the ordinance title into the record. Deb Bell, Senior Legislative Analyst, provided a staff report explaining the proposed emergency appropriation in the amount of $428,048. In response to questions, Viggo Forde, Director of Information Technology, explained why the proposed ordinance was not approved as to form by the Prosecuting Attorney's Office. Council Chair Dunn opened the hearing for public testimony. There being no persons present wishing to testify, she closed the testimony portion of the hearing calling for a motion or discussion of the Council. ACTION: Councilmember Nehring made a motion to approve Ordinance 22-040. Councilmember Peterson seconded the motion. The clerk called the roll and the motion to approve Ordinance 22-040 carried unanimously. Amended Ordinance 22-041, relating to the residential collection of 2022-0927 solid waste and recyclables in unincorporated areas of the county; amending Chapter 7.42 SCC Council Chair Dunn opened the hearing and the clerk read the ordinance title into the record. Deb Bell, Senior Legislative Analyst, provided an overview of the proposed Code amendment relating to the timing and placement of containers for residential collection of solid waste and recyclables. Ms. Bell responded to questions regarding code enforcement. Council Chair Dunn opened the hearing for public testimony. The following individual provided public testimony: 1. Michael Steinore, resident of unincorporated Snohomish County, testified in support of the ordinance and suggested an amendment to remove containers within 24 hours of collection, instead of 12 hours. There being no persons present wishing to testify, she closed the testimony portion of the hearing calling for a motion or discussion of the Council. ACTION: Councilmember Low made a motion to approve Ordinance 22-041. Councilmember Nehring seconded the motion. Councilmember Nehring seconded the motion and it carried unanimously. Discussion ensued and additional questions raised regarding code enforcement. Ms. Bell noted that she will follow up with the Department of Planning and Development Services (PDS) to provide a report to Council. Councilmember Low suggested that PDS provide an update to Council after a year, and the issue can be revisited, if needed. The clerk called the roll and the motion to approve Ordinance 22-04, as amended, carried by a vote of four to one, with Council Chair Dun opposing. Ordinance 22-043, amending Ordinance No. 22-026 extending time 2022-0966 to accept the nonexclusive cable franchise granted to Comcast Washington to Comcast Cable Communications, LLC and Comcast Cable Communications Management, LLC, jointly and severally Council Chair Dunn opened the hearing and the clerk read the ordinance title into the record. Deb Bell, Senior Legislative Analyst, provided a staff report explaining the request for an extension of an additional 60 days to accept the nonexclusive cable franchise, as approved in Ordinance 22-026. Council Chair Dunn opened the hearing for public testimony. ACTION: Councilmember Nehring made a motion to approve Ordinance 22-043. Councilmember Low seconded the motion. Ordinance 22-045, related to the 2022 Budget; making a 2022-0918 supplemental appropriation for receipt of a portion of the proceeds of the 2022 tax-exempt Limited Tax General Obligation Bonds in Emergency Communications Systems and Facilities (ESCF) fund 170 and Public Works Facility Construction Fund 188, to obtain financing for the SNO911 Project and the Arlington Public Works Operations Center Project and to pay related bond sale and issuance costs Council Chair Dunn opened the hearing and the clerk read the ordinance title into the record. Ordinance 22-046, authorizing the issuance and sale of 2022-0979 Tax-Exempt Limited Tax General Obligation Bonds of the County in Page 6 of 7 Public Hearings Meeting Minutes October 19, 2022 an original principal amount not to exceed $95,000,000 to obtain financing for the Arlington Public Works Operations Center Project and thee Sno911 Project; providing for the disposition of the proceeds of sale of the bonds; establishing funds for the receipt and expenditure of bond proceeds and for the payment of the bonds; and providing for the annual levy of taxes to pay the principal thereof and interest thereon Council Chair Dunn opened the hearing and the clerk read the ordinance title into the record. Jim Martin, Senior Legislative Analyst, provided a staff report on the proposal to issue and sell tax-exempt limited tax general obligation bonds in an original principal amount not to exceed $95,000,000 to obtain financing for the Arlington Public Works Operations Center Project and the SNO911 Project.
